Abstract

TP4 is an Attorney General's innovation to eradicate corruption. Its function and role to guard and secure national strategic projects. This research is aimed at knowing and analyzing the effectiveness of the role of the Government Guards and Safeguards and Regional Development (TP4D) in preventing corruption in the Cilacap Regency. In addition, it is also to find out and analyze the constraints of the Government Guard and Regional Development Guards and Team (TP4D) in preventing corruption in Cilacap Regency. The study used a sociological juridical approach, with secondary data sources and quantitative analysis.The results showed that, the role of the Government Guards and Regional Development Guards in preventing corruption in Cilacap Regency could be said to be quite effective, namely the Government Guards and Regional Safeguards and TP4D passively guarding, securing and supporting the success of the administration and development, namely Government Guards and Safeguards and Regional Development (TP4D) only when requested. Not all aspects of regional development are escorted by the Cilacap District Attorney and Regional Development Guards and Safety Team (TP4D), because there are other supervisory organizations such as user accounts, APIP and the internal organization of regional government. The Cilacap District Attorney Office basically acts as an effort to prevent corruption, so the Attorney General's Office will take firm action even proposing that it be stopped in the cultivator through a mechanism that is determined, if there is a procedural error we will take further action, because this is public money, and must be carried out correctly. The Cilacap District Attorney's Office escorted the Cilacap Regional Hospital renovation building construction project to the end and decreased corruption corruption cases in Cilacap Regency. The obstacle of the Government and Regional Development Guards and Security Teams (TP4D) in preventing corruption in Cilacap Regency is that it is still not well known about the TP4D duties and functions, there are still irregularities committed by the Cilacap District Government despite the assistance and socialization by TP4D and SKPD, and still not all are interested or willing to cooperate with TP4D to guard against development within the scope of the SKPD.

Abstract

Anak sebagai makhluk Tuhan Yang Maha Esa dan makhluk sosial, sejak dalamkandungan sampai dilahirkan mempunyai hak atas hidup dan merdeka serta mendapat perlidungan baik dari orang tua, keluarga, masyarakat, bangsa dan negara. perlindungan anak secara yuridis dapat meliputi perlindungan hukum anak dalam bidang hukum perdata dan dalam bidang hukum publik. Setiap anak mempunyai hak asasi, sebagaimana hak yang dimiliki oleh orang dewasa, tidak banyak pihak yang turut memikirkan dan mau melakukan langkah-langkah konkret untuk melindungi hak anak. Anak mudah sekali untuk menjadi korban dari segala bentuk tindakan kekerasan ataupun kejahatan karena anak belum dapat untuk melakukan hal-hal untuk melindungi dirinya sendiri dengan baik.Metode penelitian ini yang digunakan adalah penelitian hukum normatif. Sumberbahan hukum yang terdapat dalam penelitian ini berasal dari bahan hukum primer, sekunder, dan tersier dengan teknik pengumpulan data berdasarkan studi kepustakaan dan teknik analisis data menggunakan metode deduktif.Berdasarkan hasil penelitian ini diketahui bahwa Perlindungan hukum terhadapanak sudah diatur dalam Konvensi Hak-hak Anak yang mana hak-hak anak harusdilindungi dan dijamin agar dapat hidup, tumbuh, kembang, dan berprestasi didalam mendapatkan pendidikan yang layak dan bermutu. Demi mewujudkan perlindungan dan kesejahteraan anak maka telah tersusun kelembagaan dan peraturan perundangan yang dapat menjamin pelaksanaannya. Di Indonesia, pengaturan perlindungan hukum terhadap anak telah diatur dalam Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak, kemudian Undang-Undang Nomor 35 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak, selanjutnya telah dilakukan perubahan kedua yaitu Undang-Undang Nomor 1 Tahun 2016. Pada prinsipnya pengaturan mengenai perlindungan anak sudah cukup mengaturnya, hal ini dilandasi bahwa Indonesia melalui Keputusan Presiden Nomor 36 Tahun 1990 telah meratifikasi Konvensi Hak Anak yang mengemukakan tentang prinsipprinsip umum perlindungan anak, yaitu nondiskriminasi, kepentingan terbaik bagi anak, kelansungan hidup dan tumbuh berkembang dan menghargai partisipasi anak. Dengan demikian, Konvensi PBB tersebut telah menjadi hukum Indonesia dan mengikat seluruh warga negara Indonesia. Dibentuknya Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak dan perubahan-perubahannya dimaksudkan sebagai landasan hukum yang secara umum dan menyeluruh mengatur hak-hak anak.

