Abstract

Kasus korupsi sejak orde  baru sampai reformasi yang diselesaikan melalui proses hukum membuktikan adanya kelemahan pengelolaan proyek, terutama fungsi kontrol. Namun demikian perencanaan yang kurang sempurnapun berpotensi hal yang sama. Korupsi seumur sejarah manusia dan merupakan penyakit masyarakat yang sangat berbahaya, karena dapat mematikan kesadaran untuk hidup secara baik, jujur dan konsisten. Kemungkinan bisa diberantas sangat kecil, akan tetapi bila dicegah atau dikurangi sangat mungkin, yakni  melakukan penegakan hukum dan moralitas segenap komponen bangsa. Perkembangan hukum senantiasa jauh dari harapan masyarakatnya, apabila para penegak hukum masih berfikir normatif tidak mau dan mampu merubah paradigma legalistik  positivisme kearah yang lebih sosiologis dan bermoral.Azas praduga tak bersalah, berlaku secara mendunia yang berbeda hanya penerapannya, Indonesia paling gethal meneriakkan hal ini. Penegakan hukum di Indonesia  menutup mata dalam hal non hukum dan moral, mestinya seseorang yang dinyatakan sebagai tersangka tanpa tekanan dari pihak manapun secara moral harus mundur, seperti halnya di Jepang. Dijepang berlaku budaya mundur, sedangkan di Indonesia berlaku budaya undur-undur.

Abstract

Land is the most strategic natural resources and has an essential role in human life, therefore the preparation, allotment, and utilization of the land should to be planed well and aright in other to have the most benefit for the prosperity of the most society. The planning, preparation, allotment, and utilization the land is conducted to regulate of mastery and ownership and utilization of land by person, corporation or a group of society, so that it is regulated and not prejudiced each other. The regulation of land by government base on some instruments of law consist of: Article 33 section (30) UUD 1945, UUPA (Agrarian Acts) Article 6, 14, and UUTR (Space Regulation Acts) Number 24 Year 1992 that to be changed with UUTR Number 26 Year 2007; UULH (Environmental Acts) Number 4 Year 1982 that to be changed with UUPLH (Environmental Management Acts) Number 23 Year 1997, and to be changed anymore with UUPPLH (Environmental Management and Protection Acts) Number 32 Year 2009; and PP (Governmental Regulation) Number 16 Year 2004 about the Land Use Planning. The management of lands use planning base on the cohesiveness principle, empower and efficiency principle, harmonization and equal principle, sustainable principle, transparency principle, and equality, fairness and protection of law principle. The relevance between land use planning and environment is that, the planning, preparation, allotment, and utilization of land really have to pay attention many aspects, either the aspect of personal or society interest, aspect of maintenance and preservation of natural resources itself, or aspect of protection and preservation of Environment.

Abstract

This study aims to find out the sustainable cultural development: the future of balinese adat village posterior the enactment of law number 6 year 2014 concerning village . This research is done empirically juridically, that is by collecting data by researching and examining legal implications posterior the enactment of Law Number 6 of 2014 regarding Village. In the sense of Explanation Article 6 Act Number 6 Year 2014 that stating: “This provision is intended to prevent the intersection in regions in term of authority, institutional duplication between Desa and Desa Adat within the same region, In contradiction, in case the Balinese and the Bali regional government as well is intended to chose the desa adat/desa pakraman to be registered with the hope to the only receive a village financial empowerment every year from the Government, should personally advice that there will be a number of legal consequences with the fate and future of existence and the life of desa adat/desa pakraman as a social and cultural system of Balinese Hindu community in particular and the whole traditional adat communities in the multicultural country of Indonesia in general.

Abstract

Indonesia is one country that has a lot of islands, culture and even the crops or products produced or the results of intellectual work which later developed into an attractive arena in the world, especially in the fields of economy, industry and international trade. Acquisition of legal certainty is a matter that can only be answered normatively based on the legislation in force, not sociological, but legal certainty normatively is when a rule is made and legislated for sure will set out clear and logical, in the sense not cause doubts -raguan (multi-interpretation) and logical in the sense of a system of norms with other norms so as not to clash or conflict norms arising from uncertainty. The existence of a certificate of physical evidence data and data juridical evidence, the certificate is a guarantee of the acquisition of legal certainty to protect intellectual property, Obtaining legal certainty in the field of intellectual property is in order to protect natural resources and biodiversity are the products of society.

Abstract

Research result shown that: (1) the arrangement of legal protection and tribute on people’s rights to manage land resources has stated on in Article 18B of Institutional Law (UUD) 1945 (as a constitutional right), Article 28 I of UUD 1945 and Law number 19 of 1999 (considered as one of human rights). In the elucidation of Article 22 UUPA (Law of the land) has beed clarified that to own land ownership right could be throught land occupation, this way is feasible according to adat law where National land law based on adat law (according to Article 5 UUPA). (2) the implementation of legal protection toward ownership holders in Rowok case is still away from expectation, this could be seen from the way the government and security officer treated land owner such as committed an eviction, tumbled-down their house and some people who insist to stay on their land were arrested by security officer under allegation of law for entering people’s property without permission whereas they occupied the land previously as a place to stay and place to live.

