Abstract

A notary is a public official whose authority is given by the state to carry out some government functions in terms of making authentic deeds. In carrying out their duties, notaries have the authority regulated in Law Number 30 of 2004 concerning the Position of Notaries which has been amended by Law Number 2 of 2014 concerning the Position of Notaries. A deed made by a notary is a product in which the contents of the deed contain formal data submitted by the person present, or in other words the contents of the deed are the wishes and/or wishes of the parties. The information submitted by these parties is not entirely true, because there are parties who submit false information for personal gain, which can harm or ensnare the notary in a criminal act. Losses resulting from the deed This can cause the notary to be sued by the injured party, or in other words the notary is deemed to have bad intentions, even though the notary has carried out his duties in accordance with what is regulated in the UUJN and the Notary's Code of Ethics and is considered to have committed a criminal act. What is the legal protection for the notary and what is the notary's responsibility for the deed.

Abstract

The goal of this study is to assist the community with case management. Settlement of civil disputes can be carried out through a process in court. The research method used is a descriptive qualitative research approach, namely research on natural objects from experiments. using observational data collection techniques, interviews. Research findings describing the application of Restorative Justice in Indonesia are still limited and face various challenges, such as lack of public understanding of the concept of Restorative Justice, limited resources, and lack of support and coordination between institutions. The findings contribute to an in-depth understanding of the opportunities and barriers for incorporating restorative justice approaches into the civil justice system in Indonesia. Recognition by the community and the judiciary. There are challenges in the implementation of restorative justice, such as the lack of trained human resources and adequate facilities, so improvements and developments are needed for restorative justice to be properly implemented.

Abstract

This research focuses on the construction of wrongful acts related to the duties of curators and the considerations of judges in Supreme Court decisions. The research aims to gain in-depth understanding of wrongful acts by curators and how judges consider such cases. The theoretical contribution of the research is expected to enhance the understanding of wrongful acts in curator actions. Practically, the research results are anticipated to offer new perspectives for legal researchers and practitioners, as well as guidance for those involved in bankruptcy cases, emphasizing the principles of justice, legal utility, and legal certainty. The research has the potential to enrich legal insights related to bankruptcy and support the improvement of legal policies and practices in facing bankruptcy challenges.

Abstract

This dissertation conducted under the title “Reconstruction of Legal Protection Regulation for Service Customers of Payment System in Indonesia was based on the need for a strong legal basis concerning consumer protection of payment system since the existing legal regulation construction. In addition, its implementation is deemed in need of adjustment with the increasing development of product and service of the national payment system which is encouraged by the technological advancement that promote tons of innovation so it may increase the risk for the consumers. The present study was aimed at analyzing and describing three problems related to the construction of legal protection regulation for consumers of payment system services in Indonesia, the implementation of legal protection for the payment system service consumers, and the reconstruction of legal protection regulation for payment system service customers in Indonesia in the future. The theoretical basis employed was the theory of equality, legal certainty, and legal protection. The methodology used was normative with law approach, conceptual and comparison, and descriptive approach obtained from secondary data supported with the primary data which were analyzed qualitatively using deductive conclusion-making. The research result revealed that the construction of legal protection for customers of payment system services regulated in the Peraturan Bank Indonesia (PBI) Number 22/20/PBI/2020 concerning Legal Protection for Bank Indonesia Consumers was still considered low so it needed an adjustment. The implementation of consumer protection of payment system service including consumer complaint handling provided by the Payment Service Provider by Bank Indonesia was deemed in need of improvement or reconstruction in order to be able to give legal certainty to the customers. The reconstruction of PBI was conducted by adjusting and adding some articles including indemnity, personal data protection, establishment of an Alternative Payment System Dispute Resolution Institution, cyber risk, new product testing, and action mechanisms against unlicensed Payment Service Providers. The researcher in this study suggested the formation of new laws regulating the payment system in which consumer protection of the payment system should be regulated by referring to the comparison with other countries that have certain Laws concerning the payment system. The formation of laws will strengthen the legal basis in the activity of the national payment system as well as give legal certainty to the consumers and business practitioners in the payment system service.

