Abstract

This study examines the legal consequences of unilateral termination of the agreement. This study aims to determine the legal consequences of termination of the agreement unilaterally through two legal cases with the same problem but basing with different lawsuits. The "SARI" franchise case based the lawsuit on a breach of a suit, while Lee Kum Kee's case bases on a lawsuit against the law. This study uses normative approach method with type of research using case approach, the author tries to examine and examine the legal consequences of unilateral termination of the agreement and how the judges judge in both cases of law on the basis of different lawsuit.Keywords: legal consequences, unilateral termination of agreement, breach of contract, and unlawful acts.

Abstract

Based on the result of the research and a discussion to the main problem that proposed, therefore we can make some conclusion: The effectivity of State attorney On The Refund of State/Region Monetary Due To Corruption Act In The State Attorney Office Purwokerto, which purpose is to return the loss of state fund or state economy due to corruption act, if we review it from the effectivity of State attorney as one of the state instrument to return the state/region economy as a result of corruption act by using UU No 3 Tahun 1971 about Eradication of Corruption Act In The State Attorney Office Purwokerto, we can say that it hasn’t effective yet, due to Litigation process handled by State attorney which filed civil action to the District Court, no one is capable to pay the loss of state/region due to corruption act in civil ruling, because the defendent already has no possession.  Then, on Non Litigation way, using State attorney instrument, a little bit effective even though has to pay replacement money by credit because the defendant is capable to pay off the replacement. If we use UU No 31 Tahun 1999 that has been changed and replaced to UU No 20 Tahun 2001 about the Changes on UU No 31 Tahun 1999 about Erradication of Corruption Act to a State Attorney, it won’t be a problem because if the defendant is not capable of paying the replacement money based on the decision, the defendant will undergo the subsidiary criminal in the form of penalty, which is the period of time will not exceed the main criminal threat dan the period of time has already decided on the decision.That factors become obstacles, is the State Attorney will not able to perform a sequest sizing because the defendant is unable and has no possession in a nominal of money being corrupted, then from the Law enforcer itself, that the State Attorney is having difficulties to track posession that belongs to the defendant which is gain from the corruption act or assume gained from the corruption act, while the obstacles from the society, there is a lack of awareness from the society itself, which is a lack of concern to give information earlier and detail on the possession belong to the defendant to the law enforcer to a person a suspected as a corruption perpetrators.

Abstract

Tenaga Kesehatan merupakan profesi yang berisiko terinfeksi virus dari pasien.Pasal 57 b UU 36 Tahun 2014 tentang Tenaga Kesehatan menyatakan bahwa, Tenaga Kesehatan dalam menjalankan pelayanan praktik berhak memperoleh informasi yang lengkap dan benar dari Penerima Pelayanan Kesehatan atau keluarganya. Penelitian ini bertujuan untuk menganalisis penerapan Pasal 57 huruf b Undang-Undang Nomor 36 Tahun 2014 tentang Tenaga Kesehatan untuk memperoleh informasi dalam pelayanan penyakit menular di Kabupaten Kebumen dan menganalisis kendala penerapannya. Penelitian ini merupakan penelitian yuridis normatif yaitu penelitian hukum yang menggunakan pendekatan legis positivis. Penelitian ini adalah penelitian deskriptif analitis yang menggambarkan tentang hak tenaga kesehatan untuk mendapatkan informasi dalam pelayanan penyakit menular dalam Undang-Undang No.36 Tahun 2014 tentang Tenaga Kesehatan. Sumber data berasal dari data primer dan data sekunder, data primer digunakan sebagai pendukung diperoleh melalui wawancara dan data sekunder diperoleh melalalui tehnik pengumpulan data yang dilakukan dengan studi pustaka terhadap bahan-bahan hukum, dan bahan non-hukum. Selanjutnya analisis dipaparkan dalam bentuk uraian yang disusun sistematis mengikuti alur sistematika  pembahasan. Hasil penelitian menyatakan bahwa Pertama, Penerapan Pasal 57 b UU 36 Tahun 2014 tentang Tenaga Kesehatan telah diterapkan sebagian yaitu pada awal alur pelayanan pasien perseorangan yang datang ke fasilitas kesehatan tepatnya adalah tahap anamnesis, namun informasi atau keterangan yang diberikan oleh pasien dengan penyakit menular atau keluarganya pada tahap anamnesa ini tidak lengkap atau tidak akurat sehingga pada tahap selanjutnya di alur pelayanan menimbulkan resiko tertularnya penyakit pada tenaga kesehatan. Kedua, Kendala Penerapan Pasal 57 b UU 36 Tahun 2014 tentang Tenaga Kesehatan ataupun peraturan lain yang mengatur kewajiban pasien wajib memberikan informasi yang benar tidak memuat sanksi. Hal ini memberikan peluang pada tenaga kesehatan untuk melakukan diskresi dengan menolak memberikan pelayanan pada pasien tersebut. Saran yang dapat disampaikan adalah mengatur sanksi bagi pasien yang memberikan informasi tidak benar atau tidak lengkap. Kata kunci : perlindungan hukum, tenaga kesehatan, hak informasi

