Abstract

Prostitution is a perverted crime in society, with the development of information and technology online prostitutes use social media to peddle themselves. Online prostitution is carried out in an organized manner consisting of pimps, Commercial Sex Workers (CSWs) and users of CSW services. Positive legal rules in Indonesia in the Criminal Code (KUHP) only regulate pimps, commercial sex workers and service users there are no legal rules governing, so that the practice of prostitution remains in the midst of people's lives. This research aims to describe the legal politics of regulating prostitution through online transactions in Indonesia from Sadd Al-Dzariah's perspective. This research is a type of normative law research, using a statutory approach and a conceptual approach.This study uses the method of interpretation analysis (interpretation). The results of this study are : 1) Perpetrators of prostitution through online transactions in Indonesia are pimps, commercial sex workers (CSWs) and users of CSW services. The applicable settings only ensnare the pimps. PSK and PSK service users can not be snared. 2) The law politics of regulating online prostitution actors needs to be updated with regulations on prostitution so that online prostitution perpetrators can be snared and there is no discrimination. From a theoretical sadd al-dzari’ah perspective, prostitution is an act of adultery which causes damage to oneself, the state and society, so the need for prevention or renewal of prostitution regulations by looking at Islamic law. The presence of laws and regulations in a country serves as regulating and protecting the public. Prostitusi merupakan kejahatan yang menyimpang di masyarakat, dengan berkembangnya informasi dan teknologi para pelaku prostitusi memaanfaatkan media sosial untuk menjajakan dirinya. Prostitusi melalui transaksi online dilakukan secara terorganisir yang terdiri dari mucikari, Pekerja Seks Komersial (PSK) dan pengguna jasa PSK. Aturan hukum positif di Indonesia dalam Kitab Undang-Undang Pidana (KUHP) hanya mengatur mengenai mucikari, PSK dan pengguna jasa belum ada aturan hukum yang mengatur, sehingga praktik prostitusi tetap ada ditengah-tengah kehidupan masyarakat. Penelitian ini bertujuan untuk mendeskripsikan politik hukum pengaturan pelaku prostitusi melalui transaksi online perspektif sadd al-dzari’ah. Penelitian ini menggunakan jenis penelitian normatif, dengan pendekatan penelitian Perundang-undangan (statute approach) dan Pendekatan Konseptual (conceptual approach), Serta metode analisis penafsiran (interpretasi). Hasil studi ini menunjukkan bahwa 1) Pelaku prostitusi melalui transaksi online di Indonesia yaitu Mucikari, Pekerja Seks Komersial (PSK) dan Pengguna jasa PSK. Pengaturan yang berlaku hanya menjerat mucikari. PSK dan Pengguna Jasa PSK tidak dapat dijerat. 2) Politik hukum pengaturan pelaku prostitusi melalui transaksi online, perlu dilakukannya pembaharuan peraturan mengenai prostitusi, sehingga pelaku prostitusi dapat dijerat dan tidak terjadinya diskriminasi. Menurut perspektif teori sadd al-dzari’ah, prostitusi merupakan perbuatan zina yang menimbulkan kerusakan bagi diri sendiri, negara dan masyarakat, sehingga perlu adanya pencegahan berupa pembaharuan peraturan prostitusi dengan melihat hukum islam karena kehadiran peraturan perundang-undangan di negara berfungsi sebagai mengatur dan melindungi masyarakat

