Abstract

an international treaty is an agreement made by two or more countries to regulate their relations in various fields, such as politics, economics, security, or the environment. The relevance of an international treaty lies in its efforts to create cooperation, prevent conflict, and ensure that common interests can be realized fairly. If the agreement focuses on trade, it can open up new market access, increase investment, and strengthen economic relations between the two countries. Defense treaties or security alliances help prevent military threats and create regional stability.This study aims to determine the similarities and differences in legal protection related to trademark plagiarism in Indonesia and Singapore and to identify the factors that cause similarities and differences in the legal systems related to trademark plagiarism in both countries. The findings of this study indicate that Indonesia adheres to the Civil Law system with the principle of first-to-file registration, while Singapore follows the Common Law system with a self-assessment approach. Although both countries have ratified international agreements such as TRIPs, real differences are seen in the way law enforcement and dispute resolution are carried out. Indonesia emphasizes legal certainty through formal registration, while Singapore prioritizes efficiency and flexibility in trademark registration and dispute resolution mechanisms. Social, economic, and political factors contribute to these differences, where Singapore as a global trade center creates a responsive and adaptive environment to change, while Indonesia focuses more on protecting local industries with a more conservative approach.

Abstract

This research analyzes the legitimacy of Myanmar's government as an ASEAN member post-2021 military coup through normative juridical research methods. Myanmar's military coup has caused a humanitarian crisis with regional impacts. Research shows that the coup fails to meet defactoism theory parameters and constitutional legitimacy. ASEAN applies the Estrada theory by upholding the non-intervention principle through the Five-Point Consensus, but this approach proves ineffective. ASEAN's non-intervention principle needs reformulation by considering the High Council establishment according to Treaty of Amity and Cooperation, along with strengthened cooperation with the international community in handling coups involving human rights violations

Abstract

The recognition of a state is the acknowledgment that a unit, born and recognized, has met the requirements set by international law to be considered a state, thus recognized as a legal entity in international law and society. The emergence of a new state as a result of a peaceful decolonization process generally does not pose issues regarding recognition. However, if the new state arises from rebellion, revolution, or a movement for independence, the act of granting recognition could have negative consequences, potentially straining relations with the parent state, which may perceive it as an affront or even as intervention. International law itself is explanatory or coordinative in nature and does not recognize hierarchical structures. Recognition can be categorized into several forms: de facto recognition, de jure recognition, collective recognition, conditional recognition, provisional recognition, ad hoc recognition, premature recognition, and curator recognition. In this context, the dynamics of state recognition in international law are often influenced by global and regional political contexts. Beyond the political aspects, in the framework of international law, states are the primary subjects, and recognition establishes a state's status and sovereignty as equal to other states on the international stage. When a state receives recognition from others, it can engage in international relations with those states.

Abstract

The conflict between Israel and Palestine is receiving a lot of attention from the world community. This calls into doubt the security of every nation, particularly those engaged in hostilities. In order to better understand how Israel's military aggression against Palestine breaches international humanitarian law, this case study will focus on how the UN is in charge of deciding whether or not Palestine is recognized by international law. This study analyzes legal concerns using a normative juridical method. The criteria and tenets of positive law serve as the foundation for this. The concept of the law of war is the foundation of international humanitarian law, which governs armed conflicts in an effort to prevent atrocities and safeguard all parties.

Abstract

Indonesia and the European Union are involved in an international trade dispute over palm oil, which has been addressed through the Dispute Settlement Body (DSB) of the World Trade Organization (WTO). The dispute was triggered by the European Union's policies, such as the Renewable Energy Directive II and regulations related to palm oil-based biofuel, which are considered discriminatory and detrimental to Indonesia's exports. The WTO, through the DSB, successfully mediated the trade dispute between Indonesia and the European Union. From the perspective of international law, the WTO serves as an institution that enforces binding rules, enabling it to resolve trade disputes fairly. The WTO panel reviewed the Technical Barriers to Trade Agreement and the General Agreement on Tariffs and Trade 1994, which were the core of Indonesia's objections. The panel's findings revealed that certain European Union policies violated the principle of non-discrimination, while some of Indonesia's claims were not substantiated. This article also examines the implications of the decision through the lens of the theory of comparative advantage, which supports Indonesia's right to utilize its natural advantages in efficiently producing palm oil. The WTO's decision is expected to encourage the European Union to revise its policies and strengthen Indonesia's position in global trade.

