Abstract

Within Islamic philosophy, the implementation of punishment for those who commit a crime (jarîmah) is a form of prevention and retaliation (al-rad‘ wa al-zajr) as well as correction and education (al-islâh} wa al-tahdhîb). The implementation of imprisonment in Islam is categorized as ta‘zîr, since there is no any stipulation in the Qur’an which regulates about imprisonment. Departing from this paradigm, this study concludes that the implementation of punishment in the form of imprisonment corresponds with the aim of punishment itself within Islamic criminal laws. However, the writer argues that the implementation of imprisonment in Indonesia should be seriously enforced in order to obtain its main objective. This is because the society tends to put a negative stigma upon those who have imprisoned. Therefore, the government, penitentiary officers, and the society should work together to help and educate the convicts. Moreover, the government should be responsible for providing the penitentiary adequate facilities to support the process of education and its effectiveness

Abstract

The problem of the deradicalization policy of terrorist convicts is in the regulation of granting remissions for terrorism convicts because terrorist convicts can manipulate the conditions for granting remission to pretend to be good and cooperative (taqiyah) during their criminal period in prison, so that they can quickly gain freedom and return to the network. This empirical research was processed descriptively. Data collection was carried out through field research at the Class I Lapas Surabaya prison and Class II B Lamongan prison through a phenomenological approach, interpretive paradigm, and tarjih maqashidiy analysis. This study concludes that granting remissions to terrorism convicts has a more significant advantage (maslahah) than eliminating remissions on the grounds of extraordinary crimes. Providing the opportunity to change behavior is better prioritized than providing punishment without any attempt to change the behavior of terrorist prisoners with the maximum penalty.(Salah satu problematika yang muncul dari kebijakan deradikalisasi narapidana terorisme adalah aturan perihal pemberian remisi bagi narapidana terorisme dengan syarat kelakuan baik dan kooperatif (taqiyah) selama menjalani masa pidana. Padahal, mereka bisa berpur-pura baik agar segera keluar dari penjara dan kembali ke jaringan lamanya. Penelitian empiris ini diolah secara deskriptif sementara pengumpulan datanya dilakukan melalui observasi dan wawancara di Lapas Kelas I Surabaya dan Kelas II B Lamongan dengan pendekatan fenomenologi, paradigma interpretif, dan analisis tarjih maqashidi. Studi ini menyimpulkan bahwa pemberian remisi pada narapidana terorisme memberikan keuntungan yang lebih signifikan (maslahah) dibanding menghapus kebijakan tersebut dengan alasan kejahatan luar biasa yang dilakukan narapidana. Memberikan kesempatan mereka untuk berubah lebih baik dianggap lebih utama dan layak diprioritaskan dibanding memberi hukuman maksimal tanpa usaha apapun untuk mengubah perilakunya.)

Abstract

This article discusses the division and crisis of Shia religion, one of which was due to the existence of a prolonged khilafiyah within the Shi'a, between the two major groups, Akhbari and Usuli. Akhbari is referred to as a textualist and scripturalist group that rejects rational principles in understanding the texts of the al-Qur’an and Sunnah, while Usuli is a group that accommodates rational principles in understanding texts and concludes ijtihad-based laws. But for those who do not have the qualifications ijtihad is obliged to follow the mujtahid who are known as marja'al-taqlid.

Abstract

Artikel ini mencoba membahas tentang siapa pendiri atau pelopor Usul al-fiqh (prinsip-prinsip fiqih). Pasalnya, ada beberapa wakil dari beberapa kepala madhab yang mengaku sebagai pendiri bidang tersebut. Lantas, benarkah Syafi'i yang dikenal sebagai "ahli arsitek fikih" orang pertama yang merintis bidang usul al-fiqh. al-Syafi'i dikenal sebagai pelopor mazhab qodim dan jadid yang muncul setelah sekian lama belajar di berbagai pusat hukum di seluruh dunia. Lingkungan yang dialaminya memberikan kontribusi yang signifikan terhadap perkembangan pemikiran sejarah dan juga menawarkan metode pemikiran yang sistematis, pemikiran logika fiqh.This article tries to discuss the issue of who the founder or pioneer of Usul al-fiqh (the principles of Islamic jurisprudence) is. This is because there are severalal legations from several principal of Madhab claimed they are the founders of the field. So, is it trueal-Shafi'i known as "master architect of jurisprudence" the first person who pioneered the field of Usul al-fiqh. al-Shafi'i is well known as pioneer of "qodim" and "jadid" schools of thought which emerged after a long period of study in various legal centers around the world. This environment he experienced made a significant contribution to the development of historical thought and also offered a method of throught that was systematic, thought the logic of fiqh.

