Abstract

Abstract:  Puskesmas is a first-level health service facility whose task is to provide promotive, preventive and curative services. Health services at Puskesmas include Community Health services and Individual Health Services. School Dental Health Programme   (UKGS) is a community health service related to dental and oral health that targets primary school-age children. The Covid-19 pandemic makes many problems that have hindered the implementation of this program. Descriptive research is held to know the implementation of UKGS in Semarang Regency during a pandemic, especially in 2021, and the factors that influence it. Data was collected from monthly reports and analyzed by qualitative methods, referring to the regulation and result of discussion during evaluation activities with dental and oral health programmers at Puskesmas. Data shows that only 50 % of elementary school students had to dental examination, and only 12,5 % of students get dental treatment. The dental health worker spent more time controlling covid 19.  Prevention programme to decrease Covid 19 transmission and learning  system online is the main obstacle. There are some Puskesmas with good performance who utilize technology information to hold UKGS. Technology information is an alternative for implementing on UKGS programme, when pandemic covid 19 is still ongoing, or when it has been declared an endemic disease. So collaboration work needed to involve the health district office, school and Puskesmas.A legally binding regulation form is needed, like regulation or decree of the health minister. The Circular Letter of Health Minister, Republik of Indonesia Number HK.02.01/303/2002 concerning the Implementation of Health Services through the Utilization of Information and Communication Technology in the Context 0f Preventing the Spread of Corona Virus Disease 2019 has no binding legal force as hierarchy regulation the contained in Law number 12 0f 2011 concerning the Establishment of Law regulation. The Health Office of Semarang regency, should compile technical instructions concerning School Dental Health Programme   (UKGS ) during pandemic covid 19 and socialized it to improve the achievement of UKGS.Keywords: UKGS, Pandemic Covid 19, Semarang Regency. Abstrak: Puskesmas merupakan fasilitas pelayanan kesehatan tingkat pertama yang bertugas memberikan pelayanan promotif, preventif, dan kuratif. Pelayanan kesehatan di Puskesmas meliputi pelayanan Kesehatan Masyarakat dan Pelayanan Kesehatan Perorangan. Program Kesehatan Gigi Sekolah (UKGS) merupakan pelayanan kesehatan masyarakat terkait kesehatan gigi dan mulut yang menyasar anak usia sekolah dasar. Pandemi Covid-19 membuat banyak masalah yang menghambat pelaksanaan program ini.Penelitian deskriptif diadakan untuk mengetahui pelaksanaan UKGS di Kabupaten Semarang pada masa pandemi khususnya tahun 2021, dan faktor-faktor yang mempengaruhinya. Data dikumpulkan dari laporan bulanan dan dianalisis dengan metode kualitatif, mengacu pada peraturan dan hasil diskusi selama kegiatan evaluasi dengan programmer kesehatan gigi dan mulut di Puskesmas. Data menunjukkan bahwa hanya 50% siswa sekolah dasar yang melakukan pemeriksaan gigi, dan hanya 12,5% siswa yang mendapatkan perawatan gigi. Tenaga kesehatan gigi lebih banyak menghabiskan waktu mengendalikan covid 19. Program pencegahan penularan Covid 19 dan sistem pembelajaran online menjadi kendala utama. Ada beberapa Puskesmas yang kinerjanya baik yang memanfaatkan teknologi informasi untuk menyelenggarakan UKGS. Teknologi informasi menjadi salah satu alternatif pelaksanaan program UKGS, saat pandemi covid 19 masih berlangsung, atau sudah dinyatakan endemis penyakit. Sehingga diperlukan kerja sama yang melibatkan dinas kesehatan, sekolah dan Puskesmas.Diperlukan suatu bentuk peraturan yang mengikat secara hukum, seperti peraturan atau keputusan menteri kesehatan. Surat Edaran Menteri Kesehatan Republik Indonesia Nomor HK.02.01/303/2002 tentang Penyelenggaraan Pelayanan Kesehatan Melalui Pemanfaatan Teknologi Informasi dan Komunikasi Dalam Rangka Pencegahan Penyebaran Corona Virus Disease 2019 tidak mempunyai kekuatan hukum mengikat sebagai pengaturan hierarki yang tertuang dalam Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan. Dinas Kesehatan Kabupaten Semarang, hendaknya menyusun petunjuk teknis tentang Program Kesehatan Gigi Sekolah (UKGS) di masa pandemi covid 19 dan mensosialisasikannya untuk meningkatkan pencapaian UKGS.Kata kunci: UKGS, Pandemi Covid 19, Kabupaten Semarang.

