This study aims to analyze the legal regulation of Building Approval (Persetujuan Bangunan Gedung or PBG) as a replacement for the Building Permit (Izin Mendirikan Bangunan or IMB) within the licensing system in Indonesia, as well as the legal considerations of judges in Decision Number 93/G/2024/PTUN.JKT. The transition from IMB to PBG is part of building licensing reform intended to establish orderly and effective building administration while providing legal certainty. This study employs normative legal research using statutory, conceptual, and case approaches. The legal materials include primary legal materials consisting of legislation concerning buildings and licensing systems and Decision Number 93/G/2024/PTUN.JKT, secondary legal materials consisting of legal books and journals, and tertiary legal materials as supporting sources. The results show that PBG has a legal basis in regulations governing building administration and has replaced IMB as an approval instrument for constructing or modifying buildings. PBG emphasizes compliance with building technical standards as part of orderly building administration and legal certainty. In Decision Number 93/G/2024/PTUN.JKT, the judges’ considerations addressed the application of PBG provisions, the authority of government officials, and the conformity of administrative actions with applicable legislation. Thus, PBG is not merely a change in nomenclature but a change in the legal mechanism governing the building licensing system in Indonesia.
