Abstract

An inheritor can make a deed of will before a Notary, so that in a dispute occur later on between the heirs, the deed of will can be used as a basis for deciding the dispute between parties. Notaries who have the authority to make a deed of will have the obligation to serve the community in making a deed of will in the form of an authentic deed as stipulated in Article 15 paragraph (1) of Law Number 2 year 2014 concerning Amendments to Law Number 30 on the Position of Notary, which reads " The Notary has the authority to make authentic deeds regarding all deeds, agreements, and stipulations required by legislation and/or desired by the interested parties to be stated in an authentic deed, to guarantee certainty of the date of making the deed, to store the deed, give grosse, copy and quote of deed. All of those matters can be done by the notary as long as the deed is not also assigned or excluded to other officials or other people determined by law". So it is expected that the will certificate in the form of an authentic deed made by a notary based on the will of the inheritor can provide a solution that can be used as a basis in deciding a case of dispute between heirs. Legally, the heirs have secured the right as an heir, in accordance with Article 874 of the Civil Code. Related to the dispute between the heirs caused by the will deed made by the Notary, the Court take responsibility to overcome the dispute, so that all parties can get legal certainty.Keywords: Testament Deed, Authority of Notary, Dispute of Heirs

Abstract

ABSTRAKPenelitian ini bertujuan untuk mendeskripsikan dinamika pengelolaan BPHTB setelah dialihkan menjadi pajak daerah serta mengkaji peran PPAT untuk mendukung pelaksanaan Peraturan Daerah Kota Surakarta No. 13 Tahun 2010 terhadap penerapan sistem self assessment pada pemungutan BPHTB dalam transaksi jual beli hak atas tanah dan bangunan. Metode penelitian menggunakan yaitu digunakan sebagai pendekatan yang utama dalam menggali hukum yang didasarkan pada peraturan perundang-undangan yaitu dengan mengkaji dan mempelajari serta menelaah teori-teori, konsep-konsep dan asas-asas norma hukum.Hasil penelitian diperoleh kesimpulan bahwa Pengalihan BPHTB menjadi pajak daerah di Kota Surakarta merupakan kebijakan yang tepat untuk meningkatkan kapasitas fiskal pemerintah daerah. Pemerintah daerah Kota Surakarta cukup siap dalam menghadapi pengalihan BPHTB menjadi pajak daerah. Hal ini dapat dilihat dari segi kelembagaan (peraturan perundang-undangan, organisasi serta prosedur pelaksanaan), sarana prasarana dan SDM, walaupun dalam beberapa aspek masih perlu ditingkatkan. Peranan Notaris selaku PPAT dalam penerapan sistem self assessment pada pemungutan Bea Perolehan Hak atas Tanah (BPHTB) berkaitan dengan akta yang dibuatnya diharapkan Notaris selaku PPAT berperan aktif mensyaratkan pembayaran Bea Perolehan Hak atas Tanah (BPHTB) dalam melakukan pemindahan hak atas tanah dan bangunan, yang mana setelah terjadinya kesepakatan dan dilakukan transaksi pembayarannya, pajak sesegera mungkin harus dibayar, kemudian diteliti kebenarannya agar akta yang dibuatnya dapat segera ditandatangani.Kata Kunci: self assessment, pemungutan BPHTB. ABSTRACT This study aims to describe the dynamics of management BPHTB after redirected into tax areas as well as to examine the role of Conveyancer to support the implementation of the regulations of the Surakarta Area No. 13 Year 2010 against the application of the system of self assessment on ballots in buying and selling BPHTB rights over land and buildings. Research methods use that is used as the primary approach in unearthing the law based on laws and regulations by reviewing and studying as well as examines the theories, concepts and principles of legal norms.The research results obtained the conclusion that a transfer of tax areas become BPHTB Surakarta is the right policy to improve the fiscal capacity of local governments. Local government city of Surakarta is quite ready in the face of the transfer tax be BPHTB area. This can be seen in terms of institutional arrangements (legislation, organization and procedures of implementation), infrastructure and human resources, although in some aspects still need to be improved. The role of the Notary as a conveyancer in the application of the system of Customs self assessment on voting rights over Land Acquisition (BPHTB) relating to the deed of notary public as he is expected to play an active role requires payment of the conveyancer Bea Acquisition (land rights BPHTB) in conducting the transfer of rights over land and buildings, which after the deal and the payment transaction is carried out, the tax shall be paid as soon as possible, and then examined the truth so that he can act immediately signed.Keywords: self assessment, polling BPHTB.

