Abstract

Environment is a place for living things to live their life. The environment must be kept, maintained and developed continuously in the variety of plants existing in it. Therefore, the water source can be maintained and it can flow all the time. A simple but effective step to provide essential benefits for human life is by empowering customary people with a variety of local wisdom they have in keeping and maintaining the forest. All people who behave selfishly tend to exploit these resources, that lead to a decrease in the quality and quantity of natural resources. This selfish and free behaviors exploit natural resources, so the environment is damaged and the society as a whole suffers losses from generation to generation. Bali, supported by 1493 customary villages (pakraman), has a basic concept in managing the environment known as the Tri Hita Karana concept. All forms of activities that lead to conservation efforts and a more progressive arrangement in Balinese society will be able to be maintained well.

Abstract

The agreement in the agreement that allows a change in terms of the economy, especially for the community, including fishing groups in the village of Serangan with all the support efforts made by PT. BTID in order to achieve an optimal agreement. Various negotiations have returned to find agreement on what has been promised, because of that various interesting issues arise to be investigated regarding the implementation and response of both parties to the agreement on Serangan Island. This study discusses two problem formulations (1) How is the implementation of Agreement Number: 046/BTID-MOU/1998 between PT. BTID with Serangan Village about conservation and development of tourism area on Serangan Island, (2) What are the legal consequences of violations committed by one of the parties in Agreement Number: 046/BTID-MOU/1998 between PT. BTID with Serangan Village. This research uses empirical juridical method (field research) with the type of sociological legal research. The results of the first research the implementation of the agreement between PT. BTID and Serangan community have not been running optimally including turtle exhibition, fish market, public transportation stops, labor recruitment, education and social facilities, community participation, melasti ceremonies, tourist canals, repellent bridges, fishing facilities. The results of the second research carried out deviations by PT. BTID and its people have legal consequences on the consequences called defaults. Fulfillment of achievements is done by coordinating deliberations on the part of the tourism canal agreement, land loans and bridges repelling reinforcements. The choice of deliberation on the existence of bargaining power to reach an agreement which will be the basis for both parties to continue the implementation of the agreement by forming a harmonizing team if there are obstacles in the process of implementing the part of the agreement will be handled by the harmonization team.Perjanjian diantara masyarakat Kelurahan Serangan dengan PT. BTID menunjukkan bahwa pelaksanaan perjanjian dilaksanakan dengan berbagai cara kesepakatan, segala daya upaya dukungan PT. BTID guna tercapainya perjanjian yang optimal. Berbagai perundingan kembali untuk bisa menemukan kata sepakat tentang apa yang telah diperjanjikan, karena itulah muncul berbagai persoalan yang menarik untuk diteliti terkait dengan implementasi dan respons kedua belah pihak terhadap perjanjian di Pulau Serangan. Penelitian ini membahas dua rumusan masalah (1) Bagaimanakah pelaksanaan dari Perjanjian Nomor: 046/BTID-MOU/1998 antara PT. BTID dengan Kelurahan Serangan tentang pelestarian dan pengembangan kawasan pariwisata di Pulau Serangan, (2) Bagaimanakah akibat hukum dari pelanggaran yang dilakukan salah satu pihak pada Perjanjian Nomor: 046/BTID-MOU/1998 antara PT. BTID dengan Kelurahan Serangan. Penelitian ini menggunakan metode yuridis empiris (field research) dengan jenis penelitian hukum sosiologis. Hasil penelitian pertama pelaksanaan perjanjian antara PT. BTID dengan masyarakat Kelurahan Serangan belum berjalan secara optimal diantaranya turtle exhibition, pasar ikan, pemberhentian kendaraan umum, rekrutmet tenaga kerja, pendidikan dan fasilitas sosial, partisipasi dari masyarakat, tempat upacara melasti, kanal wisata, jembatan penolak bala, fasilitas nelayan. Hasil penelitian kedua tindakan yang dilaksanakan menyimpang oleh PT. BTID dan masyarakatnya berakibat hukum pada konsekuensi yang disebut wanprestasi. Pemenuhan prestasi yang dilakukan dengan musyawarah koordinasi pada bagian perjanjian kanal wisata, pinjaman lahan dan jembatan penolak bala. Pilihan musyawarah adanya daya tawar untuk pencapaian kesepakatan yang nantinya menjadi dasar kedua belah pihak melanjutkan pelaksanaan perjanjian dengan dibentuk tim harmoninasi tujuan bila terjadi hambatan dalam proses pelaksanaan bagian perjanjian maka akan ditangani oleh tim harmonisasi.

