Abstract

Abstract: Greeting Of ‘Merry Christmas’ By Muslims To Christians In Islamic Perspective. The greeting of ‘Merry Christmas’ is usually pronounced when the Christian welcome the birth of Jesus. In Indonesia, there are still differences of opinion on whether or not allowed for Muslims to say ‘Merry Christmas’ to Christians as a form of respect and tolerance for the Christians. Some ulema are strictly prohibiting to greet Christian by saying ‘Merry Chirstmas’ because this act is a part of religious rituals, and others allow it with certain terms and conditions. To clarify the Islamic legal regarding the greeting of ‘Merry christmas’, this article will explore more deeply through a review of the philosophy of Islamic law. This study is a qualitative research approach. In general there are two approaches that will be used by the researchers, namely: a phenomenological approach and a juridical philosopy approach. In the mean time, the researcher also used the conceptual approach, case approach, as well as comparative approach. The research shows that greeting by saying ‘Merry Christmas’ to Christian is considered as haram li dzatihi (prohibited) because faith related issues. The prohibitation applies as long as not in the state of urgent or special needs.

Abstract

Keadilan  harus  ditegakkan. Tujuan  hukum  sejatinya  adalah untuk  mewujudkan keadilan,  kepastian hukum  dan kemanfaatan. Karena hukum  lahir dari ketentuan yang hidup  dalam  masyarakat, maka hukum  harus terus dibedah dan digali melalui upaya-upaya terobosan hukum  untuk  menggapai kemaslahatan demi tegaknya  keadilan.  Bagi hakim,  yang menjadi dilema  terkadang adalah pertentangan antara sisi keadilan  dan  sisi kepastian hukum.  Hakim  melalui  penerapan penemuan hukum,  berupaya mengedepankan keadilan  dengan memutuskan suatu  perkara  menyelisihi  dari apa  yang  telah  ditentukan undang-undang. Penelitian ini bertujuan untuk mengetahui dan  menjelaskan mengenai penemuan hukum  oleh hakim dalam kewenangannya untuk  memutus suatu  perkara  di luar dari  apa  yang  telah  ditentukan oleh  undang-undang. Masalah  yang dianalisis  adalah mengenai penerapan contra  legem  dalam  putusan kasasi  Mahkamah agung  yang  memberikan hak  waris melalui wasiat  wajibah  pada ahli waris non  muslim dan  pemberian hak hadhanah untuk  ayah.  Penelitian ini menggunakan metode penelitian  kualitatif dengan pendekatan yuridis normative. Hasil penelitian  menunjukkan bahwa  putusan hakim yang bersifat contra  legem  sejatinya  adalah upaya hakim  melalui  penemuan hukum  untuk   mengkontekstualisasikan  hukum  itu sendiri demi mewujudkan keadilan.

Abstract

Mediation  is a process of problem-solving negotiations, where impartial  parties  work  with disputants to seek mutual  consent. Mediation  is also  known  in Islamic  law  that  equates mediation with  islah  or Al-Sulh, is a process  of dispute resolution in which  the parties  agree  to end  their case  peacefully. The provisions  of mediation in the last Court are regulated in supreme Court Regulation  number 1 of 2016. Regulation  Court are one of the courts  under  the Supreme Court in accordance with the mandate of constitution, therefore it is obligatory to enforce the provisions  of mediation set forth in the Supreme Court Regulation.  In accordance with its authority in terms of solving a particular dispute for Muslims, it means that the Religious Court, besides deriving from the positive law of Indonesia, must  also derive from Islamic law. Likewise with the provisions on the implementation of mediation in the Court, in addition  to following the Supreme Court, in addition  to following the Supreme Court Regulation number 1 year 2016, also follow the provisions of mediation set forth in Islamic Law.  Based on the above  background this research reveal issues,  what is the view of Islamic law in mediation procedures in religious court.