Abstract

The purpose of this study was to: 1) To determine the role of the Implementation of the notary in the deed establishment of the Foundation under Act No. 28 of 2004 on the foundation of Jepara. 2) To know the difficulties and Solutions faced a notary in the deed establishment of the Foundation under Act No. 28 of 2004 on the foundation of Jepara.Method approach used in this research is a normative juridical approach. Specifications descriptive analytical research. Types and sources of data using secondary data and primary data as well as the use of primary legal materials, secondary law and tertiary legal materials. The collection of data through library research and field study. Qualitative data analysis and deductive.Based on the results of data analysis concluded that: 1) The role of the notary in the deed establishment of the Foundation under Act No. 28 of 2004 on the foundation of Jepara includes three important things, namely, to explain the terms of the deed establishing the foundation to the founder of the foundation, make certificates of establishment, then submit the ratification to the Minister of Justice and Human Rights. 2) Barriers and Solutions encountered in the manufacturing notary deed of incorporation of the Foundation under Act No. 28 of 2004 on the foundation of Jepara is in the maintenance of the terms of the deed establishing the foundation has not completed such as TIN foundations as well as the identity of the parties is not an e-ID card, the solution is certainly advise coaches / administrators to quickly gather the requirements in the manufacture of its founding act.Keywords: Implementation; Notary Deed; Role of Establishment Foundation

Abstract

Limited Liability Company is an alliance of several people to conduct a business whose capital comes from shares owned by the members. Limited Liability Company in the current era is very much needed as the economic development. The method used was an empirical juridical method with descriptive analytical research specifications, while the data analysis method used was qualitative analysis. Based on the results of the research and discussion, it can be concluded that the delay in the registration of the establishment of a Limited Liability Company in the Legal Entity Administration System (SABH) of the Ministry of Law and Human Rights can be overcome by using the Confirmation deed on the previous deed of establishment. The delay in the registration of the establishment of a Limited Liability Company may be due to the delay in the process of making the Company's NPWP by its own Limited Company, or for other reasons which result in the date of registration cannot be registered with SABH and the previously purchased voucher has expired. Regarding the use of the affirmation deed, because of the previous deed of establishment had become an official and included in the notary protocol, the existence cannot be withdrawn. To avoid delays in registration, the notary should conduct socialization to clients who will carry out the process of establishing a Limited Liability Company.Keywords: Limited Liability Company; Legal Entity Administration System; Delay

