Abstract

The study concluded that: first, the policy taken by the head  of the KUA Kecamatan Ratu  Samban suscatin services was related  to schedule  the execution of suscatin,  providing  a free service to any  of the participants suscatin,  implement  the suscatin for 2 hours with priority material pertaining  to marriage  and households only. Second, the implementation of suscatin in KUA Kecamatan Ratu   Samban held as much  as 2 times in a week, namely  on Thursday. Participants who follow suscatin at KUA Kecamatan Ratu  Samban average each  week 2 – 3 couples  or 8 – 12 pairs per month. The material  provided among others the procedures for marriage, wedding,  Fiqh rules on marriage  and the family, the rights and obligations of husband and wife and family concepts  of sakinah  is given by using the method of lecture and question and answer.  The bride gives a varied response associated with the Government’s policy to hold suscatin to every bride. Third, the evaluation of the implementation of the suscatin  in the Subdistrict  of Ratu   Samban KUA is already  well underway in accordance with the tasks and  functions primarily in the service of marriage  guidance to society. Implementation of the suscatin Sub-district office KUA Ratu  Samban quite effective and successful in adding  to the knowledge  and insight of the bride that will foster household. Suscatin be a posi- tive effort in provide  knowledge  to the prospective bride and  groom.  This is an attempt  to prevent  early on things which can disrupt home  life in order not to divorce occurs

Abstract

Abstract: Decision On The Case Study Ofhadhanah Viewed From The Law On The Protection Of Children. Fiqh scholars agree that the laws of caring for and educating children is mandatory, because if it is not cared for and well educated, will reflect badly on themselves, can even lead to losing their lives. In the case ofhadhanah decision No.34 / Pdt.G / 2014 / PA.Crp and No. 16 / Pdt.G / 2015 / PA.Crp hadhanah has granted to the mother, but the basic of its legal consideration is vary. These Differences will be recorded, analyzed philosophically and normatively. This paper will examine how the consideration of judges in deciding cases ofhadhanah No. 34 / Pdt.G / 2014 / PA.Crp and No. 16 / Pdt.G / 2015 / PA.Crp terms of Act No. 23 of 2002 on Protection of Children and legal settings. This research is a normative legal research with qualitative methods in the form of literature studies. The approach used in this study isstatute approach and case approach. Data were analyzed using comparative analysis. The results of this study indicate that in case the decision ofhadhanah No. 34 / Pdt.G / 2014 / PA.Crp and case No. 16 / Pdt.G / 2015 / PA.Crp, judges tend to pay less attention to consideration of the regulations to the Act No. 23 of 2003 on Protection of Children Jo No. 35 of 2014 regarding Child Protection. Legal arrangements in the settlement of hadhanah isverzet, appeal, and need to be applied mediation and dwangson that the defendant is willing to fulfill his promise.

Abstract

Tujuan penelitian ini adalah untuk menjelaskan dan menganalisa pandangan fiqh klasik terhadap usia minimal kawin, landasan filosofis penentuan batas usia minimal kawin dalam Undang-Undang Perkawinan Nomor 1 Tahun 1974, serta analisis tinjauan maqȃshid asy-syarî’ah terhadap pembatasan usia minimal kawin menurut Undang-Undang Perkawinan. Jenis penelitian adalah studi pustaka. Pendekatan penelitian yang digunakan adalah pendekatan kualitatif. Teknik pengumpulan data yang peneliti lakukan adalah teknik kepustakaan. Hasil penelitian adalah bahwa dalam fiqh klasik tidak ditentukan secara jelas dan tegas mengenai batas usia minimal. Begitu pula dengan penafsiran kriteria dewasa menurut undang-undang. Landasan filosofis penentuan batas usia minimal kawin yang terdapat dalam Undang-Undang Perkawinan Nomor 1 Tahun 1974 memiliki latar belakang yang panjang dan dipengaruhi oleh unsur (tuntutan) seperti sosialpolitik, budaya, ekonomi dan agama. Sedangkan analisis tinjauan maqȃshid alsyarî’ah terhadap pembatasan usia minimal kawin menurut undang-undang perkawinan dari sudut pandang kulliyat al-khamsah (lima prinsip umum) Maqȃshid Al-Syarî’ah pembatasan usia minimal kawin terkait dengan memelihara agama, jiwa, dan keturunan. Dalam memelihara agama, menikah adalah salah satu bentuk menegakkan syiar-syiar Islam. Dalam hal memelihara jiwa, maka sejalan dengan prinsip yang diletakkan UU Perkawinan. Serta dalam hal memelihara keturunan maka, Islam mengaturnya dengan cara mensyariatkan pernikahan dan mengharamkan zina.

