Abstract

Abstract This study discusses the effectiveness of the Religious Affairs Office (KUA) in making waqf pledge deeds in Mamajang District, Makassar City. What the author explores is how the Religious Affairs Office (KUA) in Mamajang District, Makassar City acts as a PPAIW and how the management of the Religious Affairs Office (KUA) in Mamajang District, Makassar City in making waqf pledge deeds. The type of research used is field research using qualitative methods. With the main source of this research is data in the field as the main source such as observation, interviews and documentation. The results of this study reveal that the KUA in Mamajang District acts as a PPAIW which is described into four, namely, the KUA acts as a verifier, facilitator, educator, and mediator. The management of the KUA in Mamajan District in making waqf pledge deeds so far out of 11 waqf assets, only 2 waqf assets have been made into waqf pledge deeds. The KUA in Mamajang District has not been effective in issuing waqf pledge deeds, this is due to, 1) The absence of a certificate of ownership of waqf property, 2) The deceased Wakif, and 3) Lack of public awareness. The need for understanding to provide valuable insights in the development of religious and legal knowledge, especially about waqf. Support the KUA in Mamajang District in conducting more active socialization to increase public understanding of waqf. Keywords: Deed of waqf Pledge, Effectiviness, KUA

Abstract

This study discusses the Application of the Principles of Fast, Simple, and Low-Cost Trials in the Practice of Mass Marriage Isbat Trials at the Makassar IA Religious Court in 2020. The main issues consist of two sub-problems: the practice of Mass Marriage Isbat trials at the Makassar Class IA Religious Court and the implementation of The principle of fast, simple, and low-cost tests at the Makassar Class IA Religious Court. This study uses empirical legal research, which is a type of legal research method that is carried out by examining the actual situation that occurs in society. This research uses a sociological approach, a normative approach (sari), and a juridical approach. The data collection methods used are interviews, observation, and documentation. The results of this study indicate that applying the principle of expeditious justice in trials of mass marriages at the Class 1A Makassar Religious Court in 2020 has provided benefits in speeding up the trial process. With a more efficient and fast operation, the parties involved in the trial can immediately obtain a final decision. The principle of simple justice has been proven to provide easy access for the public to submit requests for constituencies for mass marriages. The simple and uncomplicated procedure makes it easier for the public to understand the processes and requirements that must be met, thereby providing more expansive opportunities for those who wish to enter into a marriage bond. Abstract

This study aims to analyze the principle of substantial justice in its application within Indonesia’s Personal Data Protection Act (UUPDP) by comparing Indonesian positive law with Islamic law. The UUPDP was introduced to protect personal data owners, covering rights such as access, rectification, deletion, and the right to refuse data processing. The implementation of this law faces challenges that ultimately hinder comprehensive data protection. Privacy rights are also emphasized in Islamic law, alongside the right to fair treatment, which is a fundamental principle aimed at protecting individuals’ substantive rights. The findings of this study reveal that UUPDP implementation remains suboptimal, particularly in terms of law enforcement, affecting the effectiveness of substantial justice applications. Enhancing the effectiveness of the UUPDP can be achieved through robust law enforcement, improved infrastructure and human resources, and public education. By integrating Islamic law and positive law, a stronger ethical foundation and a broader landscape are provided for assessing, evaluating, and maximizing personal data protection. These recommendations include enhancing UUPDP implementation, strengthening dispute resolution mechanisms, and ensuring that the principle of substantial justice is fully and optimally applied in protecting the personal data of Indonesian citizens.

Abstract

This study aims to analyze the authority of the Judicial Commission in supervising the code of ethics of judges in Religious Courts, as well as the challenges faced in its implementation. The research employs a qualitative approach with field research methods, utilizing primary data from interviews with Judicial Commission officials and secondary data from relevant legislation and official documents, which were analyzed descriptively. The findings reveal that the South Sulawesi Judicial Commission Liaison serves as an extension of the central Judicial Commission, with authority limited to monitoring judicial behavior, the application of the Code of Ethics and Guidelines for Judicial Conduct (KEPPH), and courtroom proceedings. The main obstacle lies in the broad scope of supervision compared to the limited number of personnel, only four members, necessitating a strategy of building community networks to obtain information on suspected ethical violations. The study recommends two measures: first, increasing the number of liaison members in each region; and second, strengthening the authority of the Judicial Commission so that it not only provides recommendations but also possesses executorial power in enforcing judicial ethics.

Abstract

This study aims to analyze the opinions of Imam Malik and Imam al-Shafi‘i regarding the legal position of khulʿ in Islamic marital law, particularly whether it should be classified as talaq or fasakh. The research employs a qualitative approach through library-based normative-doctrinal analysis, focusing on primary sources such as al-Muwattaʾ and al-Mudawwanah al-Kubra by Imam Malik, as well as key texts from the Shafi‘i school. Secondary data are obtained from relevant classical and contemporary literature. A descriptive-comparative method is applied to examine the underlying legal reasoning of both scholars and its implications in contemporary contexts. The findings reveal that Imam Malik views khulʿ as a form of talaq, resulting in a reduction in the number of permissible divorces and granting the husband the right of revocation during the waiting period (ʿiddah). In contrast, Imam al-Shafi‘i categorizes khulʿ as fasakh, thereby permanently dissolving the marriage without the right of revocation. Supporting Imam Malik’s position, the study argues that although initiated by the wife with compensation (ʿiwad), the legal formula of khulʿ remains the prerogative of the husband, making its classification as talaq more consistent. If considered fasakh, khulʿ would paradoxically function as a dissolution mechanism that reinforces the husband’s authority rather than reflecting the wife’s will. Overall, this study contributes to contemporary fiqh discourse on mechanisms of marital dissolution within Islamic law.
