Abstract

The crime of corruption is called an extraordinary crime (extra ordinary crime) which can damage the entire system of life, even to the moral and mental damage of the community, as well as harm the state. In fact, there are still abuses of power by government officials in the form of providing facilities and preferential treatment to other parties aimed at benefiting themselves. Acts of corruption are mark ups, budget abuse, embezzlement, fictitious reports, bribery, fictitious activities/projects, illegal levies, abuse of authority, circumcision/cutting, gratuities, extortion, double budgeting and mark downs. It is necessary to optimize the role of the Regency/Municipal Inspectorate as a supervisor for the implementation of a clean and free regional government from corruption, collusion and nepotism. As regulated by Law Number 20 of 2001 concerning Eradication of Criminal Acts of Corruption; Permendagri No. 23 of 2007 concerning Guidelines for Supervision of Regional Government Administration; Law (UU) Number 23 of 2014 concerning Regional Government.               The aims of this study are (1) to explain and analyze the optimization of the Banyumas Regency Inspectorate in supervising and preventing corruption; (2) to explain and analyze the obstacles of the Banyumas Regency Inspectorate in carrying out its role in supervising and preventing corruption. The use of descriptive qualitative research methods normative juridical approach in this study obtained two conclusions, namely (1) the role of the Regional Inspectorate of Banyumas Regency in supervising and preventing corruption has been optimally proven by awards for the management of gratuities from the results of achieving local government performance based on the best accountability system in Indonesia. -Central Java. The decreasing number of problematic OPD or ASN every year and all OPD or ASN carry out their duties and responsibilities well. (2) The obstacle for the Banyumas Regency inspectorate in carrying out its role is the limited budget for increasing APIP HR, the number of APIP available is not sufficient for the needs.

Abstract

Munculnya eksploitasi terhadap anak baik oleh orang tua maupun pihak lain sebagai pengemis merupakan kejahatan atau tindak pidana karena bertentangan dengan Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak hal ini menimbulkan kekhawatiran yang mendalam karena kasusnya semakin banyak. Adanya viktimasi anak dimana anak menjadi korban sehingga   mengalami penderitaan fisik, mental dan/atau kerugian ekonomi yang disebabkan oleh tindak pidana.Penelitian ini mengkaji anak sebagai objek viktimologi dengan memposisikan anak sebagai korban kejahatan, bentuk-bentuk viktimisasi, akibat dan pengaruhnya di dalam masyarakat dengan tujuan memberikan pengetahuan bagi anak sebagai korban kejahatan di ruang lingkup eksploitasi secara ekonomi sebagai pengemis. Metode yang digunakan dalam penelitian ini adalah dilakukan dengan      pendekatan   Yuridis Normatif dan pendekatan Yuridis empiris.Hasil penelitian dan pembahasan menunjukan bahwa Akibat Eksploitasi anak dan pengaruhnya terhadap korban akibat dari adanya tindak eksploitasi kepada anak-anak sebagai pengemis dan pengamen, akan menyebabkan trauma dan menimbulkan efek kesehatan karena selama anak diekploitasi sebagai pengemis anak dibius agar anak selalu tidur sehingga menimbulkan efek kesehatan dan perkembangan otak anak menurun, lebih jauh dari adanya trauma dan efek kejahatan itu juga menyebabkan terhambatnya generasi bangsa. Kenyataan di dalam masyarakat masih sering anak. Faktor penyebab adanya viktimasi terhadap anak dengan cara eksploitasi adalah karena kondisi ekonomi orang tua yang kurang, dipengaruhi lingkungan yang juga melakukan eksploitasi anak, adanya paksaan keluarga, kurangnya kesadaran hukum masyarakat khususnya orangtua pengemis dan pengamem, Program Pemerintah yang kurang menyentuh.