Abstract

After the issuance of the decision of the Constitutional Court Number  46/PUU-VIII/2010, Article 43 of Law Number  1Year 1974 concerning Marriage which originally stated that the married child has only a civil relationship with his mother and his mother’s  family, has blood  relation  including  civil relationship with father his biological and his father’s family although there  must  be recognition or can  be proven  on the basis  of science and  technology and/or  other  evidence. The decision of the Constitutional Court can  be seen from two sides,  namely  the protection of the rights of the married child, and  the conformity  of the  understanding of the  child outside of marriage according to Islamic  law, because according to Islamic law the  child outside marriage should  not at all have  a nasab relationship with his biological  father.  Based  on the  above background, this research reveals  two issues,  firstly how the legal power  of the Constitutional Court decision regarding the outsider marriage perspective of Law Number  35 year 2014 on Child Protection. Second, what is the conformity between the Constitutional Court decision No. 46/PUU-VIII/2010 concerning the married child against the provision of an outsider from the perspective of Islamic law. This type of research is normative juridical research or library research which  is then described descriptively.  The results of this study conclude that the legal force of the Constitutional Court decision is binding (final and binding).  Recognition  of the rights of children  outside marriage shall be exercised by all parties  concerned, in accordance with Article 59 paragraph 2 letter o Law No. 35 of 2014 on Child Protection, that every child has the right to survival, growth and development and is entitled to protection from violence and discrimination, including special protection to children  who are victims of stigmatization from labeling related to the condition of their parents. Meanwhile,  if you look at the provisions in Islamic law, the decision of this Constitutional Court should be adjusted to the understanding of children  outside marriage in Islamic law, because the Constitutional Court decision is a law made man,  while Islamic law is a law that comes from Allah SWT. It is also important to revise Article 2 paragraph (2) on the provision of marriage registration as a legal marriage requirement to be only an administrative requirement. “Outer Child Marriage, Constitutional Court and Islamic Law”.

Abstract

In this research  there  are several  problems  1). How the rights and  obligations  of parents  to children  online  game addicts. 2). How to review Islamic law against children online game addicts at Warnet BM Jalan  Salak Raya, Bengkulu City. To answer  the problem  of research  above  conducted field research  (field research)  using qualitative  descriptive approach method. The data  collected by observation method, interview and documentation, from the source of the informant  that the author  set based  on purposive sampling.  The results of the study explain,  first Rights and  obligations  of parents  to the child has not been done  due to various factors, among  others,  busy work so that the lack of attention to children who cause  children abandoned. Second  Every child should  be good  and  obedient to the parents. The child is not justified in being  abusive  to both  parents. Therefore, every child must have  obligations  and  responsibilities  to parents  who have  raised  and  nourished them  from child- hood  to adulthood. Children should keep the rights of parents, children should also maintain morals as stock in running  Ikhsan against both parents

