<![CDATA[The distribution of Agricultural Business Credit (KUT) by regional banks is frequently hindered by high default rates due to climate fluctuations and farmers' managerial failures. This study aims to analyze the legal construction of KUT agreements, the classification of default triggers, and non-litigation dispute resolution mechanisms at PT BPR Fajar Warapastika. Employing an empirical legal method with sociological and statutory approaches, all field and literature data were analyzed using a qualitative evaluative technique. The findings reveal that the bank applies prudential principles during the pre-contractual phase to ensure good faith and the fulfillment of contract validity requirements under the Civil Code. Securing collateral using a Deed of Sale and Purchase without a Mortgage Deed legally positions the bank as a concurrent creditor. The bank consciously relies on socio-cultural ties as a substitution for formal property protection. All forms of crop failure and managerial incompetence are classified as pure negligence, rather than force majeure (overmacht). Consequently, dispute resolution is pursued through credit restructuring, voluntary asset sales, and the involvement of kinship networks, which is accommodated by third-party payment regulations. This practice demonstrates a syncretism between formal civil law and local customary law. In conclusion, non-litigation resolution for KUT defaults effectively restores creditors' financial rights, despite leaving legal vulnerabilities due to the absence of absolute executory rights.]]>
