This study aims to analyze the legal provisions regarding the criminal offense of gambling under Indonesian criminal law, as well as the forms of criminal liability and legal sanctions applicable to perpetrators in gambling cases in North Jakarta. The study employs a normative-juridical method utilizing both statutory and case-based approaches. Legal materials were analyzed descriptively to correlate legal provisions with the gambling issues serving as the research subject. The findings indicate that criminal liability for gambling perpetrators must be predicated on the fulfillment of the elements of the offense, the existence of culpability, the capacity for criminal responsibility, and the absence of any justifying or excusing grounds. In the specific gambling case in North Jakarta, the actions of the defendant, Muchamad Efendi (alias Pepenk78 bin the late Rustam Tulus), were characterized as involvement in gambling as a livelihood without a permit. Consequently, the evidentiary process must focus on the defendant's concrete involvement and the fulfillment of the "as a livelihood" element. Criminal sanctions must also take into account the degree of culpability, the perpetrator's role, aggravating and mitigating circumstances, and the objectives of sentencing. The study concludes that the enforcement of gambling laws requires meticulous evidentiary proof and proportionate sentencing, balanced with preventive measures to deter the recurrence of gambling offenses.
