Abstract

This study was carried out in Subang which has many places of prostitution. The objectives of the research are: (1) review the practices of prostitution phenomenon that occurs in Subang (2) assessing the implementation of legal counseling with religion basis in preventing the practices of prostitution (3) designing a legal counseling model based on religion in preventing practices of prostitution. The result of research has showed that there is an indication of religion lack of influence activity in the prostitution localization caused by several things: (1) the influence of religious activity in the prostitution localization is being ignored by the local community. (2) the lack of religion tolerance still occur in the brothel. (3) the lack of localization prostitution citizens on religious activities in mosques. (4) the conversion of prostitute still look forced, not because there is no intention to stop repeating the job.

Abstract

Tax is a mandatory contribution for people who have fulfilled the entry requirements to become taxpayers. The tax is expected to improve the welfare of all people. The tax cannot be felt directly by the community. The implementation of tax collection must have a clear regulation. The purpose of this article is to determine the impact of tax collection in terms of the economy perspective; to know the impact of tax collection if viewed from a legal perspective; to know the impact of tax collection if viewed in terms of sociology. The results of the study indicate that Article 1 of Law Number 6 of 1983 in conjunction with Law 28 of 2007, the definition of tax is a mandatory contribution to the State owed by an individual or entity that is compulsory based on the Law, by not receiving direct compensation and used for State needs for the greatest prosperity of the people. Tax is one of the sources of government revenue. It means that the increase in tax collection directly increases government revenues. Thus, the tax has several functions, namely the function of the budget (budgetair) and the regulating of function (regurelend).

Abstract

The term citizenship is intended for citizens who already have their citizenship status, namely Indonesian Citizens, the vast territory of Indonesia is related to citizenship, many of which claim to be citizens, but in their citizenship status is unclear, even though in the positive Indonesian legal order Law No. 12 of 2006 states the conditions for someone to become an Indonesian citizen and that is not difficult. The purpose of this article is to report about the naturalization of legal procedures for dual citizenship related to the case experienced by Arcandra Tahar. Arcandra Tahar's citizenship case experienced by Arcandra Tahar is a unique case where each country has different rules and uses different principles to apply the rules of citizenship status in its country, Arcandra becomes an Indonesian citizen again after being dual citizenship. He became an Indonesian citizen through revelation and still wanted to become an Indonesian citizen and the submission of his American citizens' revocation.

Abstract

The Regency of Indramayu has been stigmatised as a land of trafficking of women and children, not only at national level, but it has also transcended overseas. This research is aimed to seek deeper into the perspective of the victims from Bongas, Indramayu regarding their involvement in the trafficking. This research employed case study method and field observation based on descriptive-analytical approach. This research reveals that the majority of the people in Indramayu are living in the breadline, and they are mostly poorly educated. Women in Indramayu are even denounced as the breadwinner, or locally called as “luruh duit” or rushing for money, and this term is inappropriately interpreted; women are burdened with the responsibility to raise the economic status of the families by working in big cities. The culture of earning money by migrating to big cities is seen as a chance for human trafficking. This research also suggests some strategies such as co-assisting and developing the program to identify, rehabilitate, and reintegrate the victims of the crime.

Abstract

Efektifitas lapas dalam menanggulangi tindak pidana teroris memunculkan pertayaan serius apakah efektifitas lapas pembinaan narapidana saat ini masih relefan atau tidak.Berbagai permasalahan yang kemudian menjadi akar dari permasalahan lainnya kemudian melemahkan fungsi lapas sebagai institusi perbaikan sosial masyarakat. Penelitian ini bertujuan untuk mengetahui (1) efektifitas pemberdayaan lapas klas lll gunung sindur Bogor, (2) model pembinaan narapidana di masa mendatang.Penelitian ini menggunakan metode yuridis empiris.Data sekunder dari perundang-undangan dan data kepustakaan yang berkaitan dengan terorisme,data primer didapatkan melalui Focus group discussion (FGD). Hasil yang didapatkan dari penelitian ini menunjukkan bahwa masih terdapat permasalahan pada sejumlah aspek pengelolaan seperti rasio petugas lapas dan narapidana dan kurang optimalnya implementasi berbagai program pemberdayaan dalam mempersiapkan proses asimilasi di masyarakat.

Abstract

Community Based Correction is a type of coaching program for inmates as they live the rest of the sentence. They have been given the chance to return to society with a particular control or supervision. To implement the necessary operational program open prison five (5) basic principles, among others: the first principle prisoners should have the opportunity to obtain employment, the principle of the two prisoners must be selected first, third principle inmates should not be exploited, the fourth principle of security system should be a minimum, and The fifth principle of the transfer of responsibility for prisoners. Community Based Correction adalah jenis program pembinaan bagi narapidana sewaktu mereka menjalani sisa pidananya. Mereka diberi kesempatan untuk kembali ke tengah-tengah masyarakat dengan pengawasan atau supervisi tertentu. Untuk melaksanakan program operasional lapas terbuka diperlukan 5 (lima) prinsip dasar, antara lain: prinsip pertama narapidana harus memiliki kesempatan untuk memperoleh pekerjaan, prinsip kedua narapidana harus diseleksi terlebih dahulu, prinsip ketiga narapidana tidak boleh dieksploitasi, prinsip keempat sistem pengamanan harus minimum, dan prinsip kelima tanggung jawab pemindahan narapidana.

