Lecturers with PPPK (Government Employees with Employment Agreements) status are entitled to competency and career development as stipulated in Article 21 paragraph (8) of Law Number 20 of 2023 concerning the State Civil Apparatus; however, there are no specific technical regulations regarding rank promotion—despite the fact that their core duties and functions are identical to those of civil servant (PNS) lecturers—raising the question of whether PPPK lecturers have the right to functional position advancement. This study is a normative legal study employing both the statutory approach and the conceptual approach. PPPK lecturers do not currently possess the right to functional position advancement due to the absence of governing regulations; however, to address this regulatory gap, administrative discretion may be exercised with the approval of the authorized official's superior.