Abstract

Abstract : A marketplace is a platform that provides and sells various kinds of commodity goods ranging from daily necessities to medicines. Marketplace users come from ages ranging from teenagers to adults, so problems arise for those who are not yet adults and make online transactions through this platform. In this paper, the author wants to discuss how the marketplace is responsible for selling drugs, one of which is abortion drugs that can be purchased freely, including by people who are not yet adults. The writing methodology used by the author is normative juridical based on library research using secondary data, namely legislation and law books. A license to sell drugs is required under the applicable laws and regulations to avoid unlawful acts and harm to consumers. Furthermore, the marketplace party should run a checking and filtering system for selling medicinal commodities to prevent illegal actions and losses. Some drugs need a prescription and are forbidden to be sold freely.. Keywords: Regulation, Marketplace, Drug Circulation, Online Transaction Abstrak: Marketplace adalah wadah atau platform yang menyediakan dan menjual berbagai macam barang komoditas mulai dari kebutuhan sehari-hari hingga obat-obatan. Pengguna marketplace berasal dari kalangan usia mulai dari remaja hingga usia dewasa, sehingga timbul permasalahan bagi mereka yang belum dewasa dan melakukan transaksi online melalui platform marketplace ini.  Dalam paper ini, Penulis ingin membahas bagaimana pertanggungjawaban marketplace terhadap penjualan obat-obatan salah satunya obat aborsi yang dapat dibeli secara bebas, termasuk oleh orang yang belum dewasa. Metodologi penulisan yang digunakan penulis adalah yuridis normatif berdasarkan penelitian keperpustakaan dengan jenis data sekunder, yaitu perundang-undangan, buku-buku, literatur, dan kamus. Untuk menghindari perbuatan melawan hukum dan kerugian bagi konsumen, dibutuhkan ijin penjualan obat-obatan sesuai dengan peraturan perundang-undangan yang berlaku. Untuk mengindari perbuatan melawan hukum dan kerugian, pihak marketplace sepatutnya harus menjalankan sistem pengecekan dan pemfilteran terhadap komoditas obat-obatan yang boleh atau tidak boleh dijual secara bebas.Kata Kunci : Peraturan, Marketplace, Peredaran Obat, Transaksi Online

