Abstract

Al-Qur'an adalah kalam Allah yang menjadi pedoman dalam hidup ini. Salah satu gaya bahasa yang ditunjukkan oleh Allah SWT dalam menyampaikan pesan suci-Nya dalam Al- Quran adalah dengan menggunakan qasam atau sumpah. Bagaimana dan dengan apa Allah bersumpah? kenapa Allah bersumpah? Dan apa saja rahasia dan manfaat sumpah yang terkandung dalam Al-Qur'an? Tulisan sederhana ini berusaha untuk dapat menjawab permasalahan tersebut dengan menelusuri pandangan sebagian ulama Al-Qur'an dalam berbagai kitab yang mereka warisi dengan harapan dapat menjadi pelajaran berharga untuk lebih meningkatkan pemahaman kita terhadap Al-Qur'an. Secara umum dapat dikatakan bahwa sumpah Allah dalam Al-Qur'an tidak lepas dari tanda-tanda yang jelas sehingga kita benar-benar memperhatikan pesan yang disampaikan, karena pesan yang disampaikan mengandung tujuan untuk kebaikan dan kebahagiaan manusia.

Abstract

MSMEs have an important step in supporting the improvement of the Indonesian people's economy, especially in terms of business opportunities and employment opportunities. Malang City is famous for its tourism and education sectors where MSMEs are an inseparable part of the economic activities of the Malang community. Malang City has several MSME industrial centers. This research examines the form of partnership agreement between the sanan tempeh chips and dinoyo ceramics industry center with large business partners in Malang City and hotels in Malang City. Researchers analyze the implementation of legal protection in partnership agreements in Malang City and analyze the fulfillment of the principles of fair partnership agreements. For this reason, in this paper the problem that will be studied is: How is the analysis of partnership agreements between MSMEs and large businesses in Malang City, and how is legal protection implemented for Partnership-based MSMEs in Malang City? This article is based on empirical juridical research with a Sociological Juridical approach which produces an analysis that: The implementation of the Partnership agreement in Malang City has not been carried out effectively which is contrary to the rules in Government Regulation Number 17 of 2013 where the concept, form of agreement and terms of partnership are not partnerships as stated in which has been mandated by law. A true partnership must be accompanied by a program of empowerment and assistance for large business actors towards small business actors. Meanwhile, large business actors themselves have a tendency not to carry out partnerships as they should. Implementation of legal protection and implementation of supervision over partnership agreements in Malang City is also still not running effectively due to overlapping authority.

Abstract

Buying and selling products with murabahah contracts are ranked first in financing practices in Indonesian sharia banks but receive particular attention regarding conformity with sharia principles and the position of consumers from a consumer protection perspective. In the framework of realizing "implementation and development of risk management, prudential principles, good corporate governance & sharia compliance" as well as encouraging the creation of a regulatory union, contract standards, products and transactions, in accordance with the recommendations of the Islamic Finance Service Board (IFSB), a study is needed to analyze the suitability of murabahah financing agreements in sharia banking in Indonesia with Islamic law and positive law. Through legal research, a study was carried out on Indonesian sharia banking murabahah contracts based on the legal principles that should be the basis. From the results of the analysis of murabahah financing contract clauses, there are several clauses that do not comply with Islamic law and positive law (Consumer Protection law and Civil law), including those relating to down payments (urbun), actions when customers are in trouble, as well as promising something that is uncertain. For the future. Likewise, based on the Consumer Protection Law, it does not support the creation of consumer protection which contains elements of legal certainty and information disclosure as well as access to information (Article 3 (d) UUPK). Apart from that, it also conflicts with consumer rights as regulated in Article 4 UUPK.

Abstract

This research aims to analyze the implementation of fair business competition in the provision of Regulation of the Minister of Public and Housing Development Number 1 of 2017 concerning the Procedures of the Procurement of Legal Entity in a Highway Toll Project (henceforth referred to as Ministerial Regulation) by analyzing the implementation of fair business competition principle in an auction service of a business entity as governed in the Ministerial Regulation and the provision of the agreement regarding the highway toll project procurement that may take up to 50 years, and this period can be extended. However, there have not been any standards of business entity in terms of how this agreement is extended and any standards that set the maximum period of the extension. That is, this research investigates whether the extension period without any strict deadline complies with the substantive aspect of Law Number 5 of 1999 concerning the Ban on Monopolistic and Unfair Business Competition Practices.