Abstract

This study raises the issue of implementation inheritance practices in society Kepahiang District of Kepahiang. So the urgency to fix the system of inheritance which has become a tradition for generations was considered good by most people Kepahiang to return it to the Islamic inheritance in order to create a qualified Muslim community. The purpose of this study (1) To investigate the implementation of the community Kepahiang inheritance; (2) To identify the background on which to base  the distribution of the next of kin; (3) To analyze  the views of Islamic law on inheritance practices implementation in society  Kepahiang and  add  related intellectual treasures of Islamic  heritage. This study uses  content analysis  (content analysis),  with a historical-normative approach. The results  showed that (1) In general  practice division of the estate made by the people Kepahiang is with individual bilateral  inheritance system  through  the deliberation and peace, this is done  to anticipate disputes among  heirs and to the achievement of welfare. It is also a habit of going on and practiced repeatedly and well-regarded in the community, while the comparison section received between heirs male and female heirs depending on the results  of consultation with emphasis on the principle  of mutual  benefit  and willingly accept any portion  thereof,  more often equally or 1:1; (2) The basis for the implementation of the division of inheritance in Kepahiang society is based on its own  traditions  that have been embraced for generations. Although there  are based on the Islamic inheritance, only when executing by way of inheritance Islam, then the disagreement / dispute they choose to implement with the tradition that has been handed down it; (3) The distribution of inheritance in the District Kepahiang society Kepahiang using a system of equal division is not in accordance with Islamic  law, because the  procedure of distribution carried out by dividing the  average whole  inheritance to the  heir on the  legal basis  is very weak.  But the  practice of the  division of the  estate in the  District Kepahiang society can be viewed  as the result of social construction, but in this Islamic regards  the division of inheritance practices such as ‘urf fasid because it is contrary to the text (Nash) of syariat. Especially if the grounds  of gender equality that will bring destruction and not in line with the objectives of the estabilishment of syari’at.

Abstract

Criminal Sanctions for Violator of Sexual Abuse Against Children by Act no. 23 years 2002 and Islamic law (Study of Bengkulu Court Decision no. 185 / pid.b / 2013 / PN.BKL). This study analyzes the Bengkulu District Court judge’s decision in a criminal case of sexual abuse against children Number: No. 185 / Pid.B / 2013 / PN.Bkl terms of the Act. 23 of 2002 and the law of Islam. Using qualitative research methods, types of legal normative juridical, with the approach of legislation, case approach and conceptual approach through the study of literature and documentary studies. The results showed that the execution of criminal sanctions against the perpetrators of sexual abuse of children, according to Law. 23 of 2002 as amended by Law No. 35 of 2014 on the protection of children can be carried out by a panel of judges to apply Article 82, if the defendant proved to meet the elements of objective and subjective elements, while the implementation of Islamic law can be applied ta’zir criminal sanction, namely the legal sanctions established by judges / legal government, Then the decision handed down by the judges on the Bengkulu District Court case number: 185 / Pid.B / 2012 / PN.Bkl, has been proven legally and convincingly guilty of committing the crime of sexual abuse of children as stated in Article 82 of Law No. 23 of 2002 to convict four years in prison and a fine of 60,000,000, - (sixty million rupiahs), while in Islamic law, perpetrators of abuse may be subjected to caning (jild) or more can create a deterrent effect and the pain is not too long with the purpose of providing education/ teaching (ta’dib) and prevention (zajr).

Abstract

The study aims to answer  the question of how the role of BAZNAS Rejang Lebong  Regency in  implementing Law no. 23 of 2011 on the collection and distribution of zakat. How is the impact of the implementation of Law no. 23 Year 2011 on the management of zakat ?. And What are the constraints and strategies facing BAZNAS Rejang Lebong Regency in implement- ing the Act on the management of zakat ?. This research  is a qualitative  research  using research  approach, phenomenological, sociological and  historical approach. This research  uses field research  type (field research), that is a research  conducted inten- sive, detailed  and  deeply  to a certain  object.  Data  Collection  Techniques This research  is primary  data  and  secondary data. In accordance with the characteristics  of empirical  legal research   using  secondary  data   as  the   initial  data  obtained  from primary   and  secondary legal materials,  then  continued with primary  data  or field data  obtained from documents, interviews and  observations. The results showed;  First, that the implementation of Law no. 23 Year 2011   in  the  management  of zakat has  run  optimally  in  accordance with  the mandate of the Act. Second, the implications of the implementation of the Law on the management  of zakat  has given a positive effect. Proven  with ZIS  funds received  in 2012-2016 there  is an increase  and ZIS funds have been distributed to mustahiq. Thirdly, the obstacles faced by BAZNAS Rejang Lebong Regency in implementing the Zakat Law are: (a) The absence of sanction  for muzakki not paying zakat, (b) Some people  consider  BAZNAS Kab. Rejang Lebong  is the same  as a community organization, whereas  BAZNAS is the official government institution   regulated  by  law. (C)  There   are   still  many   people   who   are   less concerned about  the obligations  of zakat and  the lack of zakat awareness through  an institution.  (D) Most Dhuafa  ‘consider BAZNAS’s assistance  as consumptive. The Strategy pursued by BAZNAS in the management of zakat are: First, BAZNAS cooperates with Rejang  Lebong  Regency  Government  so  that  it is issued Lo- cal Regulation and Regulation of Bupati. Secondly,  BAZNAS’s effort in managing ZIS is by way of socialization and cooperation with religious leaders  and   community  leaders.   Thirdly,  Mustahiq   who   is  reluctant   to  return   t he productive  zakat funds then for the fund the continuation is not given anymore

