Abstract

The existence of Indonesia as a rule-of-law country has consequences for promoting and protecting human rights which are inherent and cannot be separated because of the presence of the rule of law itself. The application of the death penalty in Indonesia is still a matter of pros and cons in the midst of rampant cases of sexual violence. Based on this polemic, this research focuses on examining whether the death penalty in the case of the decision actually violates human rights or vice versa. The decision stated that the defendant was sentenced to death based on a juridical analysis and the judge's considerations. The application of the death penalty should no longer be enforced in Indonesia because it violates fundamental human rights, namely the right to life.

Abstract

Extrajudicial killings is an execution by state actor without judicial proceeding. Police officers as state actor in their duty enforcing the law have the authority to use firearms. However, there are police officers commit extrajudicial killings in their duties. Extrajudicial killing is a violation of the right of life that cannot be reduced under any circumstances and violation of the Presumption of Innocence. The results of this study showed that extrajudicial killing is extraordinary crime that has been regulated in national and international regulations. The responsibilty of extrajudicial killing is the state's obligation to protect the human rights of its citizens.

Abstract

Ship crew is a job that is in demand by some people because it is based on lucrative wages, but in reality, there are cases of torture and slavery of crew members which are then classified as human rights violations. The government has an obligation in the form of protecting the human rights of Indonesian crew members on foreign ships. Legal protection the government provides consists of two forms: preventive protection and repressive protection. Not only that, in minimizing slavery to the ship crews, the government made efforts to enforce the law in the form of cooperation with other countries to achieve the goal of handling slavery.

Abstract

For non- Indigenous Indonesian citizens of Arab descent, to have land rights until now is still based on the Instruction of the Deputy Governor of DIY Number K.898/I/A/1975. Based on these provisions, non-native Indonesian citizens of Arab descent cannot have land rights, and if the descendants of Indonesian citizens who have owned property rights prior to the issuance of the Instruction of the Deputy Governor of DIY Number K.898/I/A/1975, are required to relinquish their property rights to the state for converted into other land rights. This is a form of discrimination and is against the principles of human rights.

Abstract

Air Transportation is obliged to provide safety guarantees for its passengers. The airline as the carrier is required by law to be responsible for the loss suffered by the passenger for the loss suffered due to the operation of air transportation. Until now, there are still many incidents of air transport accidents that cause death and injuries to passengers. According to data from the Aviation Safety Network, until now in Indonesia alone, there have been 104 aircraft accidents with more than 1300 fatalities. This is the basis for the importance of further reviewing the legal protection for passengers who die in air transportation.

Abstract

Patent protection on types of drugs before and after the TRIPs agreement has become a hot topic of discussion regarding drug patents and the general public's access to medicines. Drugs are available, but the quality standards are not good because they are counterfeited or produced without credible quality control so they are dangerous. The implementation of mandatory TRIPs licensing of medicines in Sweden is carried out in accordance with the Swedish State Patent Law (Sweden Patentkungörelsen 1967). Regarding the mandatory licensing of the TRIPs Agreement by the government in Sweden, it is in accordance with Paragraph 6 of the Doha Declaration on TRIPs Agreement and Public Health, namely, Promote access to medicines for all on the basis of implementation as stated in Article 31 of the TRIPs Agreement. The public hopes that the implementation of patents by the Government on drugs, especially antiretrovirals in Sweden, can facilitate access for people with HIV/AIDS to obtain the needed antiretroviral drugs. In addition, the implementation of compulsory licensing for local producers can be an effective strategy to promote generic drug competition in the pharmaceutical industry.

Abstract

Plea Bargaining developed in the United States of America. It is a negotiation between the public prosecutor and the accused or their defender so that the process of resolving criminal cases is carried out quickly and effectively. Plea Bargaining became the basis for the formation of the concept of “special lane” in Indonesia in article 199 of the Criminal Procedure Code Bill. Both of these concepts carry the short examination mechanism. The difference is in the "special lane" the defendant cannot negotiate with the prosecutor regarding charges or threats of punishment because the defendant's guilty plea was made in front of the judge during the trial and the “special line” is used for crimes that have a threat of no more than 7 years while Plea Bargaining applies to all types of crimes.

Abstract

The General Assembly is the main organ of the United Nations (UN). In this organ, all members, both large and small countries, all have equal voting rights. This organ functions as the main place of discussion and decision-making in every UN activity, which is carried out in the form of sessions that pass various resolutions. This study will discuss the regulations regarding membership, functions, and powers, and decision-making in the General Assembly that have been regulated in the UN Charter, as well as the application of these regulations in a case study related to the resolutions passed. Even though they do not have binding legal force, General Assembly resolutions can still have a significant effect on international relations.

Abstract

The momentum of the cases of Ferdy Sambo, Kanjuruhan, and the Santa Cruz incident in the past has raised legal awareness that orders from superiors can cause subordinates to act against the law. Can subordinates refuse orders from superiors that are against the law? What are the legal consequences that they must bear? Does the law even require them to refuse such orders to prevent the law from being violated? Is there a concept that governs this in international law? The method used is a normative legal study and is sharpened by discussing special cases from the practice of nations. Discussions related to the topic of Insubordination to Unlawful Order in history, provisions of international law, state practice, and Indonesian positive law as well as the main challenges that will be faced. It ends with the conclusion that countries have maintained this concept well even though there are differences in implementation, while Indonesia has not implemented it in the national legal system and will cause various legal problems. It is highly recommended that Indonesia adopt this concept as a response to the increasing intensity of global conflicts in the future.

Abstract

The manuscript entitled "The Impact Of Development In The Era Of Globalization On The Realization Of Human Rights In A Good And Healthy Environment" published in Lex Generalis Law Journal Vol.3 No.12 (December 2022) on the link https://ojs.rewangrencang.com/index.php/JHLG/article/view/317 to the Editor's search has the main similarity substance with the manuscript that has been published previously in another journal, namely Jurnal Pembangunan Hukum Vol.1 No.3 (2014) on the http://jurnal.unissula.ac.id/index.php/PH/article/view/1487/1155. When we came across these findings, we tried to contact the authors via email (as they did not contact us via text message or an app like WhatsApp nor did we find their personal social media accounts). However, because there is no answer to explain this problem, we here unilaterally see that there is copyright infringement or plagiarism by copying and pasting the entire file in one of the manuscripts in the Jurnal Pembangunan Hukum (author: Setyo Utomo), making slight changes such as changing the word "Influence" to "Impact", and submitting the file to our journal via OJS. Thus taking into account the absence of evidence or rebuttal from the author, the Editorial decided to retract this manuscript from our journal.