Abstract

This writing aims to determine the practice of Village Budgeting and Income Budgeting in Madiredo Village, Pujon District, Malang Regency. Preparation of APBDes is one of the formation of village regulations involving the Village Government and BPD. APBDes preparation is very important, mandatory, and is needed in every region including villages, according to the needs and benefits of the community, this is in line with the principles of fiqh siyasah Maliyah. This research method is empirical juridical, with sociological juridical approach. Research data described descriptively. Data collection uses interview techniques, library research and documentation and uses descriptive analysis data analysis techniques. The results of this study indicate that the preparation of the Village Budget for income and expenditure in the village of Madiredo, Pujon District, Malang Regency in its stages or preparation system has been broadly in accordance with Law No. 6 of 2014 concerning villages, but in the preparation of the district health center in Madiredo there are still many problems that arise and the efforts of the village government and the BPD in the preparation of the district health program are by conducting training, socializing village youth and the community, appointing village officials to take part in training in the sub-district, holding hamlet and village meetings, providing intensive assistance to village officials. Penulisan ini bertujuan untuk mengetahui praktik Penyusunan Anggaran Pendapatan dan Belanja Desa di Desa Madiredo, Kecamatan Pujon, Kabupaten Malang. Penyusunan APBDes merupakan salah satu pembentukan peraturan desa yang melibatkan Pemerintah Desa dan BPD. Penyusunan APBDes sangat penting, wajib, dan dibutuhkan setiap daerah termasuk desa, sesuai kebutuhan dan kemaslahatan masyarakat, hal tersebut sejalan dengan prinsip fiqh siyasah Maliyah. Metode penelitian ini bersifat yuridis empiris, dengan pendekatan yuridis sosiologis. Penelitian data diuraikan secara deskriptif. Pengumpulan data menggunakan teknik wawancara, studi pustaka dan dokumentasi serta menggunakan teknik analisis data deskriptif analisis. Hasil penelitian ini menunjukkan bahwa Penyusunan Anggaran pendapatan dan Belanja Desa di Desa Madiredo, Kecamatan Pujon, Kabupaten Malang dalam tahap atau sistem penyusunannya sudah secara garis besar sesuai dengan UU No 6 Tahun 2014 tentang desa, namun dalam penyusunan APBDes di Desa Madiredo masih sering terdapat masalah yang timbul di dalamnya dan upaya Pemerintah desa dan BPD dalam penyusunan APBDes adalah dengan mengadakan pelatihan, sosialisasi pemuda desa dan masyarakat, menunjuk aparatur desa dan perwakilan lembaga desa untuk mengikuti pelatihan dan sosialisasi yang diadakan di kecamatan, mengadakan rapat di setiap dusun dan desa, membemberikan bantuan intensif kepada para perangkat desa.

Abstract

Mahkamah Agung kembali berinovasi dalam pelayanan publik di bidang peradilan yaitu penerapan aplikasi e-Court. Rumusan masalah penelitian: 1) Bagaimana prosedur PERMA Nomor 3 Tahun 2018 di Pengadilan Negeri Madiun perspektif Mashlahah Mursalah. 2) Apakah hambatan dalam implementasi aplikasi e-Court. 3) Apakah upaya yang dilakukan pihak Pengadilan Negeri Madiun dalam penerapan aplikasi e-Court. Metode penelitian yang digunakan yaitu jenis penelitian hukum empiris, menggunakan pendekatan yuridis sosiologis. Sumber data penelitian yaitu, data primer melakukan wawancara kepada informan, data sekunder mencakup dokumen resmi, buku, laporan, peraturan perundang-undangan. Metode pengumpulan data berupa wawancara, observasi dan dokumentasi. Metode pengolahan data yang peneliti gunakan adalah editing, classifying, analizing, dan concluding. Hasil penelitian ini: 1) Implementasi aplikasi e-Court di PN Madiun sudah berjalan baik. Ditinjau dari segi mashlahah mursalah aplikasi e-Court di PN Madiun sesuai dengan mashlahah mursalah karena memenuhi ketiga syarat yang dikemukakan oleh Abdul Wahab Khallaf, ditinjau dari kepentingan mashlahah bagi kehidupan manusia termasuk tingkatan mashlahah tahsiniyah yaitu kepentingan pelengkap. 2) Adapun kendala: beberapa masyarakat belum mengetahui e-Court, belum faham IT, advokat yang sudah tua minim mempelajari IT. 3) Upaya pihak pengadilan: standing banner di pengadilan, informasi di website resmi pengadilan, meja khusus pelayanan e-Court. Kesimpulannya yaitu adanya sosialisasi secara berkala tentang e-Court kepada para pencari keadilan, agar terdukungnya penerapan e-Court dan meminimalisir terjadinya pungutan liar atau korupsi. The Supreme Court is again innovating in public services in the field of justice, namely the application of e-Court applications. Formulation of the research problem: 1) How is procedure number 3 of 2018 in the Madiun District Court perspective of Mashlahah Mursalah. 2) What are the obstacles in implementing e-Court applications. 3) What are the efforts made by the Madiun District Court in applying the e-Court application. The research method used is the type of empirical legal research, using a sociological juridical approach. Sources of research data, namely, primary data interviews with informants, secondary data include official documents, books, reports, legislation. Data collection methods include interviews, observation and documentation. Data processing methods that researchers use are editing, classifying, analizing, and concluding. The results of this study: 1) Implementation of the e-Court application in PN Madiun has been going well. In terms of mashlahah mursalah e-Court application in PN Madiun in accordance with mashlahah mursalah because it fulfills the three conditions stated by Abdul Wahab Khallaf, in terms of mashlahah interests for human life including the level of mashlahah tahsiniyah that is complementary interests. 2) The constraints: some people do not know e-Court, IT does not understand IT, the elderly advocate is minimal in learning IT. 2) Court efforts: standing banners in court, information on the official court website, e-Court special desk. The conclusion is the existence of regular socialization about e-Court to justice seekers, so that the application of e-Court is supported and minimizing the occurrence of extortion or corruption.

