Abstract

ABSTRAKBerdasarkan pada Pasal 22 Peraturan Pemerintah Nomor 37 Tahun 1998 tentang Peraturan Pejabat Pembuat Akta Tanah disebut dengan jelas bahwa : “Akta PPAT harus dibacakan/dijelaskan isinya kepada para pihak dengan dihadiri oleh sekurang-kurangnya 2 (dua) orang saksi sebelum ditandatangani seketika itu juga oleh para pihak, saksi-saksi dan PPAT”, pada dasarnya untuk pemenuhan sifat otentik dari akta, pembacaan akta dilakukan sendiri oleh PPAT, penandatanganan para pihak, saksi dan oleh PPAT, dilakukan segera setelah pembacaan akta dimaksud. Seringkali dikatahui penandatangan akta jual beli yang tidak sesuai prosedur, sering didapati penandatangan di luar kantor dan tidak di hadiri para pihak, saksi maupun notaris. Oleh karena itu penulis akan mengkaji hal tersebut melalui tesis ini.Pendekatan yang digunakan adalah yuridis empiris yang memberikan kerangka pembuktian atau kerangka pengujian untuk memastikan suatu kebenaran atau dengan kata lain disebut yuridis empiris. Spesifikasi penelitian yang dipakai dalam penelitian ini adalah deskriptif analitis yaitu penelitian yang bertujuan untuk memberikan gambaran secara rinci, sistematis dan menyeluruh mengenai segala sesuatu yang berhubungan dengan masalah dengan menggambarkan peraturan perundang-undangan yang berlaku dengan teori-teori hukum dan praktek pelaksanaan hukum positif yang menyangkut permasalahan di atas.Hasil pembahasan masalah adalah bahwa akibat hukum terhadap akta peralihan hak atas tanah (akta jual beli tanah) yang dibuat oleh Pejabat Pembuat Akta Tanah (PPAT) yang ditandatangani tanpa dihadiri oleh para saksi maka akta jual beli tersebut tetap merupakan sebagai akta otentik namun secara yuridis mengandung kelemahan jika dikemudian hari ada pihak yang mengajukan bantahannya.Saran Hendaknya dilakukan pengawasan oleh pihak yang terkait terhadap pelaksanaan tugas dan wewenang dari Pejabat Pembuat Akta Tanah (PPAT) agar tetap terjaga sifat otentik dari akta jual beli tanah yang dilakukan di hadapan PPATKata Kunci : Kehadiran Saksi, Transaksi Jual Beli Tanah, PPATABSTRACTBased on Article 22 of Government Regulation Number 37 of 1998 on the Regulation of Officials of Land Authority, it is clear that: "The PPAT Act is read / disclosed to parties with at least 2 (two) witnesses present before signing immediately, witnesses and PPAT ", basically to fulfill the authenticity of the deed, to read the deed done by PPAT, signing the parties, witness and PPAT, immediately after the reading of the deed. The familiar selling marker is not an appropriate procedure, often found outside the signing office and is not attended by parties, witnesses or notaries. Therefore the authors will examine the problem through this thesis.The approach employed is empirical jurisdiction that provides a verification framework or testing framework to ascertain the truth or in other words is called empirical jurisdiction. The research specification used in this research is descriptive analytic research which aims to provide detailed, systematic and comprehensive description of all matters relating to the problem by describing the applicable legislation with legal theory and practice practice of positive law concerning the above problem.The result of the discussion is that the legal effect on the deed of land transfer done by Indigenous Land Authority (PPAT) is signed without the presence of witness then the sales and sales deed is still valid. As a juridical but legal juridical act if in the future there is a party who filed a rebuttal. Suggestions Must be supervised by parties relating to the execution of duties and authorities of Land Assistance Officers (PPAT) to maintain the authentic nature of the deed of sale and purchase of land conducted in the presence of PPAT.Keywords: Witness Presence, Land Sale and Purchase Transaction, PPAT