Abstract

Abstract: The shortage of medical personnel (doctors) creates a situation that requires nurses to take medical actions or take medical actions that are not under their authority. These actions are carried out with or without the delegation of authority from other health workers including doctors so that it can cause legal problems related to responsibilities that are imposed unilaterally and can be detrimental to nurses. Based on the Strategic Plan of the Rote Ndao District Health Office for 2019-2024, in 2018 the ratio of specialists is 1:79,807 population, the ratio of general practitioners is 1: 12,278 population, the ratio of dentists is 1: 26,602 population and in total the ratio of medical personnel is 1: 7,501 residents. If referring to the national target according to the health workforce development plan for 2011-2025, the standard ratio of specialist doctors is 1:10,000 population, the ratio of general practitioners is 1:2,500 population and the ratio of dentists is 1:1,833 population and the ratio of medical personnel is 1:632 population. . Every state and government administration must have legitimacy, namely the authority granted by law. In administrative law, there are 3 (three) sources of authority, namely attribution, delegation, and mandate. Health services by health workers recognize the delegation of authority, which is commonly known as the delegation of authority. The practice of delegation of authority (delegation of authority) involves the nursing community, which occurs both in nursing services and in health care practices. The delegation of authority is understood as the delegation of doctors to nurses to carry out certain medical tasks. This study aims to analyze the knowledge of nurses about legal responsibilities in carrying out actions based on the delegation of doctors at Korbafo Health Center and analyze the implementation of delegation of medical actions by doctors to nurses at Korbafo Health Center. The approach method used is empirical legal research. This type of research is descriptive and qualitative. This research for novice lecturers will increase the knowledge and competence of researchers in developing research and national publications. The research output is in the form of articles in Indonesian nursing and health law journals.Keywords: Nurse knowledge, legal responsibility, medical action and delegation  Abstrak: Keterbatasan tenaga medis (dokter) menimbulkan situasi yang mengharuskan perawat melakukan tindakan pengobatan atau melakukan tindakan medis yang bukan wewenangnya. Tindakan tersebut dilakukan dengan atau tanpa adanya pelimpahan wewenang dari tenaga kesehatan lain termasuk dokter, sehingga dapat menimbulkan permasalahan hukum terkait dengan tanggung jawab yang dibebankan sepihak dan bisa merugikan perawat. Berdasarkan Rencana Strategis Dinas Kesehatan Kabupaten Rote Ndao Tahun 2019-2024 adalah Pada tahun 2018 rasio dokter spesialis sebesar 1 :79.807 penduduk, rasio dokter umum sebesar 1 : 12.278 penduduk, rasio dokter gigi sebesar 1 : 26.602 penduduk dan secara total rasio tenaga medis 1:7.501 penduduk. Jika mengacu pada target nasional menurut rencana pengembangan tenaga kesehatan tahun 2011-2025, standar rasio dokter spesialis sebesar 1:10.000 penduduk, rasio dokter umum 1:2.500 penduduk dan rasio dokter gigi sebesar 1:1.833 penduduk dan rasio tenaga medis sebesar 1:632 penduduk. Setiap penyelenggaraan kenegaraan dan pemerintahan harus memiliki legitimasi, yaitu kewenangan yang diberikan oleh undang-undang. Dalam hukum Administrasi, dikenal 3 (tiga) sumber kewenangan, yaitu atribusi, delegasi, dan mandat. Pelayanan kesehatan oleh tenaga kesehatan mengenal adanya pelimpahan wewenang, yang biasa dikenal dengan delegasi wewenang. Praktik pelimpahan wewenang (delegasi wewenang) tersebut melibatkan komunitas perawat, yang terjadi baik pada pelayanan keperawatan maupun praktik pelayanan kesehatan. Delegasi wewenang tersebut dipahami sebagai pelimpahan dari dokter kepada perawat untuk melaksanakan tugas medis tertentu. Penelitian ini bertujuan untuk menganalisis pengetahuan perawat tentang tanggung jawab hukum dalam melakukan tindakan berdasarkan delegasi dokter di Puskesmas Korbafo dan menganalisis pelaksanaan delegasi tindakan medis oleh dokter kepada perawat di Puskesmas Korbafo. Metode pendekatan yang digunakan yaitu penelitian hukum empiris. Jenis penelitian ini adalah deskriptif kualitatif. Penelitian dosen pemula ini akan meningkatkan pengetahuan dan kompetensi dari peneliti dalam mengembangkan penelitian dan publikasi nasional. Abstract : The increasing anticipation of the public in using disposable masks during the COVID-19 pandemic, was not followed by proper waste management efforts. Disposable medical masks are one source of infectious B3 waste that needs to be processed in an appropriate way to prevent transmission and control the spread of COVID-19. The lack of information and procedures for managing infectious B3 waste from the government to the community and the uneven supply and distribution of dropboxes or depots to collect infectious B3 waste from the community is a problem that requires an appropriate and fast solution from the government.Keywords: COVID-19, medical B3 waste, masks, medical masks

Abstract

Abstract: Since the beginning of 2020, COVID-19 has become a global health problem. In Indonesia, the number of COVID-19 continues to grow, including among health workers. Unfortunately, many died while taking care of those infected by this disease. The central government and local governments are responsible for providing the health workers with health service facilities, including personal protective equipment (PPE), to care for those infected by COVID-19 to break the chain of transmission. At the beginning of the spread of this disease, the number of PPE was limited even though the health workers urgently needed the equipment so they wouldn't be infected/exposed. This article will discuss the government's legal responsibility for providing PPE for medical staff to deal with the COVID-19 Pandemic.Keywords: Legal responsibility, COVID-19, PPE.Abstrak: Sejak awal tahun 2020, COVID-19 telah menjadi masalah kesehatan global. Di Indonesia jumlah kasus terus bertambah, termasuk jumlah petugas kesehatan yang terpapar COVID-19. Banyak dari petugas pelayanan kesehatan yang meninggal dunia ketika membantu merawat pasien yang terpapar. Pemerintah pusat dan pemerintah daerah memiliki tanggung jawab untuk menyediakan fasilitas pelayanan kesehatan bagi tenaga kesehatan, termasuk alat pelindung diri (APD). Pada awal penyakit ini menyebar, jumlah APD sangat terbatas padahal pelayan kesehatan sangat membutuhkan perlengkapan ini agar tidak tertular/terpapar. Artikel ini akan membahas tanggung jawab hukum penyediaan APD bagi staf medis oleh Pemerintah untuk menangani Pandemi COVID-19.Kata kunci :Tanggungjawab hukum, COVID-19,Alat Pelindung Diri (APD).

