Abstract

The issuance of Freehold Title Certificates (Sertipikat Hak Milik/SHM) for land is intended to provide legal certainty; however, in practice, ownership disputes frequently occur. The issue becomes crucial when involving the conversion of customary land titles (hak milik adat), which in practice has not fully guaranteed legal certainty regarding the history of ownership. This problematic is reflected in Supreme Court Decision No. 1012 K/Pdt/2023. The Supreme Court dismissed the cassation appeal from the heirs (certificate holders) on the grounds that they failed to prove a legal relationship with the original owner, whereas PT. MKP was able to provide evidence of a deed of relinquishment of rights and 20 years of physical possession. The results show, This decision erroneously re-imposes the burden of proving inheritance status on the SHM holder, undermines the negative publication system with a positive tendency, and fails to provide legal protection to the bona fide certificate holder.

Abstract

Drug abuse in Sukoharjo Regency has shown a rising trend influenced by increasingly complex structural, social, and individual factors. This study aims to analyze the characteristics and patterns of drug abuse within the jurisdiction of the Sukoharjo Resort Police and identify criminological factors contributing to the rise of drug-related crimes in the region. Field findings and normative analysis indicate that most offenders are individuals in the productive age group, particularly 17–35 years, with commonly abused substances including methamphetamine, synthetic tobacco, and marijuana. Distribution patterns have evolved through digital communication platforms, "drop-point" systems, and inter-regional networks, enhancing the organized nature of these crimes. From a criminological perspective, the increase in drug cases is driven by weak family supervision, peer influence, economic pressures, rapid urbanization, and the weakening of traditional social controls. Industrial environments and high population mobility further facilitate the entry of illicit drug networks.

Abstract

The purpose of this study is to reveal Constitutional Court Decision No. 20/PHPU.BUP-XXIII/2025 regarding the dispute over the results of the 2024 regional head elections in Pesawaran Regency from the perspective of Siyasah Qadha'iyyah. Using a normative qualitative method with a literature review approach, this study examines the judicial authority of the Constitutional Court and the application of Islamic legal principles in resolving election disputes. The findings indicate that the decision has embodied the principles of al-'adl (justice) and al-amanah (responsibility) by disqualifying candidates who violated administrative requirements and ordering a re-vote. However, the emergence of further legal challenges and prolonged leadership vacancies indicate ongoing challenges in achieving substantive justice and al-maslahah (public interest). This study concludes that the ruling, although procedurally adequate, requires improvement in terms of evidentiary standards, transparency mechanisms, and procedural efficiency to better align with the values of Siyasah Qadha'iyyah, which emphasizes a balance between justice, public interest, and social cohesion.

Abstract

The practice of using power of attorney to sell in land sale and purchase transactions without notarial legalisation has given rise to complex legal problems because it harms the parties and creates legal uncertainty in the Indonesian land system. This study uses a normative juridical method. The results show that a power of attorney to sell affixed with a thumbprint without notarisation does not meet the formal requirements as stipulated in Article 1874 paragraph (2) of the Civil Code and Article 286 paragraph (2) of the RBg. Analysis of the legal considerations of the panel of judges in Supreme Court Decision Number 2513 K/ Pdt/2018 reveal fundamental weaknesses because they prioritise administrative aspects, thereby creating tension between the protection of bona fide buyers and substantive justice for landowners who are victims of power abuse.

Abstract

The misuse of personal data provided for limited purposes, demonstrates a systemic vulnerability in legal protection for victims. Based on an analysis of the Nganjuk District Court Decision Number 240/Pid.Sus/2025/PN.NJK, this research identifies a normative gap between the preventive mechanisms regulated in Law Number 27 of 2022 concerning Personal Data Protection (PDP Law) and judicial practices that remain repressive-formal in nature. The judge only imposed criminal sanctions without ordering restitution or recovery measures for the victims, despite proven immaterial losses and financial risks. The key finding of the study indicates that a restorative approach—which positions victims as the primary subjects of their constitutional rights restoration—has not been adopted in the implementation of the PDP Law at the court level. The novelty of this research lies in its specific critique of the judge’s failure to apply victim recovery mechanisms despite the normative guarantees in the PDP Law, thereby emphasizing the disparity between the theory of personal data protection law and its enforcement practice.

Abstract

Abuse of authority by corporate managers or directors in using their positions to divert company funds for personal or group interests in the form of embezzlement that is not in accordance with corporate objectives and compliance principles. This study aims to analyze the form of financial embezzlement violations by corporations as well as law enforcement and efforts to prevent criminal acts of embezzlement in corporations based on the principle of legal compliance. This study uses a normative legal research method and uses a legislative approach and a conceptual approach. The results obtained from the study are that the form of violation committed is Embezzlement of Funds by Employees or corporate managers directly by taking or using company financial assets without legal knowledge and approval. Law enforcement and prevention efforts carried out are by applying Article 372 of the Criminal Code to be the basis for imposing sanctions on perpetrators of criminal acts of embezzlement. Furthermore, in efforts to prevent criminal acts of embezzlement in corporations, by applying the principles of compliance with company regulations that apply to corporations. Efforts to prevent criminal acts of embezzlement in the corporate realm are also carried out by implementing PERMA Number 13 of 2016, concerning Procedures for Handling Criminal Cases in Corporations, which gives judges the authority to criminalize corporations as legal subjects.

Abstract

This study aims to analyze the judge's considerations in the Rantauprapat District Court Decision Number 813/Pid.B/2025/PN Rap regarding the crime of aggravated theft committed by the defendant FAM against two 3 kg LPG gas cylinders. The research method used is normative juridical with a statutory approach and decision study. The results of the study indicate that the Public Prosecutor demanded a six-month prison sentence for the defendant based on Article 363 paragraph (2) of the Criminal Code, while the panel of judges sentenced him to five months' imprisonment. The decision was based on the fulfillment of all elements of aggravated theft, especially because the act was committed at night, in collaboration, and by damaging and climbing the victim's house. However, from the perspective of substantive justice, this decision raises the issue of injustice considering that the value of the victim's loss is relatively small and is below the limit of IDR 2,500,000 as stipulated in Supreme Court Regulation Number 2 of 2012 concerning Adjustment of the Limits for Minor Crimes, which opens up space for non-imprisonment settlements. Thus, this study concludes that although the judge's decision has fulfilled legal certainty, there remains a tension between the application of formal law and the principles of justice and expediency in cases of petty crimes motivated by economic motives.
