Abstract

This study aims to: analyze the impact of the Grojogan Sewu Nature Tourism Park (TWA) ecotourism development on community income, employment and business opportunities, and land use within the surrounding community; and analyze the development of ecotourism resources from a sharia tourism perspective. This study is a survey conducted around the Grojogan Sewu Nature Tourism Park tourist attraction located in Tawangmangu District, Karanganyar Regency. The results indicate that ecotourism development impacts community income, employment and business opportunities, and land use in the study area. Ecotourism development has a positive impact on community income, employment and business opportunities, and land use. The reconstruction of ecotourism resource development from a sharia tourism perspective has met the criteria for sharia tourism development, namely ecotourism resource development from a sharia tourism perspective, from an ecotourism perspective, from an environmental management system perspective, from a tourist destination competitiveness perspective, and from a perspective of preserving socio-cultural values ​​and local wisdom. The results of this study indicate that ecotourism development in the study area has met the criteria for developing ecotourism based on Sharia tourism.

Abstract

Schistosomiasis remains a persistent public health problem in Central Sulawesi, particularly in the Napu Valley, where transmission dynamics are strongly influenced by environmental sanitation and community behavior. Amid the dominance of biomedical and public health approaches, the integration of Islamic legal principles as a normative framework for disease prevention remains limited. Addressing this gap, this study aims to identify and critically examine community-based schistosomiasis prevention practices, analyze their normative legitimacy through the concept of sadd zari’ah, and articulate the theoretical contribution of Islamic law in strengthening socially grounded disease prevention through a comparative analysis of the Maliki and Hanbali schools. This study employs a qualitative approach with an empirical legal research design, utilizing observation, semi-structured interviews, and documentation, which are analyzed descriptively. The findings indicate that preventive practices include sanitation improvement, prohibition of open defecation, control of snail habitats, use of personal protective equipment, mass drug administration, and strengthened health education as systematic efforts to interrupt transmission pathways. From a comparative perspective, the Maliki school advocates a stricter application of sadd zari’ah by closing all potential avenues leading to disease transmission, whereas the Hanbali school allows a degree of flexibility provided that precautionary principles and risk prevention are maintained. Both schools substantively agree that such preventive measures constitute the protection of life (hifz al-nafs) and should be upheld as an obligation to avert harm. Therefore, schistosomiasis prevention practices in Watumaeta Village are not only effective from a public health standpoint but also represent a contextualized application of Islamic legal principles, reinforcing the relevance of sadd zari’ah as a normative foundation for community-based disease prevention in endemic settings   Keywords: Schistosomiasis prevention, Sadd zari’ah, Islamic law, Mazhab comparison

Abstract

The increasing use of identity politics in electoral campaigns in Indonesia has become a significant issue in contemporary democratic practices, particularly due to its potential to trigger social polarization and undermine democratic quality. This study aims to analyze the forms and patterns of identity politics in campaigns, examine them from the perspectives of Indonesian electoral law and Islamic law, and conduct a comparative analysis between the two legal systems. This research employs a normative legal method with a qualitative approach, utilizing statutory, conceptual, and comparative approaches. Data were collected through library research and analyzed using descriptive qualitative analysis. The findings indicate that identity politics manifests in religious, ethnic, and social group narratives, with patterns ranging from affirmative to exclusive and provocative forms. From the perspective of Indonesian electoral law, such practices are restricted due to their potential to incite conflict and violate legal norms. Meanwhile, Islamic law also prohibits divisive identity-based practices as they contradict principles of unity, justice, and public welfare. The comparative analysis reveals that both legal systems share similar normative values in rejecting harmful identity politics, although they differ in their sources and enforcement mechanisms. This study concludes that integrating legal and ethical approaches is essential to promote inclusive, ethical, and high-quality democratic practices.