Abstract

Jurisprudence may be differenhciated into normative jurisprudence and empirical jurisprudence. Based on the philosophical view, they have theirself characteristic. Ontologically, the study object of empirical jurisprudence is focused on the law as a set of human behavior (law in action). Empirical jurisprudence (Sociological Jurisprudence) gives equal attention to the society and law as two primary elements in legal application. Epistimologically, the truth in empirical jurisprudence is obteined in accordance with the scientific norm (scientific method) in general. From the axiology perspective, the perspective of empirical legal srtudy is absolutely importance in achieving the statutes neccessary to fuolfill the legal neccessity of the society, so as to it more effective in its application.

Abstract

This research aims to examine and analyze the position of PPAT’s deed that used as evidence in criminal cases and the power of proof of PPAT’s deed which serve as evidence in criminal case. This research is a normative legal research by using the legislation approach, concept approach and case approach. The results is that the position of the deed’s of PPAT as evidence in a criminal case is the same as other evidence as a proof of letter and its unbound as regulated in Article 187 of KUHAP. The judge does not have believe that the content of the deed is true because in examining the case findtruth material, and other evidence is needed to meet the minimum evidentiary as regulated in Article 183 of KUHAP.

Indonesia as a State law and State unity that holds the principle culturally diverse that were in fact very diverse religious, ethnic, racial and cultural but Indonesia as a unitary state which berasaskan Pancasila which hold tight and fast to the precepts contained in the Pancasila that one of them is deity maha esa enshrined in the teachings of the religion freely without any act of interference from other religions and coercion by the lainuntuk realizing one of the teachings of Islam are shaped muamalah in Indonesia, the more the growth of Islamic banking and even various kinds of institutions of sharia also appear good in the form of islamic banking or non bank financial institutions in the form of sharia and one of these institutions is the Baitul Maal Wat Tamwil (BMT) from this background that emerges issues How is the legal position of treasury watamwil as financial and economic institutions in the community is not a bank and Any excess treasury wat tamwil compared with other financial institutions in the form of non bang sharia as for the method used in this paper is a normative research methods. Then after that lists several studies theories related to this problem include the theory of rule of law, justice theory and the theory of the enactment of Islamic law. later in the discussion presented on the definition of non bank financial institutions offensive sebahgian or some form of non-bank financial in the form of sharia among BMT coopertive sharia state its legal basis to determine the legal position of Islamic banks themselves in the discussion of the second half saw the advantages BMT itself compared with islamic financial institutions instead of another bank and it can be seen that the excess is other than in the form of financial management in the form of microeconomics is also engaged in social field with the aim to help the community (Ummah) who needs assistance such as charities or Called Amil zakat (CAZ) and other social activities and draw conclusions as the answer to the above problems

Abstract

Penelitian ini dilatar belakangi oleh prolifersai kewenangan Pemerintahan Daerah dalam membentuk Peraturan Daerah sangat luas tidak diiringi oleh fungsi sinkronisasi dan harmonisasi peraturan perundang-undangan yang optimal. Masing-masing pihak memiliki argumen yang kuat dalam mempertahankan suatu peraturan bernuansa agama. Akibatnya melahirkan situasi hukum yang serba multitafsir, konfliktual dan tidak taat asas yang pada ujungnya menciptakan tidak harmonisnya antara satu peraturan dan peraturan yang lain. Jenis penelitian ini adalah penelitian hukum normatif. Penelitian hukum normatif lebih mengutamakan studi pustaka (library research) dengan fokus kajiannya asas-asas hukum, sistematika hukum, sinkronisasi hukum dan sejarah hukum, penelitian ini juga bersifat deskriptif. Penelitian ini berkesimpulan bahwa, pertama, desentralisasi pengaturan kepariwisataan pasca Putusan Mahkamah Konstitusi Nomor 137/PUU-XIII/2015 memberikan kewenangan kepada pemerintahan daerah dalam membentuk produk hukum sangat luas. Kedua, Pemerintahan Daerah Provinsi Nusa Tenggara Barat kurang memperhatikan prinsip dan asas lex superior derogat legi inferiori dalam pembentukan Peraturan Daerah Provinsi Nusa Tenggara Barat Nomor 2 Tahun 2016 tentang Pariwisata Halal, hal ini terlihat dari materi yang diatur dalam Perda tersebut bernuansa agama, padahal agama adalah urusan absolut pemerintah pusat.

Abstract

Sex is a act that can make disturbing of importance balance in living society. Sex of criminal act have arranged in law dictionary of Indonesia, but isn’t fill moral values alive. In 284 KUHP section just arrange sex who to do by some one of still bunch of marriage. The consept in KUHP about sex is different with the living norm in Indonesia society that assumption of sex is copulation by the men or women who isn’t bunch of marriage. The use of method is research of legal formal. Subsequently, the research use law approach and concept approach. The result to the processed use invention of law, it mean examine living law in Indonesia society. Then, analyzed and concluded by deductive think. The resulting of research conclude that application of criminal law about morality act (sex) can be applied very well if always to consider values of law or norms that living in society. There for, repair Indonesia criminal law can to do by integrate all culture value that grow in Indonesia society.
