Abstract

Developments in the field of information and communication technology have created great opportunities for online interaction, but have also increased the potential for sexual violence to occur on the internet. The aim of this research is to analyze how criminal law in Indonesia handles cases of sexual violence that occur online, examine the role of digital security policies in providing protection for victims, and evaluate how effective the regulations that have been implemented in the field are. Using a descriptive-analytical method, this study shows that legal instruments such as the Sexual Violence Crime Law, the Information and Electronic Transactions Law, and the Criminal Code have provided adequate normative foundations to ensnare perpetrators and protect victims. However, its effectiveness is still hampered by the limited ability of authorities to collect digital evidence, the community's low level of digital literacy, and a lack of coordination between the government, digital platforms and organizations assisting victims. Policies regarding digital security have a crucial role in prevention and recovery efforts, but their implementation is still not running optimally. This research emphasizes the importance of systemic strengthening through increasing apparatus capabilities, adaptive policy updates, cross-sector collaboration, and empowering victims to ensure comprehensive protection in the digital world.

Abstract

This study aims to analyze the punishment of child criminals in the Indonesian juvenile justice system and to assess the balance between child protection and punishment as a form of criminal accountability. The research method used is normative juridical research with analytical descriptive specifications, which focuses on the study of legal norms, legal principles, and the concept of child punishment in legislation. The data used is secondary data consisting of primary legal materials and secondary legal materials obtained through literature studies. The data is analyzed using qualitative analysis techniques, namely by interpreting and explaining the applicable legal provisions with the practice of child punishment. The results of the study indicate that although the juvenile justice system in Indonesia has normatively placed the protection and best interests of children as the main principle, in practice, punishment still tends to be oriented towards punishment through imprisonment. This approach has the potential to have a negative impact on child development and hinder the process of rehabilitation and social reintegration. This study concludes that the punishment of child criminal offenses should be placed as a last resort and directed towards a more proportional, humanistic approach, oriented towards training and recovery without ignoring the interests of justice for victims and society.

Abstract

The rapid growth of the online training industry (e-course) in Indonesia has created high-value digital economic commodities. However, the current Intellectual Property Rights (IPR) framework tends to view protection objects in silos, whereas an online training product is fundamentally a complex convergence of various digital elements. This study aims to dissect the legal construction of IPR protection regarding the online training ecosystem, which comprises Learning Management Systems (LMS), teaching modules, audiovisual content, and teaching methods (SOPs). This research employs a normative juridical method with statutory and conceptual approaches. The findings reveal that the online training ecosystem involves overlapping legal regimes. While videos and modules receive automatic Copyright protection, LMS intersects with Computer Program Copyright. A critical complexity arises in protecting "teaching methods" and SOPs; Trade Secret claims become weak once the material is taught to the public, while Copyright does not protect ideas or methods (idea-expression dichotomy). This fragmentation renders law enforcement against training product piracy ("access piracy") suboptimal. The study concludes that a hybrid protection strategy integrating various IPR instruments and robust contractual licensing clauses (Terms of Service) is essential to protect creators' intellectual assets comprehensively.

Abstract

This study aims to examine the implementation of Village Regulation Number 01 of 2021 concerning Animal Control in Pasalae Village, Gentuma Raya District, North Gorontalo Regency. The background of this research is based on the ongoing problems related to freely roaming livestock, which potentially disrupt public order, safety, and community comfort. This study employs a qualitative research approach, with data collected through interviews, observations, and documentation. A total of eight informants participated in this study, consisting of village government officials, policy implementers, and community members. The results of the study indicate that the implementation of Village Regulation Number 01 of 2021 has not been carried out optimally. In terms of communication, the process of information dissemination and coordination among implementing actors conducted by the village government remains limited, resulting in uneven public understanding of the village regulation. From the perspective of resources, the village government faces limitations in human resources, particularly technical personnel responsible for animal control and public socialization activities. Regarding the disposition or attitude of implementers, although there is a commitment between policy makers and implementers, its realization in the field is still not optimal. Furthermore, from the bureaucratic structure perspective, the Standard Operating Procedures (SOPs) owned by the village government have not been adequately socialized to the community. Consequently, the community does not fully understand the procedures and provisions stipulated in the village regulation. Therefore, improvements in communication, strengthening of human resources, and continuous socialization of SOPs are necessary to enhance the effectiveness of the implementation of the village regulation on animal control.

Abstract

The rapid development of Artificial Intelligence (AI) has significantly transformed various public and private sectors. Despite its efficiency and innovative potential, the use of AI poses serious risks to the protection of Human Rights, including violations of privacy, discriminatory algorithmic bias, and threats to freedom of expression and the right to a fair trial. The primary challenge in international law lies in the borderless nature of AI, while no binding international legal instrument specifically regulates accountability in its use. This study aims to analyze international legal standardization in mitigating human rights violations caused by AI systems and to compare AI regulatory approaches among ASEAN countries. This research employs a normative juridical method using conceptual, statutory, and comparative approaches. The findings indicate that AI regulation in the ASEAN region remains fragmented and predominantly relies on soft law mechanisms rather than binding legal norms. Singapore demonstrates the most systematic AI governance framework, while Indonesia is still in the process of developing a comprehensive national policy. This study contributes to international legal discourse by emphasizing the urgency of establishing a binding international convention on AI and strengthening regional regulatory harmonization to ensure effective human rights protection.

