Abstract

A rally or demonstration is a protest movement carried out by a group of people in public. However, demonstrations can also be interpreted as an activity to express opinions in public. Thus demonstration activities are actually a form of human right that is protected by law, in realizing the will of citizens in expressing opinions freely it must be maintained, so that the entire institutional social order is maintained from irregularities or violations of the law and can guarantee a sense of security in life. society, running smoothly, orderly and safely in accordance with what is the purpose of the demonstration. The police are law enforcement officers who directly deal with this matter, so this research examines the role and duties of the police in handling demonstrations in the title, Implementation of the duties and authorities of the Sabhara police unit in handling demonstrations in accordance with the Republic of Indonesia Police Law No. 2 of 2002 This study uses a sociological juridical approach, which is an approach that examines law and its systematics which is then applied to examine a problem in society with the aim of obtaining a fact, formulating a problem and finding the root of the problem. In dealing with demonstrations in this study, the police were at the forefront, namely at the stage of supervising the progress of demonstration activities, the duties of the Sabhara police in this supervision were directly related to the masses in the field, the police experienced only a few obstacles but could be handled properly

Abstract

The scholars provide different limits in determining the valid ijab phrases used in the marriage contract, some scholars provide loose limits and some scholars provide strict limits on the valid ijab phrases used in the marriage contract. The marriage contract is an act of worship. So if there are different madhhabs, there will also be different things related to the marriage contract. The focus of the problem is to find how the comparison of the ijab lafadz used in the marriage contract according to the scholars of the four madhhabs and how the comparison of the legal consequences of each ijab lafadz on the validity of the marriage contract according to the Ulama of the four madhhabs. This research uses qualitative research using primary and secondary data, namely books and documents where the object of this research is the opinion of the four madhhabs regarding ijab in the marriage contract with data analysis techniques using descriptive analysis techniques. The results of this study indicate that the Hanafiyah and Malikiyah Madhhabs use lafdh-lafadh whose meaning tends to disrespect the prospective wife. Such as the use of lafadh wahaba which means giving gifts and lafadh mallaka which means giving ownership rights. The Shafi'iyah and Hambali madhhabs can be said to be very humanist madhhabs. This can be seen from the two ijab phrases used in the marriage contract, and only these two phrases are agreed upon as valid. These two phrases are nakaẖa which means to marry and zawwaja which means to marry. These two words only contain the meaning and intention of marriage, and do not contain meanings that tend to disrespect the prospective wife. The Shafi'iyah and Hambali madhhabs impose very strict rules on the validity of the ijab used in the marriage contract. These two madhhabs only legalize the words nakaẖa and zawwaja. They argue that in relation to witnessing the marriage contract, witnessing is an act of witnessing something concrete only and must be clear. So that testimony that is abstract or unclear, let alone still requires a qarinah, the testimony is considered invalid.

Abstract

The occurrence of a rift in the household is due to the lack of provision and knowledge about the real family. There are so many hopes for the continuity of a marriage but in the middle of the road it runs aground which leads to divorce due to the lack of readiness of both parties in navigating the household. In order for all individuals to have mental, physical and material readiness at the level of marriage and so that households have strong resistance preparation in facing problems from internal and external influences. Pre-marital guidance is one of the BP-4 programs that is considered important. The type of research used in this research is descriptive analysis. The approach used by the author in this research is a qualitative approach. The conclusion about the bride-to-be course in Wolo District can be concluded that, the role of the bride-to-be course is very important for welfare in building a sakinah mawaddah warrahmah household and avoiding divorce because it has provisions and knowledge about the rights and obligations of the household.

Abstract

Islamic law is a set of regulations based on Allah's revelation and the sunnah of the Prophet regarding the behavior of mukhallaf humans which are recognized and believed to be binding for all who are Muslims. Islamic law is universal. Law must develop according to the social needs of the community, as the rule in fiqh that "law changes with the changing times and changing times". In reality, Islamic law is not yet idealistic and seems unable to anticipate changing times and tends to be far from justice. For example, old Islamic law products state that marriage or consent granted must be carried out in one assembly. The reason or legal illat of one assembly is to maintain the continuity and confidence of the witnesses for the two parties who are carrying out the contract. Social development in Indonesian society, especially in the field of technology is currently growing rapidly. Marriage in the Islamic concept is an inner and outer bond between a man and a woman and with the consent of both and based on love and affection agree to live together as husband and wife in a household bond. From the results of the study, it was found that the marriage contract via telephone in the view of Islamic law must fulfill the law and the requirements for marriage in its validity, as long as there is no firmness from law enforcement agencies. Which opinion is enforced in the religious court, then during the process of the consent granted there is no doubt and fulfills the pillars and conditions. In its implementation, it fulfills the requirements and pillars of marriage and does not conflict with the compilation of Islamic law, so the marriage is valid. This is corroborated by the provisions of articles 27 to 29 of the compilation of Islamic law, among others, not lapse of time, then it is carried out by the guardian of the marriage concerned and said directly by the groom over the telephone.

Abstract

Abstrak Penelitian berjudul “keluarga beda agama dalam pusaran maqāṣid syarī‘ah (studi di Kecamatan Ranomeeto)” Rumusan masalah dalam penelitian ini adalah: 1. Bagaimana deskripsi keluarga beda agama di kecamatan Ranomeeto? 2. Bagaimana dampak kelangsungan keluarga dalam keluarga beda agama di kecamatan Ranomeeto? 3. Bagaimana perspektif maqāṣid syarī‘ah terhadap keluarga beda agama? Penelitian ini menggunakan pendekatan multidisipliner yaitu pendekatan normatif syar’i, pendekatan normatif yuridis, pendekatan yuridis empiris, dengan jenis penelitian kualitatif. Sumber data yang digunakan yaitu sumber primer dan sumber sekunder dengan teknik pengumpulan data yang dilakukan dengan observasi, wawancara, dan dokumentasi. Hasil penelitian terdapat 5 keluarga beda agama, 3 pasang melangsungkan perkawinan dengan agama berbeda di kantor catatan sipil, 2 pasang melangsungkan perkawinan dengan calon suami menjadi muallaf. Faktor terbentuknya keluarga beda agama adalah 1. kurangnya pemahaman agama,2. suka sama suka, 3. ekonomi, 4. perjodohan. Hubungan orang tua dan anak keluarga beda agama bahwa semua agama mengajarkan kebaikan, saling menghormati dan mendukung dalam beribadah, saling berinteraksi. Asumsi anak memilih agama, melakukan kompromi antara orang tua dan anak, memberikan kebebasan, mendominasi anak. Problematika keluarga beda agama adalah komunikasi, ekonomi dan kecemburuan. 1. Dampak terhadap suami-istri tidak sahnya perkawinan karena perbedaan agama, rusaknya perkawinan karena murtad. 2. Dampak terhadap anak yaitu anak bimbang memilih agama, 3. Dampak masing-masing keluarga tidak menjalin hubungan baik dengan keluarga. Fenomena keluarga beda agama tidak sesuai dengan maqāṣid as-syarī‘ah karena mengandung banyak kemudharatan yaitu tidak terwujudnya kemaslahatan yang harus dipelihara, diantaranya memelihara agama yaitu perkawinan tidak sesuai dengan rukun dan syarat maka terjadi perzinahan, suami murtad maka terjadi perzinahan, memelihara akal yaitu minum minuman keras. memelihara keturunan yaitu terjadi perzinahan, memelihara harta yaitu pewaris terhalang dalam menerima warisan.