Abstract

The implications of Law No. 3 of 2006 on religious courts,  that the authority of the religious court expanded that includes Islamic economics were  showcased in Article 49, that the logical consequence aspects of constitutional courts religion to be the only court with jurisdiction  over issues  that occur  against Islamic economics , Writing in this thesis aims to know how the setting and execution of a security interest  in the post of Islamic Banks law No. 3 of 2006. In terms  of the types and  nature, this research includes the study of normative law, because it is done  from a juridical standpoint. The approach used  in this research is descriptive analysis, the authors describe all the existing materials and then analyze the content analysis  method. From  the  research found  that  setting  the  execution of Responsibility  Rights in Islamic  banks is through  the religious court  and  use  the settings  general  civil law and  the execution of Responsibility  Rights in Islamic banks initiated by filing a subpoena in a religious court so that the court religion did session aan maning  form of reprimand against  customer default  to meet its obligations  as an Islamic  bank  customers, and  than  if customers do not do it next Islamic banks  apply for the execution of Responsibility Rights to the customer. Head of religious courts provide execution Responsibility  Rights determination to further  instruct  the  religious  court  bailiff accompanied by two  witnesses to the execution of the seizure of the object. Abstract

Husband’s i’radh In Islamic And Positive Law Perspective, i’radh is the husband who turns away, husband’s i’radh is the beginning  of the cause  of the emergence of nusyuz. In the positive law of Law No. 1 of 1974  concerning Marriage and compilation of Islamic Law does  not  mention  the  problem  of the  husband’s husband explicitly. However,  according  to the author, a husband can be considered as an iadrad  if inside him contains  the elements  of the husband who violate taklik talak. differences and similarities in the views of husbands in the perspective of Islamic law and positive law, among  others.  In Islamic law, it is explicitly mentioned that i’radh in positive law does not explicitly mention  i’radh or nusyuz husband. In Islamic law and positive law both use the path of peace, but when the peace  that is done  is unsuccessful,  the wife can file a divorce. So that this husband could be the cause  of the wife’s divorce  case against  the husband when  he was already  in the behavior, while when he was still within the boundary he could not be the reason  for the divorce

Abstract

The  purpose of this study  is to first describe  the  views of Quraish  Shihab  and  Siti Musdah  gloriously looking  at polygamy  verses, the practice of polygamy  of the Prophet and  the fair terms of polygamy,  secondly  to describe  a fair concept in polygamy  according  to Quraish  Shihab  and Siti Musdah  Mulia, third to describe  the legal arguments of Quraish  Shihab  and Siti Musdah  His Majesty of fair concepts  in polygamy.  This research  method is literature  research  using qualitative  description research  method. Based on the results of research  and discussion can be drawn the following conclusions:  First, in understand- ing the verses of polygamy,  Quraish  Shihab  argues that based  on the demands of fair treatment of orphans as an accentuation of this paragraph, the context of emphasis  on the command to be fair and polygamy  verses do not make regulations  about  po- lygamy, because it has been  known and implemented by adherents of various shari’a religion and community traditions before the decline of this verse. Siti Musdah Mulia sees that of the whole verse of marriage, First, polygamy  is contrary to the principle and  purpose of marriage  of Islam. Secondly,  QS. An-Nisa verse 3 does  not speak  in the context  of polygamous justification, but in the context of protection for orphans and  women  from injustice behavior. Second, M. Quraish  Shihab  gives insight into the practice of polygamy of the Prophet (s), nor can it be said that Rasulullah SAW marries more than one, and such marriages should  be imitated,  because not all what is done  by the Prophet needs  to be imitated.Sedangkan Siti Musdah  Mulia, the as- sumption  that polygamy  Prophet is a sunnah that can be made  hujjah.  Thirdly, Justice  of polygamy  according  to M. Quraish Shihab  is fair in the field of immaterial  (love). Siti Musdah  Mulia gives the view that there are two main points in looking at the fair concept  in polygamy.  First, the just is meant  not only in terms of material  things such as livelihood but also in the immate- rial matter,  namely  the tendency of love and  compassion. Abstract

The prohibition and sanction criminal acts of sexual violence in the household, according to Law No. 23 of 2004 on the Elimination of Domestic Violence and Islamic law. This research is motivated by the issue of a deviant sexual towards his wife, where problems in the private sphere has been appointed to the public domain through which no detailed PKDRT Regulation explains the term forcing sexual intercourse as a form of violence. Approach legislation, conceptual, philosophical and juridical comparison is used to analyze the prohibition and sanction criminal acts of violence. Islamic law explains that sexual violence against wives are despicable acts and prohibited. Islam considers sexual violence than because the two sides (husband and wife). Meanwhile, the perpetrators of criminal sanctions can be sanctioned as jarimah ta’zir. Meanwhile, according to Law PKDRT that each act of sexual violence or similar coercive sexual relations are prohibited. The sanction is imprisonment or a fine. The second equation of the law is equally considers the act contains harm or evil. Meanwhile, the difference is that in Islamic law to first see the cause and effect of violence, both in terms of the condition of both husband and wife. Meanwhile, the Law PKDRT otherwise. Differences were also found in the penal provisions. In Islamic law, perpetrators can be sanctioned jarimah ta’zir where possible occurrence of sanctions mildest to the most severe. Meanwhile, in the Act PKDRT there is no a minimal set of sanctions so that it is possible for the victims of injustice.

