Abstract

The rapid development of information technology can be seen from the massive use of the Internet network, which has also boosted the public's need to always carry out trade transactions using the Internet network. This is a challenge for Muslims to always be careful in transactions because Islam gives freedom to its followers in transactions but still places restrictions according to the Shari'a. Therefore, this study aims to find out the form of transactions in the go-food application and what the Islamic economic perspective is on these go-food transactions. The research method uses a qualitative interpretive approach. Sources of data come from primary data and secondary data and data collected using observation, interviews, and documentation. Respondents in this study were PT. Go-Jek, Go-Jek drivers, merchants, and consumers. This research focuses on the multiple contracts contained in Go-food services and the views of Islamic Economics on the transaction model. The results of this research show that it is true that there are multiple contracts in Go-food transactions because many parties are involved in them, including service leasing transactions between PT. Go-Jek and merchants, partners between PT. Go-Jek and drivers, as well as representative transactions between consumers and PT. Go-Jek and consumers with Go-Jek drivers. Islamic Economics views this transaction model resembles the forms of contracts in Islam, namely ijarah contracts, syirkah, wakalah bil ujrah, and their application does not conflict with Islamic Economics.

Abstract

The purpose of this study was to determine the effect of Murabahah, Mudharabah, and Ijarah Financing on the Net Profit Rates of Islamic banks in Indonesia. This research uses the positivism paradigm with a quantitative approach. The population in this study were all Sharia Commercial Banks registered at Bank Indonesia while the sampling technique used purposive sampling techniques and obtained 3 Sharia Commercial Banks. The data analysis method used in this study is multiple linear regression analysis. The results of this study are murabaha financing has a significant effect on net income and mudharabah financing does not significantly influence net income, while Ijarah financing does not significantly influence net income.

Abstract

The role of the capital market for development is very important. But on the other hand, potential legal problems are inevitable. Disputes become potential cases of lawlessness in the capital market. Therefore, the focus of this study is to examine the settlement of capital market disputes through negotiations. This research uses the library research method with a content analysis approach. Data collection is obtained from books and journals. Data analysis is carried out through the stages of data reduction, data presentation, and data verification. The results of this study show that negotiation is an alternative to resolving dispute cases carried out by parties to disputes by discussing settlements without the involvement of third parties. The advantages of capital market dispute resolution are that it is not costly, is informal, prevents hostilities, and has a quick resolution time.

Abstract

This study aims to determine the effect of product quality on the Probolinggo branch of Arrum Haji pawnshops on public interest in registering for hajj. The research was conducted with a quantitative approach using descriptive methods. In this study, the population was all customers of the Probolinggo branch of Pegadaian, users of Arrum Haji products during August - October 2022, totaling 46 customers. The data collection technique was carried out using a Likert scale questionnaire. Arrum Hajj Products at the Probolinggo Pawnshop Branch Against Public Interest to Register for Hajj by 78.4%. the calculated t value of the product quality variable (X) is 12.646 with a probability significancy of 0.00 (0.00 < 0.05), then Ho is rejected and Ha is accepted, so it can be concluded that the product quality variable has a positive and significant effect on public interest.

Abstract

In several cases that have been found in several different places, the application of a murabaha contract accompanied by a wakalah contract in it has resulted in side-streaming actions by its customers. Where the existence of side-streaming actions carried out by the customer is considered to cause harm to the party concerned. However, it is different from what happened at BSI KCP Probolinggo Sudirman, where of all existing microfinance customers, there was no record of such side streaming actions. This research was conducted at BSI KCP Probolinggo Sudirman, with the aim of the research, namely to find out what are the efforts to prevent and resolve side streaming actions carried out on microfinance with a murabahah bil wakalah contract at BSI KCP Probolinggo Sudirman. This research is included in the type of case study research that uses a research approach in the form of descriptive qualitative methods. As well as using data collection methods in the form of observation, interviews, and literature studies. From the results of this study, it is known that efforts to prevent side streaming carried out by BSI KCP Probolinggo Sudirman include conducting BI checking analysis, 5C analysis, and making visits at the same time as requesting receipts/receipts of purchase of goods. As for the settlement steps that have been prepared, they are adjusted to the level of fraud committed by the customer.

Abstract

This research was motivated by the birth of the job creation law in 2020 which regulates many things including Islamic banking in Article 79. This article adds to the long list of laws and regulations on Islamic banks that have existed since almost 30 years ago (1992). Researchers want to know whether there are significant changes contained by this article and whether the legal politics of Islamic banking has changed with the birth of this job creation law. This research is a type of literature study or in the legal world is called juridical-normative legal research. This study shows that Article 79 of the job creation Law No. 11 of 2020 has a combination of properties between responsive and elitist legal products, built on the desire to develop the Islamic economy as part of National Economic Development. This article contains changes to the maximum ownership of Islamic commercial banks by foreign parties, which was originally in law No. 21 of 2008 regulated by Bank Indonesia regulations, now following the laws and regulations in the field of investment. The legal politics behind the job creation law on aspects of Islamic banking is the same as other aspects, namely inviting investors not only from within but also from abroad to invest in Indonesia. This means that the government wants to open up investment space in the Islamic banking sector wider than ever.