Abstract

Mubadalah in the husband-wife relationship has significant relevance in the context of Islamic family law which continues to develop. Understanding each person's duties and responsibilities is very important considering social changes and increasing demands for more equal and harmonious interactions in family life. This paper aims to analyze mubjadi from the perspective of Islamic family law, which emphasizes the importance of equality and mutual understanding between husband and wife in creating a just and harmonious family. Specifically, this study discusses the right to maintenance as one of the fundamental aspects in husband-wife relations, including its meaning, implementation, and responsibility for fulfilling it from a mubadalah perspective. The method used in this research is a systematic literature review based on big data via publish or perish Google Scholar and publish or perish crossref with VOS viewer visualization. The results of the discussion in this paper are on the application of the concept of mubindah in husband-wife relationships, the urgency of equality of rights and obligations, and its impact on domestic life

Abstract

This study aims to analyze the influence of regional potential and socio-economic barriers on people's decisions to use Islamic insurance in Batu Bara Regency. The study employs a quantitative approach using a survey method through questionnaires distributed to 97 respondents, determined using the Lemeshow formula with a 95% confidence level. The data were analyzed using multiple linear regression after passing classical assumption tests.The results show that partially, regional potential does not have a significant effect on people's decisions. Although the region has economic potential in the agriculture, fisheries, and MSME sectors, this has not been sufficient to encourage people to use Islamic insurance. On the other hand, socio-economic barriers have a positive and significant effect. Limited income, low literacy in Islamic finance, and the habit of relying on personal savings are the main factors influencing decisions.Simultaneously, both variables have a significant effect, with a coefficient of determination (R²) of 0.084, meaning that 8.4% of the variation in people's decisions can be explained by the research model. This study concludes that the development of Islamic insurance should focus on improving literacy, providing easily understandable education, and expanding service access so that public interest can be translated into actual decisions.

Abstract

The rapid growth of digital gold savings platforms in Indonesia namely Tring! by Pegadaian and BYOND by BSI has democratized investment access and reduced entry barriers for middle-to-lower-income communities, necessitating the reactualization of the wealth preservation principle (hifz al-mal) alongside Modern Portfolio Theory (MPT) within contemporary Islamic economic governance. This study analyzes digital gold savings from Maqashid Shariah (hifz al-mal) and MPT perspectives, evaluates akad implementation compliance with DSN-MUI Fatwa instruments, and assesses these platforms as financial inclusion catalysts toward the Indonesia Emas 2045 vision. A qualitative approach was employed, combining empirical analysis of national digital gold platform growth (2023–2026) with a normative review of fiqh muamalah, DSN-MUI Fatwa No. 117/DSN-MUI/II/2018, and modern financial theory. A strong convergence between hifz al-mal and MPT is identified, with digital gold savings demonstrated as effective inflation hedges and inclusive micro-portfolio diversification instruments. The multi- akad structure (murabahah and wadihah)is largely compliant with DSN-MUI Fatwa provisions; however, residual gharar (uncertainty) persists regarding bid-ask spread transparency, underlying asset ownership disclosure prior to akad execution, and custodial fee separation. These platforms constitute strategic financial inclusion instruments supporting household financial resilience; accordingly, regulatory intervention on fee disclosure including maximum spread limits and enhanced sharia financial literacy are recommended to ensure comprehensive maslahah and mitigate gharar.

memenuhi rukun serta syarat tertentu, salah satunya adalah adanya wali nikah. Namun, dalam warisan pemikiran ulama Islam terdapat perbedaan pendapat mengenai peran wali dalam pernikahan, terutama antara Imam Abu Hanifah dan Imam Syafi’i. Penelitian ini berupaya untuk mempelajari dan membandingkan pendapat kedua imam tersebut mengenai perwalian dalam pernikahan serta menganalisis dampaknya terhadap hukum Islam. Penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian berupa studi pustaka. Metode yang digunakan adalah perbandingan mazhab, dengan cara mengumpulkan data melalui studi terhadap dokumen-dokumen primer berupa kitab-kitab yang mewakili pemikiran kedua imam, serta dokumen sekunder berupa buku, jurnal, dan karya ilmiah yang terkait. Analisis data dilakukan dengan pendekatan perbandingan untuk menemukan kesamaan dan perbedaan pendapat yang ada di antara keduanya. Penelitian menunjukkan bahwa Imam Abu Hanifah berpendapat bahwa wali bukan merupakan bagian yang wajib atau syarat untuk sahnya pernikahan bagi perempuan yang sudah dewasa, berakal, dan bebas. Dengan demikian, perempuan bisa menikahkan dirinya sendiri selama memenuhi prinsip kafā’ah. Imam Syafi’i menegaskan bahwa wali adalah bagian yang wajib dan syarat utama dalam pernikahan, sehingga pernikahan tanpa wali dianggap tidak sah. Perbedaan ini menunjukkan perbedaan cara dalam menemukan hukum, di mana Mazhab Hanafi cenderung lebih logis, sedangkan Mazhab Syafi’i lebih berlandaskan pada teks. Dalam konteks Indonesia, pendapat Mazhab Syafi’i lebih banyak dipakai, sehingga adanya wali menjadi syarat yang wajib dalam pernikahan.