Abstract

Waqf is an established institution in Islamic religion, and belongs to the category of community worship whose position is very important as capital and means in achieving the welfare of the people. However, in practice there have been many deviations from the origin of the purpose of waqf. Therefore, a new orientation on waqf is needed, so that waqf can contribute effectively to the welfare of the people. It must meet four factors including, legal certainty status, right and proper pledge of waqf, effective management of waqf. The importance of waqf development certainly has implications on how the management of waqf in providing utilization for the community. Waqf management is required to be professional, trustworthy, transparant, and accountable. This article explains the criticism of Timur Kuran’s dilemma about the waqf system which is a lot of deviation from the goal of essensial waqf.  Therefore, a new orientation on waqf is required, so that waqf can contribute effectively to the welfare of the people. But in the other hand, Kuran does not offer concrete solutions or create a theory about the norms of Islamic economic activity to replace or revise the norms put forward by Islamic economists. To be a criticism of the dilemma, this article also sees from the side of maqashid al-shari’ah in waqf also oriented to the present interest for the achievement of development social-oriented productive property, and the result will also be felt together by maslahah ‘ammah community. Kuran based his view of the unbelievable sources of the orientalists. As Kuran believes, Islamic economics is a fundamentalistist doctrine, rigid, rigid and only excavated from traditional Islamic sources. Keywords: Timur Kuran, Waqf, Maqashid al-Shari’ah Perspective

Abstract

The process of transferring or distributing the fund to the customers, or what so called as the outlay needs such a definite contract to apply in the process of job capital budgeting. In BPR Syariah Madinah Lamongan, the contract applied is the contract of mura>bah}ah. It means that the selling prize of goods is as the same as its main prize added with the compromised profit.  It is definitely necessary to observe the expediency of the candidates before transaction while deciding to give the outlay using mura>bah}ah contract, in order to avoid such a certain risks that could fatally affect the bank’s financial loss. Some of the risks emerged because of default. It frequently happens since the debitor or customer is careless to pay the obligation on time.It is certainly contradictory to the Islamic law that intensely protects the interest of both the bank and the customer doing the transaction. So that both sides don’t suffer any loss. Those careless customers should get the proper fine or ta’zi>r. Hence, in this research, the application of ta’zi>r toward the job capital outlay using mura>bah}ah contract in BPR Syariah Madinah Lamongan will be thoroughly analysed through descriptive analysis method. The data collection of this qualitative research is conducted by doing interview, observation and documentation. The research findings reveal that the job capital outlay using mura>bah}ah contract in BPR Syariah Madinah Lamongan needs more serious attention and handling. The process is actually not quite fluent, therefore ta’zi>r needs to be implemented. Whereas the nominal amount of ta’zi>r is already in proper with the customer’s loan stated in the contract. There is only a small number of the customers who get dispensation when being late handing the payment. They are the customers who are really incapable to hand the payment or in force majeure condition. The nominal amount of ta’zi>r then distributed to social fund, such as scholarship, road and bridge construction, etc. Keywords: Implementation of ta’zi>r, The outlay of mura>bah}ah

Abstract

Artikel ini membahas tentang tipologi dan pemahaman Islam moderat berdasarkan pandangan Wahbah al-Zuhayli, seorang ulama berkebangsaan Suriah. Jenis penelitian yang digunakan dalam tulisan ini adalah penelitian kepustakaan (library research) dengan menggunakan metode analisis isi (content analysis). Adapun pendekatan yang digunakan dalam tulisan ini adalah pendekatan sosiologi. Dalam tulisan ini dapat disimpulkan bahwa Wahbah al-Zuhayli merupakan salah satu intelektual Muslim yang mempunyai integritas keilmuan di berbagai bidang, terutama di bidang hukum Islam. Pemikiran-pemikirannya, dituangkan ke dalam sebuah buku, dijadikan referensi dan rujukan oleh para akademisi dan masyarakat pada umumnya. Akar pemikiran wacana moderasi Islam Wahbah al-Zuhayli pada dasarnya didasarkan pada konsep Maqa>s}id al-Syari@‘ah yang menghendaki adanya fleksibilitas dalam hukum Islam, adanya pembaruan atau ijtihad dalam hukum Islam, dan tidak fanatik terhadap suatu mazhab atau pendapat dalam hukum Islam.

Abstract

Artikel ini membahas tentang  Ikhtiar al-Raysuni dalam mengembangkan Maqa@s}id dalam ranah hukum Islam saja, akan tetapi kajian juga dalam kajian keislaman lainnya, seperti Tauhid, Etika, Politik, Ekonomi, HAM dan lain-lain. al-Raysuni berusaha menjadikan maqās}īd sebagai manhaj al-fikr (metodologi berpikir) salah satunya adalah dengan teori dominasi (taghlib) diantara maslahah dan mafsadah adalah sesuatu yang fitrah dan ditunjukan dalam agama dan syariah, maka yang paling kuat (arjah) diantara dua maslahah adalah yang paling luas kemanfaatanya dan paling minimal daruratnya. Dalam kerangka pikir seperti di atas, Ahmad al-Raysuni dalam karya- karyanya hadir untuk mengembalikan ruh tasri’ sebagai metode istinbat hukum Islam.

Abstract

This research is motivated by the products offered by BPRS Madinah Lamongan, namely employee financing products with murabahah which recently has quite high demand from customers. Employee financing is provided to internal employees and general employees of BPRS Madinah Lamongan for consumptive purposes. This research is field research. Data sources consist of primary and secondary data using data collection methods of observation, interviews and documentation. After the data is collected, the writer analyzes the data using qualitative descriptive methods with descriptive, inductive and deductive methods. The findings reveal that the employee financing system with murabahah in BPRS Madinah Lamongan principally is in line with Islamic economics. Its impact and influence are very positive. Likewise with the implementation, elements of irregularities according to the Islamic economic system have yet to be discovered.
