Abstract

Abstract

Mangrove forests are an ecosystem element that is beneficial to the community, especially in the coastal area of Binanga village, Sendana subdistrict, Majene regency. However, gradually the degradation of mangrove forests occurs which turns into community economic activities which indirectly erode the benefits of mangroves. The management and use of land in the mangrove forest area in Binanga village, Sendana subdistrict, Majene district, West Sulawesi province seems not to be optimal in managing spatial planning so that the mangrove vegetation is threatened with destruction. This research aims to provide an analysis regarding the regulation of coastal areas as mangrove conservation zones in Binanga village, Sendana District, Majene Regency. The type of research carried out is normative juridical with a statutory approach and a conceptual approach. The research results conclude that the policy of regulating coastal areas as mangrove conservation zones needs to be managed wisely and sustainably so that the impact of human activities can be controlled and some coastal areas are maintained for conservation. Apart from that, it is necessary to institutionalize mangrove resource management in Binanga village, by optimizing the role of the village government and establishing a Mangrove Forest Resource Management Institution (LPS-HM) in the village as a formal institution established by the Village Government.

The family of the woman as plaintiff filed a lawsuit for material and immaterial damages, but the lawsuit was declared indible by the Panel of Judges. In this study conducted an in-depth review of whether the plaintiff's lawsuit can be interpreted based on customary law, whether legal considerations and judge's rulings have been oriented to Buton customary law. Research uses normative research methods, with secondary data in the form of primary legal materials and secondary legal materials, as well as court rulings. Analysis of primary legal materials is carried out description, systematization, analysis, interpretation and assessing buton customary law. Legal considerations used by judges include relative competence which in essence the Labuha District Court is not authorized to examine and adjudicate cases a quo because previously customary deliberations have been carried out 3 (three) times in resolving aquo cases, which then imposed customary fines based on buton tribal customs. by indigenous buton tribal figures to Defendant, the reason Plaintiff is not a buton tribe but a kei tribe, therefore does not have the right to file a lawsuit for customary fines buton against Defendant so that the Plaintiff's lawsuit is wrong target, and Defendant is incomplete, there are still people who must act as Defendants or withdrawn Defendants and therefore the lawsuit contains error in persona in the form of plurium litis consortium , in the sense that the lawsuit filed is less.

Abstract

This research is conducted to compare literature regarding the regulation and implementation of leniency programs specifically against cartels in Indonesia. The Competition Law of Indonesia under Law Number 5 of 1999 concerning the Prohibition of Monopoly Practices and Unfair Business Competition does not regulate leniency programs. The United States, the European Union, Japan, South Korea, and Singapore have implemented leniency programs to combat cartels in their countries, and these have proven effective. These countries have made amendments to their anti-monopoly or anti-cartel regulations. Reflecting on these advanced nations, which have successfully implemented leniency programs, Indonesia could adopt such measures effectively. However, due to the absence of legislative regulations serving as a legal basis for leniency programs, implementation becomes challenging. Indonesia must be ready to accept and initiate a movement that can bring about changes to improve the legal system. Leniency programs to eradicate cartels are one of the ways forward for Indonesia, representing a positive new initiative.

Abstract

The government, through the Minister of Investment, has decided that religious organizations (ormas) are allowed to manage mines. This decision is stipulated in Peraturan Pemerintah (PP) Nomor 25 Tahun 2024 concerning Amendments to Peraturan Pemerintah Nomor 96 Tahun 2021 on the Implementation of Mineral and Coal Mining Business Activities. This policy was made as the government's effort to achieve economic justice and encourage the economic independence of ormas, enabling them to support their programs in education, social, religious, and cultural fields. In Law Number 3 of 2020, religious organizations were not specifically mentioned as entities that can be authorized to manage mining. In that law, the entities eligible for such authority are state-owned enterprises (BUMN), regional-owned enterprises (BUMD), cooperatives, and private companies. This study aims to analyze the legal aspects of granting mining business licenses (IUP) to religious mass organizations and to assess the feasibility of such organizations if the government grants them permission to manage mines. The study found that there are differences between Undang-Undang No. 3 Tahun 2020 on the Implementation of Mining Activities and PP No. 25 Tahun 2024. Additionally, from an economic perspective, religious organizations are not yet considered eligible to receive IUP because their main orientation is to promote freedom of speech and association, which contrasts with business objectives that prioritize profit and financial gain.

Abstract

From a legal perspective, this study examines the extent to which existing regulations, both at the national and local levels, support and accommodate the application of restorative justice in the context of land disputes. The analysis will include an in-depth study of Law Number 11 of 2012 concerning the State Administrative Court, Government Regulation Number 24 of 1997 concerning Land Registration, and relevant regional regulations. In addition, this study will also identify legal obstacles that hinder the application of restorative justice. The research method used is a qualitative method with a case study approach. Data collection was carried out through in-depth interviews with the disputing parties, community leaders, customary leaders, and law enforcement officers. In addition, this study will also analyze relevant legal documents and regulations. The results of this study are expected to contribute to the development of a more comprehensive understanding of the application of the principle of restorative justice in the context of overlapping land disputes in Merauke. The findings of this study are also expected to be the basis for the preparation of more effective policy recommendations in resolving land disputes in the future, while still respecting the rights of indigenous peoples and the principles of restorative justice.
