Abstract

Brand registration is protection in the form of registering the brand itself to the Directorate General of Intellectual Property Rights. Regarding trademark registration, a form of government protection for trademark registration is that a trademark can only be registered based on an application submitted by the trademark owner who is known to be in good faith or according to the principle of good faith. Trademark Cancellation according to Prof. Dr. Rahmi Jened is a procedure taken by one party to search for and eliminate the registration existence of a mark from the General Register of Marks or cancel the validity of rights based on a mark certificate. The purpose of this article is to analyze the protection of registered trademarks against use by other parties. The research method used is Normative Juridical Law method. Law with an analytical-descriptive definition investigates and investigates trademark violations in connection with the brand law number 20 of 2016 and information related to several cases that have been rife. Based on the results of the research, it is concluded that the owner of the trademark rights fulfills the requirements under the trademark and identification law. And those who feel that their brand names are similar are entitled to legal protection from the government. This legal protection can be in the form of preventive legal protection and oppressive reparation. It is necessary to provide evidence to the violators of the brand of violation which later, if proven, will definitely take responsibility for their actions. the responsibility is carried out maybe the trademark is invalid because the trademark violator has an element of bad faith towards the registered trademark and if proven this results in a lot of losses for the trademark that has been registered and furthermore the brand offender must pay compensation.

Abstract

Good Corporate Governance is a concept that refers to the principles, regulations and practices that govern good corporate governance. GCG aims to encourage transparency, accountability, fairness, and responsibility in decision-making and company operations. The purpose of this research is to analyse non-compliance with the principles of Good Corporate Governance in the PT Jiwasraya case: legal review and implications for state-owned companies. This research method is normative juridical legal research. The result of this research is that the case of non-compliance with the Principles of Good Corporate Governance that occurred at PT Jiwasraya has a serious impact on the company, shareholders, policyholders, and other parties involved. Violations of GCG principles that occur include non-transparency of information, conflicts of interest, weak internal control systems, lack of accountability and responsibility, and weak supervision and regulation. As a State-Owned Enterprise (SOE), PT Jiwasraya should have implemented good corporate governance and GCG principles to protect the interests of stakeholders. However, it was revealed that the implementation of GCG in the company was ineffective or neglected. The PT Jiwasraya case is an important lesson on the importance of good GCG implementation and strict law enforcement in maintaining corporate integrity.

Abstract

The purpose of this study is to critically analyze the quality of Supreme Court decisions in achieving justice and legal certainty in Indonesia. The Supreme Court is an important part of the justice system in upholding justice and providing legal security to the public. Nonetheless, the success of achieving the goals largely depends on the quality of the decisions made. Relevant Supreme Court decisions and a review of supporting literature were used in this qualitative research. This method allows for a thorough analysis of the components that affect the quality of decisions, such as the protection of human rights, equality before the law, equality of treatment, consistency in the interpretation and application of the law, and the guarantee of fair and clear legal protection.

Abstract

The position and role of the witness in a criminal case is evidence to uncover and dismantle a crime. The judiciary is used to prove a crime, evidence and evidence play a role in the process of proving the Criminal Procedure Code. Witness does not give confidence to the Panel of Judges, so that the Panel of Judges is obliged to give a decision in favor of the accused (in dubio pro reo). The judge's decision is a decision whose contents impose a sentence that already has permanent legal force, so the decision can be executed. One type of judge's decision is an acquittal.

Abstract

Cryptocurrency can be defined as a virtual currency that uses a peer-to-peer system so that it is decentralized, which can have positive and negative impacts, One of the negative impacts that are present is that crimes can occur by taking advantage of these present characteristics, so that an appropriate countermeasure is needed. The research method used is normative research with legal comparisons and deductive analysis, that differences in regulations from countries make it difficult for law enforcement in the event of cross-country crimes using cryptocurrency, given the different regulations between countries and limitations on jurisdiction, so a the basic framework of regulation and exchange of information implemented by the international community together and also implemented in positive legal rules by each country, in order to be able to tackle cryptocurrency-related crimes.

Abstract

This study examines the form of legal protection against credit default on working capital installment loans by cooperatives. The type of data used in this research is secondary data, namely data that is not obtained directly from the field or the community, but through literature studies by reviewing and studying books, literature, journals, and internet data. The research approach used is an approach to systematic law, namely research conducted on certain laws and regulations or registered law. The data collection technique used was a literature study, while the data analysis technique was carried out qualitatively. The results obtained from this legal research are a form of legal protection against default on working capital installment loans by cooperatives. So that the Defendant's responsibility is in default for the occurrence of default on working capital installment loan loans by savings and loan cooperatives based on Decision Number 30/PDT.G.S/2018/PN.PWT. Thus the Defendants did not fulfill their abilities, So it can be concluded that the problem is how is the legal protection for the parties in cases of loan default based on court decisions Number 30/PDT.G.S/2018/PN.PWT and namely to make payments for their obligations, so that thus the Plaintiffs had sufficient reasons according to law that the Defendants both individually and jointly had defaulted / broken promises / defaults because they did not pay their obligations to the Plaintiffs.