Abstract

The implementation of split contract in Engineering, Procurement, and Construction (EPC) projects aims to distinguish between onshore contract or and offshore contract. Split contracts are divided into onshore contracts/domestic work contracts and offshore contracts/foreign work contracts. The application of a split contract structure in EPC projects has fundamental differences compared to the implementation of a single EPC project contract. The fundamental differences are related to taxation and exchange rate risks arising from the execution of the EPC contract itself. The implementation of a split contract structure in EPC projects in Indonesia is expected to be beneficial from the perspective of tax efficiency. The tax efficiency referred to is that onshore contractors performing work in Indonesia do not have to bear taxes on work carried out abroad. This is because the tax liability for offshore work will be borne by the employer. By taking advantage of import tax exemption rules, project owners gain tax efficiency. Split contracts (Split Contract) in EPC projects are not yet widely applied in Indonesia. Companies in Indonesia generally use a single contract structure in the implementation of EPC projects. Therefore, research is needed that discusses in detail the implementation of a split contract structure in EPC projects. This research will explore the correlation between the implementation of a split contract structure and the tax impacts on companies working on EPC projects in Indonesia. The research method used is the normative legal research method. The analysis presented in this research is based on Indonesian Tax Law, Customs and Excise Law, and other applicable legal instruments at present.

Abstract

Land problems arising from land rights that do not have legal certainty, including issues regarding Letters of Recognition of land rights that have not been registered into a certificate still occur in the community today. This results in the emergence of control over land parcels by parties that are not in accordance with the provisions of laws and regulations, such as claiming a piece of land by someone who is not necessarily entitled to the land concerned. This study raises the issue of the evidentiary power of a letter of recognition as a means of proof of ownership of land rights. The method used is research in the form of normative juridical, with a research approach, namely a legal approach and a case approach. The source of data used as material for completeness of data is secondary data by means of data collection, namely document studies. The results of this study explain that before the enactment of the UUPA, a Letter of Recognition of land rights made before the Head of the Village / Lurah or local sub-district head was still recognized as proof of ownership of land rights. However, after the enactment of the provisions of the UUPA, PP 24/1997, and PP 18/2021, written evidence of customary land other than certificates cannot be used as evidence of ownership of land rights and is only a guide in the land registration process.

Abstract

Copyright is an intangible movable object that can be used as an object of fiduciary security. However, in practice, we still encounter obstacles due to assessment issues, even though the government, through Government Regulation Number 24 of 2022, has issued regulations that can encourage the implementation of copyright guarantees as an object of credit collateral. This paper examines how the assessment can be done to determine the copyright that can be used as an object of fiduciary guarantee and how the role of the public appraiser to determine the value of the object of fiduciary guarantee in the form of copyright. The research method used in writing this scientific article is normative juridical research which is supported by data sourced from interviews, review of statutory regulations and literature study. The research results show that the assessment of copyright as a collateral object consists of 4 (four) approaches, namely the cost approach, market approach, income approach, and other assessment approaches in accordance with assessment standards. The legal position of public appraisers in assessing intellectual property is regulated in Minister of Finance Regulation Number 101/PMK.01/2014 concerning Public Appraisers as well as the legitimacy of public appraisers to assess copyright as an object of fiduciary guarantees as regulated in Government Regulation Number 24 of 2022 concerning Law Implementation Regulations -invite. Law Number 24 of 2019 concerning Creative Economy.