Abstract

Abstract:  The relationship between doctors and patients is a form of social relationship in which the relationship experiences dynamics. The dynamics that occur can create a harmonious atmosphere between the two parties. Bad relationships can also occur when one party feels aggrieved by the impact of the relationship. Bad relationships occur because patients feel dissatisfied with the health services they receive. Disputes between patients and doctors can be caused by problems of professional ethics or violations of health laws. Doctors' actions that are not by the code of ethics have the potential to be disputed. The purpose of this study is to identify and analyze non-litigation medical dispute resolution between patients, doctors, and the Konawe district general hospital. This study uses a sociological juridical approach with descriptive-analytical research specifications. The type of data used is primary data and secondary data. The data collection methods consist of 1. Literature study; 2. Field Study. The data analysis method used is qualitative. The results of the discussion can be seen that the implementation of Non-Litigation Medical Dispute Resolution between Patients, Doctors, and Hospitals is not by the aspects of Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution while the consultation between patients and the Konawe Hospital cannot be categorized as mediation because it is not facilitated by an official mediator so that it is not by Article 29 of Law Number 36 of 2009 concerning Health.Keywords: settlement, medical dispute, non-litigation, patient, doctor; hospital Abstrak: Hubungan antara dokter dan pasien merupakan salah satu bentuk hubungan sosial dimana dalam hubungan itu mengalami dinamika. Dinamika yang terjadi dapat menimbulkan suasana yang harmonis antara dua pihak. Hubungan yang buruk juga dapat terjadi ketika salah satu pihak merasa dirugikan atas dampak hubungan yang terjadi. Hubungan yang buruk terjadi karena pasien merasa tidak puas atas pelayanan kesehatan yang diterima. Sengketa antara pasien dan dokter dapat disebabkan masalah etika profesi atau pelanggaran hukum kesehatan. Tindakan dokter yang tidak sesuai kode etik berpotensi sengketa. Tujuan penelitian ini yaitu: untuk mengetahui dan menganalisis penyelesaian sengketa medis non litigasi antara pasien, dokter dan rumah sakit umum daerah kabupaten Konawe. Penelitian ini memakai pendekatan pendekatan yuridis sosiologis dengan spesifikasi penelitian deskriptif analitis. Jenis data yang digunakan adalah Data Primer dan Data sekunder. Adapun metode Pengumpulan data terdiri dari: 1. Studi Kepustakaan; 2. Studi Lapangan. Metode analisis data yang digunakan adalah metode analisis kualitatif. Hasil pembahasan dapat diketahui bahwa pelaksanaan  Penyelesaian Sengketa Medis Non Litigasi antara Pasien, Dokter dan Rumah Sakit tidak sesuai dengan  aspek Undang Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa sedangkan musyawarah antara pasien dengan pihak RSUD Konawe belum dapat dikategorikan sebagai mediasi karena tidak difasilitasi oleh seorang mediator resmi sehingga tidak sesuai dengan  Pasal 29 Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan.Kata Kunci: penyelesaian, sengketa medis, non litigasi, pasien, dokter; rumah sakit