Abstract

This article aims to examine the form of personal data protection in electronic certificates. This is a normative research with statutory and conceptual approaches. At the beginning of 2021, the Regulation of the Agrarian Affairs Ministry/Head of the National Land Agency concerning Electronic Certificates (it is referred to as Ministerial Regulation of National Land Agency Number 1 of 2021) which was issued on January 12, 2021 to modernize the land handling and services. This modernization is a form of digital transformation of the Ministry of Agrarian Affairs and Spatial Planning of National Land Agency (BPN). The digital transformation which is carried out by The Agrarian Affairs Ministry includes improving digital services and processing personal data from manual to digital, transforming conventional certificates into electronic certificates. The massive data leaks has become public concern regarding personal data. The Law number 27 of 2022 concerning the Protection of Personal Data, it can guarantee the rights of citizens by providing protection for personal data. The result of the research shows a product issued by the government with processing personal data. Based on the PDP Law, it must obtain approval from the Personal Data Protection Officer as a personal data protection form of the land rights holders.

Abstract

Meikarta merupakan megaproyek strategis yang digadang-gadang menjadi hunian masa depan impian melalui berbagai upaya marketingnya. Namun sayangnya, proyek tersebut mengalami beragam kendala yang menyebabkan banyak bangunannya mangkrak. Padahal, telah terjadi transaksi jual beli apartemen antara pengembang dengan konsumennya, bahkan hingga lunas harganya seperti yang terjadi dalam perkara dengan nomor register 162/Pdt.G/2020/PN Ckr yang penulis angkat dalam tulisan ini, dimana penggugat selaku konsumen Meikarta telah melunasi kewajibannya dalam Perjanjian “Penegasan dan Persetujuan Pemesanan Unit”. Menarik untuk membahas mengenai kedudukan perjanjian tersebut apakah dapat dipersamakan dengan Perjanjian Pengikatan Jual Beli (PPJB) dalam penyelenggaraan jual beli rumah susun. Secara normatif, PPJB sendiri diharuskan untuk dibuat di hadapan notaris. Akan tetapi dalam perkara ini, didapat fakta bahwa dalam melakukan perjanjian “Penegasan dan Persetujuan Pemesanan Unit”, pengembang dan konsumen tidak membuat dan menandatanganinya di hadapan notaris seperti yang didalilkan oleh pihak penggugat. Hal ini kemudian membawa kepada pertanyaan bagaimana keabsahan dari perjanjian tersebut. Dengan menggunakan metode penulisan yuridis normatif dan pendekatan perundang-undangan serta pendekatan konsep, penulis berupaya rumusan masalah yang meliputi kasus posisi dalam Putusan Pengadilan Negeri Cikarang Nomor 162/Pdt.G/2020/PN Ckr serta kedudukan Perjanjian Penegasan dan Persetujuan Pemesanan Unit Meikarta dalam penyelenggaraan Jual Beli Rumah Susun.

Abstract

The land is essentially the most basic need for everyone so that the presence of the State is to ensure that everyone can be legally protected by their land ownership rights. Many legal problems occur in obtaining recognition from the State of the legal status of one's land ownership. The purpose of this research is to analyze the settlement of disputes overlapping land rights certificates in Non litigation by the Land Office of Kupang Regency. This research method is qualitative, this research was conducted at the Land Office of Kupang Regency, East Nusa Tenggara Province. The population of this research is the Head of the Kupang Regency Land Office 1 person, the Head of Section at the Kupang Regency Land Office 3 people and the Community 2 people. The sample of this research uses a saturated sample technique, which will be the sample in this study are all members of the population. The result of this research is the effort to resolve the dispute over the overlapping certificate of land rights of the Land Office of Kupang Regency in mediation efforts between the two parties in accordance with the Operational Standards and Procedures (SOP) that have been established based on the Regulation of the Minister of Agrarian Affairs Number 21 of 2020 concerning Handling and Settlement of Land Cases, namely by Mediation by bringing both parties with the Head of the Land Office as mediator. While the legal consequences when the occurrence of multiple certificates will cause the certificate does not guarantee legal certainty. Because basically the ownership status of one plot of land there is only one ownership status. It can be concluded that the certificate is strong evidence as long as the other party does not prove otherwise.

Abstract

Inheritance law is the law that regulates the transfer of ownership rights over the inheritance of the heir, then determines who is entitled to become the heir and how much is each part. Regarding the inheritance rights of non-Muslims, the Compilation of Islamic Law refers more to the opinions of scholars who assert that there are religious differences between heirs with heirs that become a barrier to inheritance. In terms of determining the distribution of heirs of different religions, the Religious Courts play a role in upholding justice, truth, order, and legal certainty regarding Islamic civil cases. In 2021 the South Jakarta Religious Court issued stipulation number 890/Pdt..P/2021/PA.JS in which in this decision the South Jakarta Religious Court granted the request for determination of heirs and distribution of legal inheritance from parents who entered into an interfaith marriage with the initials ISW (hereinafter referred to as a first child) who is non-Muslim, and gets a mandatory will of 1/3 of S's inheritance and does not exceed this provision. The formulation of the problems in this research are: 1) What are the judges' considerations in granting the request for determination of heirs and distribution of inheritance in the South Jakarta Religious Court's Decision Number: 890/Pdt.P/2021/PA.JS? 2) How is the division of inheritance from interfaith marriages? This study uses a normative juridical method which is an approach through the practice of law enforcement against laws that are written and equipped with existing legal documents in Indonesia. The results of this study are 1) The basis for the judge's consideration in the Determination of the South Jakarta Religious Court Number: 890/Pdt.P/2021/PA.JS is based on applicable law and the facts revealed in the trial. 2) Distribution of inheritance from interfaith marriages to realize justice and benefit, namely non-Muslim heirs are entitled to inheritance in the form of a mandatory testament.
