Both of Islam and Hindu have regulated in detail the issues of inheritance. If the two are compared, it can be seen that there is a difference in positioning adopted child, where in Hindu law is used as the cause of inheritance whereas in Islamic law it is not. Thus, it can be seen that the adopted child does not belong to the heirs in Islamic law, so the inheritance rights remain to his biological family, not his adopted family. However, they can get a share of the property of their adopted parents by the way of a testament not more than 1/3 of a part, even in this case, article 209 paragraph 2 of KHI states that against a adopted child who does not receive a will is given a maximum of 1/3 of the inheritance of his adopted parents. Unlike the Islamic law, Hindu law classifies adopted sons including in heirs whose inheritance rights are transferred to their adopted families and are equal to those of legitimated children who inherit in the first place with the possibility to obtain all parts if no children are equal.

One of the factors that can influence family harmony is the condition of balance between husband and wife. The phenomenon in some Islamic boarding house (pesantren) in Pamekasan show new things in the implementation of kafaah in a marriage system. Many of the kyais (the figures) mate and marry their sons and daughters with the closest people or from the same level and class. This research uses descriptive qualitative method and observation, interview, and documentation study to obtain data. The results obtained from this research are: in the process of choosing a mate to their sons, they as parents prefer and emphasize on the factors of the same nasab. The goal is for the struggle of continuing their Islamic boarding school, the creation of kinship with other kyais and so on. According to the perspective maslahah, such marriages can be justified. First, because there is a basis of the Qur’an and the hadiths affiliated with it. Second, the purpose of marriage with consideration of comparability will lead to many benefits. Third, the concept of maslahah itself requires that human beings get ease in a matter, and avoid the difficulties that hinder it later.

This paper is a bibliographical research on how the implementation of children’s educational rights in the Children Development Institution of Blitar who is underwent criminal sanction for involvement in the murder of a student in Lamongan and how the application of legislation on educational rights of the students. The prisoners who are convicted of murdering student in Lamongan must undergo a 1 year term in LPKA of Blitar. During the sentence, LPKA Blitar has implemented a system of treatment of students through 4 (four) stages, namely 0-1/3 MP, 1/3-1/2MP, 1/-2/3 MP, 2/3 to free. During that time they got the right to attend their formal high school and non-formal education in LPKA, even 4 (four) children who were sitting in class XII strived to follow UNAS (national post test) at their own school and passed it well. Because their behavior in LPKA was well assessed by the Penetration Monitoring Team (TPP), it was granted conditional leave (CB) rights so that the criminal sanction was reduced by one third and after 8 (eight), they were transferred to Anta Sena Magelang institution to undergo rehabilitation. In order to obtain optimal results, LPKA of Blitar cooperates with related offices, both with the national education office of Blitar city and NGOs as well as civic organizations. In addition, the implementation of educational rights in LPKA of Blitar, juridically implements articles 1, 2, 3, 4, and 85 of the Act. No. 11 of 2012 on the Criminal System for Children and article 1, 9, 14, 23, 24 Act. No. 35 of 2014 on Amendments to the Law. No. 23 of 2002 concerning Child Protection.

PANDANGAN KEPALA KUA GAYUNGAN TENTANG PENETAPAN AWAL MASA `IDDAH PADA PERKARA CERAI GUGAT Putri Lailatul Fitriah

Abstrak: Penetapan awal masa `iddah adalah hal yang sangat penting untuk menentukan boleh tidaknya pasangan kembali rujuk atau untuk menentukan kapan perempuan boleh menikah dengan orang lain. Persoalan muncul ketika ada ketentuan yang berbeda dalam surat edaran Kemenag Nomor KW 13.2/1/Pw.001/1097/2004 dengan pandangan kepala KUA Gayungan yang merupakan pelaksana dari surat edaran tersebut. Menurut Surat Edaran, masa `iddah bagi cerai talak dan gugat dimulai dari tanggal diterbitkannya akta cerai oleh Pengadilan Agama yang menyatakan bahwa masa `iddah perempuan dihitung sejak tanggal putusan/penetapan yang mempunyai kekuatan hukum tetap yaitu tanggal yang ditulis di atas pada akta cerai. Sementara Kepala KUA Gayungan mengungkapkan, bahwa massa `iddah jatuh sesuai tanggal putusan. Perselisihan paham antara surat edaran yang dikeluarkan Kemenag dan kepala KUA ini dikaji menggunakan teknik wawancara dan dokumentasi serta dianalisis dengan analisis deskriptif. Hasil penelitian menyebutkan bahwa pandangan kepala KUA dalam menetapkan awal masa `iddah tidak bertentangan dengan Undang-undang yang berlaku di Indonesia. Kepala KUA lebih memberikan kemaslahatan bagi perempuan, karena jika menggunakan penetapan awal masa `iddah menggunakan acuan surat edaran Kemenag kantor wilayah Jawa Timur dikhawatirkan awal masa `iddah lebih lama dari tanggal putusan berkekuatan hukum tetap, karena terkadang para pihak baru mengambil atau mengurus akta cerai ketika akan membutuhkan akta cerai tersebut. Kata Kunci: pandangan kepala KUA, masa `iddah , dan cerai gugat.