Abstract

International business disputes are increasing in line with the development of trade between countries. The resolution of cross-border legal disputes through national courts often faces various obstacles, so international arbitration is a widely recognized alternative solution. This study analyzes the role of arbitration as an international business dispute resolution mechanism and the legal options used in international arbitration. Arbitration is one of the mechanisms for resolving international business disputes that tends to be chosen over the courts because of its advantages which include confidentiality, trust from business people, the expertise of arbitrators, and a fast and final process. In international arbitration, the parties have the freedom to determine the applicable law.

Abstract

The purpose of this study is to analyze gambling from the perspective of Indonesian and Thai law. From the perspective of Indonesian criminal law, the crime of gambling is threatened by the laws and regulations in force in Indonesia, namely Law Number 7 of 1974 concerning the Control of Gambling, Article 303 of the Criminal Code, Article 303 bis of the Criminal Code and Government Regulation Number 9 of 1981 concerning the Implementation of Gambling Control. Meanwhile, Thailand legalizes gambling by dividing it into two categories that have been stated in a regulation, namely the Thai Civil and Commercial Code B.E. 2466 (1923) or the Civil and Commercial Code B.E. 2466, Gambling Act, B.E. 2478 (1935) or the Gambling Law B.E. 2478 and the Government Lottery Office Act B.E. 2517 (1974) or the Government Lottery Office Law B.E. 2517 which regulates gambling currently in Thailand. Articles 835 – 855 of the Civil and Commercial Code. This research is a normative legal research with a comparative approach, using library research data collection tools as data collection techniques and analyzed using qualitative methods.

Abstract

This paper is the result of descriptive research to examine the use of firearms by certain Immigration Officials within the scope of the Directorate General of Immigration in the implementation of Immigration functions in the field of law enforcement and state security. The purpose of this study is to provide an overview of the use of firearms in accordance with Law Number 63 of 2024 concerning the Third Amendment to Law Number 6 of 2011 concerning Immigration. The approach method used is the normative juridical method, namely the application of analysis based on a statutory approach and a comparative approach to international practice. The results of the study state that there is no regulation governing the use of firearms within the scope of the Directorate General of Immigration so that it must be made immediately in order to provide comprehensive legal protection in the implementation of the Immigration function.

Abstract

In the field of maritime transportation, there is a generally accepted principle worldwide known as the Cabotage principle. This principle stipulates that domestic maritime transport activities must be conducted by local shipping companies using national flagged vessels with local crew members. Cabotage Principle implementation prevents foreign shipping legal entities from conducting business activities to serve maritime transport between ports in the the territory of Indonesia. Consequently, to engage in such business activities, foreign shipping companies must establish subsidiaries in Indonesia. However, according to investment regulations in Indonesia, foreign investors are limited to a maximum capital ownership of 49% to establish a shipping company. This paper will examine Cabotage principle implementation, which necessitates foreign investment in Indonesia for domestic maritime transport, with the investment being limited to a max of 49%. This will be analyzed in the relation to application of Control by the Host State and the principles of protection in the Foreign Investment Agreement agreed upon by the Indonesian Government with other countries.

Abstract

Letter of Credit, often referred to as L/C, is one of the internationally recognized methods of payment in Indonesia. An L/C is a document that contains a guarantee from a bank, indicating that the buyer will fulfill the payment obligations as agreed upon, including the specified amount and payment deadline. In the event of the buyer's default, the bank will guarantee the payment. Unfortunately, the implementation of L/C in Indonesia has faced criticism and issues due to the lack of rigid regulations governing its use. The regulations regarding L/C are briefly mentioned in Government Regulation No. 1 of 1982 and Bank Indonesia Circular No. 26/34/ULN, but these regulations do not fully accommodate the application of L/C in Indonesia. Based on these grounds, the author intends to examine the validity of L/C in Indonesia based on the prevailing regulations and discuss the resolution of L/C disputes in Indonesia, given the lack of specific regulations concerning such matters.