Abstract

The implementation of Banyuwangi District Regulation Number 7 Year 2017 regarding Compulsory Education for Madrasah Diniyah Takmiliyah has not been effective. The formulation of the problem chosen is How Effective is the supervision of Madrasah Diniyah Takmiliyah according to Regional Regulation of Banyuwangi District Number 7 of 2017 concerning Compulsory Education for Madrasah Diniyah Takmiliyah? What are the supporting and inhibiting factors of Regional Regulation Supervision of Banyuwangi District Number 7 of 2017 concerning Compulsory Education for Madrasah Diniyah Takmiliyah? This research is an empirical legal research using a sociology and legislation approach that describes in depth about the object under study. And data collection methods used are interviews as primary data and literature as secondary data. The analysis technique uses descriptive-analitive. The results showed that Supervision of Madrasah Diniyah was not yet effective. Researchers found that only 20% of the areas in Banyuwangi have received information since the regulation was enacted. In addition to the coverage, interviews revealed that socialization was still limited to village officials and did not reach Madrasah diniyah educators or the community. The local government does not oversee this program and there is no continuity between institutions related to the Madrasah Diniyah compulsory education program. Supervision of Madrasah Diniyah Takmiliyah is ineffective, government attention and content in the supervision function are still low, the role of government is considered to be very lacking. From previous data, such as from the effectiveness factors of the law as well as supporting and inhibiting factors that have been analyzed

