Ius Humani Law Journal is a platform (iushumani.org) open to researchers around the world. It contains articles in all languages, where writers publish original studies on persons rights (natural, human or constitutional) and about the effective procedures for the protection of rights. The studies are viewed both form the philosophical perspective and the perspective of the fundamental juridical principles. Abstract

Environmental Law, recognized as such, is one of the most modern branches of law and the study of its history and evolution divides the authors. Based on a historical review, the article presents the concept and principles of environmental law and concludes with an analysis of the constitutional texts; it proves that those principles (consequence of the referred historical review) are weakened. The article includes in its conclusions a warning about the consequences of this gradual weakening. The main objective of this article is to present the evolution of environmental law to contribute their disclosure and evidence that the importance of art in its definition to avoid weakening. This paper was written using documentary sources, literature review of research and articles by renowned writers. It contains: (i) introduction, (ii) Global and Latin American historical development, (iii) concept and principles of environmental law, (iv) brief analysis of environmental norms in the Constitution of Ecuador, emphasizing those relating to the Rights of Nature and the case of the genetically modified organisms, and concludes exposing on the prospect of future development of environmental law in Ecuador.

Abstract

The aim of this work is to show that the administrative law of a social and democratic state based on the rule of law is the right that the government has to liberty in solidarity. The method used is specific of legal research; in this case through argumentation and by showing the importance that the constitutional principles have on administrative law. The study opens with an introduction where the matter is put forward, followed by an analysis of constitutional law, and a comment on the incidence of the social state clause on Public Administration and administrative law that heralds the main conclusion: that general interest in a social and democratic state based on the rule of law is fully connected to the promotion of the fundamental, individual and social rights of people. In other words, that the dignity of human beings is central and at the root of public law, whereby all its institutions and categories should be defined and built from this perspective.

Abstract

Todo ordenamiento jurídico se propone alcanzar el bien común. Dentro de este marco institucional, la justicia es el valor supremo que procura garantizar la autoridad competente. ¿Cuándo es posible decir que se está actuando según la justicia? Encontrar una respuesta requiere remontarse a los principios fundamentales que han dado origen a toda formulación jurídica. Y detrás de tales principios se encuentra la persona, destinatario final del ordenamiento. La norma escrita no se funda –por lo menos, no debería ser así– en el azar o las ideas políticas del gobierno de turno. Ante la inminente presencia de una Asamblea Constituyente, es imperativo volver sobre los fundamentos últimos de todo Estado de Derecho.

Abstract

Este artículo aborda el principio de razonabilidad desde dos perspectivas. La primera que intenta explicar al derecho como orden en su contenido válido. La segunda, consecuencia de la primera, que usa el principio como método interpretativo para determinar la validez y constitucionalidad de las normas jurídicas, valiéndose de los subprincipios de adecuación, necesidad y proporcionalidad stricto sensu. A estos, en tanto son también juicios, les hemos sumado los de finalidad y de respeto al contenido esencial de los derechos, siguiendo la propuesta del profesor Sapag. En tanto la razonabilidad sirve de método interpretativo, se alude a ella en relación a la teoría del anticonflictivismo en los derechos fundamentales, que sostiene que no existen verdaderos conflictos de derechos y que, en realidad, dicha colisión se produce solamente entre intereses o pretensiones.

Abstract

The article presents a critique of the egalitarian political philosophy of Ronald Dworkin in light of two alternative conceptions of equality. First, in light of a political conception of equality based on the thoughts of Thomas Hobbes. Afterwards, in light of a “mystical” conception of equality based on the work of authors such as Elizabeth Anscombe and Bernard Williams. It is held that these conceptions of equality are stronger than the one presented by Dworkin and that together they leave little room for the liberal equality that Dworkin prefers. In the end, the article presents reflections on the importance of granting ethics a stronger role in grounding normative theories than the one given by Dworkin. Dworkin aims to create a relation of reciprocity and mutual accommodation between ethics and morality. In reality, ethics has primacy and what is to be sought is not to accommodate these two ideas but to fully derive morality from ethics.

Abstract

Labour Societies have developed a particular interest in Spain, settling as corporations or limited liability companies, highlighting their characteristics that most of the capital is owned by the workers, who have a 51% stake in the capital, but with the limitations that each employee can not have more than one third of what makes up the capital and in the case of breaking the employment relationship, the worker must transfer their shares or participation to other partners for right of preference established in society, in order to maintain actions within it. For the above stated, the present work aims through a descriptive and documentary methodology with the technique of observation and document analysis, supported by triangulation and legal interpretation, analyze the structure of industrial societies, their benefits and limitations, to determine convenience and forecast the impact of the existence of labor Societies in Ecuador, proposing his alternative time about the various ways to guide and train workers and entrepreneurs for opening and participation in these businesses.

Abstract

La inexistencia y la nulidad son instituciones fundamentales para el derecho privado ecuatoriano. Se trata de dos categorías distintas que tienen en común perseguir la ineficacia de los actos que no se formaron de acuerdo a los parámetros jurídicos. Tratándose de actos inexistentes, la ley los priva de toda consecuencia jurídica. Tratándose de actos nulos, la ley permite que un juez declare su invalidez y desconozca sus efectos. Este artículo revisa la regulación legal de la inexistencia y la nulidad en el derecho ecuatoriano, así como los pronunciamientos al respecto de la Corte Nacional de Justicia.

Abstract

This text explores the balance of powers in the Republic of Ecuador through Social Network Analysis (SNA). It argues that formal and informal ties among political system’s actors can be affected as a result of an improvement action within a part of the State. The Article recounts three essential elements: the theoretical apparatus of the balance of power in the State, a summary of the reform actions in the Ecuadorian juridical system, and an analytical contrast between governance models of the Ecuadorian State after the reform of the judiciary, conducted between 2010 and 2014. For this purpose, a comparison of the models of balance by using social network analysis is proposed; thereof a series of statistics that will show the possibility of changes in the capabilities of horizontal accountability of the Judiciary are obtained. This data show an evidence base that small changes in the fabric of government relations have extensive quantitative consequences on the balance of powers, and appear as heuristics of change in the dynamics of political power. It concludes indicating that reforms of the judicial system have created a more efficient system but, according to the obtained data, centrality of power can generate unwanted effects in public administration and in the structure of power control of the State.
