Abstract

The purpose of this study to analyze the regulation that regulates the strength of the law of the national sharia board fatwa MUI Number 21/DSN-MUI/X/2001 on the implementation of sharia insurance business in Indonesia and to analyze how protection of the law against the insured in case of insolvency of sharia insurance company. The results of the research indicate that the legal force of the fatwa of the MUI Sharia Council is still very weak, so there is a need for a law-level regulation to accommodate the implementation of sharia insurance in Indonesia. Based on TAP MPR Number III/2000 regarding the source of National Law and Order of Regulation of the Unitary State of the Republic of Indonesia and the Law of the Republic of Indonesia Number 12 of 2012 on the Establishment of Laws and Regulations, the fatwa does not also include the type of state legislation Unity of the Republic of Indonesia. Abstract

Artikel ini akan membahas kajian hadist dalam pandangan sunni dan syiah. Hasil analisis menyimpulkan bagi kelompok Syi'ah hadis bukan yang bersumber dari Nabi SAW, akan tetapi juga meliputi segala sesuatu yang bersumber dari Imam dua belas. Hal ini berarti ketersambungan sanad dalam Syi'ah tidak disyaratkan harus selalu sampai kepada Nabi SAW, tetapi bisa juga kepada imam yang ma'sum. Sementara Sunni hanya membatasi pada segala sesuatu yang bersumber dari Nabi SAW sebagai hadis dan sumber kehujjahan agama. Karenanya, Sunni sama sekali tidak mengakomodasi hadis-hadis yang ketersambungan sanadnya tidak sampai kepada Nabi SAW. Adapun riwayat-riwayat yang berasal sahabat disebut hadis mauquf dan riwayat-riwayat dari tabi'in disebut hadis maqtu’, keduanya tidak dapat dijadikan hujjah. Perbedaan ini berimplikasi kepada banyaknya materi hadis yang bisa dijadikan hujjah. Kata Kunci: Hadist, Sunni, Syiah

Abstract

Artikel ini membahas tentang perspektif filosofis, normatif yuridisi, psikologis tentang hikmah dilarangnya praktek poliandri. Dalam perspektif normatif bahwa poliandri hukumnya haram, hal ini berdasarkan dalil Al-Quran surat al-Nisa [4]: 24, dan al-Sunnah hadis riwayat Ahmad. Dalam perspektif yuridis, bahwa poliandri bertentangan dengan pasal 3 ayat 1, yakni bahwa seorang istri hanya boleh menikah dengan seorang suami (asas monogami). Sementara dalam perspektif psikologis bahwa poliandri sangat bertentangan dengan fitrah manusia, bahkan dapat menganggu ketenangan hati atau jiwa. Terakhir, dalam perspektif sosiologis bahwa poliandri dapat mendatangkan masalah, baik dalam keluarga maupun dalam masyarakat, bahkan bertentangan dengan nilai-nilai sosial budaya. Kata kunci: Poliandri, Normatif Yuridis, Psikologis, Sosiologis.

Abstract

The focus of this research is to describe the principles of strategic planning and implementation of an Islamic perspective. The research method used was literature review, where researchers reviewed and studied the literature related to the theme of this research. The result of this study showed that there were several principles of strategic planning and implementation of Islamic perspectives, including the importance of the strategy and the goals of the future (vision, mission, goals, and objectives), the organization had to be solid and orderly, the organization was not fragmented, the importance of deliberation in the organization, the importance of internal and external environmental analysis (SWOT) and the importance of making good policy. Abstract

The article takes the study of Ulul Albab based on The Holly Qur’an’s definition and spiritual base. It draws a conclusion that in The Holly Qur’an, Ulul Albab covers three meanings : dzikir, thinking, good deeds. This, in detail, is an ability to contemplate natural and social phenomenas. The Ulul Albab citation could be achieved only by good thinkers of themselves, natural and life phenomenas. This could invite a strong Islamic culture integrating the substance of divinity and logical values that position Islam as the supreme icon of world civilization for hundreds years ever. Abstract

The article discusses the relevance of Imam Syafi’i’s thought on waqaf Muaqqat with the act provisions No. 14 in 2004. The analysis based on some sources states that Imam Syafi’i applies law intinbath design, shahih hadiths in the texts, narrators and sanad after being takhrij. He argues that waqaf settlement is as a part of tabarru’ (releasing right). As a result, something that has been become a wakaf cannot be on sale, granted, legated due to the fact that does not belong to an individual but public. The act No. 41 in 2004, whereas, reveals that waqaf can belong for a life or a limited time. Therefore, waqaf can still become an individual’s right. Abstract

In this research, the writer analyzes some learning motivations on the view of Al-Qur’an Chapter al-Ra’d : Verse 11 in the approach of Kitab Tafsir al Jalalain by Imam Jalaluddin al Mahalli and Imam Jalaluddin al-Suyuti. Based on many sources, the writer concludes that this verse elaborates three values of education : parents’ supervision and guidance becomes the first solution that can motivates students, complete facilities both in home or school becomes the second solution in term of designing the into passive motivators. Abstract

The article elaborates children education in Islam on the Imam Ghazali’s perspective. As one of fugures in Islamic education, Al-Ghazali in his works, makes a relation between children’s natural skills and environment, character and behavior, nature and nurture. Childrens education methology and stage of Imam Ghazali’s are proper to hadiths stating that the education must be started since they are in the womb. The pattern is applying exemplary, habit, advice, attention, and reward and punishment. These patterns cannot stand alone but support each other. Abstract

Abstract This article describes a linguistic approach in interpreting the holy book of the Al-Qur'an. In this case, attempting of systematizing theories are used in the interpretation of the linguistic to the position in the place that is found the exact meaning. From the result of the study is found that the linguistic position is in the realm of Qur'an interpretation can be seen from two aspects, as the theological argument and language is as the language of the methodological. language is manifest a code of values that is fought by al- Qur’an. The language of the Qur'an is sacred code system God, holy and sublime, human or system code of profane, historical, and cultural.