Abstract

Abstract This research investigates whether the measures taken by Indonesia to implement the security of steel imports from Taiwan and Vietnam comply with the provisions of international economic law—Safeguard on Certain Iron or Steel Products (DS496). This dispute began when Indonesia put security in place against Galvalume. The Regulation of Finance Minister of the Republic of Indonesia Number 137.1/PMK.001/2014 put in place on 22 July 2014 in 2015 implies that Taiwan and Vietnam raised a claim against Indonesia according to Articles 1 and 4 concerning Understanding on Rules and Procedures Governing the Settlement of Disputes (DSU), Article XXII of GATT 1994 and Article 14 of Safeguards Agreement concerning policies in Indonesia regarding Galvalume. This research employed normative-juridical methods supported by case and statutory approaches, revealing that Indonesia is deemed to have violated the regulatory provisions of WTO and was declared guilty. In this case, Vietnam requested retaliation from an Arbitral Board of WTO demanding that Indonesia pay the compensation for the losses caused in galvalume trade from Vietnam. Indonesia and Vietnam agreed to settle the dispute through a bilateral agreement following the recommendation from the panels of WTO. Keywords: Galvalume, Safeguard Measures, Settlement of International Economic Disputes Abstrak Penelitian ini membahas tentang apakah upaya Indonesia menerapkan tindak pengamanan impor produk baja dari Taiwan dan Vietnam sudah sesuai dengan ketentuan hukum ekonomi internasional terkait Indonesia – Safeguard on Certain Iron or Steel Product (DS496).Sengketa ini bermula ketika Indonesia melakukan tindakan pengamanan terhadap impor Baja Alumunium Lapis Seng (atau sering dikenal dengan galvalum) yang berdasarkan dengan Peraturan Menteri Keuangan Republik Indonesia nomor 137.1/PMK.011/2014 yang diberlakukan pada 22 Juli 2014 Pada 2015, Taiwan dan Vietnam mengajukan tuntutan kepada Indonesia berdasarkan Pasal 1 dan 4 Understanding on Rules and Procedures Governing the Settlement of Disputes (DSU), pasal XXII dari GATT 1994, serta pasal 14 dari Perjanjian tentang Safeguards, mengenai kebijakan yang diambil Indonesia terhadap impor BjLAS. Jenis penelitian adalah yuridis-normatif dengan menggunakan pendekatan kasus dan peraturan perundang-undangan. Indonesia dianggap melangar aturan-aturan yang sudah dibuat dalam ketentuan perdagangan WTO dan dinyatakan bersalah, sehingga Vietnam mengajukan retaliasi pada badan arbitrase WTO agar Indonesia membayar kerugian perdagangan glavalum dari Vietnam. Pada akhirnya Vietnam-Indonesia sepakat menyelesaikan kasus sengketa dagang tersebut melalui perjanjian bilateral atas rekomendasi dari panel WTO. Abstract

kondisi kesehatan masyarakat dan menghambat perkembangan ekonomi serta kualitas hidup secara keseluruhan. Kelurahan Bujel, Kecamatan Mojoroto, Kota Kediri merupakan salahsatu wilayah yang memiliki permasalahan dalam penanganan sampah organik. Selama ini, bank sampah hanya menerima sampah an organik seperti bekas botol minuman, kardus, kertas, dan kaca. Sedangkan sampah organik yang memiliki jumlah yang lebih banyak belum dimanfaatkan. Tujuan dari kegiatan ini adalah memberdayakan perempuan di Kelurahan Bujel, Kota Kediri, melalui peningkatan kompetensi dalam pengolahan sampah organik menggunakan metode budidaya maggot. Metode yang digunakan dalam pengabdian masyarakat ini adalah pendekatan partisipatif, di mana para perempuan dilibatkan secara aktif dalam setiap tahap kegiatan, mulai dari pelatihan, praktik lapangan, hingga evaluasi hasil. Hasil pengabdian masyarakat menunjukkan bahwa pemberdayaan perempuan melalui peningkatan kompetensi pengolahan sampah organik dengan budidaya maggot dapat meningkatkan pengetahuan dan keterampilan mereka dalam mengelola sampah organik. Selain itu, kegiatan ini juga berhasil mengurangi volume sampah organik yang dihasilkan rumah tangga dan memberikan tambahan penghasilan melalui penjualan maggot. Kesimpulan dari pengabdian masyarakat ini adalah bahwa program pemberdayaan perempuan dengan fokus pada pengolahan sampah organik menggunakan budidaya maggot efektif dalam meningkatkan kompetensi dan kesejahteraan ekonomi perempuan di Kelurahan Bujel. Rekomendasi untuk pengabdian masyarakat selanjutnya adalah memperluas jangkauan program ke wilayah lain dan mengembangkan model bisnis yang lebih berkelanjutan untuk pengolahan sampah organik.