Abstract

The purpose of this study was to determine and analyze Notary authority in Providing Legal counseling in terms of Act No. 2 of 2014 on Amendment of Act No. 30 of 2004 concerning Notary and Notary Code. And to analyze Obstacles and Solutions for a Notary in Role Gives Legal counseling.This study uses empirical juridical approach, the specification is descriptive analytical research, data sources used in the form of primary data obtained through interviews, secondary data with the literature study, qualitative analysis. The problem is analyzed using the theory of Authority and Accountability.Based on the results of this study concluded that 1) Notary authority in providing Legal counseling to Its clients can be divided into two (2) Criteria, namely a) Legal counseling followed by Creation Deed and b) Legal counseling without being followed by Creation Deed. 2) The obstacles in conducting Legal counseling, namely a) Effect of Kinship properties, b) Effect of Position, c) Influence of Consumerism, d) Profession into Business Activity, e) Due to Weak Faith. Solutions to resolve impediments in doing Notaries Legal counseling Legal counseling is doing that is not followed by Creation Deed.Keywords: Notary authority; Legal counseling.

Abstract

The applicants auction sellers often in practice face prosecution or a lawsuit from a third party that the goods to be auctioned are their own and not the property of those who had been cut with a criminal offense, as it sometimes is the case / light after the auction conducted and considered have been completed. In addition to the auction buyer after he mastered the goods purchased from the auction process also sometimes face prosecution or a lawsuit from a third party that the goods he bought from the auction is actually owned by third parties. The purpose of this study is to analyze the legal protection given to the rightful owner of the auction the buyer of goods or execution of plunder and spoils the country carried out by KPKNL Yogyakarta. This type of research is empirical. Source data using primary and secondary data. The data were analyzed descriptively qualitative. The results showed that the form of legal protection to each of the parties related to the auction execution of plunder and booty state 1) Acting as seller / applicant auction execution is the police or the prosecutor.; 2) To the owner of the goods / owner beginning of good will get legal protection to prevent the auction execution if the auction is not conducted through the path objections / rebuttals, however, if the auction had been implemented, the original owner can file a lawsuit with the District Court, if based on the decisions of the Court the country was the original owner declared right then he can ask them to buyers KPKNL that the goods be returned; 3) To the auction buyers who have a good-faith execution of legal protection in the form of refund of the purchase that have been paid without any deduction. but if the auction had been implemented, the original owner can file a lawsuit with the District Court, if based on the District Court declared the original owner right then he can ask to the buyer that the goods be returned KPKNL.Keywords: Legal Protection; The Auction Execution; KPKNL Yogyakarta.

Abstract

ABSTRAKPenelitian ini menggunakan pendekatan hukum yuridis-empiris (sosio-legal research). Jenis penelitian hukum empiris merupakan jenis penelitian yang menganalisa suatu permasalahan hukum atau isu hukum berdasarkan suatu permasalahan yang ada dalam masyarakat itu sendiri dengan cara mendapatkan data lapangan. Bahan hukum yang digunakan dalam penelitian ini adalah bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Teknik pengumpulan data yang digunakan adalah studi kepustakaan, yang didukung data lapangan melalui observasi dan wawancara.Bentuk perjanjian nominee yang dibuat oleh warga negara asing dengan warga negara Indonesia di Lombok, yaitu dibuat dengan akta otentik oleh Notaris, melalui akta jual beli dengan menggunakan nama warga negara Indonesia selanjutnya melahirkan perjanjian-perjanjian lainnya. Bentuk pertanggungjawaban notaris terhadap perjanjian nominee yang dibuatnya yaitu tanggung jawab secara Perdata, Pidana dan Kode Etik. Akibat hukum dari perjanjian nominee yang dibuat oleh Notaris tersebut merupakan perbuatan penyelundupan hukum yang bertentangan dengan ketentuan peraturan perundang-undangan yang berakibat perjanjian nominee batal demi hukum.Kata Kunci : Perjanjian, Hak Milik, Nominee.ABSTRACTThis research uses juridical-empirical legal approach (socio-legal research). The type of research empirical law is a type of research that analyzes a legal issue or legal issue based on a problem that exists within the community itself by obtaining field data. The legal materials used in this study are primary legal materials, secondary legal materials and tertiary legal materials. Data collection techniques used are literature study, supported by field data through observation and interview. The form of a nominee agreement made by a foreign citizen with an Indonesian citizen in Lombok, which is made by an authentic deed by a Notary, through the deed of sale and purchase using the name of the Indonesian citizen subsequently gave birth to other agreements. Forms of responsibility of a notary to the nominee agreement he made, namely, Civil, Criminal and Code of Ethics. The legal consequences of the nominee agreement made by the Notary are legal smuggling acts contrary to the provisions of laws and regulations which result in the nominee agreement null and void.Keyword : Legal Agreement, Property Rights, Nominee.

