Abstract

Tax is a mandatory contribution for people who have fulfilled the entry requirements to become taxpayers. The tax is expected to improve the welfare of all people. The tax cannot be felt directly by the community. The implementation of tax collection must have a clear regulation. The purpose of this article is to determine the impact of tax collection in terms of the economy perspective; to know the impact of tax collection if viewed from a legal perspective; to know the impact of tax collection if viewed in terms of sociology. The results of the study indicate that Article 1 of Law Number 6 of 1983 in conjunction with Law 28 of 2007, the definition of tax is a mandatory contribution to the State owed by an individual or entity that is compulsory based on the Law, by not receiving direct compensation and used for State needs for the greatest prosperity of the people. Tax is one of the sources of government revenue. It means that the increase in tax collection directly increases government revenues. Thus, the tax has several functions, namely the function of the budget (budgetair) and the regulating of function (regurelend).

Abstract

In general, there are several factors that led to the occurrence of a crime. The first is the factor that comes to or contained within the offender that predispose a person to commit a crime that arises from within itself the perpetrator based on the heredity and psychological (mental illness). The second factor is the factor that originate or are outside the personal self perpetrator. Such as a person who committed a crime because of the influence of the outside of the perpetrator based on the household and environmental factors. In the legal order of the Republic of Indonesia does not exist that specifically regarding the crime of homosexuals so often the deviation homosexuals do so more and more of the homosexuals themselves.

Abstract

Indonesia has some varieties of ethnic groups that are rich in diversity of intellectual property, there are so many products produced by society. The society creations especially created by the community are assorted, one of them is Paoman Batik. Thre are two kinds of Paoman Batik, those are contemporary and traditional, which is distinguished by its motives, processes, creators. The Paoman Traditional Batik is well-known to the public than contemporary. This research has supported the creators or copyright holders to get higher benefits, both the benefits of moral and economic rights. The main problem is, first, is the current intellectual property rights regime able to provide the foundation for the protection of Paoman Traditional Batik? Second, is the UNESCO's determination that stated if batik is a world heritage, non-object from Indonesia, can be used as the foundation to charge the economic rights of Paoman Traditional Batik? Third, is it possible for Traditional Batik, including Paoman Traditional Batik, to be carried out through other regimes, in addition to the intellectual property regime? Fourth, how is the effect of Paoman Traditional Batik Registered at the Directorate General of Intellectual Property of Indonesia on the Progress of Indramayu society? The research method used is descriptive specification, by using juridical empirical approach, which focus on secondary research consisting of legal materials, both primary, secondary and tertiary. However it is supported by primary data generated from field research through in-depth interview and survey techniques. The analysis used is descriptive analysis. The results of the study show that intellectual property rights that is copyright cannot be made as the foundation of protection against the creation of society that have traditional and communal motives, including the Paoman Tradsional Batik. The establishment of Batik by UNESCO as a non-object world heritage from Indonesia has increased the moral rights of Indonesia, but it also cannot be established as the foundation for restoring economic rights when there is a misappropriation. Another alternative to intellectual property is through the Sui Generis regime, which specifically addresses the protection of community rights, including intellectual property rights.

Abstract

Indonesia as an archipelago has a very rich diversity of cultural arts. This is in line with the diversity of ethnicity, trabs and religion as a whole is a national potential which needs to be protected. After the enactment of Law No. 19 of 2002, the creators in the field of literature and science received legal protection so that it is no longer turned off the creativity of its employees. Normatively, if there is piracy, the sanctions imposed are very severe, namely a seven-year prison sentence and / or a maximum fine of IDR 5,000,000,000.00 (five billion rupiah). In fact, piracy is still ongoing. The current development of piracy is due to law enforcement carried out by law enforcement officers in this case the police are not carried out thoroughly and thoroughly, or in other words run half-heartedly so that there is no single case of piracy in the film sector that can be used as jurisprudence

Abstract

Many problems concerning food occur in Indonesia, we encountered food circulating in the community who do not heed the provisions on labeling, thus disturbing the public. Food trade expired, the use of dyes that are not intended for food, formalin, foods containing preservatives, or acts of other consequence is very detrimental to the community, it can even threaten the health and safety of human lives, especially for children in general, this cas ususally through of fraud on the food label. label is falsified or misleading adverse effects on human health and development.

Abstract

The term citizenship is intended for citizens who already have their citizenship status, namely Indonesian Citizens, the vast territory of Indonesia is related to citizenship, many of which claim to be citizens, but in their citizenship status is unclear, even though in the positive Indonesian legal order Law No. 12 of 2006 states the conditions for someone to become an Indonesian citizen and that is not difficult. The purpose of this article is to report about the naturalization of legal procedures for dual citizenship related to the case experienced by Arcandra Tahar. Arcandra Tahar's citizenship case experienced by Arcandra Tahar is a unique case where each country has different rules and uses different principles to apply the rules of citizenship status in its country, Arcandra becomes an Indonesian citizen again after being dual citizenship. He became an Indonesian citizen through revelation and still wanted to become an Indonesian citizen and the submission of his American citizens' revocation.