Abstract

ABSTRAKJurnal akta ini akan mengupas dan membahas agar dapat menganalisis serta dapat mengetahui mengenai bentuk Akta Notaris berdasarkan Perspektif Undang-Undang Nomor 40 Tahun 2007 Tentang Perseroan Terbatas serta dapat mengetaui bagaimana tanggung jawab notaris apabila akta perseroan terbatas yang sudah dibuatnya terjadi kesalahan ketika pendaftaran secara On Line?.Dalam pembuatan jurnal ini, peneliti menggunakan analisis data dengan beberapa metode, yakni berupa analisis data primer, analisis data sekunder dan analisis data tersier. metode deskriptif-kualitatif dipilih menunjang pengkajian, guna menganalisis data penelitian.Berdasarkan hasil analisis data maka dapat disimpulkan sebagai berikut: bentuk Akta Notaris berdasarkan Perspektif Undang-Undang Nomor 40 Tahun 2007 Tentang Perseroan Terbatas adalah pendirian Perseroan Terbatas (“PT”) yang mendasarkan pada perjanjian dibuat dalam bentuk akta pihak. Adapun PT setelah memperoleh status badan hukum akan berlaku anggaran dasar dari perseroan tersebut sehingga sama keadaannya dengan yayasan yang telah memperoleh status badan hukum. Keputusan yang diambil oleh para pemegang saham yang dilakukan melalui Rapat Umum Pemegang Saham (RUPS) bentuk aktanya adalah akta berita acara (relaas). Sedangkan tanggung jawab notaris apabila akta perseroan terbatas yang sudah dibuatnya terjadi kesalahan ketika pendaftaran secara On Line , Notaris bertanggungjawab untuk menganti kerugian dengan membuat akta perubahan, merubah dan memperbaiki data pendaftaran Perseroan Terbatas ketika terjadi kesalahan dalam pemasukan data.Kata Kunci: Notaris, Kepastian Hukum, Akta, Perseroan Terbatas ABSTRACTJournal of this deed will explore and discuss in order to analyze and can know about the form of Notary Deed based on Perspective of Law Number 40 Year 2007 About Limited Liability Company and can know how the responsibility of notary when the certificate of limited liability company which has made mistake when registration on On Line ?In making this journal, researcher use data analysis with some method, that is primary data analysis, secondary data analysis and tertiary data analysis. descriptive-qualitative method was chosen to support the study, to analyze the research data.Based on the result of data analysis, it can be concluded as follows: Deed of Notary Deed based on Perspective of Law Number 40 Year 2007 About Limited Liability Company is the establishment of Limited Liability Company ("PT") based on agreement made in the form of deed of party. The PT after obtaining the status of legal entity will apply the articles of association of the company so that the same situation with the foundation that has obtained the status of legal entity. Decisions taken by shareholders conducted through the General Meeting of Shareholders (AGM) form of act is the deed of the minutes of the event (relaas). Whereas the notary's responsibility when the certificate of incorporation is made by mistake when the registration is On Line, the Notary is responsible to redress the loss by making the deed of amendment, modify and improve the registration data of the Limited Liability Company in the event of errors in the data entry.Keywords: Notary, Legal Certainty, Deed, Limited Liability Company

Abstract

The purpose of this study was to: 1) To determine and analyze Systematic implementation of the Complete Systematic Land Registration in Village of Ngaringan, Tanjungharjo Subdistrict, Grobogan District 2) To identify and analyze the obstacles faced in the Complete Systematic Land Registration in Village of Ngaringan, Tanjungharjo Subdistrict, Grobogan District. The data used in this study are primary data, secondary data and data that can support tertiary study, which was then analyzed by sociological methods.Based on the results of data analysis concluded that: 1) Implementation of PTSL by adjudication teams dominate in their respective fields in their duties, their dexterity of team officials adjudication PTSL in performing their duties which is always ready to be in place basecamp / office Adjudication Team in terms of running activities, the cooperation with the village as well as their facilities and infrastructure such as the computerized system so that it becomes a factor that support the implementation of land registration through PTSL program. Rural communities in the program areas PTSL responded well and was very happy to participate as the program participants as evidenced by the demand from the public to register as a participant PTSL program that exceeds that of the set target. 2) Obstacles that occur in the field, among others, lack of knowledge of the importance of data collection for the certificate issuance process, so people tend to underestimate completeness impressed application file such as ID cards and SPPT (Income Tax Payable). In addition proof of ownership of the land acquired is minimal, so that the necessary statements and testimony. Then the location of Block SPPT on the rights object not fit image map Ricikan Block PBB Layout object existing rights in Block SPPT incompatible with image map Ricikan Block PBB, making it difficult for the task force juridical data collectors in determining the location of the object that right.Keywords: PTSL; Implementation; Obstacles.

