Abstract

After the resolution about the petition of extending the meaning of adultery rampant discussed in the community, Article 284 KUHP is still an interesting article to be reviewed. Diversity in the Indonesian community causes a number of applied regulations must become as fair as possible to be a legal protection for all layers of society, including the regulations ruling the crimes of decency. Different understanding about violating decency in some community groups causes the article in Decency Crime section, especially in adultery case, often marginalizes some groups of community. There are indeed some group that might be potential to be victims of adultery cases if the meaning of adultery ever happens to be broadened. Further in its application, Article 284 KUHP makes the line between morality and crime becomes very thin. This research is done using the approach of feminist legal theory, by reviewing legal text to get an understanding on how sexuality and imagination about the woman victim is projected by law.

Abstract

This paper focuses on the experience of women across generation living and interpreting love as part of their lives. Their experiences in living an interpreting love will be seen in two points, their romantic relationship and marriage or family institution. Based on the data of six subjects of research with different backgrounds like age, marital status and sexual orientation, showed that they have different perspective on love and marriage or family institution compare to mainstream society. They assume and believe love or romantic relationship has close relation with patriarchal cultural values, like men’s domination, subordination and ownership if we agreed with mainstream society’s thought on love. They also believe that marriage is an institution where patriarchy’s cultural values is produced there and will disadvantage women if the marriage is not built on equal and just relation. These six subjects of research agree with grand feminism narrative that love supposed to be not always related with ownership, men’s domination and must be liberating women as an independence and autonomous person.

Abstract

This essay presents a theoretical discussion, analysis, and formulation to reconfigure new meanings, potentialities, and multiplicities of homosexual relationship/s. After a brief discussion on the rapid popularisation of marriage equality as the primary goal of queer movements, an overview of queer critique of marriage is provided. Attention given to the notion of homonormativity and the sharp criticism from queer negativity/queer anti-social. For these critiques, subjects are encouraged to occupy the abject position, which I argue, only further depoliticise queer politics. After a critical overview of this political stance, I offer Foucault and Deleuze accounts to explore multiple forms of relationships beyond marital institution, focusing on the ways in which relationships are to be understood as in terms of potentialities, intensities, and emergent forms and functions beyond the existing language capacities and formalised forms. This essay should, however, not situated as masterly or prescriptive, but rather a modest effort to spur more critical concerns,discussions, and debates among queer Indonesians.

Abstract

The paper explains how criminal code of zina (fornication) criminalized women victims of sexual violence. The data of Komnas Perempuan's Annual Records and the direct complaint from the victims can illustrate that women's personal relationships are particularly vulnerable to violence. The theories of feminism are used as an analytical tool of women's lives and their problems in the private sphere, including in terms of sexual relationships and love, whether married or not. This paper concludes with the challenge of the stigma of the feminist movement, as a movement considered to be opposed to morality and religion, and it is not just happen in Indonesia.

Abstract

Falling in love is a universal experience that cannot be bounded by racial, religious, ethnic, even ideological barriers. The experiences of falling in love and be in the relationships are also faced by female feminists. In the experiences of falling in love, female feminists often confront with tension between their consciousness in holding feminist ideology and their collective experiences influenced by patriarchal culture. Therefore, they have to compromise and negotiate in the relationship. This paper aims to explain contemplative experiences of female feminists who are falling in love in the patriarchal culture in the three areas of analysis: feminist thoughts which are build their consideration and consciousness, the influences of patriarchal media, and practices in the love relationship in everyday lives. This study is descriptive-qualitative using in-depth interview as a method toward female feminists from diverse background in Yogyakarta, Surabaya, and Jombang. The results are the concept of love from female feminists cannot be separated from the existence of their partners, the experiences and the reproduction of media about the concept of love, as well as the practices of female feminists’ relationships, which already creating the concept of love before entering relationships.

Abstract

This paper raises the narrative of experience from legal counselor who once accompanied women victim in cases related to article 284 of the Criminal Code on adultery and article 285 of the Criminal Code on rape. In an interview with the author, four female public lawyers shared their experiences including challenges and obstacles they encountered while advocating cases of adultery and rape. Unacceptable reports, slow-running legal process or even halt in the middle of the process, and facing the attitude of sexism towards victims and public lawyers are some of the obstacles and challenges experienced by the legal counselor of women victims. These public lawyers saw that the criminal law is still not on the side of women and has not provided justice for women. They directly see and experience the difficulty of the legal process running for the article of adultery and rape. Using the feminist legal theory this paper found that law that do not have a gender perspective and siding with women are obstacles to the fulfillment of women victims rights.

Abstract

"Mothers of the Nation" or ibuism is a term that is often considered negative in the study of women's history. This is related to the nation's political journey, during which the New Order regime took power, the terminology was used to control and dominate women in Indonesia. Further explored, in the 1920s, the spirit of nationalism are grew, including among the (priayi) noble women. They formed an association and held the Indonesian Women's Congress I in 1928. According to Susan Blackburn, what women did at the time was their nationalistic form, becoming "Mothers of the Nation." Using a historical approach, this paper seeks to retrace how early noble women came into existence and formulated their ideas of nationalism. The sources used are the result of literature studies, whether magazines, books, scientific papers, memoirs or biographies of women movement. This paper also use oral and photo sources to complete the experiences of women who involved in this topic.

Abstract

Contemporary feminists in Indonesia do not yet have questions about nationalism, since the conversation about nationalism has been considered final at the beginning of Indonesian independence. In fact, in terms of contemporary analysis, women have problems with nationalism, when the definition of nationalism is dominated by the study of political science that is male-view biased. By tracing history to contemporary time, the relationship between women and nationalism is dominated by patriarchal interests for the mobilization of power, even if women have an independent political interest. That is why political interests of women are situated marginally in nationalism. But if we use the perspective of the social sciences, as feminist theories, then the notion of nationalism is broader than that of women and the state. We are still less productive in abstracting the relationship between women and citizens in nationalism, while it is a daily practice of women’s struggles both personally and organically. Women have proven to be an active agency to become citizens beyond the mobilization of the state. This paper seeks to arouse feminist questions about nationalism, in order to reveal the role of women who are hidden in nationalism.
