Abstract

The purpose of this study is to analyze the juridical case of Indonesia with Tiongkok related Exclusive Economic Zone in Natuna waters which claimed unilaterally by Chinese government, based on United Nation Convention on the Law of the Sea (UNCLOS) Convention 1982. The methodology used in this study is legal juridical normative research. The data used is secondary data obtained from literature study. After all the data collected, then the data then processed and analyzed, the analysis used qualitatively by means of grouping data aspects studied. Hereinafter drawn conclusions related to this research, then described descriptively. Based on this research, the results obtained by the researchers from 2 (two) formulation of the problem, first about the position of Exclusive Economic Zone Natuna Island waters in review of the UNCLOS convention, second about what legal efforts can be made on the claims of the Natuna Exclusive Economic Zone . Based on this research, the writer considers that there are still many weaknesses and weaknesses, especially related to inter-state border guarantees, there should be agreement between neighboring countries on the boundaries of the territory in order to avoid disputes.

Abstract

Along with urbanization and globalization are growing and developing so rapidly, in addition to a positive impact, but also bring negative influence including Trafficking in persons, or human trafficking. Trafficking itself is a cruel crime that violates human dignity and a violation of human rights of the most concrete and often prey on those who are weak economically, socially, politically, culturally and biologically. Trafficking is not only happening in Indonesia alone but also in the Philippines and just like Indonesia is source country, so that this crime be a global problem.A convention has been created and produced the Palermo Protocol to combat Trafficking which has been ratified by both countries. This study describes clearly and carefully about combat trafficking system (Prosecution, Protection, and Prevention) against human trafficking both countries with their salty legal provisions.This research is a normative juridical law by using the method of comparative law. Data used in the form of secondary data. Data mining is done with literature (library research). After all the data is collected, the data is then processed and analyzed, then used the qualitative analysis point by grouping the data aspects studied. Furthermore, the conclusions drawn related to this research, then described descriptively.Based on this study showed that in terms of countermeasures against crimes recorded although there are more crimes in the Philippines than in Indonesia but the government of the Philippines showed a significant increase in combating human trafficking crimes compared with Indonesia.

Abstract

Rights management is one type of land rights known in Indonesia in addition to property, right to build, right to cultivate, right to use and lease rights. By Right Management, the rights holder has the authority to: plan the allocation and use of land, use the land for the purposes of performing its duties, submit portions of the land to a third party, in accordance with the provisions of the Basic Agrarian Law, and received a cash inflow / replace annual income and money required. Thus authority owned Industrial Development Authority Batam Island (hereinafter referred to Batam Authority) since it was created as an institution that is in charge and responsible for the growth and development of Batam Island as an industrial area (Kep. Interior Minister 43/1977). And the Batam Authority granted management rights over the entire area of land located in Batam Island, including large areas of land in a cluster of islands including the widow Berhias Batam, Tanjung Sau, and nginang and Kasom Island. The purpose of this research is to know and analyzing the: if the substance of the agreement allocating land between Concession Area Agency Batam and PT. Franindo International has met the principle of legal protection and the principle of justice, remedy what can be done if the land allocated Concession Agency Batam area still controlled by the community, and the economic impact if it can not establish physical land in accordance with the development plan. Juridical empirical research methods. Result: The land allocation agreements are made and enforced Regions Batam Exploitation Agency does not meet the principle of legal protection and the principle of fairness, and the recipient sebahagian land allocation can not run the contents of the agreement because there is resistance from the people who control the land.

