Abstract

Salah satu pernyataan orientalis, salah dalam catatannya menilai bahwa para Sarjana Muslim zaman dahulu tidak berpikir bahwa mereka harus mendamaikan unsur-unsur yang bertentangan kebenaran mereka dalam usaha untuk melindungi hukum dalam bentuk idealnya, karena hukum bertindak sebagai standar keputusan dan secara otomatis mengesampingkan unsur-unsur yang bertentangan. Syari’ah sebagai hukum yang diturunkan Tuhan harus dipelihara dalam bentuk idealnya sebagaimana diperintahkan oleh Allah dalam surah QS. Al-Maidah (5):47, sebab apabila tidak dipelihara maka akan kehilangan kemampuannya untuk mengontrol masyarakat yang menjadi tujuan utamanya. Pendapat para orientalis yang salah itu sebagaian besar dikarenakan oleh fakta; bahwa kebaikan sejati dapat diketahui secara rasional dan hukum harus ditentukan oleh kebutuhan-kebutuhan sosial, sedangkan semua kebutuhan telah disediakan dalam hukum Tuhan yang mengetahui apa yang benar-benar baik bagi umat manusia. Hukum  Islam sempurna dalam bentuk sepanjang masa. Bahwa kebutuhan sosial harus ditentukan oleh hukum, bukan sebaliknya, dengan demikian tidak ada konflik dan ketegangan dalam Syari’ah.

Abstract

Type methodic law find or method even implement sentence in islamic law (istinbathal hukm) and law implement (tathbiq al hukm), in real islamic law not far in contrast to findmethod sentences and law implement that utilized by common law practitioner. Such too withmethod that diberlakukan in a state terminologicals islamic law already dikemukan by JurisIslam (fuqaha), as understanding as law which exists deep text sentence to be assessed byhermeneutikas method and also of its language facet the so called Ushul Fiqh. In knowledgeUshul Fiqh formulated by method understands islamic law and understand law theorems, withthat theorem law what do come into the world according to common sense (a. reasionableassumption) .

Abstract

Abstrak Artikel ini membahas tentang Fenomena social climber Mahasiswa Fakultas Syariah dan Hukum, untuk mengetahui Bagaimana Fenomena dan Faktor-faktor apa saja yang mendorong terjadinya perilaku social climber dan Bagaimana pandangan hukum islam tentang social climber.  Jenis penelitian ini menggunakan pendekatan penelitian “field research” peneliti lapangan, penelitian yang mengkaji sosiologi hukum yang menggunakan data primer dan sekunder. Dalam mengumpulkan data melalui wawancara penulis menggunakan studi kasus, teknik yang digunakan adalah membaca literature yang mempunyai kesamaan dan relevan dengan masalah pokok dan sub-sub masalah mengenai Fenomena social climber Mahasiswa, apa faktor yang mempengaruhi sehingga terjadinya perilaku social climber dan pandangan hukum islam tentang perilaku social climber. Adapun beberapa pendapat mahasiswa dari hasil wawancara dilakukan oleh peneliti adalah narasumber 1 mengumukakan bahwa ada dari teman dia sendiri yang begitu dan menurut narasumber itu akibat dari lingkungan sendiri atau bisa dikatakan dari orang-orang yang ada disekitarnya yang terlihat memakai barang yang bagus maka ada keingan untuk menyamainya, dan narasumber yang ke2 mengatakan lebih baik bergaya sederhana saja karena bergaya berlebihan itu bisa mengakibatkan orang-orang disekitar akan iri dan bisa memicu kejahatan. Dari pandangan hukum islam dan mahasiswa mengenai tindakan  social climber pada prinsipnya islam tidak membenarkan social climber karena didalam islam dikenal dengan istilah istishood yakni keseimbangan antara dunia dan akhirat  yang sejalan dengan tujuan islam yang disebut al-falah. Sedangkan sikap demikian disebutjuga dengan Riya. Dan dari pandangan mahasiswa tergolong banyak mendapatkan Stigma Negatif karena cenderung dianggap memaksakan diri, dianggap sebagai pemicu Kejahatan ataupun toxic bagi orang lainKata kunci: Fenomena; Social climber;  Hukum Islam. AbstractThis article discusses the social climber phenomenon of students of the Faculty of Sharia and Law, to find out how the phenomena and factors that encourage social climber behavior and how is the view of Islamic law about social climber. This type of research uses a research approach "field research" field researchers, studies that examine the sociology of law that uses primary and secondary data. In collecting data through interviews the author uses case studies, the technique used is reading literature that has similarities and is relevant to the main problems and sub-problems regarding the phenomenon of Student social climber, what factors influence so that social climber behavior and Islamic legal views about behavior social climber. Social climber is the transfer of a person's social status or members of a community group from low level to higher level, while some students' opinions from interviews conducted by researchers are the resource person 1 announcing that there are from his own friends who are so and according to the informants are a result of their own environment or it can be said of those around him who are seen to be wearing good things that there is a desire to match them, and the second speaker said it was better to have a simple style because excessive style could cause people around to be jealous and could trigger crime. From the viewpoint of Islamic law and students regarding social climber actions, in principle Islam does not justify social climber because in Islam it is known as istishood which is a balance between the world and the hereafter that is in line with the objectives of Islam called al-falah. While this attitude is also called Riya. And from the perspective of students classified as getting a lot of Negative Stigma because it tends to be considered forcing themselves, is considered as a trigger for crime or toxic to otherKata kunci : the phenomenon; social clmber; dan Islamic law.