Abstract

Legal aid is constitutional rights for every citizen to get guaranteed legal protection and equality before the law. Legal aid in court hearings is an important instrument in the criminal justice system because it is part of the protection of human rights for every citizen. Legal aid is a right held by a defendant for the purpose of his defense in the criminal justice process. Through the provision of legal aid, it is hoped that fair and impartial criminal justice can be achieved and defendants receive humane treatment. Providing legal assistance is seen as a social responsibility in the context of law enforcement to anyone. Legal aid in a broad sense can be interpreted as an effort to help groups who are less fortunate in the field of law. Based on this, it is interesting to conduct research if it is viewed from the applicable regulations related to its implementation, especially in this research in the Banyumas District Court.The method used in this research is empirical legal research. Sources of data contained in this study come from primary data and secondary and, with data collection techniques based on interviews with informants and literature study. The data analysis technique in this study uses the deductive method.Based on the results of this study, it is known that the law enforcement components such as judges and lawyers / law enforcers have implemented it according to the mandate of the laws and regulations. However, because in essence legal aid is the right of the Defendant, it is an option for the Defendant to be accompanied by a Legal Counsel or not through access to legal assistance. In the case that what the defendant experiences is a criminal threat of more than 5 years, the Legal Aid Post (Posbakum) can be a means of obtaining free legal assistance and this facility is already available in every court, especially the Banyumas District Court. The obstacles that were often faced were precisely the Defendants whose criminal threats were under 5 years, because the Defendants lacked knowledge and information, as well as difficult access to administrative requirements in the form of SKTM, made the Defendants reluctant to choose to be accompanied by a Legal Counsel through legal aid. Meanwhile, on the other hand, from the law enforcement component such as Judges or Advocates, because Defendants who are sentenced to under 5 years of punishment are not obliged to be assisted by a Legal Counsel, this means that there is no direct approach to the Defendant regarding their right to obtain legal assistance. in the form of assistance or legal advisors to defend their rights and interests in court.

Abstract

Penghentian penuntutan berdasarkan keadilan restoratif yang diatur  dalam Peraturan Kejaksaan Republik Indonesia Nomor 15 Tahun 2020 tentang Penghentian Penuntutan Berdasarkan Keadilan Restoratif dilakukan dengan upaya perdamaian antara korban dengan pelaku dan Penuntut Umum sebagai fasilitator. Apabila upaya perdamaian diterima oleh kedua pihak dan proses perdamaian berupa sepakat berdamai disertai pemenuhan kewajiban tertentu maka Tersangka wajib memenuhi hak-hak korban sesuai kesepakatan perdamaian. Dalam hal kesepakatan perdamaian tercapai, dan Tersangka sebelumnya ditahan maka Tersangka wajib dibebaskan. Akan tetapi seharusnya Tersangka tidak dibebaskan secara sebebas-bebasnya, yakni Tersangka diberi pembinaan dan pengawasan agar Tersangka benar-benar tidak mengulangi kejahatannya.

Abstract

Efforts to uphold these human rights can also be carried out in consulting institutions. One of prisoners' rights in prison is the right to receive visits from their families. In Law Number 12 Year 1995 Article 14 letter (h) concerning Penitentiary states that prisoners are entitled to receive family visits, legal counsel or certain other people. The formulation of the problem in this study are: 1) What are the procedures for conducting prisoners' online visits to Class II A prison facilities in Permisan Nusakambangan? 2? What are the obstacles in making prisoners' online visits to Class II A prison facilities in Permisan Nusakambangan? The research method used in the study is a sociological juridical approach using descriptive methods using a qualitative approach. The results of this study are that the effectiveness of the online-based legal work system is related to the visit of prisoners in prisons especially in Class IIA Permisan Nusakambangan Island has been effective. It can be seen from some of these activities that the Cilacap prison officers are also supervised and used as an alternative means of visiting family visiting hours. However, in applying the online / web-based visit, there are obstacles related to the lack of computer skills of the employees, especially for registering visits online and the difficulty of accessing the code on visitor registration.

Abstract

After the issuance of Law Number 25 of 2007 concerning Investment, foreign and domestic investors were given equal treatment. Equal treatment of domestic and foreign capital is an important principle of investment policy. Article 6 paragraph (1) of Law Number 25 of 2007 states that the Government provides equal treatment to all investors originating from any country conducting investment activities in Indonesia in accordance with the provisions of the legislation. Furthermore, paragraph (2) states that such treatment does not apply to investors from a country that obtains special rights based on an agreement with Indonesia. Law No. 11 of 2020 concerning Job Creation is expected to be able to absorb the widest possible Indonesian workforce in the midst of increasingly competitive competition and the demands of economic globalization. With the ease and simplification of the entry of foreign investment and foreign workers in Indonesia, it is able to attract the interest and desire of foreign investors to invest in Indonesia.