Abstract

This article aims to review, describe and analyze the implementation of the grant aid policy, find out what factors influence the policy of providing grant assistance and find out the effects of providing grant assistance to community groups in Badung Regency. To achieve this goal several methods and techniques are used. The method used is descriptive qualitative research type. Data collection techniques using observation, interviews and documentation. The informant determination technique used was purposive sampling with the number of informants determined. This study concludes that the provision of grant assistance to community groups in Badung Regency has been implemented very well in accordance with the principles of justice, the principle of propriety, the principle of rationality, the principle of transparency, the principle of accountability and the principle of benefits for the community. There are several factors that influence the policy of granting aid to community groups, namely communication, resources, disposition and bureaucratic structure. The policy of providing grant assistance to community groups in Badung Regency has two impacts namely positive and negative impacts. Both impacts depend on how the Badung Regency community groups react to it.

Abstract

Penelitian ini bertujuan untuk mengetahui dan menjelaskan tentang tugas, peran serta prosedur standar pengambilan keputusan lembaga Pusat Pengendalian Operasi Penanggulangan Bencana (Pusdalops PB) di dalam implementasi kebijakan Sistem Peringatan Dini Tsunami (InaTEWS) di Bali. Penelitian ini menggunakan metode deskriptif kualitatif dan pendekatan induktif dengan teknik pengumpulan data melalui observasi, wawancara, dan dokumentasi. Teknik pemeriksaan keabsahan data menggunakan uji kredibilitas dan teknik analisis data mengunakan model interaktif yaitu pengumpulan data, reduksi data, display data, dan kesimpulan/verifikasi. Hasil penelitian menunjukan Pusdalops PB mempunyai tugas dalam menganalisa informasi dan diseminasi informasi. Mempunyai wewenang mengaktivasi sirine InaTEWS, memberikan arahan evakuasi, mengarahkan seluruh potensi lembaga dan masyarakat, serta mengatur dan mengawasi implementasi kebijakan. Prosedur pengambilan keputusan arahan evakuasi yang disebarkan kepada masyarakat adalah berdasarkan informasi dari Badan Meteorologi, Klimatologi dan Geofisika (BMKG). Keputusan yang diambil tersebut, kemudian harus diteruskan kepada Gubernur dan atau Musyawarah Pimpinan Daerah Bali.This study aims to find out and explain the tasks, roles and standard procedures of the Pusat Pengendalian Operasi Penanggulangan Bencana (Pusdalops PB) decision-making agency in implementing the Tsunami Early Warning System (InaTEWS) in Bali. This study uses descriptive qualitative methods and inductive approaches to data collection techniques through observation, interviews, and documentation. Data validity checking techniques use the credibility test and data analysis techniques using an interactive model that is data collection, data reduction, data display, and conclusions/verification. The results showed that Pusdalops PB has the task of analyzing information and information dissemination. Has the authority to activate InaTEWS sirens, provide evacuation directions, direct all institutional and community potentials, and manage and oversee policy implementation. The decision-making procedure for evacuation directives distributed to the public is based on information from the Meteorology, Climatology and Geophysics Agency. The decision taken must then be forwarded to the Governor and or the Bali Regional Leadership Conference.

Abstract

This study aims (1) to analyze and find out the efforts to resolve genocide disputes from the perspective of international criminal law, (2) to determine the comparison of resolving genocide disputes that occurred in Rwanda and Myanmar. This type of research uses normative legal research, namely literature study, rules and literature related to genocide, and uses an argumentative descriptive approach. The results of this study explain the efforts and comparisons of resolving genocide disputes that occurred in Rwanda and Myanmar from the perspective of international criminal law. Genocide is an international crime that aims to eliminate ethnicity, ethnicity, race and religion in a systematic and structured manner. Efforts to resolve disputes are carried out in an international criminal manner and are handled by the International Criminal Court. The International Criminal Court is the highest judicial institution, and has the authority to handle international cases. comparative law is a method of investigation with the aim of obtaining deeper knowledge about certain legal materials. Comparative law is not a set of rules and legal principles and is not a branch of law, but is a technique for dealing with foreign legal elements from a legal problem. Court. Abstract