Abstract

The Foundation is a legal entity consisting of wealth are separated and destined to achieve certain objectives in the social, religious, and humanitarian who has no members. Foundation stipulated in Act No. 16 of 2001 as amended by Act No. 28 of 2008 and further stipulated in Government Regulation No. 63 of 2008. The Foundation is a legal entity that can act and take legal actions were legitimate and resulted of law. Wealth foundation has separated, has assets of both movable and immovable which was originally derived from capital or wealth founders who have been separated. The Foundation has a specific purpose which is the implementation of the good values of religious, social, and humanitarian non-profit. The Foundation does not have members and does not have shareholders or its allies. The Foundation is driven by better foundation organ Trustees, Trustees and administrators. Legal risk for organ foundation is not getting a salary, to be convicted, personal property administrators and supervisors can be guaranteed, the attachment foundation board on budgetary basis, the application of the principle of Duty Skill Care for administrators and supervisors, and the implementation of employee activities. The Foundation shall make an annual report and efforts to conduct an examination of the foundation.  In article 5 of 2014 concerning the Ratification of the Entity many foundations were re-registered through a system of legal entity through a notary so that the notary has the obligation to register on the foundation filed. So in the implementation strengthen notary deed establishing the foundation when it should be an adjustment but, because of the administrative system there are no legal entities adjustment column notary can only use applications with a choice of establishments column.Keywords: Legal Foundation, Legal Entity Administration System, Legalization Agency.