ABSTRAK artikel ini merupakan hasil penelitian berjudul â€œKomersialisasi Pernikahan Sirrá¿‘ Dalam Prespektif Hukum Islam Dan Hukum Positif (Studi Kasus Praktik Perkawinan Sirrá¿‘ di Desa Pekoren Kecamatan Rembang Kabupaten Pasuruan Provinsi Jawa Timur)â€. Skripsi ini ditulis untuk menjawab pertanyaan yang dituangkan dalam rumusan masalah yaitu: Bagaimana deskripsi komersialisasi perkawinan sirrá¿‘ di Desa Pekoren Kecamatan Rembang Kabupaten Pasuruan Provinsi Jawa Timur? Bagaimana analisis Hukum Islam praktik komersialisasi perkawinan sirrá¿‘? Bagaimana analisis Hukum Positif praktik komersialisasi perkawinan sirrá¿‘?. Karya tulis ini adalah hasil penelitian lapangan (field research) dengan metode penelitian deskriptif kualitatif untuk mendeskripsikan praktik komersiaisasi pernikahan sirri yang terjadi di Desa Pekoren Kecamatan Rembang Kabupaten Pasuruan Provinsi Jawa Timur. Data penelitian yang dihimpun melalui pembacaan atau kajian dari ungkapan dan tingkah laku yang diobservasi dari nara sumber di lapangan. Dengan pendekatan yuridis kemudian dianalisis menggunakan metode deskriptiif analitis, yakni menggambarkan fenomena komersialisasi nikah sirri di Desa Pekoren Kecamatan Rembang kemudian menganalisanya dengan Hukum Islam dan Hukum Positif. Hasil penelitian menyimpulkan bahwa deskripsi komersialisasi perkawinan sirrá¿‘ di Desa Pekoren merupakan pematokan harga mahar sebagai biaya operasional yang menggunakan jasa Kiai dan makelar mencarikan tipe perempuan yang diinginkan peminat. Dalam Hukum Islam, perkawinan sirrá¿‘ yang berlangsung merupakan pernikahan yang sah dengan terpenuhinya rukun dan syarat perkawinan. broker dalam hal ini dapat dikategorikan jual beli karena berbisnis, namun tetep tidak diayariatkan dalam Islam. Dalam Hukum Positif, perkawinan sirrá¿‘ yang berlangsung tidak sah karena tidak terpenuhinya salah satu unsur yaitu pencatatan perkawinan. Sejalan dengan kesimpulan diatas, maka kepada pemegang kebijakan pencatatan nikah agar membuat tegas peraturan dicatatkannya perkawinan, kedua bagi tokoh agama atau yang biasa disebut Kiai agar tidak mempermudah pelaksanaan nikah sirrá¿‘ yang bermotif sebagai penyenang. Ketiga agar ditindak secara tegas pelaku komersialisasi perkawinan sirrá¿‘ agar tidak merajalela dan menjadi ranah pidana.

Marriage is one of the topics that get the most attention. Choosing a husband is the main right of a woman without intervention from anyone, especially the marriage guardian or her father. the phenomenon of the end of this age, there are so many marriage guardians that make their daughters' marriages hampered or complicate them with illogical excuses. Most parents see from the point of view of wealth, thus prohibiting the marriage of their daughters because they do not want their children after marriage to experience misery in life. The need for marriage is basic that cannot be represented. In a hadith it is said, that a daughter has full rights to determine her future husband, or if the child does not agree with her guardian's choice then it cannot be forced. Prohibiting the marriage of women on the side of the guardian is an act of wrongdoing and will occur slander (disaster) and extensive damage on earth. The scholars agree, that the guardian has no right to prevent the women he escorts from marrying, even though the applicant is as kufu 'and with the dowry of mitsl. If the guardian hinders the marriage, the bride has the right to report her case to the court so that the marriage can take place. Under these circumstances, the trusteeship does not move from the wrong guardian to another guardian, but is directly handled by the judge himself, because blocking it is an act of wrongdoing.

Latar belakang dibentuknya peraturan Mahkamah Agung ini karena masih marak terjadi diskriminasi dan stereotip gender dalam peradilan di Indonesia. Dan peraturan yang dikeluarkan oleh mahkamah agung ini merupakan maslahah hajiyah karena kemaslahatan ini yang dibutuhkan manusia khususnya perempuan berhadapan dengan hukum untuk kemudahan hidupnya, jika tidak dilaksanakan maka akan menimbulkan kesulitan dan dampak negatif bagi dirinya baik dampak psikis maupun fisik. Namun, kesulitan tersebut tidak merusak tatanan kehidupan manusia. dengan dikeluarkannya PERMA ini diharapkan tidak lagi terjadi stereotip gender dalam pemeriksaan di pengadilan yang dapat berdampak negatif terhadap perempuan berhadapan dengan hukum baik berupa dampak psikis maupun fisik. Serta munculnya putusan yang bias gender. Diharapkan dengan dikeluarkannya PERMA Nomor 3 Tahun 2017 tentang Pedoman Mengadili Perkara Perempuan Berhadapan Dengan Hukum agar para hakim dan segenap aparatur peradilan dalam menangani perkara yang melibatkan perempuan baik sebagai pelaku, korban, saksi, dan para pihak dapat menjadi standar dalam proses pemeriksaan di pengadilan. Sehingga tujuan penghapusan segala potensi diskriminasi terhadap perempuan yang berhadapan dengan hukum dapat tercapai.
