Abstract

Diprediksi Badan Solusi Sengketa Konsumen akan mampu mencapai penyelesaian yang berkeadilan bagi semua pihak yang terlibat sengketa yang melibatkan konsumen dan pelaku korporasi. Hal ini karena memulai tindakan hukum terhadap pihak lain tidak hanya membutuhkan banyak waktu tetapi juga sejumlah besar uang dan membutuhkan waktu yang sangat lama. Melalui penggunaan proses arbitrase, BPSK mampu melakukan investigasi dan mencapai kesimpulan tentang konflik yang muncul antara pelaku usaha dengan konsumennya masing-masing. Telah disampaikan kepada kami bahwa, pada kenyataannya, bukan hal yang aneh jika fungsi yang dimainkan BPSK dalam menentukan sengketa konsumen menghasilkan ketidakpastian bagi para pihak yang terlibat dalam proses implementasi. Ini adalah sesuatu yang telah menjadi perhatian kami. Ini terutama benar ketika datang untuk menganalisis masalah pengaduan terhadap putusan yang dibuat oleh BPSK, yang termasuk dalam lingkup cabang peradilan. Ruang lingkup kewenangan hukum UUPK yang terbatas dalam penyelesaian sengketa yang melibatkan konsumen adalah masalah yang harus ditangani sesegera mungkin. Aturan (peraturan perundang-undangan) yang terkait dengan perlindungan konsumen tidak dapat memenuhi tujuan yang telah ditetapkan oleh sistem hukum karena kemampuannya yang terbatas. Kerangka kerja legislatif BPSK mencakup sejumlah batasan yang berasal dari pendapat pengadilan.

Abstract

In 2020, a hoax was disseminated through social media in Batam City, claiming that the captain of the Virginia Ship had contracted Covid-19. This hoax immediately caused significant concern among the residents of Batam City, as the ship was anchored in their city. This study aims to identify the strategies employed by the Regional Police of Riau Islands Province to combat hoaxes, specifically focusing on the case of the Virginia Ship. To achieve this objective, socio-legal research was conducted, which involved in-depth interviews with relevant stakeholders from the Regional Police of Riau Islands Province. Additionally, secondary data collected through library research was utilized. All data was qualitatively analyzed. The findings of the study indicate that the enforcement of laws against hoaxes on social media pertaining to COVID-19 news in Batam City has been effective. This success can be attributed to the establishment of a Cyber Crime Investigation Satellite Office situated at the Kepulauan Riau Regional Police headquarters.

Abstract

Technology is getting more sophisticated and more and more people are able to access and use the technology, moreover, it is not uncommon for people to abuse the technology. As is the case with the use of social media in cyberspace which is often indecent, for example the distribution of pornographic photos/pictures or even videos. Twitter, Facebook, Instagram and so on are often misused, even though the Government has stipulated rules regarding strict sanctions for perpetrators of distribution and other matters related to pornographic elements. For this reason, the author in this case examines the process of investigating cyberporn perpetrators through the Instagram application and how effective the investigation process is and the result is that the investigation process is carried out in accordance with Article 6 of the Criminal Procedure Code and is carried out on the basis of prior reports, while the level of effectiveness is influenced by three factors namely structure, substance, and legal culture. This research was conducted using normative methods obtained from secondary data sources and laws and regulations.

Abstract

Hukum pidana di Indonesia erat kaitannya dengan asas legalitas yang terdapat di dalam Pasal 1 ayat (1) KUHP. Asas legalitas di bawah hegemoni paradigma positivisme, menekankan suatu perbuatan dapat dipidana apabila ada aturan hukum yang mengaturnya terlebih dahulu yakni aturan hukum pidana dalam bentuk undang-undang pidana. Jika hanya berorientasi pada undang-undang saja maka keadilan yang diwujudkan hanyalah keadilan formal. Paham critical legal studies menentang dan mengkritik pemahaman tersebut. Fokus sentral critical legal studies adalah untuk mendalami dan menganalisis keberadaan doktrin-doktrin hukum atau asas hukum, termasuk asas legalitas. Penelitian ini bertujuan untuk memberikan pemahaman bahwa paradigma critical legal studies memberikan pandangan yang berbeda terhadap asas legalitas. Metodologi penelitian ini menggunakan penelitian hukum normatif dengan pendekatan filosofi, perundang-undangan, dan hermeneutik. Berdasarkan hasil penelitian, bahwa paham critical legal studies telah masuk di dalam sistem hukum di Indonesia, baik melalui teori hukum maupun melalui undang-undang. Pasal 10 ayat (1) dan Pasal 5 ayat (1) Undang-Undang Nomor 48 Tahun 2009 tentang Kekuasaan Kehakiman merupakan refleksi dari pemahaman critical legal studies. Pasal tersebut memberikan arti yang berbeda mengenai asas legalitas dari apa yang dipahami selama ini serta mengisyaratkan peluang untuk mengisi kelemahan dari asas legalitas status quo.

Abstract

Waste management is something that is important and needs attention. The 1945 Constitution has guaranteed the basic rights of citizens to the environment as stipulated in Article 28H paragraph (1) of the 1945 Constitution which reads "Everyone has the right to live in physical and spiritual prosperity, to have a place to live, and to have a good and healthy environment and entitled to health services”. The Batam City Government has established Batam City Regional Regulation Number 11 of 2013 concerning Waste Management as the implementing regulation of Law no. 18 of 2008 in the city of Batam. However, in reality in the field, the management and handling of waste in the city of Batam can still be said to be not optimal. Based on the data, the waste transported to the TPA (direct and indirect is 57.36% or 1,523.20 m³/day, the waste is managed independently by the community is 0.033% or 0.95 m³/day, the 3R Processed waste (TPS3R/ TPST/Waste Bank) of 0.52% or 1.45 m³/day, and Unprocessed waste of 42.56% or 1,130.04 m³/day.This research is an empirical juridical study using a sociological approach.Primary data used in this study were field studies in the form of data and interview results with the Batam City Environment Service as well as the results of interviews with some communities around the Batam Kota sub-district, and coupled with data obtained from research questionnaires which were distributed to communities around the Batam sub-district area City using random sampling method.