Abstract

This study aims to analyze the effectiveness of facilities and infrastructure management at PT Kereta Api Indonesia (Persero) Regional Division I of North Sumatra from the perspective of railway service users at Medan Station. A qualitative approach with a case study design was employed. Data were collected through in-depth interviews, observation, and document analysis, and analyzed thematically. The findings indicate that the effectiveness of facilities and infrastructure management is perceived not merely in terms of availability, but more importantly through functional consistency, accessibility, and maintenance practices in service delivery. Although the management of facilities and infrastructure is considered reasonably effective in supporting basic railway services, limitations remain in terms of functional sustainability and alignment with users’ needs. This study highlights the importance of user perspectives as external indicators in evaluating the effectiveness of public transportation facilities and infrastructure management.

Abstract

This study aims to analyze the influence of materialism, repayment capacity, and economic conditions on financing quality, as well as to test the role of religiosity as a moderating variable. This study uses a quantitative approach with data obtained through direct questionnaire distribution by researchers to respondents. The data collection technique used Purposive Sampling technique with the target respondents being BSI KCP Pangkalan Brandan financing customers. The analysis technique used is Moderated Regression Analysis (MRA). The results of the study indicate that materialism partially has a negative and significant effect on financing quality, while repayment capacity and economic conditions partially have a significant positive effect. The influence of materialism, repayment capacity, and economic conditions simultaneously also affect financing quality. Furthermore, the results of the moderation test indicate that religiosity is able to moderate the relationship between materialism,repayment capacity, and economic conditions on financing quality. Religiosity is proven to weaken the negative influence of materialism and strengthen the positive influence of repayment capacity and economic conditions. The results of this study provide a more comprehensive understanding to the public while enriching insight regarding various factors that influence financing quality, especially in Islamic banking such as Bank BSI KCP Pangkalan Brandan. This research fills this gap by examining how religiosity plays a role in strengthening or weakening the influence of these three variables on financing quality, thus providing a new, more holistic and relevant perspective for managing financing based on Sharia values.

Abstract

Marriage in Islam requires that both spouses share the same religion, namely Islam. In maqasid sharia, it is explained that preserving lineage (hifz al-nasl) must be maintained through lawful marriage and by avoiding adultery. An invalid marriage according to Islamic law may affect the legal status of children born from the marriage, particularly in terms of lineage (nasab), which may be disconnected from the father. Apostasy (riddah) often occurs in individuals who intend to marry someone of a different religion. Due to religious differences, one party may choose to convert to Islam or leave Islam in order to facilitate marriage. Over time, after a long period, a desire may arise to return to the previous religion, resulting in apostasy (riddah). This study aims to identify the factors influencing apostasy and the legal implications of apostasy behavior after marriage from the perspective of Islamic law. The method used is qualitative with a library research approach. Apostasy in marriage can be caused by internal factors such as weak understanding of faith and external factors such as family and environmental influence. Divorce claims may be granted if apostasy leads to disharmony in the household based on the Compilation of Islamic Law (Kompilasi Hukum Islam). In fiqh, apostasy in marriage before consummation (jima’) results in immediate dissolution of the marriage. However, if consummation has occurred, the marriage may be suspended until the end of the iddah period; if the apostate returns to Islam within the iddah period, the marriage remains valid. If not, the marriage is considered dissolved.
