Abstract

Wakalah bil ujrah covenant implementation is an agreement covenant of an authority delegation to do something (delegating an affair) in which the implementation can be implemented in the field of wedding exertion by a wedding organizer. But generally, in the field implementation, the society has not been fully acknowledge and understanding how this implementation of an authority delegation in a wedding exertion accords with the the things which have been appointed by the syari’a economic law, and the legal consequences from the achieved wakalah agreement.The problems formulation of this thesis is how the form of the wakalah covenant implementation and also the system of the ujrah taking in the authority delegation of a wedding exertion by Shahira Wedding Organizer Surabaya and analyzing the implementation based on the syari’a economic law of the National Syari’a Board - Majelis Ulama Indonesia (DSN-MUI).This Study was conducted using online research instruments (online field research) with qualitative method. As for the data collecting techniques were done and achieved by online, observation, and the documentation data that are in correlate to the object of the study. The collected data, furthermore is arranged and analyzed using descriptive analysis method, it is describing how the akad wakalah bil ujrah implementation concept in obligating the authority the wedding exertion is done from the shahibbul hajat to Shahira Wedding Organizer Surabaya.The results of the research show that the wakalah bil ujrah covenant implementation in delegating the authority from the shahibbul hajat to Shahira Wedding Organizer Surabaya is done orally through the agreement in choosing the packages of Gumush, Altin, and Platin using simple statements (informal language) as the Surabaya’s people do. Furthermore it will be followed by some representation acts by the Shahira Wedding Organizer Surabaya. Dealing with the ujrah or the fee taking, it will be alocated and included into the price-list of the packages that automatically when it was on the first offer, the value of ujrah has been written and agreed. According to the perspective of the syari’a economic law, this wakalah bil ujrah practice done by the Shahira WO has fulfilled the well conformity in the implementation for the whole components between the both sides have been fulfilled in both of the pillars and the requirements that have been set by the Fatwa DSN-MUI No. 10/DSN-MUI/IV/2000 about wakalah.Keywords : Wakalah Bil Ujrah, Wedding Organizer and Syari’a Economic Law Perspective

Abstract

The agreement of a transaction is a prelimenary agreement before the main agreement (AJB) done in front of the PPAT. PPJB often causes a problem when the right of the land is treated as a commodity by the seller and it is not registered its changes in Agrarian Office. The registration may be done after the right of the land is changed into the lastest buyer.The approach of this research uses the approach of laws and the conceptual approach. The result of the analysis is concluded as the law protection of the latest buyer in accord with Government Regulations No. 24 of 1997 about the land registration, so that the Notary in maing PPJB has an obligation to pay attention to the principles of caution and the risks because of law concerning the document of the buyer.Key words : Agreement of transaction; document of transaction; the right of the land and the building.

Abstract

To know and tempeh trade that takes place in Laok Jang-Jang Kangean village has been practiced according to the habits that have been in place for a long time in the community. But Islam regulates its people on how to transact well between each other. All the work done should not go out of the way, so that no one feels harmed and no one feels remorse in the future. The problem in this study is how the trading practice system. To know and tempeh in Laok Jang-Jang KangeanSumenep Village and how to Implement Islamic Economic Law in Laok Jang-Jang KangeanSumenep Village. The purpose of this research is to uncover the problem of The Implementation analysis of Islamic Economic Law AgainstTempe To know-selling practices in Laok Jang KangeanSumenep Village.This research is field reseach that is analyzed using a qualitative descriptive approach. Samples are taken using total sampling that all sellers and buyers know and tempe so that this problem can be presented clearly, the research instruments used are interviews, observations and documentation. Data analysis is done through three steps, namely data reduction, data presentation, and withdrawal of conclusions or verification.  Based on research, it is known that the practice of buying and selling toy and tempeh that occurs in the villagers of Laok Jang-Jang KangeanSumenep. it has become a tradition where in trade transactions know and tempe that often only use purchase receipts even some are only by oral.Key Words:Islamic Economic System, Against Buying and Selling Practices

Abstract

This study was based on the assumption that Islamic concumption theory which existstoday is result from combination between conventional concumption theory and Islamicreligion theory. Conventional concumption theory has many limitations and incompatibilitywith Islamic teachings and ethics concumption. This study aims to build Islamic concumptiontheory through infak model. Infak model which is not only materialist, but shar'i, spiritualist,socialist, fair, moral and ethical is believed to be very compatible with the characteristics ofMuslim consumers. This study is a type of library study that requires philosophical andtheoretical studies that have to do with empirical facts. Results of study showed that Infak ofconsumption is an activity to spend wealth in an effort to fulfil the needs for the benefit of theworld and the hereafter. In infak of concumption activities, consumers must pay attention tolimitations that cover two important components, namely Islamic law and ethics. Then infakmodel explains the level of priority that is the theory of consumer decision making inspending wealth. Furthermore, the purpose of consumption in infak of consumption includestwo components; material satisfaction and prosperity in hereafter. Both components arecontained in a term called "maslahah".