Abstract

Keterbatasan transportasi umum membuat sebagian masyarakat lebih memilih untuk membawa kendaraan pribadi dalam melaksanakan aktivitas sehari - hari seperti sepeda motor. Pembelian sepeda motor yang mudah didukung dengan hadirnya lembaga pembiayaan konsumen dengan jaminan fidusia sebagai prosesnya, membuat masyarakat mudah untuk membuat perjanjian dengan lembaga pembiayaan. Walaupun perjanjian yang dilakukan adalah perjanjian baku yang telah dibuat oleh lembaga pembiayaan konsumen dalam bentuk formulir dimana konsumen hanya tinggal menandatangani perjanjian tersebut tanpa mengetahui akibat jika melakukan wanprestasi seperti keterlambatan pembayaran angsuran. Dalam hal ini menjadi permasalahan ketika lembaga pembiayaan konsumen kerap kali melakukan tindakan penyitaan atas sepeda motor yang di angsur oleh konsumen yang biasanya dilakukan oleh pihak ketiga yang diberikan kuasa oleh lembaga pembiayaan konsumen, yaitu melalui jasa debt collector. Penelitian ini merupakan penelitian hukum dengan menggunakan metode pendekatan yuridis normatif dan spesifikasi penelitian deskriptif analistis. Data yang digunakan dalam penelitian ini adalah data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Data yang diperoleh melalui studi kepustakaan dan penelitian lapangan yang berupa peraturan perundang - undangan, buku, jurnal, dan media elektronik. Penelitian ini terdiri dari 2 (dua) hasil yaitu Pertama, Tindakan lembaga pembiayaan konsumen yang melakukan penyitaan sepeda motor, merupakan tindakan yang tidak sah karena klausula yang menyatakan hak-hak lembaga pembiayaan untuk melakukan tindakan tersebut adalah batal demi hukum sebagaimana diatur dalam ketentuan Pasal 18 Ayat (3) UU 8/1999 tentang Perlindungan Konsumen. Kedua, tindakan proses eksekusi yang harus dilakukan satu – satunya cara yaitu dengan cara mengajukan gugatan perdata ke Pengadilan Negeri melalui proses hukum acara yang normal hingga turunnya putusan pengadilan. Inilah pilihan yang prosedural hukum formil agar dapat menjaga keadilan dan penegakan terhadap hukum materiil yang dikandungnya.

Abstract

The world of banking in Indonesia began to show its concern for environmental problems through various banking activities known as Green banking. Green banking is a program for a financial institution that makes sustainability a top priority in its business. Currently banks that have pledged green banking are required in OJK Regulation Number 51 / POJK.03 of 2017 concerning the Implementation of Sustainable Finance for Financial Service Institutions, Issuers and Public Companies to report on the results of implementing green banking. This writing discusses how the legal consequences of the implementation of green banking for banking business activities in Indonesia after the enactment of POJK Number 51 / POJK.03 in 2017 concerning the Implementation of Sustainable Finance for Financial Services Institutions, Issuers and Public Companies and how OJK conducts supervision. This study is a legal research using a normative juridical approach and descriptive analytical research specifications. The data used in this study are secondary data consisting of primary, secondary and tertiary legal materials. Data obtained through library studies and field research in the form of legislation, books, journals, and electronic media. The findings of this study are 2 (two) explanations namely First, the legal consequences of the implementation of green banking in banking business activities in Indonesia in realizing sustainable development have not been able to be carried out due to banks and financial services institutions both banks and non-banks do not yet have specific guidelines or references governing this green banking. Second, the obligation for banks that have pledged green banking is to provide insurance for the environment, considering that banking business activities also include insurance referring to Article 7 of the Banking Law. OJK has actually launched environmental insurance, but the Indonesian government has not responded to anything that has been conveyed by the OJK. The reason for the government according to the OJK informants is that the development of a little more would certainly damage the environment, so that environmental insurance is impossible in Indonesia.

Abstract

At present many foreign investment contracts are made by the State subdivisions and State companies on one side with foreign private companies on the other. For countries that want to carry out a lot of business contracts in the field of foreign investment, which of course must provide stimulating incentives for investment, including the provision of supervision of foreign companies, because foreign investment means getting knowledge, experience, technical and managerial fields. The main considerations of foreign investment to carry out business contracts are basically their market expansion, besides the low production costs due to relatively cheaper labor costs, tax-free facilities (tax holidays) and other facilities free of charge by the capital receiving countries ( host states).

Abstract

The existence of a central bank is also needed to regulate and supervise banks so that their activities can develop healthy and run smoothly so that it can encourage economic activities. This is considering that the existence of an impartial regulator will bring banks to carry out their operations efficiently and be able to advance economic development. In the interbank payment system, Bank Indonesia has the duty to regulate and maintain a smooth payment system. Including the problems that occurred in the case of Bank Bali, the task of Bank Indonesia as an institution that regulates and maintains a smooth payment system between BDNI and Bank Bali.