Abstract

The religious court judges interpretation of the child outside the marriage after the Constitutional Court Decision No. 46 / PUU-VIII / 2010 on the review of Act 1 of 1974 in the Religious Navan and How the legal consequences of the Constitutional Court Decision No. 46 / PUU-VIII / 2010 on the review of Act No. 1 In 1974 in the Religious Purwokerto. This research method approach using Method approach taken in this study is a combination of socio-juridical field that uses primary data and secondary data from interviews with informants. Legal consequences of the Constitutional Court Decision No. 46 / PUU-VIII / 2010 on the testing of Law No. 1 In 1974 the Religious Court of Navan, which is stated in the decision of the Decision No. 1306 / Pdt.G / 2012 / PA.Pwt, that the reason behind the law to assert that illegitimate children were entitled to legal protection. The panel of judges to interpret the law or the interpretation of such cases and legal considerations have encouraged the necessity of providing protection and legal certainty to the status of a child born and the rights available to it, including against children born even though the validity of marriage is still disputed. Keywords: child outside marriage, interpretation and legal consequences.

Abstract

Gambling can be a barrier to national development that more material-spiritual, because gambling is educating people to earn a living by not only natural and formed the character of "Slacker". Very reasoned if then gambling should immediately look for ways and solutions that are rational for solving them.This study uses qualitative methods with the Juridical Sociological approach. In an attempt to obtain the data needed to draw up this writing, descriptive research types will be used. The source of the data required in the research of this thesis is the primary data and secondary data.The policy of prosecution by the Prosecutor General (JPU) against the crime of gambling in the State, based on the guidelines of the Banyumas on the Attorney General's circular letter number: SE-013/A/JA/12/2011 29 December 2011, dandalam implementation to determine light criminal charges made in a hierarchical (plan Demands).

Abstract

Khilafah Islamiyah can be interpreted as a government based on Islamic Shari'ah. The Islamic Khilafah is coveted by some Islamic groups as an effective way to hold power, and establishes it as a religious obligation. In a country with a majority of the population is Muslim, but uses a general constitution like Indonesia, the idea of the Islamic Caliphate is a special dilemma. Is it true that the practice of Indonesian constitution which has been going on in stark contrast to the values contained in the Islamic Khilafah, may have been partially accommodated, or even fully in line. Questions like this must be found as quickly as possible so that divisions can be avoided, in the midst of the increasingly rowdy debate on the pros and cons of the Caliphate.This study aims to analyze in depth the meaning of the Islamic Caliphate in the perspective of the constitutional system of the Republic of Indonesia. The research method used in this research is normative juridical. Focusing on the normative method, according to the discussion of the analysis, this method is called normative analysis. Comparative and hystorical approach are some of the approaches used.The results of this study conclude that: First, the basic values contained in the Islamic Caliphate movement are deliberation, justice, equality, brotherhood. Second, these values are indirectly reflected in Pancasila, obedience to leaders in the first principle, peace, recognition and protection of human rights in the second principle, deliberation on the fourth principle, justice, equality and free trial in the 5th precept. The conclusion of this study is that the values of the Islamic Khilafah can be contextualized in the practice of Indonesian constitution, such as the value of deliberation realized through an honest and fair electoral system. Islamic Sharia can be implemented through the enforcement of free and impartial law supremacy. The value of universal brotherhood is realized through international relations in a free and active political framework.