Abstract

Perlindungan hukum terhadap merek di Indonesia ditujukan supaya dapat melindungi hak merek yang dimiliki oleh seseorang atau badan hukum, penelitian ini bertujuan untuk mengetahui bagaimana perlindungan hukum terhadap merek yang sama pada usaha tertentu dan Untuk mengetahui bagaimana pertanggungjawaban hukum pihak toko Bossini Tangerang kepada Pihak Bossini Inggris. Metode yang di gunakan adalah metode penelitian hukum normative. Hasil penelitian tersebut adalah gugatan yang di masukkan pihak bossini inggris dan bossini tangerang diakhiri dengan putusan Peninjuan Kembali No 111PK/Pdt.Sus-HKI/2018 yang isinya bahwa pihak tergugat (Bossini Tangerang) beriktikad tidak baik dan menyatakan pembatalan merek sehingga merek dagang Bossini milik Jusi dalam hal ini bossini tangerang sudah tidak berlaku secara hukum. Kesimpulan dari penelitian ini perlunya pendaftaran merek oleh pihak bossini inggris sebelum mendirikan cabang di Indonesia melalui Dirjen HKI supaya terhindar dari pengambilan merek oleh pihak lain.

Abstract

Globalization has basically been implemented in cyberspace, which connects all digital societies or those who often use the internet in their daily activities. Transportation development also includes the method of ordering and payment of transactions for transportation services. In the past, transportation service users ordered via telephone and then paid in cash. In its current development, there are transportation that can be ordered and paid for in a darling (online) system that connects passengers with car drivers through a mobile application In order to answer the problems in this study, the author uses a type of normative research supported by primary data obtained by the author from interviews with various sources. According to observations made by the author, the provider of transportation services with a digital payment system under the auspices of the limited liability company Dompet Anak Bangsa is not fulfilling the terms and conditions to secure the balance (money) owned by users of transportation services with the digital payment system. This situation has a correlation with the results of the author's interview discussed above. Other parties who do not have the right to access the digital payment system and access the balance held by users of transportation services with digital payment systems. Therefore, digital providers of transportation services should also be responsible for reducing the balance of digital payment systems owned by service users because of anything. The intended liability due to the reduction in balance is very detrimental to the service user and the balance is reduced in the digital payment system provided by the service provider. Although this problem is also a criminal offense that can be reported to the police because it is related to cyber crime.

Abstract

Indonesian and Singapore as maritime state, bolstering the maritime sector in every way. One of the effort is through the financial support from the bank sector for shipping industry. And yet the effort of Indonesian and Singapore have faced many problem. The major problem is the nonperforming loan till the event of default, both state must provide legal solution for every bank sector. One of the most suitable legal solution is through the confiscation execution of the ship as credit guarantee. This method offers the most appropriate and fast solution for the bank sector to reclaim their payment from the event of default of nonperforming loan.This research is a sociological law by using the method of comparative law. Sources of data used in the form of primary and secondary data sources. Data mining is done with field research and literature study. After all the data collected, the data is then processed and analyzed, the qualitative analysis is used with the intention to classify aspects of data studied. Furthermore, it is concluded that the research associated with this, then described descriptively.Based on the results of this study showed that there are some similarities and differences in the legal procedure and application of confiscation execution of ship vessel as nonperforming loan guarantee in Indonesia and Singapore. However, in terms of legal liability, the provisions and legal principle in Singapore is better than Indonesia, seen in firmness and law certainty to solve the problem.

Abstract

The purpose of this study is to describe clearly about the rights of Indonesia migrant workers who work in Malaysia. Indonesia is the largest migrant-sending countries in ASEAN and the largest migrant-receiving countries of Indonesia in ASEAN is Malaysia. Indonesia itself as a migrant-sending countries already has regulations that governing the protection of the rights of migrant workers working abroad, namely in the Constitution of 1945 set in general on the rights of migrant workers, and more specifically regulates the protection of the rights of Indonesian migrant workers abroad, namely in Law No. 39 of 2004. Malaysia itself also has regulations that governing the protection of migrant workers, namely the 1955 Employment Act. This research is a normative law by using the method of comparative law. The data used in the form of primary and secondary data. Performed with data mining literature (library research). Once all the data is collected both primary data and secondary data, the data is then processed and analyzed, the qualitative analysis was used to group the data point by the studied aspects. Further conclusions drawn related to this study, then described descriptively. Based on the results of this research, Regulations in Indonesia and Malaysia that governs the protection of the rights of migrant workers who work abroad have not been effective in terms of both rules substance and implementation. Memorandum of Understanding (MoU) governing labor migration between the two countries (Malaysia and Indonesia) in 1998 and signed another one on May 10, 2004. MOU made by the two countries also contains many weaknesses in this MOU are not regulated at all about the migrant workers who work at home and have not been effective in protecting the rights of migrant workers.

