Abstract

This study is grounded in the importance of human resource development in improving employee performance within public service institutions, particularly the Halal Product Assurance Agency (BPJPH) Jakarta. Employee performance is not only influenced by managerial aspects such as motivation and job satisfaction but also by ethical values that shape organizational work culture. Therefore, this study aims to examine the partial effect of motivation on employee performance, the partial effect of job satisfaction on employee performance, the simultaneous effect of motivation and job satisfaction on employee performance, and to assess the extent to which work patterns at BPJPH align with the values of Ahlussunnah wal Jama’ah (Aswaja) of Nahdlatul Ulama. This research employs a quantitative approach with a field research design. The population consists of 205 BPJPH employees, with a sample of 70 respondents selected using a convenience sampling technique. Data were collected through questionnaires, observations, and interviews, and analyzed using descriptive statistics and multiple linear regression with the assistance of IBM SPSS Statistics. The findings reveal that motivation has a positive but not significant partial effect on employee performance, while job satisfaction has no positive and significant partial effect. However, motivation and job satisfaction simultaneously have a significant effect on employee performance. Furthermore, the work patterns at BPJPH generally reflect Aswaja values tawassuth (moderation), tasamuh (tolerance), tawazun (balance), and i’tidal (justice) although improvements are still needed in incentives, career development, and recognition systems. This study contributes to the development of value-based human resource management, particularly in integrating Islamic values into professional work ethics within public service institutions.

Abstract

This article offers a novel reconstruction of legal reasoning in Indonesian Islamic courts by proposing a Constitutional Maqāṣid framework that bridges the long-standing tension between textualism and contextual justice. While existing adjudicative practices often oscillate between rigid adherence to statutory texts and fragmented contextual considerations, this study argues that both approaches remain insufficient to address the complexity of contemporary socio-legal realities. The novelty of this research lies in the integration of maqāṣid al-sharīʿah with constitutional values particularly justice, human dignity, and legal certainty into a unified interpretive model termed Constitutional Maqāṣid Justice (CMJ). Employing a normative juridical method combined with conceptual and statutory approaches, this study critically examines judicial reasoning patterns within Indonesian Islamic courts and identifies a persistent gap between formal legality and substantive justice. The proposed CMJ framework repositions judges not merely as appliers of legal texts, but as ethical interpreters who harmonize Qur’anic objectives, statutory provisions, and constitutional mandates. Through this synthesis, maqāṣid principles such as the protection of religion, life, intellect, lineage, and property are elevated from moral guidance to operative constitutional reasoning tools. The findings demonstrate that the Constitutional Maqāṣid approach enables a more adaptive, proportional, and humanistic form of legal moderation. It ensures that judicial decisions remain legally grounded while being socially responsive and normatively transformative. Furthermore, this model contributes a new theoretical paradigm within Islamic legal studies by embedding maqāṣid within a constitutional framework, thus advancing a form of Islamic sociological jurisprudence that is both context-sensitive and institutionally legitimate. Ultimately, this research not only enriches the discourse on legal moderation in Muslim societies but also offers a practical blueprint for reforming judicial reasoning in pluralistic constitutional systems like Indonesia.

Abstract

Patriarchal culture continues to shape family relations among Nahdliyyin communities and is often legitimized through gender-biased religious interpretations. This article examines the role of Nahdlatul Ulama (NU) figures’ exemplary conduct in reducing patriarchal culture through the implementation of equality-based values in the Compilation of Islamic Law (KHI). The study employs a qualitative approach with a case study design and a sociological-juridical perspective. Data were collected through open-ended questionnaires, semi-structured interviews, participatory observation, and documentation, and were analyzed using Pierre Bourdieu’s theory of social agency. The findings indicate that patriarchal reduction is reflected in NU figures’ involvement in domestic work, respect for women, and support for women’s personal development through education and public roles. Their habitus, field, and capital position them as social agents with persuasive cultural influence. This influence fosters a more balanced understanding of KHI principles concerning the rights and obligations of husbands and wives within Nahdliyyin families, thereby contributing to more egalitarian family relations. The study suggests that social transformation in Nahdliyyin families is more effectively achieved through a culturally persuasive approach grounded in uswah hasanah and aligned with the moderating principles of Islam Nusantara. This study provides an empirical contribution by analyzing the application of Aswaja Nahdlatul Ulama values in Islamic family law, advancing theoretical understanding of patriarchal cultural transformation, and proposing a culturally-based intervention model as a reference for both research and practical implementation in traditional Muslim family communities