ABSTRAKKeberadaan desa adat (pakraman) di Bali sebagai desa yang memiliki hak otonom dalam mengurus kepentingan desanya masing-masing memiliki karakteristik yang sangat unik. Keunikan tersebut tidak hanya dilihat dari sistem pemerintahan tradisionalnya, tetapi masing-masing desa adat tersebut memiliki adat kebiasaan, kebudayaan, dialek bahasa termasuk seni serta prosesi ritual keagamaan yang diyakininya juga menunjukkan perbedaan antara satu desa dengan yang lainnya. Sekalipun demikian halnya, secara universal segala aktivitas berkebudayaan dan berkeagamaan yang dilakukan dapat dipandang sebagai pengewantahan dari ajaran agama Hindu yang dianutnya serta dijiwai oleh falsafah Tri Hita Karana.Berbagai peran telah diberikan kepada desa adat tersebut, karena dalam realitasnya hingga saat ini sejumlah aktivitas pembangunan nasional selalu melibatkan keberadaannya baik pembangunan yang bersifat fisik maupun non fisik, dengan hasil yang sangat membanggakan. Sebagai bukti perlu dikemukakan beberapa contoh di antaranya, pengelolaan kebersihan dan lingkungan hidup berbasis desa adat, pembangunan keluarga yang bahagia dan sejahtera berbasis desa adat serta penanggulangan kenakalan remaja dan kejahatan narkotika pun berbasis desa adat. Di samping itu dalam kerangka penguatan kebudayaan melalui kegiatan pelestarian bahasa dan sastra juga telah dilakukan secara berkesinambungan, baik kegiatan dalam bidang sastra daerah maupun sastra nasional.Dalam pelestarian bahasa dan sastra Bali, desa adat telah membangun suatu sistem penghayatan sastra melalui seni makekidung, makekawin, macepat yang sering dikenal dengan kegiatan Utsawa Dharma Gita, lomba penulisan sastra Bali dalam lontar, puisi dan sastra serta menuangkan pelajaran bahasa daerah Bali dalam setiap kurikulum kegiatan pasraman baik untuk tingkat anak-anak, remaja dan dewasa. Keseluruhan aktivitas tersebut bermuara kepada penguatan budaya daerah dan sekaligus mengarah kepada penguatan budaya nasional, karena budaya nasional adalah merupakan puncak-puncak dari budaya daerah.Kata kunci : desa adat, bahasa dan sastra, pelestarian dan kebudayaan.

Abstract

The pros and cons were debated in limiting national legal substance with full recognition of Customary Criminal Law in the bill of Criminal Code and its future enforcement. On the other hand, there are arguments against the inclusion of Customary Criminal Law in the Criminal Code and the resulting disparities in legal enforcement caused by some Judges’ ignorance of judging customary criminal cases settled with the imposition of customary sanctions, which resulted in an unjust situation. This article aims to serve as a legal academic framework for establishing, identifying, and analyzing the formulation of Customary Criminal Law into the Indonesian Criminal Code, as well as to contribute to the discussion of judges’ roles in sentencing customary criminal cases, which they should determine and judge based on customary law. This article demonstrated the use of normative legal research in conjunction with statutory law, legal conceptual, and philosophical approaches to law. This article discovered that: first, several issues concerning the formulation of Customary Criminal Law into several national Bills of Criminal Code were debatable; second, it also cannot be enacted due to conflicting contexts with Criminal Law principles, unwillingness, and an ambiguous law-making process. Furthermore, the prospect of including the Customary Criminal Law in the Bill of Criminal Code is based on various justifications and legal needs that reflect the diverse local genius that still exists and adheres to Pancasila law principles. Additionally, it relates to a proposed new paradigm that Judges and other legal enforcers should adopt when enforcing Customary Criminal Law in any criminal customary case.

Abstract

Article 28E paragraph (1) of the 1945 Constitution states "Every person shall be free to choose and to practice the religion of his/her choice, to choose one’s education, to choose one’s employment, to choose one’s citizenship, and to choose one’s place of residence within the state territory, to leave it and to subsequently return to it.” In paragraph (2), everyone has the right to the freedom to believe in his/her beliefs, to express his/her views and thoughts, according to his/her conscience. The constitutional guarantees for believers can also be seen in Article 29 of the 1945 Constitution stating that the state shall be based upon the One and Only God and the State guarantees all persons the freedom of worship, each according to his/her own religion or belief. The Constitutional Court affirms that the right to adhere to a religion or belief in God Almighty is a citizen's constitutional right, not a gift from the state. Therefore, the state is obliged to protect and guarantee the fulfillment of the rights of it’s the citizens to embrace a belief other than the six religions developed in Indonesia. However, in practice the dissolution of beliefs is actually carried out by community organizations. In this study, two things will be discussed namely: 1) What is the legal position of adherents of belief in the national legal system? 2) Do community organizations have the authority to dissolve religious beliefs? This research is normative juridical research, in which the problems in this research are analyzed qualitatively.