Abstract

Hukum yang berlaku dalam masyarakat, pada dasarnya berasal dari masyarakat itu sendiri agar terciptanya keamanan, keselamatan dan secara sengaja pula dibebankan kepadanya, agar masalah/konflik kesehatan serta keselamatan dapat diminimalisirkan. Metode dalam tulisan ini menggunakan metode penelitian hukum normative. Hukum yang diterapkan selalu memperhatikan kaidah yuridis, kaidah filosofis, kaidah sosiologi sehingga tidak bertentangan dengan nilai-nilai yang hidup dalam masyarakat. Hukum yang dibuat dalam masyarakat mempunyai tujuan untuk menciptakan perdamaian, ketentraman, dan ketertiban dalam masyarakat serta memberikan kepastian hukum. Tujuan hukum dapat dirasakan secara komprehensif dalam masyarakat, jika hukum itu dapat berfungsi dalam masyarakat. Dengan demikian hukum dan masyarakat mempunyai korelasi yang sangat signifikan. Masyarakat tanpa hukum, maka akan terjadi kacau balau serta terjadi tindakan yang sewenang-wenang, begitu pula sebaliknya hukum tanpa ada masyarakat, maka hukum itu tidak berarti sama sekali. Bukan negara yang membatasi, tapi COVID-19 yang sulit dilihat dengan mata melukiskan derita kita yang diterjang tiga krisis: medis (epidemi itu sendiri), ekonomi (yang terpukul keras apapun dampak epidemi) dan psikologis.

Abstract

State-owned enterprises in the form of Persero which in carrying out its business continues to develop, it is unfortunate until now there are still unclear provisions of the arrangement and often cause problems in relation to the element of state ownership of the assets of the Persero, especially if the Persero experienced losse. So it raises msalah concerning the status of state assets separated on state-owned enterprises in the form of Persero and the relationship between state assets separated on state-owned corporations with corruption in the case no. 1144 k / pid / 2006 and no. 414 / K / PID.SUS / 20114. This Research was conducted based on normative law using Normative Law Research method. The data source used is secondary data source. Data were collected by literature study. After the data is collected, the Author processes and analyzes the data. Qualitative analysis is used to classify data based on the aspects studied. The conclusions illustrated relate to this study, then presented by the author descriptively. Based on this research study, State Property Status Is Separated In State-Owned Enterprises There is no uniformity or disharmonization of legislation regarding the rules that govern UUKN State Wealth Is Separated In State-Owned Enterprises Persero still be the object of state finances but instead UUBUMN looked at the State's Wealth Separated In State-Owned Enterprises are separated from state wealth. The relationship between state assets separated from state-owned enterprises and corruption is closely related, law enforcement officials place the loss of SOEs in the public legal aspect (State finance) so that the rules follow the mechanism set forth in the State Finance Law and the Corruption Eradication Act. Abstract

Everyone, including the government of a country needs to be aware of the importance of human rights as one as the natural right. One of them is the freedom to associate, including the freedom to associate for the employees. The intention of the author in this thesis is to make a review about provision of legal protection for employees in the State of Indonesia and Malaysia, in terms of providing fulfillment to employee’s right, as one of human rights. The methodology by author in this research is used the normative legal research based on comparative law. The data in this research is used secondary data obtained from the study of literature (library research). After the required data has been collected, it will be processed and analyzed to find the object of legal issues. Furthermore, the authors will provide a conclusion and describe the conclusion descriptively. The result of this research indicates that the State of Indonesia and Malaysia already have provisions on freedom of association for employees. The difference between provisions of Indonesia State and Malaysia State is the Indonesian State has a firmer provision than the State of Malaysia, Indonesia also provide the better law protection for freedom of association for employees in the country.