Abstract

The terms "Default" and "Fraud" and/or “Embezzlement” are often interchanged without clarity of meaning in many discussion forums, both oral and written. This confusion can be seen from the many court decisions that acquit defendants from prosecution which have permanent legal force. The public often hears that law enforcers carry out criminalization, such as witnesses becoming suspects, suspects becoming defendants and so on by shifting the civil legal action of Default to criminal act of Fraud and/or Embezzlement. Using 'criminalization' and 'criminalized' in this article is considered inappropriate, so it has been replaced by 'criminalizing' and 'criminalized'. If there is an action to shift the civil legal act of Default into a criminal act of Fraud and/ or Embezzlement, so from a human rights perspective, it is against the law. By using normative legal research methods, this paper examines how to differentiate civil legal acts of Default from criminal acts of Fraud and/or Embezzlement, how to apply civil compensation in cases where there are already criminal legal remedies, and what is the legal and human rights perspective when criminalization occurs. This paper uses a statutory approach and a case approach. The results show: First, there is a real difference between civil legal acts of Default and criminal acts of Fraud and/ or Embezzlement; Second, the application of compensation can be carried out through criminal and civil procedural law mechanisms; Finally, criminalizing civil legal acts into criminal acts is a form of violation of human rights.

Abstract

The national health insurance program in Indonesia aims to ensure assurance, protection, and welfare for citizens in fulfilling their fundamental health requirements. The social insurance framework employed in the program's execution comprises four principles: the principle of cooperation, the principle of mandatory participation, the principle of income-based contribution determination, and the principle of non-profit orientation. After a decade of the program, numerous issues persist, including incomplete participation, prohibitively high contributions resulting in arrears, and suboptimal program benefits. This study establishes the optimal structure of social insurance systems inside national health insurance. The employed study method is normative, analyzing applicable laws and regulations, supplemented by a legislative and comparative approach to identify the optimal framework for social insurance regulation. By analyzing legal materials using descriptive-analysis, the study's main findings reveal that although JKN has enrolled over 91% of Indonesia’s population, it still faces significant challenges, including delayed premium payments by participants and difficulties in achieving Universal Health Coverage (UHC). Compared to Thailand and Taiwan, JKN has yet to meet the UHC standards recognized by the WHO. The analysis concludes that the four foundational principles of social insurance within the national health insurance framework are insufficient; therefore, an additional four principles are required to ensure certainty, protection, and benefits for program participants, which is essential for the realization of the National Social Security System Law's objectives. The optimal design of a social insurance framework should include the principles of mutual cooperation, mandatory participation, proportional contributions, and non-profit operations. Abstrak Program jaminan kesehatan nasional di Indonesia bertujuan untuk memastikan jaminan, perlindungan, dan kesejahteraan bagi warga negara dalam memenuhi kebutuhan dasar kesehatan mereka. Kerangka kerja asuransi sosial yang digunakan dalam pelaksanaan program ini terdiri dari empat prinsip: prinsip kerja sama, prinsip kepesertaan wajib, prinsip penentuan iuran berdasarkan pendapatan, dan prinsip orientasi nirlaba. Setelah satu dekade program ini berjalan, masih terdapat beberapa permasalahan yang dihadapi, termasuk kepesertaan yang tidak lengkap, iuran yang terlalu tinggi sehingga menimbulkan tunggakan, dan manfaat program yang tidak optimal. Penelitian ini bertujuan untuk menentukan struktur sistem asuransi sosial yang optimal di dalam jaminan kesehatan nasional. Metode penelitian yang digunakan adalah normatif, menganalisis peraturan perundang-undangan yang berlaku, dilengkapi dengan pendekatan legislatif dan komparatif untuk mengidentifikasi kerangka kerja yang optimal untuk regulasi asuransi sosial. Dengan menganalisis bahan hukum menggunakan deskriptif-analisis, temuan utama studi ini mengungkapkan bahwa meskipun JKN telah mencakup lebih dari 91% penduduk Indonesia, JKN masih menghadapi tantangan yang signifikan, termasuk keterlambatan pembayaran premi oleh peserta dan kesulitan dalam mencapai Cakupan Kesehatan Semesta (Universal Health Coverage/UHC). Dibandingkan dengan Thailand dan Taiwan, JKN belum memenuhi standar UHC yang diakui oleh WHO. Analisis ini menyimpulkan bahwa empat prinsip dasar asuransi sosial dalam kerangka jaminan kesehatan nasional tidak cukup; oleh karena itu, diperlukan empat prinsip tambahan untuk memastikan kepastian, perlindungan, dan manfaat bagi peserta program, yang sangat penting untuk merealisasikan tujuan UU SJSN. Desain optimal dari kerangka kerja asuransi sosial harus mencakup prinsip-prinsip gotong royong, partisipasi wajib, iuran proporsional, dan operasi nirlaba.

