Abstract

The discourse on waqf recently appears the back to the surface. It not only discusses about the opinion of the fiqh scholars who have no uniform about understanding and nature waqf  itself, but also to reform and optimize waqf  in order to do more, namely to superintend the social problems of society, related to the prosperity of the economy of the people. Therefore, contextualization and repositioning of waqf institutions becomes a necessiry for immediate implementation. The function and role of waqf is very large in supporting the development and progress of the muslims. Therefore the management of waqf must be able to be optimized. Tragically the management of waqf in Indonesia is still not maximized, so there are some waqf property abandoned in its management, some even missing. This is due to the waqf management still uses traditional-consumptive management pattern. Efforts to develop waqf to be productive and productive, there are four things to note; Institutional aspect, accounting aspect, auditing aspect and aspect of nadhir. If these four aspects can be met, then the utilization of waqf will be more efficient. There are several forms of models that can be run by the manager of waqf, such as by holding Sharia banks as a partner with schema of murabahah, istisna’, ijarah muntahiyah bi al-tamlik (financial leasing with purchase option), muzara’ah, qard al-hasan, musharakah (partnership) and mudarabah muqayyadah. Keywords: Contextualization, Repositioning of Waqf, Prosperity of the People

Abstract

When the enactment of Act Number 7 of 1992 concerning banking there is another alternative form in addition to conventional banks that are known a bank based on the principle of profit sharing. Act Number 7 of 1992 concerning Banking has not yet used explicitly the term sharia bank or Islamic bank. The mention still uses the term “profit sharing principle”. There is no more detailed provision regarding banks conducting business based on sharia principles. Financing is the majority of assets of sharia banks so that the financing must be maintained with quality based on the principle of prudence. The precautionary principle is a bank management guideline that must be adopted in order to realize a sound, robust and efficient banking system in accordance with the provisions of laws and regulations. Implementation of prudential principles by sharia banks is one of which is realized in performing a financing analysis that is analyzing confidence on the willingness and ability of prospective customers of the facility receiver to repay all obligations in time, before the Sharia Bank and/or UUS channel funds to the facility receiver. This confidence is derived from a careful assessment of the time, ability, capital, collateral, and business prospects of a potential customer (character, capacity, capital, collateral, condition). The sharia bank in providing financing hopes that the financing proceeds smoothly, the customer obeys what has been agreed upon in the agreement and pays in full when it matures. However, it can occur within the financing period of non-performing financing. Efforts made by sharia bank to handle problematic financing by conducting a rescue of troubled financing with restructuring efforts if the customer still has good intentions in the sense of still willing to be invited to cooperate in efforts to save troubled financing, but if the customer has no conviction either in the sense cannot be invited in an effort to rescue non-performing financing, sharia banks will make efforts to settle non-performing financing. Keywords: Sharia Bank, Non Performing Financing, Handling Solution

Abstract

The failure of the capitalist system in realizing just welfare becomes a necessity for mankind to deconstruct the economy of capitalism into a just and civic economic system which in this case of course Islamic economics deserves to be considered as one alternative in realizing human prosperity. As one of today’s contemporary muslim economists, Baqir Sadr’s ideas are increasingly finding relevance to the current global economic situation. This article examines the thoughts of Baqir Sadr in the book Iqtishaduna (our Economic) by using the approach of library research. The results of this study include. First The idea that capitalism is a system that is solely oriented to the accumulation of capital and ignore the values outside the economic motive. The two important meanings of the State’s role in economics at Baqir Sadr’s foundation can be found in the notion of a conventional economist, one of which is former US Federal Reserve governor Alan Gleenspan, which highlights the importance of state involvement in economic activities as in the case of the Subprime Mortgage financial crisis. The three ideas of wealth distribution that require the circulation of property in both local and transnational domains become very relevant to see the imbalances that occur in the world today as the United Nations Development Program (UNDP) said as many as 20% of the rich in the world are enjoying 86% of world wealth, while 80% of the world's poor enjoy only 14% of the world's wealth. Keywords: Relevance, Capitalism Failure, Baqir Sadr Thought