Abstract

ABSTRAKPenelitian dengan judul ”Hukum Waris Islam Di Indonesia (Studi Perkembangan Hukum Kewarisan Dalam Kompilasi Hukum Islam Dan Praktek Di Pengadilan Agama )”Penelitian ini menggunakan pendekatan yuridis normative, dalam pengumpulan data lebih ditekankan pada sumber bahan primer, berupa peraturan perundang-undangan, menelaah kaidah-kaidah hukum maupun teori ilmu hukum yang terkait dengan masalah yang di teliti.Berdasarkan metode tersebut penelitian menghasilkan pada pokoknya : (1) Formulasi hukum kewarisan islam dalam fiqih dan Kompilasi Hukum Islam (a) Formulasi hukum kewarisan Islam dalam fiqih pada al quran dan al hadist yaitu : Al quran, QS. An-nisa (4): 7, QS. An-nisa (4): 11, QS. An-nisa (4): 12, QS. An-nisa (4): 33, QS. An-nisa (4): 176, QS. Al-anfal (8): 75, dan Hadist Rasulullah SAW (b) Formulasi hukum kewarisan Islam dalam Kompilasi Hukum Islam di atur dalam Pasal 171 sampai dengan Pasal 193.(2) Perkembangan hukum kewarisan Islam dalam Kompilasi Hukum Islam di banding dengan kewarisan dalam fiqih yaitu banyak memasukkan unsur-unsur hukum adat dan kepentingan-kepentingan yang dibutuhkan masyarakat Indonesia masa sekarang, maka banyak bentuk-bentuk hukum kewarisan yang belum tertuang dalam fiqh konvensional (fiqh al-mawarits), namun hal itu telah termuat dan terkodifikasikan dalam hukum kewarisan Kompilasi Hukum Islam, antara lain: pasal 171 tentang harta bersama, pasal 177 tentang pembagian ayah secara `ashabah, pasal 209 yang menyatakan bahwa ayah angkat dan anak angkat menerima warisan, dan bila mereka tidak menerima wasiat, maka berhak menerima wasiat wajibah dan Kopilasi Hukum Islam pun mengakui harta gono-gini padahal fiqh tidak mengakui; (3) Perkembangan hukum kewarisan Islam dalam praktek putusan pengadilan agama di Indonesia hal ini tidak lepas dari Kompilasi Hukum Islam merupakan intruksi Presiden No. 1 Tahun 1991 tanggla 10 Juni 1991, sehingga perkawinan, kewarisan, dan wakaf bagi pemeluk-pemeluk Islam telah ditetapkan sehingga dapat dijadikan pengadilan agama sebagai “pedoman” dalam artian sebagai sesuatu petunjuk bagi para hakim Peradilan Agaman dalam memutus dan menyelesaikan perkara, maka kedudukannya adalah tergantung sepenuhnya dari para Hakim dimaksud untuk menuangkannya dalam keputusan-keputusan mereka masing-masing sehingga kompilasi ini akan terwujud dan mempunyai makna serta landasan yang kokoh dalam yurisprudensi Peradilan Agama. Dengan cara demikian, maka Peradilan Agama tidak hanya berkewajiban menerapkan ketentuan-ketentuan yang sudah digariskan dalam kompilasi, akan tetapi justru mempunya peranan yang lebih besar lagi untuk memperkembangkan dan sekaligus melengkapinya melalui yurisprudensi yang dibuatnya..Kata kunci : Hukum waris Islam, hukum Kewarisan, Kompilasi Hukum Islam ABSTRACTThe research entitled "The Law of Inheritance of Islam in Indonesia (Study of Legal Development of Inheritance in Compilation of Islamic Law and Practice in Religious Courts)" This research uses normative juridical approach, in collecting data more emphasized on primary source material, in the form of legislation, - the rule of law and the theory of jurisprudence associated with the problem in the perusal.Based on these methods, the research produces basically: (1) Formulation of Islamic inheritance law in fiqh and Compilation of Islamic Law (a) Formulation of Islamic inheritance law in fiqih on al quran and al-hadist namely: Al Quran, QS. An-nisa (4): 7, QS. An-nisa (4): 11, QS. An-nisa (4): 12, QS. An-nisa (4): 33, QS. An-nisa (4): 176, QS. Al-anfal (8): 75, and Hadith Rasulullah SAW (b) The formulation of Islamic inheritance law in the Compilation of Islamic Law is set in Articles 171 to 193. (2) The development of Islamic inheritance law in the Compilation of Islamic Law in appeal to inheritance in fiqih which includes many elements of customary law and the interests that are needed by Indonesian society today, so many forms of inheritance law that has not been contained in the conventional fiqh (fiqh al-mawarits), but it has been contained and codified in the law of inheritance The Compilation of Islamic Law, among others: article 171 on common property, article 177 on the division of fathers asabah, article 209 which states that foster and adopted sons receive inheritance, and if they do not receive a will, it is entitled to a mandatory and compulsory law Islam also recognizes the property gono-gini fiqh although do not recognize; (3) The development of Islamic inheritance law in the practice of religious court ruling in Indonesia is not separated from the Compilation of Islamic Law is the Presidential Instruction. 1 In 1991 on 10 June 1991, so that marriage, inheritance and endowments for the followers of Islam have been established so that it can be used as religious courts as a "guide" in the sense that a guide for the judges of the Religious Court in deciding and settling the case, depends entirely from the Judges intended to put it in their respective decisions so that this compilation will materialize and have a firm meaning and foundation in the jurisprudence of the Religious Courts. Abstract