Abstract

Government bestows authority to regional governments to provide protection for victims of gender-based violence and children as regulated in Article 9 and Attachment of Law Number 23 of 2014 concerning Regional Government. In order to carry out this authority, the Purbalingga Regency Government established Purbalingga Regency Regional Regulation No. 2 of 2017 concerning Protection of Victims of Gender-Based Violence and Children in Purbalingga Regency. This Regional Regulation regulates the implementation of Gender-based Violence Victims Protection and child protection through prevention and protection efforts, namely complaint services, legal aid services, repatriation and social integration services, social rehabilitation and community participation established  by service centers and integrated service center units at the sub-district level. The integrated service center and the sub-district integrated service center unit obey to carry out the tasks as stipulated in Article 9 and Article 19 of the Purbalingga Regency Number 2 of 2017 concerning the implementation of the Protection of Gender-Based Violence and Children, although not optimally because it has not been supported by sufficient budget and infrastructure, law enforcers who do not have a gender perspective, there is still a lack of socialization to the community regarding the regulation. On the other hand,patriarchal culture is deeply rooted in society.

Abstract

Asas desentralisasi dalam otonomi daerah yang diatur dalam Undang-Undang Nomor 23 Tahun 2014 tentangPemerintahan Daerah menjelaskan adanya pembagian penyelenggaraan urusan pemerintahan di pusat dan di daerah. Masalah dalam penelitian ini adalah 1) Bagaimana kewenangan pemerintah Provinsi Banten dalam pelaksanaan program pengendalian penduduk; 2) Bagaimana keseimbangan program pengendalianpenduduk pada BKKBN dan DP3AKKB Provinsi Banten ditinjau berdasarkan Undang-Undang Nomor 52Tahun 2009. Penelitian ini merupakan penelitian yuridis empiris digunakan untuk melihat hal-hal yang menjadi urusan pemerintah Provinsi Banten dalam program pengendalian penduduk serta kesimbangan program dari BKKBN dan DP3AKKB Provinsi Banten sebagai stakeholder yang berwenang melaksanakannya. Berdasarkan penelitian yang dilakukan, diperoleh kesimpulan 1) kewenanganpemerintah Provinsi Banten dalam bidang pengendalian penduduk diatur dalam pasal 11 ayat (1) dan (2) serta pasal 12 ayat (2) Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintah Daerah dan berimplikasi pada hubungan keuangan sebagaimana diatur dalam Undang-Undang No. 33 Tahun 2004 tentang Perimbangan Keuangan; 2) Program pengendalian penduduk pada BKKBN dan DP3AKKB Provinsi Bantenditinjau berdasarkan Undang-Undang Nomor 52 Tahun 2009 diketahui masih belum bisa seimbang danmaksimal sebagai implikasi dari perubahan Kewenangan program pengendalian penduduk berupa KB yang dulunya berada di pusat (BKKBN) dan kini diserahkan kepada pemerintahan daerah, yang menyebabkan ada berbagai kebijakan yang berbeda satu daerah dengan lainnya. Kata kunci: Pengendalian Penduduk, Pembangunan Keluarga, dan Urusan Pemerintah

Abstract

 Penelitian ini bertujuan untuk mereview efektivitas penegakan hukum terhadap dugaan pelanggaran Peraturan Daerah Nomor 6 Tahun 2012 tentang Pengelolaan Sampah di Kabupaten Banyumas serta faktor-faktor yang mempengaruhinya. Peraturan Daerah ini mengatur norma-norma yang ditaati oleh masyarakat, namun pada kenyataannya masih terdapat dugaan-dugaan pelanggaran yang dilakukan. Penegakan hukum terhadap dugaan pelanggaran tidak berjalan efektif karena pengaruh faktor kendala lembaga pelaksana (legal structure) yakni jumlah personil yang terbatas, kemampuan serta integritas petugas yang kurang serta hubungan koordinasi antarinstansi yang tidak maksimal

Abstract

The authority of the Regional Government as the organizer of regional government affairs according to the principle of autonomy and co-administration is expected to be able to explore financial sources through Regional Original Revenue. In the process of collecting Rural and Urban Land and Building Taxes in the context of exploring regional financial sources, there are many differences of opinion or tax disputes between taxpayers and the government regarding the amount of tax to be paid, tax objects that no longer exist, and applications for relief in the form of installments in the form of installments. payment of taxes.This study aims to analyze legal policies and legal implications for the provision of reduction, relief, and exemption from land and building taxes in rural and urban areas in Brebes Regency. This study uses a normative juridical approach, descriptive analysis research type, secondary data sources, and data obtained by using literature studies, presented in the form of narrative texts that are arranged systematically, and analyzed qualitatively normative.The results of the study indicate that the Legal Policy for the Granting of Reductions, Relief, and Exemption of Land and Building Taxes in Rural and Urban, is based on the principles of financial politics, economic principles, and the principles of justice. Administrative principles, juridical principles. The legal implications arising from the granting of reduction, relief, and exemption from land and building taxes in rural and urban areas are: Implications of authority, Implications of Supervision, Implications of Finance and Implications of Human Resources.