Abstract

Jabatan Notaris terus menerus mengalami perkembangan dan perubahan sesuai dengan perkembangan zaman dalam artian perubahan-perubahan di dalam mempersiapkan para Notaris untuk kepentingan masyarakat, diantaranya diundangkannya perubahan atas Undang-Undang Jabatan Notaris (UUJN). Salah satunya adalah mengenai pengertian tentang minuta akta dan kewajiban Notaris melekatkan cap ibu jari/sidik jari tangan penghadap. Penelitian dengan judul ”Akibat Hukum Pembubuhan Sidik Jari Tangan Para Penghadap Pada Minuta Akta Notaris Sebagai Sempurnanya Akta Autentik Menurut Undang-Undang Jabatan Notaris, bertujuan  untuk mengetahui  prosedur pembubuhan sidik jari tangan para penghadap sebagaimana dinyatakan dalam UUJN, karena bila tidak dilaksanakan Notaris bisa mendapatkan sanksi administratif.Dalam hal ini pokok permasalahannya yaitu bagaimana prosedur pembubuhan sidik jari tangan para penghadap berdasarkan UUJN dan sampai sejauh mana sanksi yang dikenakan atas akta yang dibuatnya serta sanksi kepada Notaris sendiri jika tidak melakukan kewajiban tersebut.Metode penelitian yang dipakai adalah penelitian hukum normatif, dengan menggunakan metode analisis kualitatif, yang dilakukan dengan teknik Deskriptif dan Interpretasi, adapun jenis dan sumber datanya menggunakan data sekunder sebagai sumber utamanya, yaitu mempelajari aturan hukum, prinsip hukum maupun doktrin-doktrin hukum guna menjawab mengenai isu hukum yang dihadapi serta melakukan wawancara dengan Notaris/PPAT sebagai nara sumber.Kesimpulannya adalah Notaris wajib melakukan pembubuhan sidik jari tangan para penghadap sebagaimana tersebut pada UUJN yang mengatur hal tersebut. Apabila Notaris tidak melakukan pembubuhan sidik jari tangan para penghadap dapat terkena sanksi administratif sebagaimana diatur dalam Pasal 16 ayat (11). Terhadap kedudukan aktanya tetap sah dan mempunyai kekuatan pembuktian yang sempurna. Sudah seharusnya Notaris melakukan kewajiban pembubuhan sidik jari tangan para penghadap dalam pembuatan akta, sehingga amanat Pasal 16 ayat (1) huruf c terpenuhi dan akta yang dibuatnya akan lebih sempurna.Kata Kunci : Pembubuhan Sidik Jari, Minuta Akta

Abstract

In every office attached to someone will be accompanied by moral rules called code of ethics as well as the notary office. Code of conduct notary entire moral code is determined by the association organization "Indonesian Notary Association" (INI), where applicable, and must be obeyed by all members of the association as well as others who have positions of notary. Notary is necessary to know and understand the code of conduct notary. This code of conduct govern all actions of what can be regarded as a violation of the code of conduct and what sanctions if violated the code of conduct. In practice, a notary public notary supervised by the board of trustees. This oversight is necessary so that the notary did not ignore the majesty and dignity of the profession.The method used in this research is normative. The data used are primary data and secondary data. Primary data in the form of research conducted in the field related to the object of research and data secondary, namely in the form of legislation, library, archives, expert opinions and regulations associated with the object of research.Discussion of the results shows that the sanction of conduct for notaries who have multiple offices are in violation of the code of conduct notary office. based on the above factors, it is important to know what is an indication of an offense involving the notary in the notary office area coverage authorized by a notary office code of ethics. Should the effort of the board of trustees for providing information about the code of conduct for all notaries to avoid misunderstandings about the ban notaries and exclusion. Therefore the role of the board of honor in the enforcement of the code of ethics notary must be implemented properly and in accordance with the applicable rules.Keywords: Notary Code; Honor Council; Office of the Associate; Notary.