Abstract

Fenomena penggantian caleg terpilih yang disebabkan oleh recall partai politik pengusungnya kembali terjadi pada Pemilu tahun 2019. Sejumlah partai politik mengganti kadernya yang telah berhasil menjadi calon anggota legislatif terpilih tanpa alasan yang jelas. Beberapa caleg terpilih yang telah berhasil memenangkan suara terbanyak dari konstituennya menjadi kehilangan hak konstitusional akibat dari recall oleh partai politiknya. Penelitian ini bertujuan mengkaji hak konstitusional calon anggota legislatif terpilih yang di-recall oleh partai politiknya serta konstruksi pengaturan terhadap pemecatan anggota partai politik yang berdampak pada ketidakjelasan status hukum calon anggota legislatif terpilih. Adapun penelitian ini menggunakan metode penelitian hukum normatif dengan menggunakan dua pendekatan yaitu pendekatan perundang-undangan dan pendekatan konseptual. Hasil dari penelitian ini adalah calon anggota legislatif terpilih berhak untuk dilantik menjadi anggota legislatif yang sah. Apabila ada penggantian dari partai politiknya, prosedur yang dilakukan harus sesuai dengan undang-undang yang mengatur. Penggantian calon terpilih akibat diberhentikan partai politiknya dengan alasan melanggar AD dan ART tidak dapat serta merta dibenarkan. Karena klausula “melanggar AD dan ART.” belum diberi kejelasan dan batasan sehingga pengaturannya cenderung mengandung muatan politis dan berpotensi menghilangkan hak konstitusional calon anggota legislatif terpilih. The phenomenon of replacing elected candidates due to the recall of the political parties that bear them again occurred in the 2019 Election. A number of political parties have replaced their cadres who have succeeded in becoming elected legislative candidates for no apparent reason. Several elected candidates who have succeeded in winning the most votes from their constituents have lost their constitutional rights as a result of the recall by their political parties. This research aims to examine the constitutional rights of elected legislative member candidates who are recalled by their political parties and the construction of regulations on the dismissal of political party members which have an impact on the unclear legal status of the elected legislative candidates. This research uses normative legal research methods using two approaches, namely the statutory approach and the conceptual approach. The result of this research is that the elected legislative member candidates have the right to be appointed as legitimate members of the legislature. If there is a replacement from a political party, the procedure to be carried out must be in accordance with the governing law. Replacement of elected candidates due to dismissal of their political parties on the grounds of violating the AD and ART cannot be justified automatically. Because the clause "violates the AD and ART." clarity and limitations have not been given so that the regulations tend to contain political content and have the potential to diminish the constitutional rights of elected legislative candidates.

Abstract

In implementing regional regulations, it has not been fully implemented effectively. Legal factors, law enforcement factors, facilities and infrastructure or facilities, and community factors are obstacles in overcoming violations in traditional market areas. For example in the Bandar market area, the use of buildings provided for traders is not optimal, as evidenced by the emergence of traders who sell on the sidewalk. So that this condition results in a lack of comfort for market users and road users in their activities. Slum, dirty is something that will definitely be found in the market, this condition has a negative impact on the development of the market itself. The formulation of the selected problem is How is the effectiveness of Article 18 of the Regional Regulation of Kediri City Number 5 of 2013 concerning the Arrangement and Development of Traditional Markets, Shopping Centers and Modern Store in Bandar Market Kediri City? How is Maslahah Mursalah's review of the traditional market Bandar area in Kediri City Market after the enactment of Regional Regulation Number 5 of 2013? This research is empirical legal research using a sociological juridical approach by describing in depth about the object under study. And the data collection methods used are interviews (interviews), observation, and documentation. The results showed that the effectiveness of Regional Regulation No. 5 of 2013 concerning the Arrangement and Development of the Bandar Kediri City Traditional Market was not yet effective. This is due to the non-compliance of traders selling merchandise on the sidewalk. Whereas the Regional Regulation according to Maslahah Mursalah's perspective has provided benefits where the purpose of the establishment of Regional Regulations brings benefits to lawmakers, law enforcers, and those who implement the law.

Abstract

The participation of public politics in the implementation of elections is a very important aspect, so the General Election Commission uses strategies aimed at improving the participation of the community in the implementation of the elections in 2019. This research aims to determine the strategy of the General Election Commission of Boyolali district in increasing public participation in the elections. This research uses the type of empirical research with a qualitative approach, then using methods of data collection in the form of interviews and documentation. Infotman in the study of this time is the KPU Boyolali district by adjusting to the topic of discussion. The results showed that the KPU strategy of Boyolali District in increasing community participation focuses more on socialization of the important segments of Boyolali. Then the factor that affects community participation is the education and political awareness of the society. In Islam there are also institutions in charge of choosing the head of State, the institution Ahlul Halli Wal-Aqin carrying its duty to choose the head of State using deliberation. Partisipasi politik masyarakat dalam pelaksanaan pemilu merupakan aspek yang sangat penting, sehingga Komisi Pemilihan Umum menggunakan strategi yang bertujuan agar dapat meningkatkam partisipasi masyarakat pada pelaksanaan pemilu tahun 2019. Penelitian ini bertujuan untuk mengetahui strategi dari Komisi Pemilihan Umum Kabupaten Boyolali dalam meningkatkan partisipasi masyarakat dalam pemilihan umum. Penelitian ini menggunakan jenis penelitian yuridis empiris dengan pendekatan kualitatif, kemudian memakai metode pengumpulan data berupa wawancara dan dokumentasi. Infotman pada penelian kali ini adalah KPU Kabupaten Boyolali dengan menyesuaikan dengan topik bahasan. Hasil penelitian ini menunjukkan bahwa strategi KPU Kabupaten Boyolali dalam meningkatkan partisipasi masyarakat lebih berfokus kepada sosialisasi kepada segmen-segmen penting di Boyolali. Kemudian faktor yang mempengaruhi partisipasi masyarakat adalah pendidikan dan kesadaran politik masyarakatnya. Dalam Islam terdapat pula lembaga yang bertugas memilih kepala negara , lembaga Ahlul Halli Wal-Aqdi dalam menjalankan tugasnya memilih kepala negara menggunakan musyawarah.