Tujuan dari penelitian ini adalah untuk mengetahui dan mengkaji pemahaman masyarakat terhadap akta notariil dan fungsinya; peran Notaris dalam memberikan pemahaman hukum kepada masyarakat yang kurang mampu dalam memahami hukum kaitannya dalam pembuatan akta-akta notariil di wilayah Kedu Selatan; serta peran Ikatan Notaris Indonesia (INI) dalam pembinaan terhadap Notaris untuk memberikan pemahaman hukum kepada masyarakat yang kurang mampu dalam memahami hukum kaitannya dengan pembuatan akta notariil.penelitian ini termasuk dalam jenis penelitian hukum normatif, karena penelitian ini berangkat dari adanya kekosongan norma (rechtsvacuum). Jenis pendekatan yang diterapkan dalam penelitian ini adalah jenis pendekatan perundang-undangan (statute approach). Bahan hukum yang telah dikumpulkan dan disistematisir kemudian dilakukan analisis secara kualitatif.Hasil dari penelitian ini adalah (1) Pemahaman masyarakat tentang akta notariil dan fungsinya belum memadai, sehingga banyak orang yang menuangkannya di dalam akta Notaris, baik itu yang berbentuk perikatan yang melibatkan pihak lain maupun sekedar untuk menyatakan maksud tertentu agar dijadikan sebagai dokumen legal yang mempunyai kekuatan hukum, dengan harapan untuk mendapatkan kepastian hukum dikemudian hari. Akan tetapi banyak masyarakat ataupun para penegak hukum dan bahkan para Notaris sendiripun masih banyak yang kurang memahami peranan tugas dan tanggung jawab Notaris dalam masyarakat terutama dalam membuat akta autentik; (2) Peran Notaris dalam memberikan pemahaman hukum kepada masyarakat yang kurang mampu dalam memahami hukum kaitannya dalam pembuatan akta-akta notariil dilakukan dengan penyuluhan hukum kepada kliennya, dapat dibagi menjadi 2 (dua) kriteria, yaitu penyuluhan hukum yang diikuti dengan pembuatan akta dan penyuluhan hukum tanpa diikuti dengan pembuatan akta. Penyuluhan hukum yang diikuti dengan pembuatan akta merupakan satu kesatuan yang tidak dapat dipisahkan; serta (3) Tugas Ikatan Notaris Indonesia (INI) dalam pembinaan Notaris tidak lepas dari pada penegakan Etika Notaris, meliputi norma agama, norma hukum, norma kesusilaan, dan norma kesopanan. Norma agama, norma kesusilaan, dan norma kesopanan berhubungan dengan etika. Kode Etik dalam arti materiil adalah norma atau peraturan yang praktis baik tertulis maupun tidak tertulis mengenai etika berkaitan dengan sikap serta pengambilan putusan hal-hal fundamental dari nilai dan standar perilaku orang yang dinilai baik atau buruk dalam menjalankan profesinya yang secara mandiri dirumuskan, ditetapkan dan ditegakkan oleh organisasi profesi.Kata Kunci: Peran Notaris, Pemahaman Hukum, Masyarakat Kurang Mampu, Akta Notariil

Abstract

The purpose of this study was to: 1) Analyze determine and analyze the role of the notary in the completion of the loan agreement with collateral Mortgage PT. Bank Tabungan Negara (Persero) Tbk. 2). Analyzing the causes of a default in settlement of loans with collateral Mortgage PT. Bank Tabungan Negara (Persero) Tbk. 3) Analyze the settlement of disputes in the credit agreement with collateral Mortgage PT. Bank Tabungan Negara (Persero) Tbk.This research is a field research or empirical research with sociological juridical approach. Sociolegal research done by researching in the field (field research) by means of interviews with respondents who are the primary data and researching library materials is a secondary data and also referred to the research literature. Analysis of data using Qualitative analysis.The research results are: 1) Task, responsibilities and authority of the Notary is a deed of credit agreement requested by the bank based on information that is clear, to legalize the deed of credit agreement, and is responsible for the correctness, accuracy, completeness of documents, provide counseling to clients / debtors , conceal the identity of the debtor's creditors, enter into a deed of the District Court registry book. 2) Notarial acts as a public official entitled to a deed of credit agreement. And provide legal certainty for the parties to the credit agreement. Besides the role of the Notary as well as the authorities to check against collateral in the form of Encumbrance to ascertain whether goods such guarantee was legal or not, or to avoid if there is a possibility in the collateral Mortgage were made in the warranty is still disputed law or case law. 3) Barriers faced by a Notary is a lack of understanding on banking borrowers, thus providing an explanation to the parties concerned to a mistake in making the agreement can be minimized.Keywords: Deed; Loan Agreement; Encumbrance.