Abstract

Abstract: Do Not Resuscitate (DNR) is a clinical decision that often becomes an ethical, moral, and legal dilemma for medical personnel. This study aims to provide an overview of factors that influence DNR decisions and their legal consequences in Indonesia. This study is an empirical juridical research based on the medical record of several patients with each different diagnoses who were treated in the Emergency, Intensive Care Unit, Inpatient Installation, and Covid-19 Isolation Room. Furthermore, a normative juridical analysis is carried out using legal sources in force in Indonesia. The study results are the description of patient, family, care professional, resource, and bioethical understanding factors that influence DNR decisions. The consequences of criminal law are possible if the DNR is carried out without a strong clinical reason and the correct procedure as stipulated in the Regulation of the Minister of Health Number 37 of 2014. Therefore, doctors and hospitals must ensure DNR decisions are made on patients in a condition that cannot be cured due to the illness (terminal state) and medical action is futile; decisions are involved by all relevant hospital organs (Professional Team of Care Providers, Patient Services Manager, Director, Medical Committee, Ethics and Legal Committee); and based on the patient's family's written decision.Keywords: Do Not Resuscitate (DNR), influencing factors, legal consequences Abstrak: Do Not Resuscitate (DNR) merupakan keputusan klinis yang sering menjadi dilema etik, moral, dan hukum bagi para tenaga medis. Penelitian bertujuan untuk memberikan gambaran faktor yang mempengaruhi keputusan DNR dan bagaimana konsekuensi hukumnya di Indonesia ketika keputusan terpaksa dipilih. Penelitian menggunakan metode yuridis empiris berdasarkan rekam medis beberapa pasien dengan masing-masing diagnosis berbeda yang dirawat di Instalasi Gawat Darurat, Intensive Care Unit, Instalasi Rawat Inap, dan Ruang Isolasi Covid-19. Selanjutnya dilakukan analisis secara yuridis normatif dengan menggunakan sumber hukum yang berlaku di Indonesia. Hasil penelitian ini adalah ditemukannya gambaran faktor pasien, faktor keluarga, faktor tenaga profesional pemberi asuhan, faktor sumber daya, dan faktor pemahaman bioetika yang mempengaruhi keputusan DNR. Konsekuensi hukum pidana adalah mungkin, bila DNR dilakukan tanpa alasan klinis yang kuat dan tidak dilakukan dengan prosedur yang benar sebagaimana diatur dalam Peraturan Menteri Kesehatan Nomor 37 Tahun 2014. Oleh karena itu, dokter dan rumah sakit harus memastikan keputusan DNR dilakukan pada pasien yang berada dalam keadaan yang tidak dapat disembuhkan akibat penyakit yang dideritanya (terminal state) dan tindakan kedokteran sudah sia-sia (futile); keputusan melibatkan semua organ rumah sakit terkait (Tim Profesional Pemberi Asuhan, Manajer Pelayanan Pasien, Direktur, Komite Medik, Komite Etik dan Hukum); dan berdasarkan keputusan tertulis keluarga pasien.Kata Kunci:  Do Not Resuscitate (DNR), faktor-faktor yang mempengaruhi, konsekuensi hukum

