This article is dedicated to the scientific legacy and life of Sayyid ibn Muhammad Ustuvoi, a distinguished scholar born in the village of Ustuvo in Khorasan, who holds a special place among Eastern intellectuals. Information about his pursuit of knowledge, teaching activities, and his contributions to his village can be found in numerous historical works. Studying his life is essential for advancing research aimed at renewing the educational and spiritual heritage of the East.

The article discusses Ahmad ibn Mahmud ibn Abu Bakr Nuriddin Sobuniy, a great mutakallim (theologian) and jurist from ancient Bukhara. He was born in the early 6th/12th century and is recognized as one of the prominent figures in the Maturidi school of thought. Sobuniy contributed significantly to the fields of kalam (theology), fiqh (Islamic jurisprudence), and usul al-fiqh (principles of Islamic jurisprudence).

Abstract

This article discusses the concept of destiny and its relationship with human will and freedom, exploring the various descriptions of destiny provided by Islamic scholars from different periods and schools of thought. The views of various Islamic sects, such as Sunni, Shia, Qadariyya, Jabariyya, Mu'tazila, Jahmiyya, and Karamiya regarding destiny, are examined. Additionally, the article investigates the views of the two major Sunni theological schools: Maturidi and Ash'ari, analyzing their similarities and contradictions. The author provides scholarly conclusions based on the relationship between the concept of destiny and the notions of secularism and religiosity in contemporary society.

Abstract

Penelitian ini menganalisis implementasi Sistem Manajemen Kearsipan Digital di Dinas Perpustakaan dan Kearsipan Kota Bandung dalam mendukung tata kelola pemerintahan yang efisien dan transparan. Studi ini mengungkap proses transisi dari sistem lokal ke Srikandi, aplikasi nasional berbasis digital, yang menghadapi tantangan seperti keterbatasan sumber daya manusia, anggaran, dan infrastruktur. Meskipun terdapat kendala, penerapan sistem ini menunjukkan potensi untuk meningkatkan efisiensi pengelolaan arsip, mengurangi ketergantungan pada arsip fisik, dan mempercepat transformasi digital. Penelitian ini merekomendasikan penguatan pelatihan, dukungan teknis, serta sinergi antara pemerintah pusat dan daerah untuk memastikan keberlanjutan dan optimalisasi sistem.

Abstract

Perbuatan Melawan Hukum dalam sistem hukum di Indonesia dibedakan secara konteks Hukum Pidana dan Hukum Perdata. Istilah Perbuatan Melawan Hukum yang dalam bahasa Belanda menggunakan istilah “Onrechtmatige Daad” dan “Wederrechtelijk”. Namun pada intinya, istilah ini mengacu pada tindakan atau perbuatan yang sifatnya hukum yang dilakukan oleh subjek hukum sehingga tindakan tersebut memiliki konsekuensi hukumnya masing-masing baik secara konteks pidana maupun perdata. Penelitian dilakukan dengan studi kasus putusan pengadilan no 28/Pdt.G/2024/PN Tmg dan 113/Pid.Sus/2024/PN Tmg. Tujuan dari penelitian ini adalah untuk memahami dan membedakan apa saja unsur-unsur yang harus terpenuhi sehingga suatu perbuatan dapat dikatakan sebagai Perbuatan Melawan Hukum dalam perspektif Hukum Perdata dan hukum Pidana. Metode yang digunakan dalam penelitian ini adalah metode penelitian Yuridis Normatif. Sehingga dihasilkan Kesimpulan bahwa PMH dalam konteks perdata harus memenuhi 4 unsur dalam pasal 1365 BW. Sedangkan dalam konteks Hukum Pidana secara sederhana dapat diartikan sebagai perbuatan yang sifatnya melawan hukum. Dalam artian perbuatan yang melawan hukum tersebut tidak akan hapus dengan perbuatan lain semacam pemberian kompensasi.