Abstract

The establishment of the act of no. 16 years old 2011 about legal aid give new hope to the poor to get access to justice (access to justice) and similarity in to law (equality before the law). This research intend to understand the extent of the implementation of the provision of assistance in central java and the obstacles affecting it in their implementation. The research is the qualitative study with the methods normatif-empiris approach. Data collection is done with the study documents and interviewing people who are considered closely connected with the problems the treatment. The accumulated data analyzed by using analysis of qualitative data. Act of no. 16 years old 2011 about legal aid not implementation well in central java. Abstract

Mandate to promote participation of the villagers stated in Article 18 paragraph (7) and Article 18B (2) of the Constitution of the Republic of Indonesia Year 1945, one of which is to encourage initiative, movement, and the participation of village communities to the development potential and Assets Village in order commonweal.The substance of the Village Act of 2014 contains a lot of opportunities for people to participate in governance and rural development. Article 3 explicitly states that the village setting one of them are basically the principle of participation that is actively involved in an activity, and then in Article 4 letter d. states that the setting of the village aims to encourage initiative, movement, and the participation of the village community to the development potential and assets for the welfare of the village together, even in Article 68 paragraph (2) letter e. that society is obliged to participate in various activities in the village.Establishment of Village Regulation (Perdes) participatory must reflect the shared commitment between Kepala Desa (village head), Village Consultative Body (BPD) and villagers. To make a good Perdes conducted prior study of potential village and constraints, so Perdes made totally based on needs and not wants.In the process of its formation, Village Regulations require community participation so that the final outcome of Village Regulation can meet the legal enforceability aspect and can be implemented according to the purpose of its formation. Public participation in this case can be input and discordant thoughts in the formulation of the substance of Village Regulations setting. Law or legislation will be able to be effective if it meets three power sell well as the philosophical, juridical, and sociological. Besides, it also must pay attention to the effectiveness / economic power and political behavior.In essence Preparation of Village Regulation is not an activity that is carried out solely to fulfill the duties of Head of Village and BPD, but really to solve the problem and provide benefits to rural communities so respected by the communities themselves.Keywords: Participation, Communities, Village Regulations

Abstract

Health is a basic human right and one of the elements of well-being which must be realized in accordance with the ideals of the nation of Indonesia. The number of doctors who are a little bit in some areas cause most doctor who conducts independent practice or physician clinics delegate or grant authority in conducting medical practice to the health workforce personnel have different competencies, such as Midwives.The purpose of the study to analyse the provisions of the medical act of authority pelimpahan conducted by doctors at the clinic. Methods of Juridical Normative approach is used, the type of research Preskripsi. Data sources used are: primary Data and Secondary Data. Method of Data collection is done with the study of librarianship, research results are analyzed further Normative Qualitative.The limitations of medical personnel (doctor) give rise to situations that require that the nurse or midwife do treatment or perform an action that is not a medical authority. Basic health services at the Clinic could not be fully implemented by the doctor, so many services/medical action which is the authority of doctors carried out by nurses/midwives, medical services at health centers also Roving as well as Clinics Maid only served by nurses/midwives. Legally, labor nurses/midwives do not have the authority to carry out medical services.

Abstract

This study aims to understand the extent of the subject of law in the health ministry`s regulation this obeyits obligations, and constraints that have been faced in fulfilling facility or equipment practices.The research uses a method of approach juridical sociological, with the primary and secondary date. Date collection by means of interviews with informants, observation and documentary. Location this research in purbalingga it precisely in rembang, in kejobong and in kalimanah.The research results show that the fulfillment of completeness place and apparatus for midwife practice has not been implemented effectively.Thus the implementation of the abovethe health ministry`s regulation not be reached,Cause of the low the effectiveness of health minister this includes: factors invented her own: The health ministry`s regulation number 1464/menkes/per/x/2010 regulation on licenses and the implementation of midwife practice in considerans does not include the purpose; a factor the law enforcement: supervision, guidance and supervision by the health office district Purbalingga was never;Factors facilities and facilities : absence of special officers assigned to supervise, guidance and supervision of dkk; as well as the community and culture: midwives request for permission practices private done collectively charity over organisationprofession so do not know the deficiency possible.It Ignorance of the health ministry`s regulation and attitude of the would not know the regulation.     Keyword: effectivity, organisationprofession, licenses

Abstract

ABSTRACT Big issues that are being faced by Police at this point in the criminal justice system is a great dilemma in law enforcement i.e. on one side of the quality and quantity of criminal cases that occur in the community over time tend to experience improvement and on the other hand, police have the authority in law enforcement by law has a relatively limited ability.Research methods with the Juridical Sociological approach, primary and secondary data sources. Type of this research is descriptive qualitative analysis.In the task of national police as a law enforcement officer who not only thinks the problems resolved in juridical normative alone, but should also be looked at from the perspective of sociological and legal anthropology. Criminal policy in operasional Police in the task can be done as an implementation of discretion. The underlying law enforcement on the authority and duties of the police's preventive and repressive in detail defined in Article 13, article 14 paragraph 1, article 18 of law RI No. 2 the year 2002 about the State police of the Republic of Indonesia. The application of the principles of Restorative Justice in law enforcement criminal acts of light by the national police is that prioritizes actions win-win solution both to the victims as well as perpetrators.Keywords: Police, limited liability, a law enforcement