Abstract

Abstract: Health is a fundamental and very fundamental thing in human life, health is a blessing given by God to humans, therefore humans must take care, however, humans who have maintained their health will not always be healthy, but there are conditions where humans need help with exercise medical personnel to maintain their health. Medical personnel who are experts in the field of health have an obligation to carry out their duties as guardians of public health. In every action of medical personnel to humans or referred to as patients, there must be consent which is the basic principle of carrying out medical services, therefore in this study the researcher focuses on the application of the aspect of consent in medical actions to patients. This study aims to analyze the aspect of consent in a medical action called informed consent which is based on the principle of agreement adopted by Indonesian positive law. This study uses a normative juridical research method which is a study of regulations and literature related to the problems to be discussed. The results of the study are expected to be a legal reference for the community and also medical personnel so that they can increase understanding and awareness of medical actions that have high risks by upholding their professional code of ethics and carrying out all work procedures in accordance with applicable regulations.Keywords: Consent in a Medical Action, Informed consent,  Principle of Consensualism. Abstrak: Kesehatan merupakan hal yang mendasar dan sangat fundamental dalam kehidupan manusia, kesehatan merupakan berkah yang diberikan oleh Tuhan kepada manusia, oleh karena itu manusia harus menjaga, namun demikian tidak selamanya manusia yang telah menjaga kesehatannya akan selalu sehat, tetapi ada kondisi dimana manusia membutuhkan pertolongan oleh tenaga medis untuk menjaga kesehatannya. Tenaga medis yang merupakan tenaga ahli dalam bidang kesehatan memiliki suatu kewajiban untuk melaksanakan tugas sebagai penjaga kesehatan masyarakat. Dalam setiap tindakan medis kepada pasien harus ada persetujuan yang merupakan prinsip dasar dilakukannya layanan medis, oleh karena itu maka dalam penelitian ini memfokuskan peneliti kepada penerapan aspek persetujuan dalam tindakan medis kepada pasien. Penelitian ini bertujuan untuk menganalisis  aspek persetujuan dalam tindakan medis yang disebut dengan informed consent yang berdasarkan pada prinsip perjanjian yang di anut oleh hukum positif Indonesia. Penelitian ini menggunakan metode penelitian yuridis normatif yang merupakan kajian regulasi dan kepustakaan yang berkaitan dengan permasalahan yang akan dibahas. Hasil penelitian diharapkan dapat menjadi referensi hukum bagi masyarakat dan juga para tenaga medis sehingga dapat meningkatkan pemahaman dan kesadaran atas tindakan medis yang memiliki resiko tinggi dengan memegang teguh kode etik profesinya dan menjalankan segala prosedur pekerjaan dengan sesuai dengan peraturan yang berlaku.Kata kunci : Persetujuan Tindakan Medis, Informed Consent, Asas Konsensualisme.

Abstract

Abstract: The importance of the protocol for returning bodies to hospitals related to the Covid-19 pandemic requires that all hospitals in Indonesia implement standard operating procedures for returning bodies. One of the hospitals that implements this is the Bhakti Wira Tamtama Hospital. The problem that often occurs is that the family refuses to process the body according to the protocol for returning the bodies of Covid-19The purpose of this study was to get an overview of the arrangements and implementation as well as the factors that influence the process of returning the bodies at the Bhakti Wira Tamtama Hospital in Semarang. The research method uses qualitative research. Primary data was taken from direct interviews with informants, namely the person in charge of the installation and the corpse handling officer.The policy for returning the bodies of Covid-19 patients at Bhakti Wira Tamtama Hospital is carried out in accordance with the Standard Operating Procedures (SPO), which consists of the preparation stage, the process of returning the bodies, to the handing over of the bodies. The juridical factor is that there are no specific regulations governing the disposal of bodies from probable, suspected or confirmed cases. Bhakti Wira Tamtama Semarang Hospital experienced difficulties in terms of providing education to the family. The sociological factor is that the family refuses if the body is recovered at the hospital. Barriers to technical factors at the Bhakti Wira Tamtama Hospital were the knowledge of the officers who were not optimal and the availability of inadequate infrastructure, as well as the limited PPE when the pandemic began to hit Indonesia.Keywords: Protocol, Retrieval of Bodies, Covid-19, Hospital, Laws and Regulations. Abstrak: Pentingnya protokol pemulasaran jenazah di rumah sakit terkait pandemi covid-19 mewajibkan untuk seluruh rumah sakit yang ada di Indonesia menerapkan standar operasional prosedur pemulasaran jenazah. Salah satu rumah sakit yang menerapkan hal tersebut yaitu rumah sakit Bhakti Wira Tamtama. Permasalahan yang sering terjadi yaitu keluarga menolak proses pengurusan jenazah dilakukan sesuai protokol pemulasaran jenazah covid-19Tujuan penelitian ini untuk mendapatkan gambaran pengaturan dan pelaksanaan serta faktor-faktor yang mempengaruhi proses pemulasaran jenazah di Rumah Sakit Bhakti Wira Tamtama Semarang. Metode penelitian menggunakan penelitian kualitatif. Data primer diambil dari wawancara langsung dengan narasumber yaitu penanggung jawab instalasi dan petugas pemulasaran jenazah dan.Kebijakan pemulasaran jenazah pasien Covid-19 di RS Bhakti Wira Tamtama dilakukan sesuai Standar Prosedur Operasional (SPO) yang terdiri dari tahap persiapan, proses pemulasaran jenazah, hingga penyerahan jenazah. Faktor yuridis yaitu belum ada peraturan khusus mengatur tentang pemulasaran jenazah dari kasus probable, suspek, maupun terkonfirmasi. RS Bhakti Wira Tamtama Semarang mengalami kesulitan dalam hal memberikan edukasi kepada pihak keluarga. Faktor sosiologis yaitu pihak keluarga menolak jika jenazah dilakukan pemulasaran di rumah sakit. Hambatan faktor teknis di RS Bhakti Wira Tamtama berupa pengetahuan dari petugas yang belum maksimal dan ketersediaan sarana prasarana yang kurang memadai, serta keterbatasan APD pada saat pendemi mulai melanda Indonesia.Kata kunci :          Protokol, Pemulasaran Jenazah, Covid-19, Rumah Sakit, Peraturan Perundang-undangan.

