Oleh karena itu, diperlukan penguatan regulasi, peningkatan profesionalisme aparat penegak hukum, serta konsistensi hakim dalam menerapkan due process of law agar fungsi praperadilan dapat berjalan lebih efektif ABSTRACT Pretrial proceedings are a legal instrument designed to control the actions of law enforcement officers during the investigation phase to prevent abuse of authority that could harm the rights of suspects. However, in practice, investigators still encounter actions that allegedly exceed their authority, such as naming suspects without sufficient evidence, arrests and detentions that do not comply with procedures, and terminations of investigations without clear legal justification. This study aims to analyze the implementation of pretrial proceedings in examining the actions of law enforcement officers during the investigation phase, identify factors that contribute to the suboptimal effectiveness of pretrial proceedings in preventing abuse of authority, and assess the effectiveness of pretrial proceedings as an instrument for protecting suspects' rights. This study uses a normative legal research method that is descriptive and analytical, with a statutory, conceptual, and case-based approach. The data used are secondary data obtained through literature review and analyzed qualitatively using deductive methods. The results indicate that the implementation of pretrial proceedings provides suspects with the opportunity to challenge the validity of investigators' actions, particularly regarding suspect naming, arrest, detention, searches, and seizures. However, the effectiveness of pretrial proceedings still faces various obstacles, including limited scope of examination, differing interpretations of pretrial proceedings by judges, short examination periods, and the lack of uniform standards for assessing the legality of investigators' actions. On the other hand, developments in pretrial regulations, including the expansion of pretrial proceedings in the latest Criminal Procedure Code (KUHAP), indicate a strengthening of the pretrial process's function as a mechanism for monitoring and protecting human rights in the criminal justice process. Therefore, regulatory strengthening, increased professionalism of law enforcement officers, and consistent judicial implementation of due process of law are needed to ensure the pretrial process's effectiveness.
