Abstract

In Islamic view, common well-being management may not go against syariat Islam. To it, it is not possible in state that setting to terminological syariat Islam, E.g. do floozie localization as arena do adultery or concedes nauseating liquor sell or concedes gambling, since that conduct are prohibited conducts that prohibitted by Syariat Islam.   In Islamic view, people is entitled to welfare, and honor bound advance common welfare, smartening up people life, even active deep all life aspect towards well-being all its citizen its state. Maybe no one state even at world it that don't program prosperity in economic area for its citizen. All politician make poverty remove as  central issue well while campaign term, and also after as president or governance head. For state already go forward, well-being increasing problem its citizen, must not miss from its parent plan, beside approaching on another areas. But such, trick that sailed through by it can variably at each state.

Abstract

This study aims to describe the forms of error in using Indonesian language in the legal ruling on sharia economic cases in the Makassar Religious Court. Research is a descriptive qualitative research that is documentative or library research. The data in this study are the use of legal language on the decisions of sharia economic cases number 73 / Pdt.G / 2015 / PA. Mks. Makassar Religious Court. Data collection is done through documentation techniques, by examining a number of references to the use of legal languages, both in the form of books, journals, magazines, newspapers, research reports, and legal documents that are relevant to the problems under study. Recording, namely the author records all matters relating to the phenomenon of legal language usage, which is obtained from the decisions of the Makassar Religious Court and relevant documents, into the notebook prepared in the form of a body of data. The steps of data analysis, namely (1) Identifying the legal language that has experienced an error, (2) Classifying the form of sentence writing errors in the decision of the sharia economic case of the Makassar Religious Court, (3) Analyzing the form of sentence using the Indonesian language in economic case decisions Makassar Islamic sharia, (4) Describe any form of language use error accompanied by descriptions or explanations. The results of the study showed that the Indonesian sentence in the law in the sharia economic decision of the Makassar Religious Court experienced structural errors as a result of not having the function of the subject in sentences, and improper use of conjunctions, and not paying attention to punctuation, diction, ambiguous words, use of redundant words, and adjust the context of the case with the right reasoning pattern. As a result of these errors, the meaning of the sentence becomes ambiguous, making it difficult for the reader to understand. Apart from that, sentence structure errors can cause differences in the meaning that is generated in a decision.

Abstract

The purpose of this study was to determine the application of Islamic economic values in the Belawa Market, Malangke sub-district, North Luwu Regency. In this study the authors used a type of qualitative descriptive research. Data sources used are primary data sources and secondary data. Primary data obtained from interviews with traders in the Belawa Market, while secondary data sources were obtained from library studies and documents. There are also data collection techniques used through observation, interviews, and documentation. The results of the study show that sharia economic forms in the Belawa Market are those which traders are not responsible for their merchandise and do not apply fairly to their consumers so that consumers feel disadvantaged and wronged by the treatment of traders and consumers who are not comfortable in conducting transactions conducted by traders irresponsible and unfair traders. The application of Islamic economic values in the Belawa Market is not well organized due to a lack of traders' knowledge of Islamic economic values and there are still some traders who cheat in conducting transaction activities and do not pay attention to ethics in trading in accordance with Islamic law.

Abstract

The development of Islamic economics can not be separated from the historical development of Islamic civilization. The study of the history of economic thought by analyzing the description of economic thinking Ibn Taymiyyah and the history of life that affect the economic thinking of Ibn Taymiyyah. According to Ibn Taymiyyah pricing by the government is good, but not absolute, because the actual prices are set by the forces of demand and supply. Another case, if the price increases caused by injustice market mechanism, the government may intervene in pricing. To achieve this purpose, it is necessary formation hisbah institutions with the aim of protecting the interests of buyers and sellers

Abstract

This article aims to review the fatwa concerning sharia economics in Indonesia which includes the method and process of establishing a fatwa on sharia economics and fatwa on sharia economics issued by the National Sharia Council of the Indonesian Ulema Council. This institution has the duty to explore, study, formulate the values and principles of Islamic law (syariah) to be used as guidelines in transaction activities in Islamic financial institutions, as well as oversee their implementation and implementation. This guideline is then poured in the form of fatwa by paying attention to the general welfare and maqashid syari'ah so that the fatwa can truly answer the problems that arise in the community and can truly be an alternative that can be used as a guide in running a sharia economic business in Indonesia.