Abstract

Tujuan penelitian ini yaitu pertama untuk menganalisis implementasi pendekatan rule of reason terhadap permasalahan persekongkolan tender dalam Putusan KPPU Nomor: 05/KPPU-L/2015 dan Putusan KPPU Nomor :03/KPPU-L/2016. Kedua.menganalisis perlindungan hukum para pelaku usaha lain yang dirugikan akibat adanya persekongkolan tender dalam Putusan KPPU Nomor: 05/KPPU-L/2015 dan Putusan KPPU Nomor: 03/KPPU-L/2016. Metode pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif, dengan metode pendekatan kasus.Sumber data yang digunakan ialah data sekunder, dengan bahan hukum primer / sekunder / tersier.Metode analisis yang digunakan dalam penelitian ini adalah metode analisis normatif kualitatif. Diperoleh hasil penelitian bahwa pada Putusan Nomor 5/KPPU-L/2015 dan Putusan Nomor 3/ KPPU-L/2016 KPPU Majelis Komisi telah menerapkan pendekatan rule of reason dengan cara membuktikan adanya unsur dalam Pasal 22 UU Nomor 5 Tahun 1999, mengenai dampak akibat dari persekongkolan dalam persaingan usaha, mencari faktor penyebab terjadinya pelanggaran Pasal 22 UU Nomor 5 Tahun 1999. Perlindungan hukum para pelaku usaha lain yang dirugikan akibat adanya persekongkolan tender dalam Putusan KPPU Nomor: 05/kppu-l/2015 dan Putusan KPPU Nomor: 03/kppu-l/2016 diakomodir dalam ketentuan Pasal 38 UU No. 5 Tahun 1999 yang memberikan hak untuk melaporkan dan hak untuk dilindungi kerahasiaan identitasnya serta dalam ketentuan Pasal 47 yaitu hak untuk mendapat ganti rugi jika terbukti pelanggaran Pasal 22 tersebut menimbulkan kerugian, serta hukuman denda dan larangan mengikuti lelang bagi pelanggar ketentuan Pasal 22 Undang-Undang Nomor 5 Tahun 1999.

Abstract

Elections are one of the most tangible forms and ways to implement democracy asa form of people's sovereignty, so the people through the General Election will choose its leader. If democracy is defined as the government of, by, and for the people, so that the way of the people to determine that government is done with elections. Approach Method used by Sociological Juridical with Descriptive Research Specifications. Used Data Sources are Primary Data and Secondary Data. Method of Data Collection by Way of Interview and Literature Study. Narrative Presentation Method with Qualitative Analysis Method. The mechanism of law enforcement against money politics (money politics) crimes uses reference to The Regulation of the Election Supervisory Board of the Republic of Indonesia No. 7/2018 on The Handling of Findings and Reports of Election Violations Article 2 paragraph (2) Bawaslu, Bawaslu Province and/or Bawaslu District/City, Panwaslu Subdistrict, Panwaslu Village/Village, Panwaslu LN and/or TPS Supervisor shall carry out a crackdown on alleged election violations. Law enforcement against  alleged crimes of money politics or money politics in the 2019 Elections in Kabuapten Purbalingga conducted by The Center of Gakkumdu Purbalingga District has been done to the maximum by predicing the existing rule of law, namely by referring to Law No. 7 of 2017 on Elections and Regulations of the Electoral Supervisory Board No. 7 of 2018 on The Handling of Findings and Reports of Election Violations.

Abstract

The legal protection for the insured in an insurance agreement with PT  Asuransi Ramayana Tbk exists while being observed generally by insurance law for the fulfillment of rights and obligations of both the insured and the insurer. In case of force majeur (unsure occurance) which causes loss; then based on Indonesian Standard Insurance Policy for Motor Vehicle Chapter 1 Article 1 and Article 2, the insured deserves to get the indemnity due to theft, and also get the solution for the dispute through a mediator under Article 54 Chapter XI 40 of 2014 concerning insurance about the protection of Insurance Policy holders, the Insured or the participant. The refusal of legal validity of the claim by PT. Asuransi Ramayana Tbk is not appropriate and does not have any correlation with the case of theft occurred because in Mr. Mery Sam Arvianto’s case, the insurance agreement with the insurance policy number 18.0212.14.001512 must covers All Risk / Comprehensive ( collateral damage to a part or the whole car because of falling objects, fire, collision, traffic accidents, theft or collision), and the insured should receive compensation, based on Chapter 1 Article 1 paragraph 1.3 Indonesian Standard Policy for motor vehicle insurance governing the guarantee, including guarantee from theft.Key Words:  The legal protection for the insured in an insurance agreement.