Abstract

The zakat collection unit is tasked with collecting and distributing zakat funds to mustahiq zakat, but in its distribution in the Musthafawiyah Abituren Family Zakat Collection Unit distributes it to the construction of educational facilities, distribution outside the eight Asnaf is guided by MUI Fatwa No. 14 of 2011 concerning the Distribution of zakat assets in the form of managed assets. Zakat can only function when the collected zakat funds reach mustahiq, in the existing literacy mustahiq zakat consists of eight asnaf, all of which are understood by the majority of people, but in practice there are some zakat collectors who distribute the benefits of zakat to schools. Therefore, it is necessary to know what is the law of distributing zakat funds for the construction of school facilities. This research uses qualitative research with empirical juridical research type in which this research was conducted at the Musthafawiyah Abituren Family Zakat Collection Unit. From this research it is found that scholars have different views on the issue of distributing zakat to other than the eight asnaf, Wahbah Az-Zuhaili and the Jumhur scholars in the madhhabs agree that it is not permissible to distribute zakat to other than the asnaf determined by Sharia.

Abstract

This article aims to find out the perspective of the Compilation of Islamic Law (KHI) regarding gender partnerships in the concept of family resilience, and how it is implemented in Karo Muslim families in STM Hilir District. This research is empirical juridical research using a legal science and legal sociology approach (legal sociology approach), using primary and secondary data sources. Primary data sources were obtained from interviews with a number of informants who are members of the Karo Muslim community in STM Hilir District, while secondary data sources were obtained from primary legal materials such as Law No. 1 of 1974 concerning marriage, the Compilation of Islamic Law (KHI), and the book of fiqh. The data analysis method used is a qualitative method. The research results show that. Gender partnership is one of the variables in the concept of family resilience which has four indicators, namely aspects of togetherness in the family, husband-wife partnership, openness in financial management, and family decision making. From the perspective of the Compilation of Islamic Law (KHI), although the article does not specifically regulate gender partnerships, the indicators can be found in several articles in the KHI which support the realization of gender partnerships in family life. In its implementation, from 10 informants from the Karo Muslim community in STM Hilir District, it was discovered that indicators of openness in family financial management were implemented well, where husband and wife were directly involved in managing family finances together and transparently. Meanwhile, explaining other indicators still needs to be improved so that the values ​​of gender partnership as regulated in the KHI can be implemented well in Karo Muslim families, STM Hilir District.

Abstract

Law Number 8 of 1999 Concerning Consumer Protection (UUPK) states that consumer protection is all efforts that guarantee legal certainty to provide protection to consumers. As consumers, the public is often in a weak position, one of the causes of this weakness is the weakening of power in regulating and supervising consumer rights. Currently, free trade supported by advances in communication technology has ecpanded the space for the flow of transactions of goods and/or services between countries, this condition, on the one hand, has benefits for consumers because all consumer needs can be met, as well as more freedom to choose various types of quality goods and services according to the wishes and abilities of consumers. However, on the other hand, such conditions can result in the consumer’s position being in a weak position and consumer protection rules that are no longer sufficient to keep up with the developments and sophistication of the times. Everything related to the purchase of goods/services regulates consumer rights. But in fact, currently consumer protection provisions are unable to act as a legal umbrella in the era of free trade with the existence of business actors who do not pay attention to consumer rights. Strengthening consumer protection in Indonesia after free trade is absolutely necessary to provide protection to the public and create a balance between business and consumers. Efforts to improve consumer protection by amending the UUPK, strenghthening consumer protection institutons, providing consumer education and a commitment to establising laws and regulations that protect consumers.

Abstract

The dominant influence of technology, especially the internet, and smartphones, on almost all aspects of human life. Internet technology, which was originally only used for office activities, has now penetrated various lines of life through mobile devices. Smartphones have become multifunctional tools, from making phone calls to banking transactions, and various other applications that facilitate human life. One application that attracts attention is online shopping applications. Although it provides convenience, the application also raises several issues, especially regarding the rights and obligations between sellers and buyers. In Indonesia, online shopping transactions through Electronic Commerce often lead to consumer protection issues that feel harmed by service providers. These cases often involve the use of standard clauses by online shopping service providers to avoid claims from consumers.

Abstract

Indonesia, as a developing country, still needs a lot of development in all sectors, especially in the economic sector. The role of corporations in the economic development of society not only has a positive impact, but also has negative impacts, one of which is the development of deviant behavior carried out by corporations with economic motives whose characteristics and modus operandi are different from conventional crimes in general so that law enforcement requires handling with special instruments. . The research method used is normative legal research. The urgency of criminal liability for corporations as perpetrators of environmental criminal acts is because corporate criminal acts in the environmental sector have widespread and complex negative impacts so that they not only cause direct losses to society and the environment but also disrupt the financial and economic stability of the country, considering the actions Environmental crimes are carried out with economic motives. The punishment pattern for corporations that commit environmental crimes in the PPLH Law should contain provisions related to environmental conservation-based punishment patterns which include the severity of criminal fines, regulations for the implementation of criminal fines, and sanctions for remedial action resulting from criminal acts.