Abstract

The purpose of this study was to find out (1) the form of implementation of coffee buying and selling in tenders in Latimojong District, Luwu Regency, (2) Islamic economic views on the coffee buying and selling system in tenders in Latomojong, Luwu Regency. This research is a qualitative study using the type of social research and syar'i. Using data collection methods from literature studies (literature studies) and field research (field studies) with interview techniques directly to sellers and buyers in Latimojong District by giving specific questions about research. The results of the study revealed how to sell coffee with tenders in Latimojong Subdistrict, where sellers install prices will first use the seller using a bargaining system, after the buyer sees the Coffee location then buys a bargain at the price provided by the previous seller then bargains with willingness. Based on the Islamic economic view of the coffee buying and selling system in Latimojong Subdistrict if it is reviewed from the implementation of buying and selling based on harmony and the terms of buying and selling in accordance with Islamic Sharia regulations, because of Islamic pillars and buying conditions to buy coffee in Latimojong Subdistrict, Luwu Regency there are sellers, buyers, ijab and qabul and there are items that are traded. Not included in gharar because the quality, price, price, and time of delivery are clear.

Abstract

It is undeniable that leasing transactions are common in the community. Renting is basically permissible in Islam, because basically human beings are always constrained by limitations and shortcomings. Therefore, humans between one and the other are always bound and need each other, and renting is one of the applications of limitations that are needed by humans in social life. However, if viewed from the nature of speculative renting a garden, it means that there is no certainty whether the plantation will succeed or not at all produce in large or small quantities, then this element of uncertainty cannot be justified in Islamic law.

Abstract

This article gives an overview of the role of financial services authorities in monitoring the risk of financing from investment that occurs in the community, the data used in this article are primary data in the form of laws and books relating to financial services authorities and financial and material risks secondary in the form of other reference materials that support the writing of this article. This article uses in-depth analysis techniques, which are to thoroughly examine and analyze the context discussed in this article. The conclusion of this article is that in every investment activity carried out in the community, it will have potential risks in the future, especially when there is a fraudulent investment in the community, therefore to overcome the existence of financial services authorities have the following roles: how to disseminate and inform the public about the characteristics of fundraising and financing, through seminars, and the Group Focus Discussion by involving academics as presenters 2) Facilitating dispute resolution between parties to disputes related to financing carried out by communities in a fictitious investment 3) Making regulations (regulation) as a form of protection so that there are no fraudulent investment activities in the community and 4) Making Investment Alert Task Force (Satgas) in each province in the archipelago.

The profit sharing arrangement is an agreement or a common bond in conducting business activities. In the business agreement for sharing of benefits to be obtained between the two sides or more. Islamic economics and regulations governing the sharing agreement will have a positive impact on the practice of revenue sharing in society

Abstract

The Islamic Economic Doctrine is a comparative study that looks at the fundamental principles of Islamic economics, and compares them with the economic and philosophical foundations of capitalism and Marxism. It identifies through a review of theoretical economics the structural problems that lie in the current economic order. Poverty and Inequality have increased in last two decades and the millennium development goals are still far from achieved. The research identifies that lack of an ethical foundation, unbridled pursuit of self interest in production as well as in consumption, interest based financial ad monetary system are the major problematic issues in Capitalism against which mixed economy has also shown limited effectiveness. Socialism promises to create heaven   on earth, but takes fundamental human rights and profit motive away and in the extreme case give way for an autocratic or totalitarian regime. Islamic economic system in its true sense is not present in any country. It is a blend of natural features present in Capitalism i.e. right to private property, private pursuit of economic interest, use of market forces etc. used along with some distinct features derived through Islamic economic teachings i.e. interest free economy, moral check on unbridled self-pursuit and provision of socio-economic justice to achieve the goals of Socialism as far as is naturally possible without denying individual freedom and profit motive.
