Abstract

This study examines water resource management in Indonesia following the annulment of the Water Resources Law by Constitutional Court Decision No. 85/PUU-XI/2013, which mandated that water governance prioritize the greatest prosperity of the people. Despite the subsequent enactment of Law No. 17/2019, persistent issues of corporate industrialization, exploitation, and privatization of water sources threaten citizens' fundamental right to water and ecological sustainability. The paper adopts Jasser Auda’s contemporary Maqashid al-Shariah with its system approach as an alternative analytical framework. Auda's methodology shifts the maqasid focus from classical preservation to construction, development, and the fulfillment of human rights (hifdz al-huquq al-insan), employing six interconnected features, including a hierarchical structure. The analysis explicitly places the fulfillment of the people's rights to water within Auda's General Maqasid (Maqasid al-‘Ammah). This classification underscores the urgent need for water access as a fundamental human necessity, requiring a social and public dimension of governance that transcends individual interests.

Abstract

This study addresses the growing legal challenges posed by rapid technological development and globalization, particularly in data privacy, intellectual property rights, and consumer protection in the digital era. These developments have created a noticeable gap between existing legal frameworks and the realities faced by contemporary society. This research aims to examine the often-overlooked dimensions of law and to understand how law functions and adapts to ongoing socio-economic and technological changes. The study applies a qualitative method with a conceptual and literature-based approach, focusing on legal theories, statutory regulations, and relevant academic works. The results show that legal systems frequently fall behind technological advancements, leading to regulatory gaps, limited protection of individual rights, and inconsistent enforcement, especially in digital contexts. In addition, current legal frameworks have not fully accommodated the needs of vulnerable groups or responded adequately to emerging technologies. Based on these findings, it can be understood that law needs to become more adaptive and flexible, while also incorporating interdisciplinary perspectives. Strengthening legal responsiveness is therefore essential to ensure effective protection and justice in contemporary society.

Abstract

BPI Danantara was established as a state-owned legal entity to manage SOEs' assets and investments, adopting the principle of meritocracy, similar to Temasek Holdings in Singapore. Normatively, the recruitment and appointment of officials is expected to be based on competence and professionalism. This research is a normative legal research using conceptual approaches and legislative approaches. The results of this study show a gap between the ideal of meritocracy and BPI Danantara's institutional practices. Through a comparative approach and normative analysis of Law 1/2025 and PP 10/2025, this study found that the institutional design and recruitment mechanism of BPI Danantara still opens room for political influence, both through the involvement of political actors in supervisory and executive organs and through the pattern of employee placement from ASN and SOEs. This finding confirms that meritocracy in BPI Danantara has not been fully institutionalized and continues to intersect with politicized practices in state investment governance.
