Abstract

Stunting is actually the main matter that Indonesia will face in the future. Indonesia had suffered great crisis in the Suharto era, hence so many people breed children without thinking how to feed them nor giving them proper education. This doesn’t count the conflict of wealth shared between families led into more homeless family. Today, due to numerous ignored cases, Indonesia finally joins hand to prevent Stunting from dominating Indonesia. However, as we get informative and professional media for that, we also experience the digital disruption created by political buzzer. This makes the reality be clearer that government decision is connected to their election.

Abstract

The Child Decent City Policy in Indonesia is based on Article 21 of Law Number 35 of 2014 concerning Child Protection which states that the State Government and local governments are obliged and responsible to respect the Fulfillment of Children's Rights, then Law Number 11 of 2006 concerning the government of Aceh which in its derivatives Aceh qanun number 11 of 2008 concerning Child Protection emphasizes the fulfillment of children's rights. Qanun Number 2 of 20212 concerning Child-Friendly Cities, which is a derivative of the regulation on which it is explained that the City government makes together with the Gampong government, parents, communities and community organizations in realizing development that protects children's rights. This study aims to find out how the Implementation of Banda Aceh City Qanun number 2 of 2021 concerning Child Friendly Cities, what factors affect the Implementation of Banda Aceh City Qanun number 2 of 2021 concerning Child Friendly Cities and the legal consequences of the unimplementation of Banda Aceh City Qanun number 2 of 2021 concerning Child Friendly Cities. The type of research used is empirical juridical with a statutory approach and an analytical approach, both of these approaches are needed to analyze and examine the implementation of the qanun, research sources consist of primary data sources (interviews, observations), secondary (laws, literature and other legal materials). The results of the study found that the implementation of the qanun of Banda Aceh City regarding a child-friendly city has not run well and effectively, this is influenced by several factors, the inhibiting factors consist of human resource factors, financial resource factors, leader commitment factors and policy implementation factors, while the supporting factors in the implementation of Child Decent Cities in Banda Aceh are resource factors, facilities and infrastructure, and community institution support factors. Then the legal effect of the non-implementation of the Banda Aceh city qanun concerning Child Decent Cities is administrative sanctions, although in fact the implementation of these sanctions has so far never been applied.

Abstract

State-owned enterprises (SOEs) are crucial to a country's economy. One of the ways SOEs obtain capital is through the transfer of shares. SOE share transfer arrangements are important in overseeing state capital in SOE companies. This study analyses the urgency of changing the share transfer arrangements in SOEs as state capital participation. This research uses normative research methods. The techniques used by researchers to obtain legal materials are document studies and literature studies. All legal materials successfully found and selected by researchers were inventoried, classified, and analyzed using systematic, grammatical and historical interpretation techniques. The results show that the ratio legis of the transfer of state-owned shares in BUMN as state equity participation in other BUMN in Government Regulation No. 72/2016 is to improve the performance of BUMN to be more efficient, effective, and profitable. The transfer of state-owned shares in SOEs as state equity participation in other SOEs aims to increase the efficiency of SOEs by optimizing existing resources, increase the effectiveness of SOEs by improving the quality of services to the public and increase the profitability of SOEs by increasing revenue and reducing costs.

Abstract

There is a building failure in terms of the time period after the construction work was handed over for the last time (FHO), when viewed from the substance of the work, the building failure has occurred in part or in full malfunction of the results of the construction work from a technical, benefit, safety and health perspective Work; in summary the time after the FHO, due to non-functioning construction work results. The specifications of the research used are descriptive analysis and normative legal research. The technique of collecting legal material that will be used as a source in this study is library research, namely collecting legal material by reading laws and regulations, official documents, journals, articles from the internet, as well as other literature that is closely related to The issues discussed are based on secondary legal materials. The implementation of the project or building construction involves various parties who take part in it, namely the employer, the architect and the contractor. A contracting agreement is an agreement between one party (the contractor) and another party or (the contractor) in which he binds himself to carry out a work regarding the manufacture of a work (het maken van werk) by receiving a price according to the specified price. Efforts to settle alternative dispute resolution in the settlement of contracting disputes through several efforts such as arbitration, negotiation, mediation or by making efforts or applying court channels if they are not resolved out of court.