Abstract

Tulisan ini membahas tentang resiko pada perdagangan komoditi kontrak berjangka yang ditinjau dari perspektif hukum positif dan hukum Islam, dalam memberikan jawaban terkait masalah resiko yang ada dalam perdagangan komoditi kontrak berjangka. Dalam penulisan dalam penelitian ini digunakan pendekatan kepustakaan atau Library Research. Penulis juga menggunakan Teknik penelitian normatif kualitatif yang mana penulis melihat permasalahan tersebut kemudian dikaitkan dengan ketentuan hukum dan menyimpulkan resiko apa yang ada dalam perdagangan komoditi kontrak berjangka yang bisa menimbulkan permasalahan hukum baik dalam perspektif hukum positif maupun hukum Islam. Dalam penelitian ini penulis menemukan bahwaalam perspektif hukum positif perdagangan komoditi kontrak berjangka menghadirkan resiko tidak jelasnya perlindungan yang diberikan kepada nasabah dalam hal ini investor pada bursa berjangka yang membuat nasabah yang tidak menjadi anggota bursa kesulitan untuk membuktikan atau menuntut kepada bursa dalam hal ini pialang berjangka Ketika nasabah mengalami kerugian yang diakibatkan perbuatan melawan hukum ataupun wanprestasi dikarenakan pada klausul undan-undang a quo menyatakan tanggung jawab atas tindakan pialang ditanggung oleh nasabah sepenuhnya, sedangkan nasabah tidak memiliki penguasaan penuh terhadap sistem perdagangan berjangka. sistem atau metode dalam perdagangan komoditi kontrak berjangka pada umumnya dan Sebagian besar ulam berpendapat memiliki atau cenderung mengarah ke transaksi yang dilarang seperti gharar dan maysir ataupun akad yang dilaksanakan pada saat transaksi tidak memenuhi rukun dan syarat akad seperti tidak adanya harga dan barang pada saat terjadi transaksi.