Abstract

Tujuan dari penelitian ini untuk mengetahui implementasi Undang-undang Nomor 23 Tahun 2011 dan Peraturan Menteri Agama Nomor 52 Tahun 2014 terhadap pendayagunaan zakat produktif pada fakir miskin di  Kecamatan Kampung Melayu Kota Bengkulu dan mengetahui faktor-faktor yang mendukung dan menghambat. Jenis penelitian ini adalah penelitian lapangan (field research) yang menggunakan pendekatan kualitatif deskriptif. Data didapat dari observasi, wawancara dan dokumentasi. Dalam penelitian ini menggunakan teknis analisis data model Miles dan Humberman. Adapun hasil penelitian ini: 1) implementasi Undang-Undang Nomor 23 Tahun 2011 dan Peraturan Menteri Agama Nomor 52 Tahun 2014 terhadap Pendayagunaan Zakat Produktif Pada Fakir Miskin di  Kecamatan Kampung Melayu Kota Bengkulu  belum sepenuhnya terlaksana        2) faktorfaktor yang mendukung yaitu pinjaman dari zakat produktif bisa untuk menambah modal usaha mereka, mustahiq memiliki kesadaran yang cukup tinggi untuk berinfaq dan bersadaqoh sedangkan faktor-faktor yang menghambat yaitu : jumlah pinjaman dari zakat produktif ini belum mampu untuk mengembangkan usaha para mustahiq, belum adanya pendampingan secara rutin dan berkala dan belum adanya pemberdayaan kelompok.

Abstract

The considerations of the Panel of Judges  in the first instance of the courts (High Religious Court of Bengkulu) are: 1) Frequent quarrels and quarrels between  husband and wife are not solely due to the mistakes of the wife, but also because there is no mutual  understanding between  the two parties.  2) The evidence  submitted in the form of photographs and  statements of witnesses is not sufficient to prove the behavior of nusyuz of the wife because it is not equipped with other supporting evidence.3) Criminal acts of corruption committed  by the wife can not be used as the basis of the assessment that the concerned has acted and behave nusyuz, not directly related to the rights and duties between  husband and wife in household affairs. 4) The wife likes to indebted to a third party without the knowledge  of her husband can not necessarily be the legal basis that the concerned has acted nushyuz. Because  there is only one evidence  that explicitly indicates that the concerned has paid off the wife’s debts, while other evidence  shows the wife who has paid off its own debts.  5) The occurrence of separation of residence between  husband and wife is not because the wife has left the place of residence without the applicant’s / appealed permission,  but the separation of the applicant’s / appellate residence has surrendered his wife to his parents  in a kinship and good manner. 6) During the sepa- ration of the house  because of repatriation to the home  of her parents, the wife remains  obedient to the wishes of the applicant/ comparable is to remain  settled in the home  of his parents. 7) The wife as the plaintiff of reconvention is not proven  to act and behave nusyuz as the opinion  of the court of first instance.  So that he remains  legally entitled to get the rights as a devout  wife to the husband. 8) During the separation of the husband’s dwelling only performs  the obligation  as a father to his childre.that is transfer to the savings account of his children.  Second, in terms of the jurisprudence