Abstract

Drug abuse is a significant problem, various rehabilitation efforts are carried out at the Cirebon Class IIA Narcotics Penitentiary, one of which is by using therapeutic communities to provide expectations of drug abuse inmates. The problems studied in this research are related to the rehabilitation of prisoners and their implications with the therapeutic community method at the Cirebon Class IIA Penitentiary. This research is empirical research that uses survey methods, observations, interviews, and literature studies. The data obtained are collected and analyzed qualitatively by analytical descriptive methods. The results showed that the therapeutic community can be implemented optimally but is still faced with the first problem therapeutic community has not been focused on the fundamentals of the resident's addiction and the second problem is that the resident is still faced with having to fight his mind with the effects of the relapse he feels.Keywords: Coaching, Therapeutic community, Relapse.

Abstract

In the development of the prison system in the world, the element of religiosity has become a vital value that has a significant impact on changing the behavior of criminals in prison. Therefore, in a number of prisons in the world, religious-based reform activities are the main aspect in the effort to reform prisoners’ behavior. This study aims to analyze the impact of implementing religion-based reform programs in Indonesian prisons. The method used in this research is a qualitative method, with a case study approach. The sample used is a number of prisons in Indonesia that implement a religion-based reform program in order to encourage changes in the behavior of inmates in prison. Data was collected by using open interview techniques and time recording observations to produce comprehensive data and be able to provide a holistic picture. The results of this study indicate that the religion-based prisoners reform program shows significant impacts on prisoners’ behavioral change, which is indicated by the low recidivism rate in ex-convicts underwent religion-based reform programs during their sentence, the decreased rate of violence in prisons, and the increasing number of prisoners who receive remissions for good behavior after undergoing a religion-based reform program

Abstract

Abstract This overcrowding problem has become a very difficult problem to solve and occurs continuously in almost all correctional institutions in Indonesia. This research was conducted using a qualitative descriptive method by taking analytical techniques, namely literature studies combined with field observations and interviews. Based on this research, it is known that the overcrowding problem is caused by several factors such as problems with imprisonment policy, lack of alternative non-prison punishments, and over criminalization. The implications of overcrowding cases in the majority of detention centers and correctional institutions in Indonesia include the decline in the physical and mental health of prisoners, high cases of sexual violence in prisons, high suicide rates in prisons, and the consistency of increasing government budgets for finance penitentiary. Based on the findings related to the implications of overcrowding in Indonesia, efforts that can be made to overcome them are by implementing non-prison restorative programs such as community-based correction or open prisons equipped with work briefings to optimize the assimilation function. Abstrak Permasalahan overcrowding ini telah menjadi permasalahan yang sangat sulit untuk dipecahkan dan terjadi secara terus menerus di hampir seluruh lembaga pemasyarakatan di Indonesia. Penelitian ini dilakukan dengan menggunakan metode deskriptif kualitatif dengan mengambil teknik analisis yaitu studi literatur yang dikombinasikan dengan observasi lapangan dan wawancara. Berdasarkan penelitian ini, diketahui bahwa permasalahan overcrowding disebabkan oleh beberapa faktor seperti permasalahan pada kebijakan pemenjaraan, kurangnya alternatif hukuman non-penjara, dan over criminalization. Adapun implikasi yang ditimbulkan dari kasus overcrowding di mayoritas rumah tahanan dan lembaga pemasyarakatan di Indonesia antara lain adalah menurunnya kesehatan fisik dan mental narapidana, tingginya kasus kekerasan seksual di dalam lembaga pemasyarakatan, tingginya angka bunuh diri di dalam lembaga pemasyarakatan, dan konsistensi peningkatan anggaran pemerintah untuk membiayai lembaga pemasyarakatan. Berdasarkan temuan terkait implikasi overcrowding di Indonesia, maka upaya yang dapat dilakukan dalam mengatasinya adalah dengan mengimplementasikan program-program restoratif non-penjara seperti community-based correction atau penjara terbuka yang dilengkapi dengan pembekalan kerja untuk mengoptimalkan fungsi asimilasi.

Abstract

The involvement of women in various aspects of life, both socially and economically, has exposed the potential for criminal behaviour among women. This situation has led to the phenomenon of women's involvement in criminal acts commonly associated with men, such as robbery, murder, organized crime, and human trafficking. Poor social and economic conditions tend to be triggering factors and solid reasons for women to engage in criminal activities. This background has become the basis for the increasing number of women in prison in Indonesia, opening the possibility of various forms of violence within women's prisons. This presents a significant challenge for the management of women's prisons in optimizing the reintegration system due to the escalation of significant demotivation resulting from the violence experienced by female inmates, both among themselves and with prison staff. This research employs an exploratory qualitative approach, focusing on women involved in criminal cases and sentenced to prison. Primary data from interview results are descriptively analysed, producing a comprehensive, authentic, and representative narrative. The findings of this study indicate that the concept of punishment in Indonesia still emphasizes punitive functions over corrective functions, where both physical and mental violence are considered effective forms of punishment, especially for women. Violence occurring within women's prisons is then negatively responded to and becomes a driving factor for the decreased interest of female inmates in succeeding in the reintegration program. This reluctance then triggers a negative response from the staff in the form of violence against female inmates. A solution to mitigate violence in women's prisons is the placement in open prisons, with the involvement of independent external parties in both the supervision process and the implementation of reintegration programs to achieve an inclusive and constructive effect for all parties involved.
