Abstract

Mahkamah Konstitusi sebagai The Guardian of Constitutions sekaligus pula sebagai lembaga yang dapat melindungi hak asasi manusia berwenang menguji Pasal 31 ayat (4) UU No. 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Putusan Mahkamah Konstitusi Nomor 5/PUU-VIII/2010 menyatakan bahwa sejatinya penyadapan (interception) adalah sebuah perbuatan melawan hukum. Hal ini dikarenakan penyadapan merupakan sebuah tindakan yang melanggar privasi orang lain dan oleh karenanya melanggar hak asasi manusia (HAM). Pengaturan penyadapan melalui Peraturan Pemerintah adalah tidak tepat. Bentuk Peraturan Pemerintah hanya merupakan pengaturan administratif dan tidak memiliki kewenangan untuk menampung pembatasan atas HAM.

Abstract

Capital markets have a strategic role in national development as a source of long term financing for businesses who also is one investment alternative container for the owners of capital (investors) that tends to channel these funds into the banking and property sectors. The capital market is one of the collector container investors, who also is a provider of container funds (capital) for the community, which will use the funds for improvement and development of its business for the long term.

Abstract

As stipulated in the article 24 (1 and 2) of the constitution of Republic ofIndonesia 1945, Constitutional courts is, beside Supreme Court, one of the judicial courts element. This means that constitutional court is bound to general principles of judicial power, i.e. freedom, impartial and independent from any other institution in enforcing law and justice. One of the constitutional court’s decisions assumed to be controversy is what so called “ultra petita decision”. In the context of procedural law prevails in the court, ultra petita is decision which contains things out of claimant’s request within a judicial review process. This clearly will bring about legal discussion among legal experts.

Abstract

The establishment of Law number 14 of 2001 concerning Patent as a follow up policy after the ratification of the World Trade Organization (WTO) including its attachment concerning Trade Related Intellectual Property Rights (TRIPs) has brought legal consequence. That is to apply The TRIPs agreement in national law where one of the principle is knows as the National principle toward foreign patents in Indonesia. The foreign Patent rights will be preserved as long as the invention has registered to directorate-general of Intellectual Property Rights of the Republic of Indonesia. The invention registration could be applied in 2 (two) mechanism i.e. priority right registration and Patent Cooperation Treaty (PCT) and the application must be authorized by Indonesian IPR consultant.

Abstract

One of the activities of Islamic banking business is accumulating funds from the public by using wadi’ah and mudarabah contract muthlaqah. Contract wadi'ah developed in Islamic Banking is wadi'ah clearing and savings wadi'ah, while Mudharbah muthlaqah principle is applied by Islamic banks in the form of savings and deposits mudarabah. From the second contract mudharabah only be done while sharing agreement wadi’ah but it should not be giving bonuses to customers but on the willingness and may not be agreed upon beforehand. While the main principles of Islamic banking operations is an agreement to the yield and risk, where banks and customers share the profits based on the ratio of the outcome is predetermined in the contract. The risk is to assume liability for any damages caused by events beyond the fault of either party. There are several types of risk in the Islamic banking financing risk, market risk and operational risk. A key feature of the results is that the gains and losses on the responsibility shared by both lenders and by employers. Method of sharing in Islamic banking are two of profit sharing and revenue sharing, the method should be stated in the agreement made ​​at the beginning of the agreement. The choice of method for determining the outcome so the gains customers and banks. Besides, it is possible for the goal should also be determined by the amount of profits that fund management do Islamic banking, ie, the greater the profit, the greater the bank to reverse the result if a small profit then the results have to be small.
