Abstract

The ratification of Law Number 3 of 2022 concerning the State Capital (UU IKN) has many pros and cons. This is because the formation of the IKN Law has many inconsistencies, such as the lack of public participation and the shortness of the formation process because it only takes 43 days. Then, legal politics has a strong relevance to the policy direction of forming legal products. This paper uses a normative juridical method with a law and case approach. The results of the study stated that in the formation of the IKN Law, the legal politics in it did not reflect the needs of the community. It is evident from the shallow analysis of academic texts to indications of formal and material defects due to hasty formation.

Abstract

After the enactment of Law Number 3 of 2022 concerning the State Capital, it has implications for the regional government system. This is a logical consequence of the a quo arrangement which designs of the Archipelago Capital Authority with a special nature and all the powers attached to the agency. The new regional government system certainly reaps pros and cons because it is considered unconstitutional and the concept of regional government is ambiguous.  However, at the legal political level, the actual establishment of the Archipelago Capital Authority Agency is a manifestation of Article 18B paragraph (1) of the 1945 Constitution of the Republic of Indonesia which expressly states that the state recognizes and respects regional government units which are special and exclusive.

Abstract

The provisions of Article 5C of Law No. 17 of 2022 concerning West Sumatra Province contain the Adat Basandi Syarak - Syarak Basandi Kitabullah (ABS-SBK) which is a Minangkabau traditional philosophy. However, the determination of the Minangkabau traditional philosophy does not yet have a clear benchmark, thus making the legal politics of the West Sumatra local government seem to favor one particular group. It is feared that the philosophy based on syarak will form a sharia-based regional regulation. In addition, the traditional philosophy leads to a custom, namely Minangkabau, which raises questions about the position of the Mentawai in West Sumatra who are not Minangkabau indigenous peoples.

Abstract

The 2009 Montara case has caused losses to around 15,000 seaweed farmers in NTT. In 2021, the Australian Federal Court found PTTEP Australasia guilty and obliged to pay compensation. The judge's consideration is that he believes that the Montara oil spill did indeed reach Rote/Kupang and materially contributed to the damage to the seaweed. The judge found that PTTEP Australasia had a duty of care for the victims who were actually violated. This decision has the potential to set a precedent for transboundary marine pollution cases, trigger more environmental class action lawsuits, and demonstrate the need to establish an international convention regarding compensation for losses due to pollution caused by offshore oil businesses.

Abstract

Research by Indonesian Corruption Watch shows that corruption is one of the bad images of the State Civil Apparatus. On the other hand, Permendagri No. 15 of 2020 concerning the Code of Ethics for State Civil Apparatuses regulates the code of ethics that forms the basis for ASN performance. This study examines the relationship between corruption and the ASN Code of Ethics with the results of the study concluding that the ASN code of ethics prohibits the practice of benefiting oneself and one's class for ASN with the threat of dishonorable dismissal to the imposition of sanctions regulated through various regulations. Abstract

After the Constitutional Court of Indonesia declared it unconstitutional conditionally, the Law on Job Creation was declared valid within 2 years of the revision. Based on the enactment of the Law on Job Creation, the regulation in Law on the environment is changed in Law on Job Creation which previously drew criticism and is declared valid. There are criticisms of it regarding the environment in the Law on Job Creation. First, regarding Business Licences that abolish Environmental Permits, and the regulations regarding the issuance of AMDAL which is only a requirement for high-risk business activities. These policies are considered only concerned with the business sector without considering sustainable environmental preservation as regulated in the Law on Environmental Protection and Management.

Abstract

Biodiversity in Indonesia has provided many benefits for the community. Unfortunately, the issue of biodiversity crisis is starting to become dangerous, so efforts to preserve the environment are needed in areas that are in close contact with the community, one of which is tourism. For this reason, the term ‘community-based ecotourism’ principle has now been developed. This principle involves local residents, who have long known and managed various types of resources contained in an ecotourism area, as the main actor in the tourism sector. The recommended form of involvement in implementing this principle is the use of the bottom-up approach and the existence of law in it.

Abstract

The Mineral and Coal Law currently used is Law No. 3 of 2020 concerning Mineral and Coal Mining, a change to Law No. 4 of 2009 concerning Mineral and Coal Mining. This Act is a tool for regulating the mining of minerals and coal and its various permits. With the aim that the state obtains huge profits from mining products that can be used for the welfare of the people. But in reality, currently, there are several crucial articles that have the potential to harm the community and also the environment in Law No. 3 of 2020 and the Manuscript of the Job Creation Law No. 11 of 2020 in the Mineral and Coal Mining Sector in lieu of the Mineral and Coal Law.

Abstract

The passage of the Job Creation Law brought about many fundamental changes in economic policy, including environmental licensing. The reason is that there is a fundamental legal political change that is more directed towards the ease of doing business and investing compared to environmental conservation, namely by changing the terminology of environmental licensing to environmental approval. So in this paper, the author will discuss how to analyze the legal politics of environmental licensing governance after the Job Creation Act. The results of this study indicate a change in legal politics in environmental licensing governance after the Job Creation Act which has implications for the business licensing system. So that a legal mapping is needed regarding the ideal concept of environmental permitting to be in accordance with the 1945 Constitution of the Republic of Indonesia.
