Abstract

Electronic agreements are increasingly used in online sales, platform services, online credit, and digital commercial transactions. Their binding force is commonly justified through pacta sunt servanda under Article 1338 of the Indonesian Civil Code. However, electronic agreements create problems that cannot be resolved by repeating classical civil-law doctrine alone, because electronic consent, standard clauses, authentication, electronic signatures, system reliability, and electronic evidence affect whether a digital agreement is valid, fair, enforceable, and provable. This article analyses how the binding force of electronic agreements should be interpreted under the Indonesian Civil Code, Law Number 11 of 2008 concerning Electronic Information and Transactions as amended by Law Number 19 of 2016 and Law Number 1 of 2024, Government Regulation Number 71 of 2019, and consumer-protection principles. It also explains the relevance of electronic agreements to police handling of digital transaction disputes and online fraud complaints. This study uses normative legal research with statutory, conceptual, and issue-based approaches. Primary legal materials include the Civil Code, the ITE Law and its amendments, Government Regulation Number 71 of 2019, and relevant rules on electronic evidence and standard clauses. The findings of this study demonstrate that electronic agreements bind the parties only when electronic consent is legally meaningful, the contractual clauses are not contrary to good faith or fairness, and the electronic system can support evidentiary reliability. In police practice, electronic agreements are relevant as initial evidentiary materials for distinguishing ordinary contractual default from online fraud. Thus, pacta sunt servanda in electronic agreements must be interpreted proportionally: it protects legal certainty, but it is limited by valid consent, good faith, consumer protection, system reliability, and evidentiary accountability.

Abstract

Police patrol is one of the crime prevention efforts that has long been implemented by the police institution. However, patrols should not be understood solely as routine operational activities; they need to be studied and developed to have a more effective impact on crime prevention. Therefore, revitalising police patrols is necessary, both in terms of the meaning of police presence in the community and in terms of their implementation, including utilising advances in information technology. The revitalisation of police patrols in Bandar Lampung City Police jurisdiction is implemented through Patroli Janji Jaga (Promise to Guard) innovation, consisting of jingle patrols and QR code patrols. Jingle patrols adopt the communication patterns of traditional street vendors, such as meatball or satay vendors, to signal to the public that police are nearby. Meanwhile, QR code patrols digitise conventional patrols by replacing patrol boxes in crime-prone locations with QR codes accessible to officers and the public. During the implementation, patrol officers conduct attendance checks and dialogue visits, and facilitate public participation through satisfaction surveys, complaints, and suggestions. This study aims to analyse the role and implementation of this revitalised police patrol as a crime prevention effort using Routine Activity Theory and Rational Choice Theory approaches. The research method employs a mixed-methods approach, and data are collected through observation, documentation, and QR code-based public satisfaction surveys. The results indicate that the revitalised police patrols have a strong theoretical basis and practical benefits in crime prevention, as well as increasing public safety and trust in police presence in public areas.

Abstract

The communal conflict in Ambon City between 1999 and 2002 produced lasting social, cultural, and spatial impacts that continue to shape local communities. Beyond casualties and physical destruction, the conflict generated material remains that became embedded in the post-conflict social landscape, actively shaping collective memory and security perceptions. This article develops a conceptual framework that integrates conflict archaeology, collective memory theory, and community policing paradigms into a unified model by defining one core construct from each field and stating five explicit propositions that link them. Using theoretical synthesis and a structured synthesis of Scopus- and Web of Science-indexed sources, supplemented by Google Scholar results, books, official reports, and policy documents, it constructs a conceptual argument for the relevance of conflict material remains as a strategic knowledge resource for community-based security management. The theoretical synthesis demonstrates that conflict material remains, including socially segregated areas, historical conflict sites, peace monuments, and post-conflict public spaces, function as repositories and transmitters of collective memory that are theorised to shape security perceptions and intergroup relations. By integrating Lefebvre's spatial triad, Nora's concept of lieux de mémoire, and Halbwachs's social frameworks of memory, this article develops the Conflict Archaeology-Based Community Policing Model as an original conceptual framework. The article calls for empirical testing of the model in Indonesian post-conflict regions, including Ambon, Poso, and Aceh.