Abstract

Perkara Tindak Pidana Pencucian Uang. Jenis penelitian ini adalah penelitian kualitatif dengan mengambil sumber data dari buku-buku perpustakaan (library research). Adapun hasil penelitian ini menunjukkan bahwa Penyitaan dalam perkara Tindak Pidana Pencucian Uang walaupun tidak diaitur secara khusus dalam undang-undang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang namun penyitaan di atur dalam Peraturan Mahkamah Agung Nomor 1 Tahun 2013 tentang Tata Cara Penyelesaian Permohonan Penanganan Harta Kekayaan Dalam Tindak Pidana Pencucian Uang atau tindak Pidana Lain dibentuk untuk mengisi kekosongan hukum. Petunjuk pelaksanaan lelang secara umum diatur oleh Peraturan Menteri Keuangan No. 27/PMK.06/2016 tentang Petunjuk Pelaksanaan Lelang, dimana atas pelelangan barang bukti juga harus tunduk pada ketentuan tersebut. Petunjuk pelaksanaan pelelangan barang bukti ini berlaku pada masing-masing instansi pejabat penyidik, Penuntut Umum dan Hakim yang sedang memeriksa perkara dimaksud. Namun untuk Tindak Pidana Pencucian Uang dengan Korupsi sebagai Tindak Pidana asalnya itu diatur secara eksplisit didalam Peraturan Pemerintah Nomor 105 Tahun 2021 tentang Lelang Benda Sitaan Komisi Pemberantasan Korupsi. Adapun yang perlu diperhatikan dalam menganalisa proses lelang benda sitaan dalam perkara tindak pidana pencucian uang mengenai rukun, syarat dan ketentuan umum jual beli lelang dalam Islam.

Abstract

The main problem of this research is related to the Review of Islamic Law on the Process of Electronic Pawn Delivery (HP) Mechanism: Abu Hanifah's Thought Study (Bursha Phone Pallangga Pawn Tip Study, Gowa, South Sulawesi). The type of research carried out is field research that departs from observation and discovery of social facts that are studied using a statutory approach (statute approach). The results of this study show that the mechanism of pawning in Bursphone is the determination of the price of mortgaged goods determined by market prices, when there has been an agreement between the store owner and the customer will be given an agreement to return the money every one week gradually, and when customers who are due date and have not been able to redeem the mortgaged goods, The company will confirm to the customer and will give time with a period of 3 days. However, if the customer requests an extended ransom time, the store owner will still provide relief to the customer to extend the redemption time, but if the time requested by the customer still exceeds the given time limit, the customer's goods will become the sole property of the store owner. The pawn company Bursa Phone located in Pallangga, Gowa Regency, can be said to have met the requirements of pawnshops in Indonesia, because, in addition to paying attention to the benefits of the shop owner, it also does not forget to pay attention to the ability of customers related to the redemption of their goods by providing relief in the form of additional redemption time. Likewise, when viewed from the problems of Islamic law, this company has also fulfilled the requirements of Islamic law in carrying out its pawn mechanism, starting from the conditions, to the form of application carried out by shop owners, because in fact, pawn companies only want to ease the burden on the ummah by not ruling out the problem of agreements that have been made by the company.

Abstract

The main problem in this study is how the views of the Shafi'i and Hambali Schools on the practice of social gathering decreased in Cabbenge Village, Lilirilau District, Soppeng Regency The type of research used in this study is field research which is descriptive analytic. The sources of this research are the organizers of the social gathering and people who have joined the social gathering group. Furthermore, the data collection methods carried out are observation, interviews, and documentation. Then, data processing techniques and data analysis are carried out through data reduction, data presentation, and conclusion or verification. In this study, it can be concluded that this declining arisan practice has a debt contract that has different advantages and disadvantages for each participant. The existence of these advantages and disadvantages. The distinct advantage is that the initial participant gets a time gain and a loss in the amount of money earned. Whereas, the end participant gains the amount of money earned and the time loss. So that social gathering is not allowed because it contains elements of usury'. The implication of this research is for parties who carry out arisan with a declining system in order to be able to carry out the arisan activities in accordance with the basics of Islamic law that have been regulated in the Quran, as-Sunnah, Ijma, along with the provisions of the scholars, and in the implementation of declining arisan there should be no difference (+/-) between what is paid and obtained by each member in order to create the main purpose of the arisan, namely help.