Abstract

The purpose of this study were: 1) to identify and analyze the role of the notary to manufacture special power of attorney notarized deed oath in filing for divorce in the Religious Court. 2) To identify and analyze the constraints notary in the manufacture of a special power of attorney notarized deed oath in filing for divorce in the Religious Court. The data used in this study are primary data, secondary data, and the data to support the assessment tertiary then analyzed with normative juridical method. Abstract

ABSTRAKTujuan penelitian adalah untuk menganalisis dan mengkaji peranan Notaris dalam pembuatan Akta Pemberian Hak Tanggungan (APHT) terhadap kreditur dan debitur, untuk untuk menganalisis dan mengkaji kendala-kendala yang dihadapi Notaris dalam pembuatan Akta Pemberian Hak Tanggungan (APHT) terhadap kreditur dan debitur, dan untuk untuk menganalisis dan mengkaji dalam notaris dalam memberi solusi yang dihadapi Notaris dalam pembuatan Akta Pemberian Hak Tanggungan (APHT) terhadap kreditur dan debitur. Penelitian ini merupakan penelitian kualitatif dengan metode pendekatan secara yuridis normatif.Berdasarkan hasil penelitian dan pembahasan dapat diketahui bahwa peranan Notaris dalam pembuatan APHT sesuai Pasal 15 Undang-Undang Republik Indonesia Nomor 2 Tahun 2014 Tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris terhadap kreditur dan debitur terletak pada tanggungjawabnya yaitu tanggungjawab terhadap akta yang dibuatnya serta perlindungan terhadap para pihak yang terkait di akta tersebut bila dikemudian hari terjadi sengketa di antara para pihak. Hal ini sesuai teori keadilan tindak menjadi monopoli pemikiran satu orang ahli saja dan teori kemanfaatan hukum dimana tujuan hukum semata-mata untuk memberikan kemanfaatan atau kebahagiaan.Kata kunci : peranan notaris, pembuatan APHT, perjanjian Kredit ABSTRACTThe purpose of this research is to know and explain the role of Notary in making Deed of Assignment Rights (APHT) to creditors and debtor, to know and explain constraints faced by Notary in making Deed of Assignment Rights (APHT) to creditor and debtor, and to know and explains how to overcome the constraints faced by a Notary in the creation of Deed of Assignment Rights (APHT) to the creditor and debtor. This research is a qualitative research with normative juridical approach method.Based on the results of research and discussion it can be seen that the role of Notary in making APHT pursuant to Article 15 of Law of the Republic of Indonesia Number 2 Year 2014 About Amendment of Law Number 30 Year 2004 About Position Notary to creditor and debtor lies on its responsibility that is responsibility to deed which he made as well as the protection of the parties concerned in the deed if in the future there is a dispute between the parties. Abstract

ABSTRACTThis study aims to determine the implementation and analyze the role of notary in a franchise agreement between PT Pos Indonesia (Persero) Pati with individual business entities, obstacles and solutions in the implementation of franchise agreement between PT Pos Indonesia (Persero) Pati with individual business entities and legal effects if the agreement A franchise between PT Pos Indonesia (Persero) Pati and individual business entities are not made by notarial deed.Method This research is empirical law research method, that is research based on implementation in effort to get primary data preceded by library research to get secondary data. The research was conducted at PT Pos Indonesia (Persero) Pati, and the overall data obtained was analyzed qualitatively.The results showed that the implementation and analysis of the role of notary in a franchise agreement between PT Pos Indonesia (Persero) Pati and individual business entities are agreements that are not contradictory to the law, religion, public order and morality. This means that the franchise agreement is valid and therefore the agreement becomes a law for those who make it, and binds both parties and the agreement is a standard reciprocal agreement because each party has equal rights and obligations put forward the principle of win-win solution Which are mutually beneficial. The obstacles that exist are the frenchisee can do wanprestasi which result in frenchisor loss. The solution is a franchisee before deciding to franchise must adjust to the franchise recipient character.Against the legal consequences that arise as a transaction that breeds the agreement, the franchise invariably involves two parties with independent interests and sometimes opposites. The principle of profit maximization is also essentially a source of differences in interests and disputes that can occur between the two parties. This great advantage can only be achieved by both parties if both parties can establish a mutually beneficial synergism.Keywords: Notary, Franchise Agreement, Individual Business Agency