Abstract

Memiliki keluarga sakinah merupakan dambaan semua pasangan suami istri baik yang baru menikah atau yang sudah menjalani kelurga. BP4 merupakan institusi pemerintahan yang menjalankan fungsinya sebagai lembaga yang memberikan penasihatan, pendampingan keluarga. Suscatin atau kursus pra-nikah merupakan salah satu programnya yang seyogyanya dilaksanakan dengan maksimal. Penduduk yang ada di Kecamatan Gading Cempaka Kota Bengkulu ketika mendaftar nikah di KUA Kecamatan Gading Cempaka yang rangkaian kegiatan berikutnya adalah diberikan kursus calon pengantin atau kursus pra nikah. Untuk memberikan  pengetahuan tentang bagaimana membina keluarga yang baik, sehingga tidak terjadi perpecahan dalam keluarga. Masalah tersebut sangat penting sebagai salah satu upaya menekan terjadinya perceraian. Namun saat ini program tersebut belum berjalan dengan optimal. Suscatin diatur dalam Pasal 2 Peraturan Direktur Jendral Bimbingan Masyarakat Islam No. DJ. II/542 Tahun 2013 tentang Pedoman Penyelenggaraan Kursus Pra Nikah. Pendekatan penelitian ini adalah pendekatan kualitatif dengan menggunakan metode pengumpulan data yaitu observasi, wawancara dan dokumentasi. Lokasi penelitian ini dilaksanakan di KUA Kecamatan Gading Cempaka Kota Bengkulu. Hasil penelitian dapat disimpulkan bahwa, pelaksanaan suscatin di KUA Kecamatan Gading Cempaka tidak berjalan secara optimal. Suscatin ada pengaruh  terhadap masyarakat di Kecamatan Gading Cempaka Kota Bengkulu yang sekarang ini sudah berjalan dengan baik, hanya saja perlu merevitalisasi pelaksanaan suscatin dengan alokasi waktu yang lebih panjang dengan berpedoman kepada Modul Bimbingan Perkawinan untuk Calon Pengantin tahun 2016 .

Abstract

The purpose of this research is to know  the  Role of Post  of Legal Aid (Posbakum) based on Supreme Court Regulation  Number  1 Year 2014 and  implementation of Posbakum in serving  the  justice  seeking society  that  can  not afford in Religious Court of Bengkulu  Class I A. Research conducted at Bengkulu  City Court, at March-June  2017. The research method used  is survey method and data retrieval technique done  by library study and open  interview. Data were analyzed  descriptively  qualitative.  The result of this research is expected to have social value which  is giving information to Bengkulu people in particular,  and society (nation) Indonesia generally about  the benefits  or the power  of Legal Aid to the poor people in Religious Court of Bengkulu Class I A.

Abstract

This study discusses the implementation of the determination of Integrated  Marriage of The formulation of this re- search  are: Firstly, how is the society’s response to the enactment of Government Regulation  No. 19 of 2015  on Non-Tax  State Revenue in the Ministry of Religious Affairs? Second, what factors cause  the community to carry out marriage  in the Central Marriage on KUA Kecamatan Ratu Agung?The  type of this research  is descriptive research  with sociological juridical approach. Data collection using interview technique, observation, documentation. This study concludes  that: Firstly, the public welcomes a positive response to the enactment of Government Regulation No. 19 of 2015. The regulation is considered as the government’s new breakthrough to discipline the marriage  cost so as to minimize illegal levies. In addition, people  with limited economic abil- ity who want to get married  is greatly helped  by the existence  of this provision.  If previously the cost of marriage  is felt by them is quite high, with this provision they can perform the marriage  for free with the condition must be implemented in the Office of Religious Affairs and at work hours. Of course this gets a positive response from the community, because it is very helpful espe- cially for the middle to lower society. Secondly,  the factors that cause the community to carry out marriage  in the marriage  hall at the Office of Religious Affairs of Ratu Agung District are economic factors and work permits. In general, informants  stated that getting married  in the Office of Religious Affairs without cost so as to ease the financial burden. In addition, the informant  was married  in the Office of Religious Affairs of Ratu Agung Sub-district due to the reason  of the work permit which was not long