Abstract

Indonesia melakukan penetapan Enhanced Nationally Determined Contribution (E-NDC) menjadi 32% atau setara dengan 912 juta ton CO2 pada tahun 2030. E-NDC adalah target pengurangan emisi yang ditetapkan oleh negara yang meratifikasi Paris Agreement. Negara juga merumuskan tindakan-tindakan adaptasi mitigasi apa yang akan dilakukan secara domestck serta memformulasikan pembangunan rendah emisi GRK jangka panjang. Ekonomi hijau dalam hal ini datang dan menjadi alternatif pilihan terbaik dalam rangka melaksanakan model pembangunan yang reducing emission from deforestation and degradation (REDD). Ekonomi hijau sebagai konsep perekonomian baru dan ramah lingkungan, melahirkan konsep Investasi Hijau yang merupakan cara paling efektif dalam alternatif solusi untuk mendapatkan dukungan modal yang besar dalam mendukung proyek pembangunan. Investasi hijau ialah suatu pendekatan investasi yang bertanggungjawab secara sosial (social responsible investment) atau model investasi jangka panjang yang berkelanjutan. Dalam kaitannya dengan hal tersebut Indonesia regulasi di Indonesia telah mengamanatkan mengenai Investasi Hijau sebagai upaya memberi kepastian hukum kepada calon investor., yakni yang paling utama adalah pada Undang-Undang Penanaman Modal dan Peraturan Presiden tentang Rencana Umum Penanaman Modal. Namun demikian, implementasi pnerapan Investasi Hijau dalam peraturan perundang-undangan dianggap masih belum dilakukan secara maksimal.

Abstract

DKI Jakarta sebagai ibukota negara adalah kota metropolitan yang memiliki keramaian lalu lintas yang sangat padat. Kepadatan lalu lintas tersebut disebabkan oleh banyaknya kendaraan bermotor, yang secara langsung berpeluang meningkatkan pendapatan daerah yang berasal dari pajak khususnya kontibusi Pajak Kendaraan Bermotor. Pajak Kendaraan Bermotor merupakan salah satu penerimaan terbesar terhadap Pendapatan Asli Daerah yang diharapkan dapat membiayai pengeluaran pemerintah untuk pembangunan. Pajak kendaraan Bermotor, sebagai salah satu jenis Pajak Provinsi, dapat dimaksimalkan pendapatannya apabila diatur dibawah payung hukum yang bersifat desentralistis karena diperlukan dan tepat untuk diterapkan di negara yang memiliki sebaran wilayah kepulauan yang luas dengan keanekaragaman budaya majemuk seperti Indonesia ini, terutama di Provinsi DKI Jakarta ini. Maka dari itu perlu adanya peran dan upaya Pemerintah Daerah untuk menyadarkan masyarakat yang memiliki kendaraan bermotor sebagai wajib pajak, untuk memenuhi kewajibannya membayar pajak, dikarenakan Pajak Kendaraan Bermotor adalah salah satu sumber dominan untuk penerimaan dana secara optimal ke kas daerah.

Abstract

Keberadaan Badan Usaha Milik Negara (BUMN) sebagai salah satu pilar terkuat perekonomian di Indonesia tentunya tidak dapat kita pungkiri merupakan cerminan dari keterlibatan negara dalam rangka pemenuhan kebutuhan masyarakat. BUMN sebagai pelaku ekonomi berbentuk badan hukum yang diberikan hak istimewa dari negara untuk menjalankan usahanya. Kemudian dalam perjalanannya BUMN mengembangkan usahanya dengan membentuk anak perusahaan yang memiliki bidang-bidang bisnis tersendiri. Berkaitan dengan hal ini, perlu untuk dilihat sejauh mana kaitan antara negara sebagai pemegang saham pada BUMN dengan anak-anak usaha yang kemudian dibentuk oleh BUMN. Selain itu, masih dengan kaitannya dengan keuangan negara, bahwa setiap keuangan negara, terdapat suatu badan yang bertugas memeriksa pengelolaan dan tanggung jawab keuangan negara yakni adanya Badan Pemeriksa Keuangan. Sehubungan dengan hal tersebut, dalam konteks Anak Perusahaan BUMN, perlu ditinjau sejauh mana kewenangan BPK untuk memeriksa pengelolaan dan tanggung jawab keuangan negara.