Abstract

Al-Qur’an sebagai pedoman bagi umat Islam telah memberikan pelajaran tentang etika bertamu. Menjaga etika bertamu dalam hidup bermasyarakat merupakan hal yang sangat penting agar hubungan dengan orang lain selalu terjalin dengan harmonis. Namun, di tengah masyarakat sekarang ini masih banyak yang belum memahami etika bertamu dengan baik. Dengan demikian, perlu pemahaman yang komprehensif tentang etika bertamu seperti yang diajarkan Al-Qur’an. Dalam hal ini, penulis akan merujuk pada Tafsir Al-Misbah karangan Prof. Dr. Quraish Shihab dengan indikator bahwa ia merupakan ulama tafsir yang memiliki pembahasan luas dalam menafsirkan ayat-ayat Al-Qur’an. Penelitian ini bersifat deskriptif yang bermaksud menggambarkan secara sistematis, faktual dan akurat mengenai obyek yang ada. Hasil Penelitian menunjukkan (1) meminta izin sebelum masuk. (2) memberi salam kepada penghuni rumah. (3) berkunjung pada waktu yang tepat. 4) tidak berlama-lama dalam bertamu. Adapun terkait dengan penafsiran M. Quraish Shihab tentang etika bertamu, ia menyatakan bahwa meminta izin bisa dilakukan mengucapkan salam lalu minta izin dengan cara mengetuk pintu atau memanggil orang yang ada di dalam rumah. Bagi tuan rumah, harus mejawab salam dengan ucapan salam yang lebih baik. Pemahaman yang baik tentang etika bertamu dapat menjadikan seseorang bersikap saling menghormati kepada sesama. Oleh karena itu, etika bertamu dalam Al-Qur’an perlu dikaji dan diamalkan, agar fungsi Al-Qur’an sebagai sumber ajaran pertama bagi umat Islam dapat diwujudkan dan membumi.

Abstract

The evidentiary process plays a crucial role in procedural law, particularly in business competition trials. As a fundamental aspect of legal proceedings, evidence must be properly utilized, presented, and maintained to ensure fairness. Ideally, parties involved should have the broadest possible access to present evidence that strengthens their position. In this context, business competition laws and regulations establish evidentiary mechanisms that serve as guidelines for law enforcers, including the Indonesia Competition Commission (KPPU) and the Commercial Court, to uphold justice effectively. This study aims to examine the evidentiary framework in business competition cases, particularly addressing conflicting norms that impose limitations on the use of evidence. Using a normative legal research method, the study employs literature review and case analysis to qualitatively assess the application of evidentiary principles. The findings highlight the concept of proportional proof in business competition cases, emphasizing the principle of due process of law. The study concludes that evidence in both legal science and business competition cases must adhere to the principle of due process to ensure fairness. Evidentiary procedures at the KPPU and in objection proceedings at the Commercial Court rely on legally recognized forms of evidence, including both direct and indirect evidence, in accordance with prevailing regulations.