Abstract

Hate speech is a vulnerable term dealing with the right to freedom of opinion and expression as in Article 28E paragraph (3) of the 1945 Republic of Indonesia Constitution. The intensity of hate speech behavior increases when approaching elections, due to differences representing SARA groups as a campaign strategy to attack and bring down political opponents. The purpose of this study is to analyze legally the hate speech in elections based on Law of Number 7 of 2017 concerning Elections and fiqh siyasah dusturiyyah. This study is a juridical-normative research with a statute approach and conceptual approach and the data includes primary legal material, namely from legislation especially Law Number 7 of 2017 concerning Elections while secondary legal materials are from books and journals of law and Islam. The results of the study showed that the hate speech in elections in Indonesia have not yet been interpreted clearly, even in Law Number 7 of 2017 concerning Election; it is not explained in detail about the definitions, victims, sanctions imposed, or benchmarks or restrictions that can be categorized as hate speech. In Islam, the hate speech is prohibited because it can cause harm to the soul, which should be maintained or safeguarded for every human being from any group as the concept and the principle of fiqh siyasah dusturiyyah in promoting human rights guarantees and bringing the justice. Ujaran kebencian merupakan istilah yang rentan berhadapan dengan hak kebebasan berpendapat dan berekspresi sebagaimana dalam Pasal 28E ayat (3) UUD Negara RI Tahun 1945. Intensitas perilaku ujaran kebencian meningkat saat mendekati pemilu, disebabkan adanya perbedaan yang mewakili kelompok SARA sebagai salah satu strategi kampanye guna menyerang dan menjatuhkan lawan politik. Tujuan dari studi ini adalah untuk menganalisis secara hukum tentang ujaran kebencian dalam pemilu berdasarkan UU No.7 Tahun 2017 tentang Pemilu dan fiqh siyasah dusturiyyah. Studi ini merupakan kajian yuridis-normatif dengan pendekatan perundang-undangan (statute approach) dan konseptual (conceptual approach) dan sumber data berupa bahan hukum primer yaitu dari peraturan perundang-undangan terutama UU No.7 Tahun 2017 tentang Pemilu sedangkan bahan hukum sekunder dari buku-buku serta jurnal hukum maupun islam. Hasil penelitian menunjukkan bahwa ujaran kebencian dalam pemilu di Indonesia hingga sekarang belum ditafsirkan secara jelas, bahkan di UU No.7 Tahun 2017 tentang Pemilu tidak dijelaskan secara detail bagaimana definisi, korban, pelaku, sanksi yang dijatuhkan, maupun tolok ukur yang dapat dikategorikan sebagai ujaran kebencian. Dalam Islam, ujaran kebencian merupakan perbuatan terlarang karena dapat menimbulkan kerugian terhadap jiwa, yang seharusnya dijaga oleh setiap manusia dari golongan manapun sebagaimana konsep dan prinsip fiqh siyasah dusturiyyah yakni mengedepankan jaminan HAM serta mewujudkan keadilan.