Abstract

Indonesia is a unitary state which is divided into provincial areas which are further subdivided into areas of the district/city based on the principle of regional autonomy. The existence of local regulation is very important, but unfortunately there are a variety of problematic regulations that live in the society, either because it does not conform with the conditions of the society or for not complying with legislation is another. Local regulations are problematic it can be minimized by monitoring function held by Parliament, as mentioned in Article 42 paragraph (1) letter c of Act No. 32 of 2004 which stipulates that Parliament has the duty and authority to supervise the implementation of local regulations. Supervision by the Provincial Council and District Council carried out local regulation on the implementation by the Act 32 of 2004 uses the concept of supervision in the narrow sense that focused on matching between rules and their implementation in the field. Parliament in the means used to supervise the implementation of regulations in general through the implementation of the rights of Parliament, implementation consulting, receiving complaints and aspirations of the people. Yet there are clear arrangements regarding the parameters of supervision, monitoring and corrective action mechanisms of monitoring the implementation by the parliament.Keyword: local governments, local regulations, supervision

Abstract

The existence of the National Health Insurance Program organized by Healthcare and Social Security Agency (Badan Penyelenggara Jaminan Sosial Kesehatan or BPJS Kesehatan) causing increased number of visits to health centers. However, the increase patients were not followed by the increase of health human resources, especially Pharmacists. Being limited number of pharmacists who became one of the factors of negligence of pharmacist task in community healt centre.This research aimed to analyze the implementation of Pharmaceutical care at the health center. This research also aims to analyze law enforcement due to the negligence of pharmacist task at the health center. This research methode is a qualitative by the sociological juridical approach. Collecting data through observation and interviews to 10 Pharmacists who work in health centers and the head of health centers, also  the head of  Indonesian Pharmacist Association (IAI) in Banyumas regionThe pharmaceutical care in health centers are still not in accordance with the laws and regulations that apply where the phramacist task in the health centre is still done by a non-pharmacist staff and drug information to patient also incomplete in providing drug services, it is becoming one of the factors the occurrence of negligence.Law enforcement due to the negligence of the pharmacist in performing pharmacist task at the health center willbe solved by take out-of-court action with promote the rights of the patient or the victim, in which patients who experience the error due to the negligence of the pharmacist then directly solved by replacing drug medications error and in case undesirable of side effects from the use of drugs is carried out free medical treatment in accordance with the provisions. In increasing the phramaceutical care at the health center should be no additional health human resources, especially pharmacists or pharmacy technical staff while minimizing an increase in visits of patients will require an active role of other health professionals to optimize preventive health efforts in the awareness level of health awareness in the community. Staff pharmacist in health center should always increase the knowledge, skills and behavior in order to maintain and improve their competence through education and training.Key words : Pharmacist, Negligence, Law Enforcement

Abstract

Al-Jamariah, the Act of a person, which is usually limited to acts that are prohibited only. The term jarimah when associated with Islamic law, and sometimes also used the term delik when associated with positive law. The method of approach in research is the juridical normative, with secondary data sources and analysed normative qualitative basis.The results of preventive qishas legal research so that crime can be preventedbefore they occur considering the punishment accordingly. Prior to the ruling of the judge executed then the victim or the victim's family has the right to revoke or cancel the ruling of the judge, because the victim or victim's family forgave the penal action and usually the punished with fines or rewarded cancellation shall become the Redeemer of sin for the victim, as in the Qur'an, Surat Al-Maidah verse 45. The basis of justification or justifying the existence of a criminal just at criminal acts (conditions of objective as the basis justification) and error (subjective terms as basic permaaf). Therefore, it is as if the criminal is considered a consequence of absolute that there should be, if both terms is evident. This gives the frame a legitimacy that the CRIMINAL CODE currently is "model of certainty" that stiff. Therefore in the future CRIMINAL CODE BILL should remain the underlying nature of the "model certainty", but its currently ossified, must be revamped to become flexible.

Abstract

PT.GO-JEK Indonesia to the base ojek who only sit and wait for passengers join as partners, the drivers must establish cooperation with the company. The cooperation is stated in the form a partnership agreement. Problems because drivers do not understand the partnership agreement and create an imbalance between the parties, the driver demands that the employe or worker be sued. PT.GO-JEK Indonesia gives drivers a big bonus as a form of rewards, this trigers drivers to apply fraudulently for the bonus by making fictitious orders. The action of fictitious orders is detrimental to consumers and companies. The need for legal protection for consumers and companies against violations comitted by drivers. This sudy to analyze PT.GO-JEK Indonesia partnrship agreements with drivers reviewed according to the Privat Law and legal protection againts PT.GO-JEK Indonesia and consumers for fictiious order violations made by drivers. This study uses a normative juridical approach to analyze partnership agrements as what is written in legislation. The research specifications are descriptive analytical, namely providing an overview of the PT.GO-JEK Indonesia partnerhip agreement with the drivers and legal protection for companies and consumers against fictitius order violations. The analysis is based on secondary data which is reinforced by interviews with PT. GO-JEK Indonesia.