Abstract

Economic activity is defined as inseparable thing in life. The process that occurs in terms of exchange with a particular agreement creates a system which we then call the economic transactions. The transaction is nothing but an attempt to make ends meet. In this case, the government will supervise the activities. Individual actions in the economy in particular and action in general, depends on the mind and worldview of the individual. Therefore, Islam as a universal religion has regulated and provided the right pattern of action in life, socially, culturally and economically. The writing will try to answer the question: how the Islamic economic thought of Imam al-Ghazali on money in the context of mashlahah mursalah. The research is literature research, which examines the sources of books, books, scientific journals, articles and other forms of material or commonly related to the discussion of this paper. The data have been collected from many sources, analyzed using content analysis method, namely research technique to make replicable inference and valid data with respect to context. The description is presented in descriptive or narrative form the data already collected is analyzed in accordance with historical events or facts, especially the detailed description of the activity, attitude, behavior and position of Imam al-Ghazali in historical events. In addition, data analysis is presented in an inductive form on data already collected or evidence analyzed, compiled or abstracted based on existing sources (primary data and secondary data). The results showed that to build a good economy and smoothly should be able to run economic activities based on Islamic law by implementing the concept of mashlahah mursalah, including in managing finances well according to the needs of the community and conduct muamalah activities in accordance with the existing ethics. Islamic economy according to Imam al-Ghazali in its achievement must promote the public good. It implements the concept of maslahah mursalah with the maintenance of the five basic objectives (maqashid shari’ah). While in carrying out economic activities, the government must intervene, especially when there are problems in the community. Economic goals should not be concerned only one side of life, but must be balanced between the world and the hereafter. Keywords: Imam al-Ghazali, Money, Maslahah Mursalah

Abstract

Science, including Islamic economics, is a systematic knowledge acquired in certain ways agreed upon by scientists. Certain ways to acquire such schematic knowledge are called methodologies. Science is obtained through investigation or investigation. But not every investigation can be called a legitimate and recognized way to gain the knowledge. Science has certain ways or processes called research. Thus, the methodology is in fact the ways or scientific research techniques. The technique here means ways of conducting an investigation and assessing the findings or evidences, ie judging whether the finds are true or false. After seeing how important the methodology is in building a discipline, especially the discipline of Islamic economics, this paper will try to answer the question: how is the methodology offered by Monzer Kahf to build Islamic economics? The research method used in this research concerns types, approaches, sources and data types, data collection techniques, data analysis techniques. The type of this research is library research, namely research conducted by taking and collecting data from the literature related to the issues discussed. Sources of research data obtained are from the existing literature, by collecting primary and secondary data. Primary data in this study refers to the books and other research journals by Monzer Kahf. The secondary data in this research is obtained from books, magazines, journals, articles, and so forth, written by other writer. Analytical technique used is descriptive-analytical analysis method. The results show that the task of describing the Islamic economic system consists of two parts. First, Islamic economists have to find the theory of the components of the economic system and its internal relations. Second, they are to investigate the economic validity and power of the system. Essentially, the approach used to find the Islamic economic system is similar to the approach used to find the general theories and rules of fiqh. Economics as one of the social sciences needs to develop a path to history to explore its experiences and determine the direction of long-term economic life. Islamic economists must revise conventional economic theory to recognize and separate biased postulates. Abstract

Waqf is an established institution in Islamic religion, and belongs to the category of community worship whose position is very important as capital and means in achieving the welfare of the people. However, in practice there have been many deviations from the origin of the purpose of waqf. Therefore, a new orientation on waqf is needed, so that waqf can contribute effectively to the welfare of the people. It must meet four factors including, legal certainty status, right and proper pledge of waqf, effective management of waqf. The importance of waqf development certainly has implications on how the management of waqf in providing utilization for the community. Waqf management is required to be professional, trustworthy, transparant, and accountable. This article explains the criticism of Timur Kuran’s dilemma about the waqf system which is a lot of deviation from the goal of essensial waqf.  Therefore, a new orientation on waqf is required, so that waqf can contribute effectively to the welfare of the people. But in the other hand, Kuran does not offer concrete solutions or create a theory about the norms of Islamic economic activity to replace or revise the norms put forward by Islamic economists. To be a criticism of the dilemma, this article also sees from the side of maqashid al-shari’ah in waqf also oriented to the present interest for the achievement of development social-oriented productive property, and the result will also be felt together by maslahah ‘ammah community. Kuran based his view of the unbelievable sources of the orientalists. Abstract

Financial institutions and contemporary business today have been transformed into a sharia-based financial institution and business. However, this change of a new transformation is done systemically by system and not implemented by culture. Thus, despite the growth of Islamic bank is so high, polemics is increasingly unsettled. Based on this, the necessary of transformation of corporate culture has to change based on Islamic values to create sustainable development and competitive advantage. This paper attempts to offer relevant ideas based on Islamic corporate culture. At the end of this paper, the author offers the characteristics of Islamic corporate culture, corporate culture in Islamic bank in Indonesia, and the development of quality of Islamic corporate culture on Islamic bank in Indonesia. This paper concludes that Islamic corporate culture has a major role in increasing employee motivation, employee work ethic, job satisfaction, employee's prestigious behavior and employee performance. Abstract

