Abstract

This article is an extract from my dissertation which offers a historiography of the Dayah, Aceh’s traditional institution of Islamic education and picks up at the point of Aceh’s history where its Dutch colonial experience began. The section presented here details some of the theological, philosophical and political factors that contributed to the development of the regions current variety of educational institutions. However, despite the effects of such historical and ongoing developments, that continue to inform the theological understanding and social concerns of Aceh’s ulama, the Dayah still manages to represent a distinct Muslim identity that express the richest cultural heritages of the region within an orthodox religious framework. Therefore, the Dayah of Aceh continues the traditional Islamic educational experience for the Muslims of the region despite the historical and ongoing influence of cultural, political and social developments.

Abstract

Islamic exertion (ijtihad) is a tool which makes Islamic law be compatible and relevant to the current progress of time. Some contemporary problems which are being faced by human are needed to be solved from Islamic law perspective. In this regard, to intensify Islamic exertion collectively by involving all scientists from various backgrounds of science and knowledge is a way to solve such kinds of contemporary problems which being faced by mankind generally and Muslim particularly.

Abstract

This study aims to look at the Indonesian government’s strategy in improving the process of Human rights democratization. Democracy and human rights are two things that can not be separated. However this study has found that besides providing legal penalties to the perpetrators, Indonesian government should also pay attention to the development of social dynamics and the tendency of other countries to understand human rights issues. In this study the author recommend that holistic paradigm is a suitable paradigm offered in human rights issues to be developed in Indonesia.

Abstract

Baitul Qiradh Bina Insan Mandiri has a commitment to fund the people whose focus on microfinance so that they have more opportunity to develop their business by increasing the capital. Although BQ Bina Insan faces high risk of level, BQ tries to overcome the problem professionally by using decent standard test even there are many obstacles because micro-entrepreneurs are not able to fulfill the main standard. The examined aspects include market and marketing aspect, production technique and technology aspect, management and human resources, low and legality aspect as well as finance and economic aspect. Baitul Qiradh Bina Insan Mandiri is very flexible in applying its feasibility concept by considering the effort of microfinance customers and its limited coverage aspects.

Abstract

The Goverment’s policy or the state administration officials regulation in The City of Lhokseumawe, Aceh, and its as part of a regulatory authority policy (Vrije Bevoegdheid) in government to act, based on the principle of freies ermessen or discretion. In the implementation of the government rules, this policy as a part of the operational implementation and that can not change or deviate the legislation. In fact, this policy has not been affectively implemented in the community, due to its implementation complied by most people of Lhokseumawe, whether they are compliance, identification, or Internalization.

Abstract

Islamic banking and finance has experienced tremendous development and impressive achievement in Indonesia even though there is no consensus among Shari’ah scholars on the position of interest banking. This paper will observe the various perspectives of Indonesian Shari’ah scholars’s and analyze the dynamics of fatwa issued on banking interest by three main Islamic organizations in Indonesia, namely; MUI, Muhammadiyah and Nahdhatul Ulama. The paper will also attempt to look to what extent the scholars have contributed to the development of shariah banking in Indonesia. The fatwas are gathered from the resolutions issued by respective organizations in their meeting which have been evolving along with the development of shariah banking in Indonesia.

Abstract

This article aims to provide an overview of ethical marketing management for banking products and financial services in accordance with the principles and values of Islam. This paper is divided to several parts, first: to explain what is meant by marketing, scope and importance of marketing in business. The second part: marketing management discusses how ethics in Islam, the third part explains what is the difference between Islamic and conventional view on marketing. Last discussion is about how the ethics and values of Islam applied in marketing management for banking products and services. There are several things to be noted in the discussion of this article, the application of ethical practices in banking companies will always benefit the company both medium and long term. It also can increase the motivation of the crew, to protect the principle of freedom of trade and increase competitive advantages. Overall management strategy that has been created based on ethics will be a success, according to the plan, if the parties have consistently execute marketing strategies implemented, and conduct a review of the marketing strategies that have been implemented if it does not succeed in business.

Abstract

Clumps of Islamic scholarship include, among others, Kalam, Tafsir, Hadith, Fiqh, Philosophy, Mysticism. Also can be added Ulum al-Qur’an, Ulum al-Hadith, Arabic with it various branches. In terms of “Kalam”, often more popularly called Aqeedah, Fiqh is called Shariah and Sufism called Akhlaq. Thus, the Islamic religious sciences trilogy as found in Islamic religious education in schools covering Aqidah - actually a discussion on Kalam/ theology, Worship-represented by Fiqh or Shariah-and Akhlaq-whose roots are Tasawwuf. Internal relationships between all disciplines of Islamic sciences are often interrelated, because they are actually could not be segregated and separated. This kind of Islamic sciences relationship are not alike with the relationship between Mathematics, Sociology and Law where their discussions can really be separated, meanwhile the relationships among Islamic sciences indeed interrelated to one another. In such approach, then when the paper titled ‘Kalam’, in fact it discusses very indirectly related to the discussion of Fiqh / Shari‘ah, Philosophy and Mysticism. When mentioned “Kalam” here means a way of life or view of religious Islamic World, which includes a variety of many disciplines in Islamic sciences. This paper is going to discuss Jasser Auda’s idea to answer the questions: whether the world view of Islam colored Religiously static (ghairu qabilin li al-niqash wa al-taghyir) or vice versa, the Islamic religious world view actual dynamic (qabilun li al-niqash wa al-taghyir) so that the concepts, understanding and interpretation of the old and new can be moved on a dialogue and discussion without unnecessary tension because of the history of human development and history of Muslims continues and always on the move and change according to the motion of the universe, as in fact the planet is spinning move as the movement and rotation of the other planets. In this paper, “Kalam” will be seen in the context of historical changes in human experience, from the traditional era, then how in the modern and postmodern as well as contemporary Muslim intellectuals, as Jasser Auda react it and how about the form or format Kalam world view in a nation-state era and in the global era like nowadays. What are the implications and consequences on education, propaganda, social- community relations, politics and so on.

Abstract

This article aims to examine the Islamic legal thought developed by Hasbi Ash-Shieddieqy between purification and modernization. Studies show that Hasbi is consistently as a modernist. This conclusion is based on two cases that raised issues of worship, which is about the Friday prayers and zakat measurement. In understanding these two issues, Hasbi not solely used naqli (revealed) arguments, but also ‘aqli (reason arguments).

Abstract

Hasbi Ash-Shiddieqy (1904-1975) argued, Muslims should be able to distinguish between the Shari’ah which directly from Allah SWT, and fiqh, which is the interpretation of the Shari’a by the mujtahid scholars. So far, there is an impression that Muslims in Indonesia tend to regard fiqh as a Shari’a jurisprudence that should be applied absolutely. As a result, the books of fiqh regarded as a source of religious law, although the Islamic legal opinions of the school sometimes are—to some how—incompatible with the current context. Hasbi saw the need to do ijtihad (Islamic exertion) in favoring the benefit for the people in response to the flow of modernization because Islamic law can basically meet public needs and the needs of mankind. Hasbi offered muqaranah (comparative) method which applied not among the Islamic schools, but also between schools and modern legislation. Hasbi offered idea ijtihad jama’i (ijtihad collectively) by engaging and involving various Muslim scientists so that decisions made are closer to the truth and a much more in line with the demands of the situation and welfare of the community. Since 1940, Hasbi offered the need for having Indonesian fiqh to be a pillar for the development of the Indonesian law. Through ijtihad collectively, according to Hasbi, Indonesian Muslims could formulate and have fiqh according to the personality of the Indonesian nation