Abstract

Abstract: RSUD dr. H. Soewono Kendal is one of the health service units designated by the Government as a Covid-19 referral hospital for the people of Kendal so that medical workers and health workers on duty at Dr H.Soewondo Kendal Hospital, especially in the emergency room, must make physical contact and have close contact with suspected COVID-19 patients and those who have tested positive for COVID-19. This causes the risk of transmission of Covid-19 to health workers to be great, so there is a need for legal protection for medical workers and health workers who work in the emergency room as one of the main entry points for patients at the hospital.This research is a sociological juridical research with a descriptive-analytical research specification. This study uses primary data and secondary data. Data collection in this study was carried out through field studies and literature studies to obtain the necessary data. The data analysis method used is qualitative.The implementation of legal protection for health workers in the emergency room against the risk of transmission of Covid-19 has been well implemented through preventive legal protection in the form of screening, triage, the establishment of a 3M task force, the existence of various internal regulations related to PPI during a pandemic, provision of health insurance and covid-19 vaccination, repressive legal protection is carried out by providing health services for exposed health workers as well as providing incentives and death benefits. There are factors that hinder and support its implementation, namely social factors, juridical factors and technical factors. As a result of these factors, patient fluctuations still occur in the ED because the inhibiting factor causes the risk of transmission to remain because of this.Keywords: legal protection, pandemic, covid-19, health workers, emergency room Abstrak: RSUD dr.H. Soewono Kendal merupakan salah satu unit pelayanan kesehatan yang ditunjuk oleh Pemerintah sebagai rumah sakit rujukan covid-19 bagi masyarakat Kendal sehingga tenaga medis dan tenaga kesehatan yang bertugas di RSUD dr.H.Soewondo Kendal khususnya di ruang IGD harus melakukan kontak fisik dan kontak erat dengan pasien terduga covid-19 maupun yang sudah positif covid-19. Hal ini menyebabkan risiko penularan covid-19 kepada petugas kesehatan menjadi besar, sehingga perlu adanya pelindungan hukum bagi tenaga medis dan tenaga kesehatan yang bertugas di ruang IGD sebagai salah satu pintu utama masuknya pasien di rumah sakit.Penelitian ini merupakan penelitian yuridis sosiologis dengan spesifikasi penelitian desktiptif-analitis. Penelitian ini menggunakan data primer dan data sekunder. Pengumpulan data pada penelitian ini dilakukan melalui studi lapangan dan studi kepustakaan untuk memperoleh data yang diperlukan. Metode analisis data yang digunakan adalah kualitatif.Pelaksanaan pelindungan hukum bagi tenaga kesehatan di IGD terhadap risiko penularan covid-19 sudah dilaksanakan dengan baik melalui pelindungan hukum preventif berupa skrining, triase, pembentukan satgas 3 M, adanya berbagai peraturan internal terkait PPI di masa pandemi, pemberian asuransi kesehatan dan vaksinasi covid-19, pelindungan hukum represif dilakukan dengan pemberian layanan kesehatan bagi tenaga kesehatan yang terpapar serta pemberian insentif dan santunan kematian. Terdapat faktor yang menghambat dan mendukung pelaksanaannya yaitu faktor sosial, faktor yuridis dan faktor teknis. Akibat faktor-faktor tersebut adalah di IGD masih terjadi penumpukan pasien karena faktor penghambat menyebabkan risiko penularan tetap masih ada karena hal tersebut.Kata kunci: pelindungan hukum, pandemi, covid-19, tenaga kesehatan, IGD