Sharia financial Institution is one of the economic supporters of Indonesia. It is evidenced by the number of Islamic financial institutions that have sprung up this year, both sharia bank and non-bank sharia financial institution. It accommodates the aspiration and need of the society. The public is given the widest opportunity to establish a bank based on sharia principles, including convert from commercial banks whose business activities are based on conventional patterns into sharia patterns. The more sharia financial institutions that emerge, the more products offered by Islamic financial institutions to customers with the level of risk that can be overcome. The writing aims to answer the formulation of problem of settlement of import debts, contract of ju’a>lah and Sharia Certificate of Bank Indonesia (SBIS) in perspective of DSN-MUI fatwa. The result of research shows that in the DSN-MUI fatwa, it is explained that the settlement of imported debt or we know as letter of credit (L/C) may use the kafa>lah contract by taking a fee. It is also explained that one of the forms of kafa>lah contract is kafa>lah bi al-ma>l which is the application of kafa>lah contract which guarantees the payment of goods or debt repayment. This guarantee may be provided by the sharia bank to its customers in return for a fee. For the settlement of import debt there are several contracts that can be used, namely the contract of h}iwa>lah bi al-ujrah, waka>lah bi al-ujrah, and kafa>lah bi al-ujrah The Sharia Certificate of Bank Indonesia which used to be wadi>’ah with Wadi>’ah Certificate of Bank Indonesia which is now changed with Sharia Certificate of Bank Indonesia uses ju’a>lah contract. In this contract, Bank Indonesia pays the repayment upon maturity of SBIS with the relevant sharia banking record having performed and achieving the objectives expected by Bank Indonesia. If the sharia banking concerned is not able to achieve the desired objectives or stipulated by Bank Indonesia in terms of monetary control based on sharia principles, the relevant sharia banking will not receive any compensation from Bank Indonesia. Keywords: Import Debt Settlement, Ju’a>lah, Sharia Certificate, Bank Indonesia, DSN-MUI Fatwa

Abstract

One thing that needs to be understood is that every result of human thought is always historical, tied to the space and time around it. The economic policies issued by Umar ibn Khat}t}a>b, Umar ibn Abdul Azi>z and Ghazan Khan must have certain truths in accordance with the dimensions of space and the cycle of time. However, the form of policy is an effort to solve the problems of the State, especially the economic sector that occurred in the middle of their leadership period. This article aims to examine the political economic thought of three caliphs, namely Umar ibn Khat}t}a>b, Umar ibn Abdul Azi>z, and Ghazan Khan with a historical approach. Political economic policy decided by Umar ibn Khat}t}a>b, Umar ibn Abdul Azi>z, and Ghazan Khan has a character that is flexible. It means however its method, during its goal to create welfare for the people and not in conflict with al-Quran and al-Sunnah, then that policy is applied. This was apparent when some of their policies are not always same as Prophet’s policy, even differ from each other, but with that difference, the world has recorded them as a brilliant decision maker. The policy of the three caliphs teaches us the ultimate determinants of the economic policy of the meaning of welfare (mas}lah}ah) which form the basis of the formulation of one policy. Rigid economic system will only become a separate boomerang for economic growth itself. Because the true that the holy economic goal is not economic growth, but the welfare of mankind as perpetrators of economic activity in this hemisphere. Keywords: Islam, Economic-Politics, Flexible, Welfare

Abstract

Islamic finance made its first appearance in the 1970s. Since its inception, Islamic finance has made phenomenal progress and progressed beyond its traditional market into a global phenomenon. The recent global financial crisis has also brought Islamic finance into navel attention. Regardless of the minimal impact accused on Islamic finance, the crisis offers an opportunity for introspection and evaluation. It is inevitable to determine whether it can be a viable alternative to conventional systems in global financial markets. Therefore, Islamic financial institutions must ensure that all transactions are in accordance with sharia, not only in the form and technical law, but more importantly, in their economic substance, which should be based on the objectives outlined by the sharia, also known as maqa>s}id al-shari>’ah. This article aims at examining the concept of maqa>s}id al-shari>’ah  of Islamic jurisprudence in order to appreciate its contribution toward more comprehensive, rational and realistic answers to contemporary financial issues and thereby to increase the awareness of the maqasid approach in structuring and developing Islamic finance products. For this purpose, the author examine the literal and conceptual meaning of maqa>s}id al-shari>’ah  and scrutinise its position in Islamic law. They also highlight the essential elements of maqasid al-shari'ah and explain how this approach may contribute to better solutions for various Islamic finance issues and challenge. Islamic finance as an institution based on the ethical and moral framework of Islamic law assumes a distinctive role in society. Furthermore, the maqashid al-shari’ah framework also implies that. The characteristics of Islamic finance institutions are shaped by higher Islamic legal objectives that emphasize overall social and economic goodness rather than infectious greed and infectious individualism.
