Abstract

This research was conducted to find out how the legal punishment for non-Muslims is applied in the Aceh Sharia Court based on the judge's decision. This research takes the form of field research with an empirical juridical approach. The informants used to obtain information regarding caning laws for non-Muslims were judges, everyone at the Aceh Sharia Court by conducting interviews using the purposive sampling method, documentation in the form of judge's decisions, judge's notes. In implementing Islamic law in Aceh, many obstacles were encountered, including sociological obstacles, firkah obstacles, juridical obstacles, community consolidation obstacles, formulation obstacles and political obstacles. So far, the implementation of Islamic sharia law enforcement in Aceh has always been improved. Based on findings in the field, non-Muslims who are found guilty constitutionally have the right to choose state institutions or sharia institutions to obtain justice. By choosing to go to the sharia court, the guilty person must make a letter of compliance so that caning can be applied as a sanction for the wrongdoing.

Abstract

Restorative Justice is a form of resolving criminal cases non-litigation or outside of court. However, not all crimes can be resolved through restorative justice. In several regulations, it is explained that criminal acts that can be resolved through this settlement are minor crimes with one of the criteria being imprisonment for more than five years. So in this case Domestic Violence can be resolved because in accordance with Law Number 23 of 2004 concerning the Elimination of Domestic Violence, domestic violence is punishable by a maximum of five years. In restorative justice, it is known as returning to the original state. Here the author criticizes that domestic violence should not be included in restorative justice solutions because domestic violence is considered a physical crime by criminal law, the victim here suffers from physical and even psychological injuries. And these wounds will be a trauma forever for the victim. The type of research carried out by the author is normative research in which data collection is carried out by searching literature such as statutory regulations, written.

Abstract

Punishment is a  reaction to the crime. So, if a crime occurs, it will entitle the criminal to be punished, both from the social and legal perspectives. This study aims to see the interpretative dynamics of the provisions of legal sanctions with relaxation of punishment in Islamic criminal law, and how is the preference for positive legal sanctions and Islamic law in responding to justice amid the development of society's progress. This is anormative research based on library studies using a historical and comparative approach. This research is also strengthened by textual and context analysis of the criminal process that occurred in the early days of implementing Islamic criminal law, as well as sentencing practices in the history of Islamic criminal law. From the study and assessment carried out, the research states that in the application of criminal law, Islamic criminal law always considers the preferences of dynamic contextual compromises and ideal principles of Islam. The existence of this interplay arises from the existence of mitigating circumstances that allow other factors to be considered. Furthermore, there are various models of criminal sanctions imposed on perpetrators adjusted based on the place, time, and criminal individualization.

Abstract

This is a research article conducted to analyze the implementation of the double track system against narcotics abuse perpetrators in the jurisdiction of the East Tanjab Police according to the statutory system in force in Indonesia and the reality in the field. This research is juridical-empirical research with a sociological juridical research approach. The results showed that the double track system in the jurisdiction of the East Tanjab Police was applied in the form of giving rehabilitation sanctions to narcotics suspects. The results also show that the application of two-track criminal sanctions has been effective, although there are still some obstacles both from structural, technical, and surrounding community factors.

Abstract

In the United Nation structure there are important organs, one of which is the Security Council which plays an active role in resolving international disputes carried out by the parties. However, the settlement of such disputes is often hampered by vetoes proposed by the five permanent members of the UNSC including China, Russia, the United States, France, and the United Kingdom, so the use of veto power in this case has shifted to protect the interests of the country. By using juridical-normative methods through conceptual and historical approaches and using qualitatively analyzed literature data. The results showed that there is still no clear regulation regarding the consideration of permanent members in issuing veto rights. The recommendation given is in the form of an appeal mechanism (extra judicial review) for denial of the principle of Soveregein Equality because the existence of veto power is still problematic in realizing balancing between countries. The hope is that there is a decision-making mechanism in the UN Security Council that is more equitable by applying positive consensus in realizing peacekeeping missions.

Abstract

الملخص: يلعب تنفيذ القانون في مكافحة الجريمة الرقمية، خاصة في مجال جرائم الإنترنت، دورًا هامًا في حماية المجتمع والحفاظ على الأمان في سياق التكنولوجيا الحديثة. يناقش هذا الورق البحثي كيفية تنفيذ القانون في مكافحة جريمة الإنترنت في إندونيسيا من منظور ضروريات الخمس في مقاصد الشريعة الإسلامية. هذا النوع من البحث هو بحث مختلط حيث يتم تحليل البيانات التي تم الحصول عليها كميًا وكيفيًا. تشير نتائج البحث إلى أن تنفيذ القانون في مكافحة جريمة الإنترنت في إندونيسيا لا يعكس تمامًا الأهداف كما هو موجود في ضروريات الخمس، والتي تتمثل في الحفاظ على احتياجات الإنسان الأساسية من النواحي التقنية والأخلاقية والأخلاقية. لذلك، يتعين تحقيق التناغم بين القانون الإيجابي وقيم الإسلام لتوفير حماية أفضل للمجتمع من تهديد جريمة الإنترنت المعقدة. بالإضافة إلى ذلك، يجب تحقيق التوعية بين الجمهور، والتعاون بين قطاعات مختلفة، والجهود المشتركة لخلق بيئة رقمية أكثر أمانًا وعدلًا وفقًا لمبادئ الأخلاق المدرجة في مقاصد الشريعة الإسلامية.

Abstract

Respect for individual rights is an important moral and legal foundation in maintaining justice and humanity in the criminal law system. Although the individual has passed away, complexities arise as their rights still need to be respected. A deceased individual's legacy, including reputation and social influence, remains relevant and influences society. This research aims to understand how the criminal law system, particularly in the Criminal Code (KUHP), handles cases involving deceased individuals, including the protection of their reputation and open legal liability. This research utilizes a normative legal research method that involves analyzing existing legal norms. The results show that the Indonesian criminal law in detail regulates respect for deceased individuals in the Criminal Code. Despite having physically left the world, the law still recognizes and protects their rights regarding honor, reputation, and inheritance. Crimes against corpses are regulated in Chapter V of the Second Book of the Criminal Code on Crimes Against Public Order. Articles in the Criminal Code, such as Articles 175, 178, 179, 180, 181, 320, and 321, provide protection to the reputation, burial, graves, corpses, as well as preventing insults or defamation of deceased individuals, punishable by imprisonment or fines. Although the individual has biologically left the world, the law still recognizes and protects their rights regarding honor, reputation, and inheritance. Chapter V of the Second Book of the Criminal Code regulates crimes against public order involving corpses. Articles such as Article 175 to Article 321 provide protection to reputation, burial, graves, and corpses, and prevent insult or defamation of deceased individuals, punishable by imprisonment or a fine.