Abstract

Maritime security in the ASEAN region faces serious challenges due to the rise of transnational crimes, such as human trafficking, narcotics smuggling, piracy, and other cross-border offenses. Efforts to counter these crimes often focus on state security aspects, yet tend to overlook the protection of human rights for ship crews, migrants, and coastal communities. This research aims to analyze the responsibilities of ASEAN member states in ensuring maritime security in alignment with human rights principles and to examine the need for regional legal harmonization in tackling transnational crimes within ASEAN waters. The research problems include: (1) how maritime security legal frameworks and human rights protections are regulated in addressing transnational crimes in the ASEAN region; and (2) what constitutes an ideal construction of state responsibility to balance security interests and human rights protection. The research method employed is normative legal research with conceptual, statutory, and comparative approaches to maritime security policies and regulations in several ASEAN countries. The results indicate a disharmony of norms and differing standards of human rights protection in maritime law enforcement practices among ASEAN states. The philosophical novelty of this research lies in the paradigm shift from state sovereignty-based maritime security toward human security-based maritime security, which places human rights as the ethical and normative foundation for maritime law enforcement. This research concludes that strengthening regional cooperation and legal harmonization within ASEAN is a primary prerequisite for achieving effective, just, and sustainable maritime security.

Abstract

Advances in space technology have brought humanity to the brink of commercializing space resources, including mining on the Moon and asteroids. These activities trigger fundamental legal debates regarding wealth distribution and the protection of human rights. This research analyzes the risks of space resource monopolies by developed nations and private corporations, which potentially infringe upon human rights—specifically the right to development and the right to the common heritage of mankind. The research problems addressed include: (1) how the international legal framework balances the commercial rights of investors with the principle of human rights protection for all humanity in space exploitation, and (2) the positions and challenges of ASEAN countries in facing the international space exploitation regulatory race. The research method employed is normative juridical with a conceptual approach through the "Common Heritage of Mankind" doctrine, a statutory approach toward the Outer Space Treaty 1967 and the Moon Agreement 1979, as well as a comparative approach within the ASEAN region, specifically between Indonesia, Thailand, and Vietnam. The results indicate a significant void in international law regarding equitable benefit-sharing mechanisms, thereby threatening the economic sovereignty of developing nations. Comparatively, ASEAN countries remain behind in codifying domestic space laws capable of protecting national interests on the global stage. This study recommends the establishment of a new international regime under the UN to guarantee inclusive distribution of space benefits and the strengthening of ASEAN space diplomacy to create collective bargaining power.

Abstract

The development of Artificial Intelligence (AI) in the field of global cybersecurity presents a significant legal paradox: the tension between the necessity of national security protection and the obligation to respect Human Rights. While the utilization of AI for digital surveillance, cyber threat detection, and large-scale data analysis enhances security effectiveness, it simultaneously risks infringing upon the right to privacy, freedom of expression, the principle of non-discrimination, and state accountability. These challenges are further complicated within the ASEAN region and an international legal order that remains fragmented. This research aims to analyze the challenges of human rights protection in AI utilization for global cybersecurity through a comparative perspective of ASEAN national laws and international law. The research employs a normative juridical method with conceptual, statutory, and comparative approaches, examining national regulations in several ASEAN countries alongside international legal instruments related to human rights, cybersecurity, and AI governance. The findings indicate that AI regulation in cybersecurity across ASEAN countries remains predominantly security-oriented and has not fully adopted a human rights paradigm. At the international level, the absence of binding legal instruments results in weak standards for human rights protection in AI practices. This study asserts a philosophical novelty in the form of a paradigm shift from state security-centric governance toward a human-centered and rights-based governance of AI. The research recommends the harmonization of ASEAN regulations and the strengthening of human rights-based international norms in the governance of AI and global cybersecurity.

Abstract

Bagian dari hukum Islam adalah hukum kewarisan Islam, yang didasarkan pada al-Qur'an dan perintah Nabi Muhammad saw. Para mujutahid menafsirkannya berdasarkan pendapat mereka sendiri. Meskipun tidak memberikan hak waris kepada anak dalam sistem kewarisan Jahiliyyah Anak-anak dan perempuan tidak mendapatkan harta rampasan perang karena dianggap lemah dan tidak mampu bertempur. Kewarisan hanya dapat dibagikan kepada anak laki-laki dewasa, anggota keluarga orang yang meninggal, dan individu yang bukan anggota keluarga karena adopsi atau perjanjian. Inilah yang membedakan sistem inheritansi Islam dari sistem inheritansi Jahiliyyah, sesuai dengan perintah Allah. yang memberikan hak kekayaan kepada keluarga. Karena itu, penting untuk memahami dan mempelajari teori Aristoteles tentang keadilan distributif, korektif, dan komutatif. Metode penelitian ini didasarkan pada pendekatan analitis dan konstruktif dari asas persamaan proporsional dengan asas keadilan berimbang. Pembagian hak yang seharusnya diberikan kepada seseorang berdasarkan kewajiban dan kemampuan mereka dikenal sebagai persamaan proporsional. Namun, prinsip keadilan berimbang dalam hukum waris Islam mengatur bagaimana harta warisan dibagi antara laki-laki dan Perempuan.

Abstract

This study aims to explore the role of dowry in traditional marriage practices among the Coastal Malay community in Pantai Lunci, Sukamara District. Using a qualitative approach and empirical method, this research collected data through in-depth interviews and participatory observation in January 2026. Dowry, which is a requirement in traditional marriage, serves not only as a religious obligation but also as a symbol of social status and prestige in the community. The results show that the amount of dowry is influenced by the family's socio-economic factors and the educational status of the groom's family. Variations in dowry amounts were observed based on the groom's family education status, with families with higher education levels tending to offer higher dowries. The study also identified social inequality in access to traditional marriages influenced by economic and educational conditions. Some families prefer to give dowry in the form of cash, gold, or symbolic items, reflecting the symbolic value and cultural traditions that are still highly regarded in the community. This research contributes to the development of more inclusive customary policies that align with the current socio-economic conditions
